somerville. >> and i'm gasia mikaelian. breaking news in the case of michelle le. the release says the coroner had not determined the remains of michelle le. the search was the eighth time volunteers have looked for the nursing student. authorities described the area where the remains were found as not heavily traveled. this morning the 27-year- old woman accused of murdering michelle le appeared briefly in court. esteban did not enter a plea. the lawyer representing esteban would only say that the defendant is coping. esteban is due back in court eight or nine days from now. the volunteers who found michelle le's body is the mother of a murdered teenager.

amber's mother kerry mcgiver was the woman who found the remains. stay with ktvu for continuing coverage. the ktvu morning news will be following this major new development in the michelle le case beginning at 4:30 tomorrow morning. the temperature is heating up and so is fire danger in the bay area. this morning crews evacuated campers in the east bay hills because the fire was burning too close for comfort. ktvu's lloyd lacuesta tells us firefighters had one factor working in their favor. >> reporter: there are no high wind for one gasia. we're told tonight that firefighters remained on the scene just to make sure that there are no flair ups and campers have been allowed back in. the fire broke out shortly after 4:00 this afternoon on

the north eastern lane of north shabul. the park was closed for three hours and some 30 campers had to leave their camp sites. this couple had just arrived from europe yesterday. >> a gentlemen came to say that we must move immediately because of the fire. >> reporter: while the end of summer is at hand, historically september and november have been the most dangerous months of the fire season. there are no high winds today but this is the time of the year for them. >> they're known as the diablo ends and they are hot, dry and very strong blowing from east toward the bay. >> reporter: that's what happened 20 years ago next month. the oakland hills fire storm that killed 25 people and destroyed more than 3,000 homes. fire officials are telling hillside residents not to let their guard down. state law requires that grass and debris be cleared within 100 feet of a home. >> we have always cleared it if

minutes with your forecast for tomorrow. you can monitor bay area fire and weather conditions at ktv u.com look for the weather menu on the home page. the fire started about 4:30 p.m. on washington street in the japan town neighborhood. firefighters say because the building is a victorian house build back in 1892 it was difficult to get control of the flames. a viewer sent us this picture of the fire which clearly showed he saw a moment ago, showed smoke pouring out of the attic. the construction of the home allowed the flames to spread in the walls quite easily and go from the basements to the attic without firefighters being able to see them. >> dangerous fire for firefighters because the danger, if they don't know it's burning in the basement they actually can fall through in the first floor and end up in the basement. >> reporter: as many as 11 people are in a temporary shelter tonight. none of them was at home when the fire started and the cause of that fire is not unknown.

drivers headed through oakland be forewarned. american road work has closed down several lanes of north bound 880. currently three lanes of traffic are closed near high street. you see the result there, those lanes going northbound are on the right side of the screen. the california highway patrol says they are now allowing trucks to drive on 580 so they can avoid the traffic troubles on 880. no word on how long the road work will take. new at 10:00, regret and support tonight from san francisco police following a police shooting on a crowded north beach street that left two innocent bystanders injured. healther holmes live where the chief defended the officers actions. >> reporter: gasia, tonight we learned that it was an innocent man from oakley and an innocent -- [audio difficulties] he stands by his officers actions. >> reporter: police gunfire disresults night life in north beach saturday and tonight the

chief is fighting off criticism. >> if an officer believes his or her life is in danger they can defend themselves. >> reporter: chief greg suhr expressed concerns about an officers decision to fire his weapon while chasing a suspected drug dealer. it happened around 2:00 a.m. saturday. just as bars and clubs were closing and the sidewalks were filled with peel. >> the place shouldn't really be firing into a crowd of people as an officer -- they shouldn't be firing where there were innocent bystanders. >> reporter: having just arrive in san francisco hours earlier, this man was shocked. he says police should have given more thought before firing. but the chief says there wasn't time. he says the 20-year-old suspect jesus rodriguez threatened officers as he ran down broadway. >> he turned and pointed what ended up being the firearm behind me which is described as a tech nine machine pistol, fully loaded, 22 in the magazine, one in the chamber

ready to go. >> reporter: police say one officer fired one shot hitting the two bystanders. both were treated and released from the hospital. >> the department could not feel worse about having two bystanders injured. however the alternative of having a suspect with this weapon could have been a lot worse. >> reporter: board of supervisors david chu questioned need to be made to the department policies. as for the suspect, he remains in jail tonight facing assault weapon and assault charges. our crew spotted about a dozen protesters at the civic center, but the demonstration didn't grow like this one recently or the others we've seen in the past. meanwhile state lawmakers have now passed assembly bill 716 that will allow b.a.r.t. to temporarily bar anyone who

commits two infractions on b.a.r.t. property. police in south san francisco are warning parents tonight after a girl reported that a man tried to kidnap her. the group says it happened around 8:45 this morning at the end of camaritas avenue. the girl told them the man grabbed her arm and tried to pull her away. she says she was able to escape to a near by school and that the attempted kidnapper was last seen at alta loma avenue. 9-year-old ryan white was severely injured after a phillies giants game in san francisco last month. he suffered -- [audio difficulties ] however doctors say he's not quite ready to go back to school yet. >> my teacher came over a couple of days ago and gave me

occurring phenomenon caused by increased planktin. >> it's something that happens every year, it's worses some years. >> reporter: surfing and swimming in red tide can make some people sick. the unusually warm temperatures brought out lots of people including surfers eager to ride the waves despite the red tide. the owner of wise surfboards across the beach says symptoms can create discomfort. >> some people do have an allergic reaction. they get nasally stuffed up. probably from the algea going up into their sinuses. when you surf everything goes everywhere. >> i noticed the red tide a couple of days ago. the water is kind of murky and there tends to be a stinky smell to it. >> reporter: these surfers told us the red tide won't stop them

from getting into the water. >> it won't kill you. >> reporter: red tide can last from several days up to a few weeks. reporting live at san francisco's fisherman's wharf, amber lee ktvu channel 2 news. firefighters at kent penelton are working to contain a fire after a chopper crashed. base officials say the 120-acre fire is 80% contained tonight. the fbi tonight is investigating a bomb threat that affected two bay area airports. an alaska airlines flight from seattle landed safely in a remote part of oakland international airport this morning after an employee at sfo said a bomb was on board. the note also mentioned the seats where two men had been sitting, as you see here in this cell phone video. >> these two gentlemen had nothing to do with the note.

at the time we didn't know that so they were questioned. no different than when you pull a car over because it matches a description of a crime that just occurred and they just happened to be driving in the area in a similar car. >> reporter: the men were later released and authorities found nothing suspicious in the flight. last year's recordings of proposition eight trial should be revealed. those opposed are vowing to appeal. the federal judge said there was no compelling reason to keep the recordings secret. before last year's trial began the u.s. supreme court ruled the proceedings could not be broadcast. the official sponsors of prop eight issued a statement today saying quote, today'sdecision is bizarre for many reasons but mostly because it defies a direct order of the supreme court. today the pentagon said it is already taking applications from openly gay candidates.

more now on tonight's confirmation that human remains found over the weekend are in fact, those of missing nursing student michelle le. we just received a statement from the le family. they acknowledged her death and thanks thanked all the volunteers that helped search since the day she went missing. the family says, thank you for your support, prayers and thought. our family has greatly appreciated and would be at a loss without the help of so many people and volunteers. the family also asks for privacy. grief counselors were at hand in south san francisco high school following the

shooting death of a 14-year-old boy. as ktvu's jana katsuyama reports the gunman approached the victim and his friend just before 9:00 last night in the 600 block of first lane. >> there are three more here. >> reporter: neighbors showed us the gray chalk marking each bullet that was shot. >> i think they were following the guy. you can see it right here. >> reporter: neighbors say they heard the shot about 8:50 last night. south san francisco police achieved at the interstate of first lane and magnolia and they found three boys, one uninjured and two who had been shot. joseph maharaj died at the hospital. his friend, a boy who lived on first lane managed to run away to a neighbors home. >> he was over here turned, he said oh my god. please help me i've been shot. >> reporter: trina says the boy was shot and left a trail of blood along her stairs.

today school officials lowered the flags and brought in grief counselors to help the staff and students. >> some grieved, you know. others are in shock and just trying to provide the support we can. >> reporter: south san francisco police have no indication that the students were involved in any gangs. >> it is a gang area, it doesn't necessarily mean it was a gang shooting. >> reporter: police are saying they are looking for two suspects and a black honda accord or civic. it had two hispanic male suspects. one was wearing black suite shirts and a white beanie. paul castillo is being held on several charges following his arrest. castillo shot and robbed a man

40-year-old anthony payne, the woman's identity has not yet been released. police say she was not arrested. in news of the world tonight, from yemen comes words that anti government protesters have seized the base of the elite republican guard. meantime in the capital, at least 50 people have died in a second day of bloodshed. witnesses say the government used snipers and rocket propelled grenades against prodemocracy protesters. for the past seven months the protesters have been calling for the president of yemen to step down. the death poll from yesterday's 6.8 earthquake has now climbed to 53. most of the victims are in indian state in the himeleyans. -- the flooding affected 5 million people many of whom

firefighters are keeping a close eye on a large compost fire in the town of lethrop. authorities believe the hot temperatures started the fire. they say they're going to let the fire burn itself out because it's not threatening any structures and it would take too much water to put it out. authorities expect it to burn for up to another five days. the plan to build a new state of the art stadium for the san francisco 49ers in santa clara cleared a major hurdle today. robert handa tells us the team is now a part owner of great america and that ends a long

staying in jail. according to the da's office donny allen thomas supervised a group that stole more than $300,000 of taxpayer money. they allegedly wrote false invoices for personal items and ran their own personal business on county time. thomas faces three years in prison and must pay almost $1,770,000 in restitution. tomorrow night the berkeley city council is expected to consider expanding it's opt out program to include at&t's yellow pages. residents have to go through at&t's website to opt out of their phone book. the city will call on at&t to honor opt out requests from their agencies. the google wallet app was released to sprint users today.
