witnesses heard popping signs and it looked like a fire ball. new video of today tonight's devastating fire in san francisco. good evening everyone i'm frank somerville. >> and i'm julie haener. new information about that fire that ripped through a corner of two of san francisco's most well known streets. ken wayne is live now in

filmore. tell us to the building that housed 26 apartments and two businesses. >> reporter: the corner has been reopened but you can see fire trucks are still arriving at the scene here and firefighters are still inside the building looking for hot spots. they're going to be here all tight long. investigators will return tomorrow morning to try to find out what started this fire. this home video shows the fire at its peak. flames shot out windows and dense black smoke filled the sky. the fire was first reported just after four o 4:00. >> early on we heard explosion noises. not huge explosions but kind of popping noises. there's some type of material in there yet to be determined. >> reporter: the fire started in the upper floor. as you can see from news chopper 2 it quickly spread to the attic and roof prompting

the call for a second alarm. >> we were running short with resources in the third alarm. >> reporter: this man says he helped people out as the flames spread. >> i got the fire extinguishers and tried to get everybody out of there. >> reporter: incredibly nobody was hurt. people were concerned of some pets left inside but it appears they got out too. >> i was still inside so i went to the fire department person and they went to the room and found him. >> i was relieved. it's her dog. she was ecstatic. >> we grabed the art from the wall. we have a friend who lives across the street so we moved

a female student reported being raped by two male acquaintances in her dorm room. no arrests have been made but police say they have identified the suspect. another rape was reported on campus, an 18-year-old student was arrested in connection with that incident. a large skeptical crowd gathered to hear the school district's restructuring plan. heather holmes live at one of the school that's been targeted for closure. >> reporter: the gates are closed tonight here at lake view elementary and parents are fighting hard to keep them from being locked permanently. >> save our school, save our school. >> reporter: young lake view students walked nearly a mile to tonight's oakland school board meeting. most of it uphill as their parents prepare for an uphill battle. >> i have to do anything i can to save lake view. >> reporter: saying the district has too many schools and not enough students,

superintendent tony smith is recommending closing lake view along with four other elementary schools at the end of this academic year. >> we have to figure out how to better use our resources. >> reporter: smith also proposes closing seven others, he says the move is needed. >> when you look at -- unified, they have 12 fewer schools that we have. they are able to use resources in very different ways to support children. >> reporter: the closures prompted a very emotional debate tonight. >> for me, my daughter, students, the faculty, please don't close our school. >> reporter: with more than 400 people attending. many forced to wait outside for a seat to open up. >> i refuse to believe that my

approve an expanded smoking ban in the downtown area. as we first told you last night the smoking ban includes a 20 block area. tonight's vote is the council's first on the issue. a second and final vote is scheduled for october 18th. if that vote passes, the ban should go into effect 30 days later. anyone smoking in public would be in violation of the ban. the offense would be a misdemeanor. san jose city council finalized new rules and restrictions today for medical marijuana dispensaries. instead of the existing 490 collectives the new limit will be 10. and all have to grow the marijuana on-site. a shush, a slap and now an apology. the dispute between two members of the salsalito council

meeting members has been resolved. two weeks ago ford raised her hand and said sshhh to kelly. kelly then slapped her hand. she then filed charges accusing him of assault. a replacement nurse called a medical error for taking the life of a 66-year-old cancer patient, a nurses worse nightmare. judith ming died in oakland over the weekend. sources confirmed the death halved after a replacement nurse gave her a supplement intervenously. she's among 500 replacement nurses that were dispatched to bay area hospitals when nurses were on strike last week. >> most of us have five to 20

sat in the second row including father joe, mother katherine and sisters latoya and janet. in los angeles, adam housley, fox news. a third man has been indicted in the drug and corruption scandal surrounding the narcotics task force. former police officer louis lombardi was released today on bail. he is believed to have sold confiscated drugs. a sunnyvale mother was charged with murdering her 8 -month-old son. police say they found 27-year- old leticia serna threatening to kill herself. when detectives went to her home they say they found the

body of her son. investigators say the baby had been suffocated. come tomorrow a coalition of california school officials plan to sue the state of california over the budget that was passed back in june. the group says the budget shortchanges schools by $2 billion. they also say the state improperly calculated how much schools should get under the requirements of a 1992 constitutional amendment. supporters of prop eight won a round in court today. a panel of ninth circuit appeal put in question a lower question's ruling. releasing the tapes could expose some witnesses to harassment. the appeals court is asking both sides to present their written arguments on the matter by october 10th. a report from the census bureau shows same-sex couples

developing news now from east of sacramento where there is a street on fire at this hour in roseville. fire officials say an underground gas leak sparked the fire. it started burning just before 7:00 tonight. from what we understand it is still burning now. so far no one has been injured. the golden seat warriors made -- golden state warriors made a decision on who will lead their team. >> i want to here today officially welcome rick as our new president. >> reporter: rick is 58-year- old rick welt. he says until may he was just

straight. we now know when apple will unveil its next generation iphone 5. apple sent this invitation out. the icon refers to tuesday october 4th at 10:00 at its cupertino campus. on the bottom it reads, let's talk iphone. apple isn't saying when the iphone five will be available for sale. google wants to help you put your solar -- google wants to help you put solar panels on your roof. today the company announced a $75 million investment in san francisco based clean power finance. the money will be used to help finance the installation of 3,000 residential solar panel units. google also has an investment in a company called solar city. is the postal service on its way to making it final

it. >> reporter: if congress doesn't act the postal service will default and may have to shut down entirely. lloyd lacuesta, ktvu channel 2 news. federal authorities unsealed an indictment today accusing members of the hell's angels of mortgage fraud. two hell's angels leaders obtained more than $10 million worth of loans. the money was allegedly used to buy homes across the bay area for marijuana growing operations. a man in a wheelchair who was killed in a hit-and-run accident over the weekend has been identified as 68-year-old robert walter smith of santa clara. the incident happened at the interception of homestead road around 1:00 sunday morning. police say the car involved in the accident was a late 1990s model mid-sized sedan dark in color. the hit-and-run driver is described as a man with a medium build wearing a white t-

shirt. police say the car most likely has front end or windshield damage or both. a san mateo family tell us they are heartbroken and angry about the loss of their dogs shot and killed by police yesterday. san m ateo police say the two boxers were being aggressive and snapping at children, adults and even officers. at least one officer shot the boxers. the male died, the female was wounded and was put down last night. >> they were wonderful, great beautiful boxers and they wouldn't hurt anyone. yesterday was the first time they got out of the backyard. >> reporter: bella and jordan had been spade and neuters and they never had problems with them before. the peninsula human society told ktvu it was not going to second guess the officers actions. the faa says a helicopter crashed on highway 49 in the sierra foothills it happened

yesterday morning. 71-year-old lee haley was flying his 51-year-old bell helicopter when it crashed into some trees. both he and his passenger suffered minor injuries but are expected to recover. hundreds of millions of the dollars are still needed to build the 49er stadium, butted models have been introduced. >> reporter: this is the model of the 49er stadium planned. although the 49ers aren't discussing prices publicly we have learned many cost $45,000 a year. >> it's roughly a 35,000 square foot club that spans the lenght of the football field. >> reporter: the stadium cost has gone up to $987 million.

another large dust storm rolled over phoenix this afternoon. the dust storm is called a haboob. and it dropped tons of dust on the city. it's the fourth major dust storm to hit phoenix this year. the biggest on which occurred july 5th. thunderstorms kept engineers from repelling down the washington monument today. climbing ropes were put into place on the monument to climbers can inspect the landmark after it was shaken by a 5.8 quake last month. engineers say the elevator system was damaged and a few exterior tiles cracked. they say over the next several days they hoped to scale down the monument to further assess the extent of the damage. people went on a two hour tour which gave them an up close look at the new bridge. it's part of an architecture festival going on in san

francisco. the group was treated from special insight from caltrans and architects. a typhoon blew a shore today bringing torrential rains. at least 16 people are reported dead. the storm hit the capital manila causing flooding. some 100,000 people have been evacuated from low lying areas. in israel the government today approved construction of 1,100 new housing units. the area is already home to a growing jewish onclave. last week they asked the united nations to recognize the state of palestine. in peru police have released the video of van der sloot, in it he's asked if he

okay so no one has actually seen it, but a bear may be roaming around mount paletine state park. >> reporter: this afternoon we were lucky enough to spot this buck in the brush. >> it's not uncommon to have encounters with you know a coyote or two or maybe a bob cat but it's rare we see a bare. >> reporter: but two bikers told forest employees they spotted bear scat.

>> all we see is bear excrement, it appears to be bear. how we know that is the size of it. >> reporter: manzanita berries were found in the scat. and that's primarily what the bear would eat in this season. >> it's unusual because bears don't live in marin. we did have a visit in 2003. >> reporter: district officials speculate because the black bear population is increasing they may be looking for new territory. scott young often carries his camera while hiking here. >> you can't go wrong, you just enjoy while life and take it as it comes you never know what can come your way. >> i would love to see it. that would be quite an experience. a wildlife experience in marin. >> reporter: black bears here are not a threat to people. they eat acorns and berries and do not associate humans with food and would most likely run
