but have not yet arrested the shooter. >> reporter: right heather, they think that owner was defending himself and first called police. like you said, police cleared the scene moments ago, but were going in and out of house. on the inside they said it was obvious someone was pulling copper wiring from the home, that was until that person was confronted by the owner. the sight of police and crime scene tape around three vacant houses in antioch had neighbors on edge, especially when they learn a man was shot and killed inside one of the homes. >> i have known that house to be empty and for that to happen, it's just mind blow. >> reporter: police say this gray, two story house was not empty when the owner stopped by around 2:30 this afternoon and investigators say he interrupted a burglary in progress and when the suspect threat íened the owner with a weapon, that owner shot and killed him. >> you have people doing crazy stuff because of the economy and it's sad that lives have to

drive the water away. and at times mother nature seemed to cooperate, no matter the weather, nothing dampened the spirits of these two young women from eugene, oregon. >> we have to get back-to- school on tuesday, so we'll be here through the weekend and definitely, i mean the rain is not going to deter us. we're from oregon. can do, but offer our resources. we have limited tarps and limited tents. >> reporter: does the weather defer you at all? >> tonight it will, but i don't think it will be permanent. >> we have been monitoring the occupy movements and ktvu's alex savidge was in oakland and caught a confrontation on- camera, but not with police. that is coming up. . well, the wet weather is making things difficult for crews in san francisco working right now to repair a water- main break in the mission district. that 16" transition line ruptured on 23rd street near san francisco general hospital. officials say they are working tonight to divert water to the area from other mains nearby. no indoor flooding or injuries have been reported, but officials tell us that repairs could take several more hours.

today marks one year since the sentencing of a former bart officer convicted of shooting and killing a passenger. friends and family of bart passenger oscar grant gathered at frank ogawa plaza. grant supporters say former bart officer mehserle got off early tonight shooting on new year's day 2009. >> were it not for the videotape we would not have seen a trial for the murder of oscar grant. >> that is right. >> and as strong as the video evidence was, the judge never wanted to see that officer convicted. >> mehserle was convicted of involuntary manslaughter and released from jail in june after serving eleven months. morgan hill police are investigating a drive-by shooting that left a 14-year- old girl dead and three other teenagers wounded. police arrested four men. the shooting happened last night on kos moe and del monte

avenues on the lawn of an apartment complex. investigators say the suspects are gang members, but none of the victims are affiliated with a gang. police in san francisco are investigating a shooting that sent three men to the hospital before 11:00 at 16th and hoff streets. police say two of the victims are in serious condition and the third victim suffered non- life-threatening injuries. so far no arrests have been made. people in the east bay may have felt a bit of a jolt, a 3.2 magnitude earthquake struck this afternoon. it was centered three miles southeast of downtown berkeley. this is the latest in a series of quakes centered in east bay in the past few weeks. today's quake was centered on the hayward quake. ktvu's allie rasmus

talks to scientists. >> weare actually standing onn the main trace of the hayward fault. >> reporter: geophysicist lienkaemper took a visual tour of the fault. the hayward fault runs underneath this parking lot where we're standing. >> we can show it by pointing out the break of the curve. >> reporter: on this side, it's slowly moving south and on this side it's moving north. can you see more evidence in the warped wall of this building and the foundation outside of this restaurant where the asphalt was forming a half-foot gap. >> you could do this from the south end of fremont to san pablo and eventually the fault goes under san pablo bay. >> reporter: lienkaemper says that slow creep doesn't reduce the likelihood, but can reduce the size. >> the creep is taking nearly half the energy.

>> reporter: people say they have become more curious about the hayward fault after last month's quake. >> i hear a bump night and think is that an earthquake? because you hear a sound and makes you nervous. >> reporter: everyone wanted to know when is the next big one? >> the probability is approximately 30%. >> reporter: a 30% of a 6.7 earthquake or higher in the hayward fault in the next 30 year. students like this man say he will see the ground he walks on everyday a little differently. >> after this i's from going look at the cracks in the ground and see what is going on. an update on the gas leak discovered in palo alto in the same pipeline that exploded in san bruno last year. new documents reveal that portion of the line is salvaged. the leak was found during testing yesterday, about 20 moils south of san bruno. pg&e documents show the gas line contains eused pipe that

pace, energized by the occupy movement. >> i think it's really important with the respect of age and not just one people. >> reporter: we're getting word that the occupy san francisco encampment could be expanding and setting up in a new location. one organizer told me that they may set up at civic center plaza in the coming days. in san francisco, alex savidge, ktvu channel 2 news. three people are recovering after being hit by a car during the occupy d.c. protest. it happened last night in downtown washington. the three were part of a group of demonstrators who either ran towards the car at a green light. they were taken to the hospital with non-life threatening and the driver was not cited. in new york, at least 20 protesters are under arrest tonight after a tense standoff with police. authorities say the demonstrators blocked the roadways near the white house building at foley square even

after orders to clear out. protesters not arrested rushed back to their home base at zuccotti park. the occupy movement is growing overseas. hundreds of demonstrators marched through the streets of sydney, australia, demanding economic change. police were out in full force for the event. the protest was mostly peaceful. only two people were arrested for report thely becoming hostile with officers. occupy has gained momentum beyond wall street and big cities and john sasaki reports live from concord. >> reporter: mr. moneybags character strung crime scene tape along the wells fargo bank in concord this afternoon. >> werls fargo specifically is closing down on my family. i have a foreclosure. >> reporter: it was national move your money day and the protest has spread heartily to the suburbs.

>> we're tired of the banks getting bailed out and the people getting sold out. >> reporter: walnut creek had a demonstration that was much more subdued. >> we want it grassroots with respect to the oils of the bank and take our action by moving our money. >> reporter: organizers say most of these protesters were closing their accounts at the big banks. >> i joined first united services credit union and put my money there and found out a lot of things that i was paying for the with the banks i didn't have to do that with the credit company. >> reporter: there was also a protest outside of the big banks. >> we know they are going to continue with their shenanigans and we believe the only way to impact them is to tell them you don't want to do business with them anymore. >> reporter: i asked for comments from the banks, but was repeatedly turned down. an regional division in oakland defends his bank. >> we give to public schools and contribute over $20 million here in the bay area.

>> reporter: another difference with protests in the big city, there is no camping out here. as one protester told me, i's from too old for that. in concord, john sasaki, ktvu channel 2 news. demonstrators were joined by the vice president of mechanics bank who says small, regional banks offer customers something big banks don't. >> we actually care about the relationship. we care about the people and we care about bringing in our local community and investing back to our communities and investing in local businesses and that is what is important to us. >> schwartz says his company as seen a spike of new customers in recent weeks. credit unions across the country gained about 650,000 new customers just last month. that is 50,000 more than the number of new members in all of last year. and 36% of long time bank members surveyed last month say they already have or plan to move their money after announcement about new checking account and debit card fees.

police officers and five alleged taliban militants are now facing charges in connection to the assassination of former prime minister benazir bhutto. miss bhutto was killed in december of 2007 during a campaign appearance. the two police officers were charged with security breaches and failure to protect the former prime minister. the five suspected taliban members are accused of bringing a suicide bomber to carry out of attack. musharraf pervez has been implicated, but denies the allegations. a week after the surprise october form storm, 3 million people lost power across the northeast and as of tonight, 140,000 people in connecticut are still without power. connecticut light and power is trying to meet a self-imposed deadline to have 99% of its customers back on-line by midnight tomorrow. many residents though are angry

a very difficult night for travel for folks going eastbound towards lake tahoe. a lot of problem problems on the roadway with slick roads and trucks lowing control and spinouts. fortunately no serious injuries, but the flipside is that some people are really happy with it. a handful of skiers and snowboarders have the ski area all to themselves. skiing in a well-lit snowstorm until 9:00. >> it's perfect, nobody is here and it'snize and soft and you couldn't ask for me. >> it's not too bad. >> reporter: good start for the season? >> definitely. >> boreal has taken advantage to make more snow. the driver of a westbound pickup truck went off the road and so did the trailer he was pulling. the driver was making a lane change and lost control. fortunately he was not injured.

they will be reducing seasonal staffing, but will continue to operate engines in the two counties during the rainy season. people in hayward got a chance today to share with city leaders their plans for the downtown area. and some of those who attended today's community workshop called for more walking areas. while others say it's important to make the downtown more of an entertainment center with restaurants and theaters. other suggested that the city should work with cal state east bay to put student and faculty housing downtown. they are hoping to get money from the sustainable communities grant from the state to further fund the plans. a young woman is in the hospital after she was struck by a tractor-trailer in petaluma this morning. 23-year-old heather kotbos was
