and protesters have already clashed once this evening. >> reporter: so far, no arrests, but they have gotten in each other's faces a couple of times as we watch this camp shrink. police set 10:00 as the hour they will start enforcing park rules again. at martin luther king jr. park, eviction notices. these officers handing them out, need a retreat, but their message is clear, this camp is on borrowed time. berkely's mayor says crime here is out of hand. >> just last week, we had a situation where a woman was raped. >> a lot of people came from san francisco. a lot of people came from oakland. >> reporter: many admit, when refugees came from the enclosed

camp, berkely went downhill. >> there's a better way to fight the system. that's the legal way. not a bunch of scoundrel people that really don't care, they just want to disrupt the place. >> reporter: many campers are homeless. as some packed tonight, they're wondering where to, next. >> they're nothing more than heartless. they're doing this four days before christmas. >> it's time to move on. the question is when exactly we'll implement that in a more forceful way, we'll see. >> reporter: officers confiscated one tent, someone's possessions inside. >> they didn't even look inside. they shook it to make sure no one was inside, and started dragging it away. >> reporter: other than the two visits by police earlier, no sign of them now at this 10:00 hour. but as you can see, this order is being taken seriously.

defending itself against management that one of its players sent out a sexually explicit photo to a fellow employee. monta ellis is one of the warriors star players. he is starting the season, defending himself from this woman. erika smith, the warriors former director of community relaces filed a sexual harassment lawsuit. >> it started with the phrase, hey sexy. >> reporter: the lawsuit alleges beginning in november of 2010, he sent her text messages and a picture of his genitals to smith. her job description changed, and she was fired. >> it wasn't my fault that i was let go. >> reporter: she advises lowers not to do anything retaliatory. she says jurors will be suspicious. especially since it seems smith

has evidence. >> it's going to be difficult to persuade a jury those were welcome advances. >> reporter: smith says she never had a sexual relationship with ellis. we caught up with the guard earlier today at a charity event and asked him about the allegations. >> he responded already, i'm just here to put a smile on his face. what happened happened. >> reporter: smith says she thinks now that she has come forward, she will be black listed from the industry. as far as ellis goes, he is married, and this lawsuit is seeking unspecified damages. reporting live from oakland, ktvu, channel 2 news. the warriors are also named in that lawsuit. the team's chief operating officer responded this afternoon saying that when management found out about what he called a consensual relationship between ellis and smith, the warriors told them to stop. >> we live in a litigious

arriving on the scene. >> police say an officer armed with a shotgun tried to stop the man, but couldn't, and then shot the man in the torso. the man's name has not been released. a pittsburgh man has been arrested. he faces felony charges for allegedly setting more than 50 dumpster fires in pitsberg, antioch, and bay point. officials say the fires caused thousands of dollars in damage. los gatos police say they have arrested a registered sex offender who was accused of luring boys with the promise of a job. he was booked on charges of molesting a child under the age of 18. investigators said he would hire boys to wash vehicles. he allegedly would then refuse to pay them, unless they took off their clothes or showered with him. police are investigating to determine if there may be more victims in this case.

a scuffle with a passenger on muni unledded with a police officer accidently getting pepper sprayed. a muni isn'ter was checking to see if they were checking the fare. the suspect was hit with pepper spray along with one of the officers. their eyes were flushed with water. the suspect was arrested on several charges. more than 100 soldiers just recalled from the war in iraq, arrived at oakland international airport this evening. >> yeah, welcome home. >> 188 soldiers landed shortly before 6:00 tonight. it was their first landing on u.s. soil since leaving the middle east. the soldiers spent months in iraq. >> it feels great to go and see my family for the holidays. so i'm excited. i'm very, very excited. >> it was wonderful.

in less than nine hours, thousands of nurses are expected to walk off the job at hospitals throughout the bay area. lauren blanco tells us the last time these nurses went on strike, a patient being cared for by a repolicement nurse ended up dying. >> i lost the baby. you know i lost the baby at 33 weeks. >> reporter: less than two months from welcoming a new baby girl, marilyn suarez hopes they can avert a looming strike. >> it's scare. especially me right now being pregnant. i'm a high risk pregnancy. it's harder for me, unfortunately, i've had some mishaps happen. >> reporter: suarez knows the last time the nurses walked out

in september, a patient died. the hospital sent us a statement. in part, it readsk we're deeply disappointed in the union's decision to call this strike, particularly at this time of year. the temporary replacement nurses are highly skilled, and especialliy trained. >> reporter: nurses put up signs today. they tell us the only way they won't use these, is if sutter health removes its confession. two big ones. they want to reduce paid sick days, and stop the union from using ther nurses. >> a nurse is in healthcare, and she can't even be sick. we're not iron. actually, we're human beings too, and right there in the midst of a lot of illness. >> reporter: the nurses plan to take these signs to the streets tomorrow morning at 7:00 a.m. sutter says, the nurses who strike tomorrow can't come back until christmas eve. in oakland, ktvu, channel 2 news. more details now on which hospitals are part of the

accused of killing jeffrey pettigrew. ernesto gonzalez was a flight risk. he had a reservation on a flight to el salvador the date before he was arrested. the judge today agreed, and said she's not sure if gonzalez was more afraid of being found by police or by hells angels. poisoning has replaced traffic accidents as the leading cause of accidental death in the united states. the centers for disease control says cars are now made to be safer, and more people are accidently overdosing on prescription painkillers. the latest figures are for 2008. about 38,000 people died from vehicle accidents while 41,000 died from poisoning. some of those overdoses come from legal over-the-counter medicines that are readily available to children. new at 10:00, lloyd lacuesta is

there is word today the city palo altos that given at&t the go ahead to install new antennas. it was approved this month over the objections of some residents who said they would be eyesores. the new rules don't take effect for two years, they also don't cover all types of pilots. >> reporter: two years ago, two pilots made errors that killed all 49 onboard, and one on the ground near buffalo, new york. uncle sam says fatigue

7-2. the sharks crushed tampa tonight. getting hurt is bad enough, but when it comes in a meaningless exhibition game, it runs salt in the wound. or in this case, the ankle of warrior star stephan curry. it's a chronic problem for him, unfortunately. it looks doubtful he will make the opener on christmas night. we sure don't know for sure until the game gets going against the chiefs, what kind of lasting affect the raiders gut wrenching loss has on them. they talk about you need to have a short term memory. simply put, the lions loss has the raiders in a long shot situation with regard to the postseason. coach jackson asked if the team will be able to move on after this loss. >> i'd say it has to be.
