man who shot and killed a 5- year-old boy. tonight there is a growing memorial for the child at the scene of the shooting. >> decide today to begin the year not the same as you ended 2011. >> reporter: dozens attended a vigil to remember gabreille martinez junior. parents are fearful for their children. >> i don't like it i mean -- i don't know how many children more to die for change. >> reporter: he was shot shortly before nine friday when a man who police say had bought food from the truck moments earlier opened fire. the boy's father said tonight that he hopes no other family has to experience his pain. >> visitors have not said what the motive was. the talk in the community is that the father had thwarted a robbery attempt at a restaurant and that it the shooting was in

revenge. family members said tonight that they don't believe there is a link. the death follows on the heels of two other children being killed. in august a 3-year-old was shot also in east oakland. in november a 23-month-old was shot in west oakland while he was with his father. >> just angry. angry, frustrate, words can't begin to describe kind of just the fury. >> reporter: late this afternoon we caught up with two homicide investigators. they declined to answer questions but did say they need the community's help in finding the killer and that they are working around the clock to solve the case. reporting live. amber lee. jury . >> 24-year-old edwin ramos has plead not guilty to three counts of murder.

prosecutorrers say he killed a father and his two sons thinking they were rival gang members. they were actually returning a picnic. new details about the case of a 40-year-old nurse suspected of killing a woman whose neighbors say is the mother of her girlfriend. police say she used a machete to kill the 65-year-old on friday. she first said she and kirk were attacked by a man but police say that didn't hold up. neighbors say the suspect and her girlfriend live in the house and that she said her girlfriend has been on vacation for several weeks. >> a woman is dead after a fire started in her bedroom. it appeared about 10:30. >> when firefighter as lived they say the second story bedroom was on fire. they found the body of the 52- year-old bobby mitchell as well as that of a small dog.

firefighters were able to rescue another dog. an autopsy is scheduled for tomorrow. investigators still trying to find what started the fire. one person suffered minor injuries in this fire. it started around 3:15 in the kitchen of a home on camel back. as you can seat fire spread to the attic. the damage is thought to be at $350,000. the fire did major damage to the condo and one next to. vehiclors haven't determined the cause. gop hopefuls are rush over iowa even at this late hour and the countdown is on for the official start to the 2012 contest and tonight the race is fluid and unpredictable. craig boswell joins us with the latest. >> reporter: good evening to you. a rush is the way to put it. all the candidates fanning

right now. most of them were closed for the holiday. they hope that all of this repair work is wrapped up when they reopen in the morning and that they don't find more damage. reporting live. heather holmes. >> and east bay mud crews dealing with another water main break that happened yesterday near hawthorne and willow. crews spent much of the day trying to find how to do the repair. they plan to start the work tomorrow. they say no customers currently without water since other pipelines are week used. >> in pacifica several thousand pg&e customers are without power. that number was about 3,000 at last check. that's down from 5700 customers when it was reported earlier this evening. pg&e said it hopes to have service restored to everybody by midnight. no word on the cause. the california highway patrol said dui arrests went up

while traffic deaths went down during the holiday weekend. statewide officers arrested almost 1200 people for driving under the influence president that's up from 961 during the same period last year. traffic related deaths are down with 18 reported statewide compared to 22 the year before. in 9 bay area santa clara county reported 75 fewer arrests this holiday season. >> new, a restaurant upside the california academy of sciences shut down forcing people to change their plans for new year's day. it closed on december 31st and is being taken over the owner of the slanted door. he also operates the academy cafe on the main floor. saw 15 employees lost their jobs. >> the change was simple,

chase quickdeposit. take a step forward and chase what matters. ♪ we just keep on keepin' on ♪ ♪ keep on . a store in modesto has evacuated for a time after shots were fired in the parking lot shortly before 5:00 p.m. modesto police say a suspect ran in to the store before being tracked down and arrested. police say they found ammunition on that individual. police later found four other suspects in a car nearby. nobody was injured but the car was hit with several bullets. in los angeles a plan is under arrest tonight an arson charges. since friday there have been more than 50 arson attacks mostly setting cars on fire. >> reporter: police arrested a person of interest between three and four monday morning

near hollywood in los angeles. he appears in his early 30s, white, a receding hair line and pony tail and matches earlier surveillance video taken friday near one of 55 arson fires set since friday. he meets a description from several witnesses who saw a man fleeing the scene. >> the sheriff's department detained a 24-year-old man named harry burke hart. he has been charged with one count of arson -- and is currently being housed without bail. >> reporter: police took a van which appeared to have canada plates. they are searching the van and have found ignition materials inside consistent with arson according to the times. police believe the suspect may be from germany. >> we are confident in this arrest but we have a long way to go and i think it's important that the media and public recognize that. >> reporter: many of the fires
