developing news an escaped inmate back behind bars minutes ago after an exhausting search in santa rita jail. good evening i'm heather holmes. >> and i'm frank somerville. deputies found him in the last hour. ken wayne to tell us about the escape, the search and how the man was just captured. >> reporter: this all happened

within the last 30 minutes when we learned that the inmate that had escaped was found. he was returned to the jail in santa rita. we want to show you pictures of the sheriff deputy cars arriving. the suspect is in the first call, jose luis perez. at first deputies thought he might be trying to escape the weather. >> you know it's very cold out here at night. we don't believe he had anything more than his jail issued court which is not unusually cold for this type of weather. that may have forced him to seek warmth. >> reporter: alameda deputys are still trying to determine how jose luis escaped jail.

he was in a minimum security area. authorities say franco was last seen climbing a fence in the gun range area. the whole thing is unnerving for some near by residents. this woman got a call from her children's school. >> there were some afterschool activities they had to cancels are this is just the third escape from the jail. other residents say that record makes them feel safe. >> i've been living here for 15 years now. it really hasn't happened too much, so it's not something i worry about on a day-to-day basis. >> reporter: here's what we just learned in the last few minutes that franco was spotted on a bicycle by a citizen in the dublin area who saw him and called police and said that's your man. dublin police responded, saw him on the bicycle at a gas station, he fled on that bike,

tried to hop a center divider and apparently crashed on the other side and basically ran into the waiting arms of another police officer. he suffered some minor injuries and was treated at the scene and returned here to the jail. so once again jose luis franco is back in custody. he apparently broke out after he was being transported back to the jail from a court appearance. he was on a sheriff bus, after he was being taken off the bust and into the jail somehow he got away. authorities are trying to figure out exactly how it happened so they make sure it doesn't happen again. ken wayne, ktvu. happening now, police in nevado called in reinforcements tonight and added patrol as they try to track down a serial arsonist. they're searching for a firebug who's lit dozens of fires two nights running. debra villalon is joining us

and tells us there's concern because one of those fires may take off -- amber lee joining us now. >> reporter: two fires were set here in the queen creek area this morning. police officer, firefighters and sheriff deputies headed out from nevado police headquarters. they're following an arsonist. these neighbors near rush creek open space told us about 3:00 this morning the smell of fire awoke them. but they thought it was someone burning wood in their fireplace. >> we opened the door and said it's stronger outside than in. but i had no idea this was happening. >> reporter: police say someone set small fires along the trails in the park. a popular spot for dog walkers and hikers. >> oh my god, it would be so easy for a fire to come up over that hill and just come right down and wipe us out. >> reporter: the string of arsons started saturday night

around 9:00. and lasted into the early morning hours of sunday. then the arsonist struck again last night. and early this morning. >> i'll be on the look out for any strange actions or people in the area. >> reporter: police say there have been 55 small fires so far. investigators won't say what was used to start the fires. but say they've been able to collect items from several locations. >> this is definitely not a prank. this is a very serious business that someone is engaging in and they are really jeopardizing people's property and more importantly their lives. >> we have to worry that whoever is started fires wants more and more attention. >> reporter: police say they have no suspect description. so far the fires have not damaged any homes or injury. police say they are now working on a reward for a person providing information for the person or persons responsible for the fires. the lack of any substantial rain so far this winter is helping create conditions very

be able to choose their own medical coverage. >> i like to be able to fire people that do not provide good services to me. >> other republicans pounced on the comment saying they want to hire people not fire them. later romney tried to control the damage saying his comments were taken out of context. ken pritchett is in new hampshire and spent today in the heels of the candidates as they criss crossed the state in a final effort to sway voters. >> reporter: for governor john huptsman. >> we're going to surprise the world. >> reporter: the night ended with what looked like a victory party in new hampshire. a ruckus final rally before the vote. what a difference a day makes. it was a tranquil scene as huntsman started the day in the town of henecker. population 5,000. >> how is everybody doing?

is reviewing a police report. mayor lee swore in alagi. alagi is a long time community analyst. she also helped organize the effort to get lee to run for mayor. series -- alagi is only the third latino woman to run for senator. in a statement today, mary hayashi said i accept responsibility and i offer responses. my medical condition may have complicated my condition. but i want to be clear that i take full personal responsibility for my actions. she was sentenced to three years probation. her attorney suggested a brain tumor affected the assemblywoman's behavior. exclusive new information about a man accused in a string of violent sexual attacks.

the death of a well respected city clerk over the weekend. heather holmes is live now in berkeley and tells us the woman was found dead inside her home after falling down the stairs, heather. >> she was just 37 years old and the unexpected tragedy hit hard among colleagues of diana disbane. this city clerk's office an office which she has left for the last three years was closed today to allow people the opportunity to grieve for this wife and mother. a quiet sadness fills city hall as people mourn. >> she was just a beautiful person. everybody was stunned when they heard she died. >> reporter: at 37 years old, brought innovative ideas to help government operate faster and better. >> she came in and she modernized the city clerk's

office. she made it really transparent so people could see what we're doing. she led us in new frontiers. >> reporter: tonight that progress is on hold after she was found dead by her husband. the preliminary autopsy shows injuries similar to those of her injury. disbane moved quickly up the rank after entering the clerk's office. in 2010 she swore in the new police chief. she was appointed to lead the office in 2009 after serving as the interim city clerk four years. >> her personality was such that she was just a really well liked person. people really are going to miss her awfulfully. >> reporter: and the city

council plans to honor disbane at its meeting next week. here in berkeley, i'm heather holmes. work begins tomorrow on the first section of the high speed train. alameda firm stacy and whitback will do the project. tomorrow should be a red letter day for b.a.r.t. the u.s. department of transportation is set to recommend some $900 million in federal aid for the train extension. and congress is expected to approve the money. b.a.r.t. wants to build an extension from fremont to san jose and hopes to have the project completed by 2016. firefighters say thanks to the quick work of neighbors police and fire crews no one was critically injured in a three alarm fire earlier today in san jose.

>> this was the scene at the may fare golden manor around 1:45 this morning. firefighters say the complex is considered a senior residence. neighbors knocked on doors and one man pulled a woman from her apartment. >> ran through there and got her. took her straight out. >> reporter: lee says lopez is her hero. firefighters say one fire had significant burns to the feet and several others were taken to the hospital for observation. the cause of the fire is under investigation. and 16 people are out of their homes because of the damage. a suspected drunk driver in richmond took out five parked cars and a street sign. it happened at about 12:30 this morning when police say a woman drove into the cars on maricopa avenue and 23rd street. officers say when they arrived they found the woman who appeared very drunk pinned inside her car: she was taken

to the hospital with moderate injuries. new details tonight on a story we first broke on ktvu channel 2 news at 5:00 and 6:00 involving a rape suspect in san francisco. fredrick dosier is in police custody and today ktvu's david stevenson found out he admitted his involvement and he works for the sacramento school district. >> reporter: the suspect the áf in the assaults in the mission district has admitted to participating in the three attacks. >> the last scene that we went to the victim actually, there was a lot of blood. it was a very brutal scene. >> reporter: police on friday arrested fredrick dozier after an anonymous tip. >> the biggest break in this case came from a tip that came in. and from that tip came a name, the first name. >> reporter: police say dna evidence ties dozier to the

crime scene. the early morning assaults in june, december last year raised fear. police distributed this sketch of a suspect and a surveillance video and called in outside help. >> all told it was probably close to about 100 people and we had outside agencies. we had the fbi on board. we had people from quantaco, virginia on board. they were doing a profile. >> reporter: investigators say dozier worked for a recycling program but today ktvu confirmed he was also employed by the san francisco unified school district something he also posted on his facebook page. district officials say a full background check turned up nothing unusual he's now been fired. residents near the assault say they are relieved with the arrest. >> it's reassuring. i have to work every morning at 4:00 to 5:00 a.m. >> reporter: dozier is to be arranged wednesday afternoon.

david stevenson, ktvu. chp officers are looking for witnesses in a hit-and-run accident that killed a police dog. boss has worked with his handler for more than five years but on december 27th he got out of a fenced yard and was hit. investigators are searching for the driver who did not stop. anyone with information about the incident should contact the chp. and temperatures outside were on the warm side. we have lots of low 50s, it was 67 degrees in santa rosa. highs tomorrow aren't going to be quite as warm. more cloud cover. as we go into tomorrow these clouds increase. here we are tuesday morning at 7:00 a.m.: you see a few sprinkles. is it going to rain? no. will there be light sprinkles? yes. even some fog south of

teaching jobs are on the line where nine schools could lose a total of $7 million in state funds all because the number of students in some classrooms exceeded guidelines. as alex sadvege reports, mount diablo high is one of the schools that must coordinate with the state. >> reporter: now mistakes by the school and the district have put those funds at risk and it could mean as many as 20 teachers losing their jobs. >> that's devastating, and that's -- we're already hurting here at mount diablo. they don't need another hit. they can't afford it. >> it's scary because i want like every parent the best education for our kids. >> reporter: in order to get $1.5 million a year from the state. mount diablo high must have classes with no more than 25

students. this year that didn't always happen. and that's why their funding could be pulled. mike langley says this was a major blunder by the district. >> allow them to get small class sizes so they could work with individual students and that's going to be taken away from them. that's the key. it's the keupbdz that is going to be damaged the most. >> reporter: district representative lori o'brien blames turnover. >> i think it's a very important situation. i feel very worried about it. it very definitely has our attention. >> reporter: to avoid losing the money, the school is now appealing to the state. the board of education tells me they plan to make a final decision by march. alex savidge. some prekindergartners will feel the impact of budget cuts.

we'll have that story coming up. gm had held the spot of top auto maker. gm is expected to release final global sales earlier this month but the company was on pace to sell 9 million vehicles last year. that's 800,000 more than toyota and volkswagen. the hyundai elantra took home the auto award. detroit's big three auto makers boosted double digit sales increases but were shut out when the awards were handed out today. twitter is pulling out the vail in renovations at its new offices in the mid-market neighborhood. a product manager released these photos showing work at the new office at tenth and market in the historic furniture mart building. as you can see there's a nice view of city hall from what

more of an advantage. >> reporter: last year san jose unified district introduced the transitional program for next year. 25 classrooms for 600 students. the governor's decision to drop transitional kingergarten angered many parents and teachers. >> somebody needs to stand up and say, this has gone on too far. why do one and four year olds have to bare the brunt in their classrooms. >> it will not give them the time to put the deposit or the reservations in for the preschool that the children will have to go to next year and that will yield another class of students who are not prepared. >> reporter: today after several hours in a closed door meeting the superintendent told us san jose unified has decided not to give up on its plans and will lobby state legislatures and other districts to keep transitional kindergarten alive. the superintendent says it would take several million

an overturned truck led to a trying day for some bay area commuters. the accidented happened on westbound highway 24 on the oakland side of the caldecut tunnel. backed up traffic for several hours. the truck was carrying a load of scrap metal which spilled all over the road. more people are being caught at the nation's airports with guns in their carry on

bruno explosion. >> this culture of profits over safety needs to change. >> a pg & e spokesman told us the utility hasn't taken a position on the proposed bills but is supportive of improvementing safety. the legislation is set to be introduced to the assembly this week. now to a story where the pictures pretty much say it all and here they are. no snow from above the lake tahoe area. look at those pictures. in fact, the situation is so bad that several lake tahoe area resorts are actually closed. in other parts of california resorts such as mammoth mountain are seeing major dips in business. mammoth is the third busiest resort in the u.s. and reported a 10% drop in visitors compared to last year. look at those picture, many of you are looking at donor lake don -- donner lake in the

background. and donner summit that's borreal ridge they made snow in november and december with temperatures below average. so they were able to make a lot of snow. but those picture really say it all don't they. manmade snow then nothing. they have nothing to offer you in the next 24 hours expect maybe the slight chance of a sprinkle. some increased clouds. and certainly temperatures a few degrees cooler than they were today. so tomorrow look for the clouds to increase. i'm putting a chance of a sprinkle and you will see it come up on the computer model. you will see why i did. but when you see the model you will say, maybe you didn't have to put it in there. but you have to put it out there because the mechanisms are out there but there's nothing it can do more than drizzle. we might get down to 32 in santa rosa. you go out in the pacific and i've been saying this all along. here's another big weather system. last year, this is a nice weather system too. this were to move right through us. the system will move right to

the north. very strong ridge of pressure. here comes this little tweak that blows through tomorrow morning. that's basically it. the main impact will be slight cooling. as you look at the computer models, 7:00 a.m. tomorrow morning. look at where we're looking at. there's nothing. the models are fairly good with what's being coming in this weak system. it's very weak on any type of rainfall. then around 10:00 a.m. you see a few sprinkles. this could, there's dynamics here so it could trigger some drizzle right along the coast. watch what happens here in the afternoon time. all of a sudden the next shot is everything going this way. that's the model saying, high pressure just came back in and filled in that vacuum that was created by that low. then high pressure comes in and blows the clouds away. blows everything offshore and we're back into the dry. that's where we stand. tomorrow morning maybe some sprinkles. do not cancel your plans. it would be mainly right along the coast, mainly at the bay
