states. >> reporter: the president's state of the union speech began on an emotional note. a hug for giffords. a standing ovation for troops getting osama bin laden. then it was on to business with the president making way for housing for 1.2 million americans. >> it's time to stop rewarding companying that send jobs overseas and start rewarding those who keep jobs here in america. >> reporter: to help california students who have seen tuition rates jump 22%, mr. obama asked congress to increase tuition help. the president is also sending congress a plan to help lower california's foreclosure rate which is twice the national average by helping homeowners refinance. the president also asked congress to reform the tax code

still debating a request to put the building of a stadium for the san francisco 49ers back to the voters. that will likely not happen and the courts will have to decide. i do not want to pay for the stadium, i pay taxes here. there's a lot of other nice things to pay for the taxes to go to. >> please don't let us lose what we worked so hard for. the city council chambers are packed tonight. some expressing their opinions with their clothing. last week an anti stadium group turned in to petitions with some 11,000 signatures asking for another vote on building the $1 billion stadium in a parking lot of the great america amusement park. but the santa clara attorney is asking not to -- the measure

j passed by a 58% margin. but opponents say at the time there was no mention of an $850 million loan, the council unanimously approved last month for stadium construction. >> the 49ers owned and marketed measure j. and intentionally left the facts of what it was going to cost our city off the ballot. >> reporter: one city council member who voted for the stadium said there is cause for a second look. >> i do think there's a reasonable beast that folks have gathered the petitions have raised and that is the issue of did they get the whole story when they voted for measure j? >> the city is still going ahead with construction plans that are scheduled to begin next week. and i have just received this text from the deputy city manager that so far 65 people have spoken before the council. council continues to debate. if there is a decision before the end of this newscast we'll bring it to you. live in santa clara, lloyd lacuesta, ktvu channel 2 news. the federal judge

overseeing the oakland police department consent decree has ordered the interim police chief to work more closely with an independent monitor. chief howard jordan was ordered to concede. the department entered into an agreement to make reforms in the wake of the writers misconduct scandal. the writers were a group of officers accused of beating and framing suspects. the officers were never convicted of any crime. we have an update tonight on the people evacuated from their homes by a rock side on san francisco's telegraph hill. this evening the department of public works said the people working in three yellow tagged apartments could return to their homes. an engineer and geologists assessed the hillside today and they say it appears to be stable. the san mateo board of supervisors took steps to

manage the golf course in pacifica. the golf course is one of two public golf courses and it is currently managed by san francisco's parks department. environmental groups have sued to close the course, saying that golfing on the course threatened endangered wildlife. what we have learned now about yet another woman in the mirkarimi case. bill joins us with tomorrow's forecast and how in distance ]

new at 10:00 tonight, school officials in pleasanton are considering bringing in dogs to address student drug abuse. a decision was just made within the past hour, heather haener is live. >> reporter: meet camo, a drug sniffing dutch shepherd. we watched this afternoon as the trained canine searched this old police cruiser for the marijuana his handler had hidden behind a hub cap. it took him less than 30

seconds to locate the drugs. pleasanton school officials are hoping for that success on their campus. >> in the last suspensions 18 of them have been drug related. >> reporter: not only has there been an increase on incidents on campus but here at foothill high which has already surpassed the number of drug related suspensions for all of last year. >> we're hoping it makes it more difficult for kids to bring and have access to drugs on campus. >> reporter: camo and other canine will be brought in at no charge to the district to conduct random searches of the parking lots and pe lockers at pleasanton's three high schools. some opportunities and civil rights suits are afraid of the dog accuracy. >> they are constantly getting work, never get a chance to get stale and forget stuff and

soon face allegations from another woman. allegations that may include physical abuse during the course of their relationship. >> mr. mirkarimi has been steadfast that he has not physically abused anybody that he has had a relationship with. >> reporter: that relationship comes a few days after mirkarimi released a statement. >> mr. mirkarimi did have a relationship with this woman, it ended poorly about three years ago. he hasn't spoken to her in three years. and mr. mirkarimi denies any domestic violence against her. >> reporter: lopez says her husband did not abuse her. >> i think it's incumbent upon the sheriff, whether the day-to- day oerpgs of the sheriff department can be done. >> reporter: mayor lee spoke to

mirkarimi to see if he will step down. >> reporter: the sheriff is due back in court on thursday to ask a judge to lift a protective order that keeps him from seeing his 2-year-old son. in san francisco, david stevenson, ktvu channel 2 news. more details now, when that trial begins, mirkarimi reported he will not be taking any pain, but he also retated he will not be stepping down from his job. he also the áf added that he will not be taking any disciplinary action against any officer in his department. ktvu cameras were there as the suspect identified as christopher dudle was taken away in an ambulance with nonlife threatening injuries. police say the victim was found on north point street near fisherman's wharf early this morning. a homeless man told ktvu he saw

the suspect and the victim in the bushes and alerted police. >> when they were pulling into the lot, i said i found her. i found her. >> police say the victim was visiting from outside the united states. and that she had become separated from her group while buying some items at a near by 7 eleven stores. >> it appears a two alarm fire at carl's jr. started when hot greece got into the buildings ventilation system. firefighters arrived, they could see flames and dark smoke coming from the roof. six employees were inside but none was hurt. a man accused of setting six fires over the holidays

pled not guilty. burkhart says he was upset about accusations against his mother. palo alto residents complain the city has a will the of dead zones for cell phone coverage. others don't like the way the antennas work. later at 2/3 vote will be needed to end the pensions but that's still not guaranteed. this comes at the city council calls for changes in the pension plan for city employees. and temperatures outside right now are on the cool side, 46 in napa, 48 in fairfield. as we go into the overnight hours it's going to get colder.

overnight lows in the mid-30s and upper 30s. dewpoints are high. that's because the ground is wet. the central valley had a dense fog advisory. i have a lot of fog up in marysville. we will see patches of dense fog tomorrow morning as we head off to work. just be thinking that way, it'll be a little thicker and denser than it was this morning. widely scattered, not all over. but just in the places, the usual suspect spots. i will watch that for you, when i come back we will go to the five day forecast, we will go looking for rain and we'll look at the weekend. i know it's a ways off but we will take a look at it any way. the climb up half dome was limited to 400 people per day last year, now officials are recommending 300 a day to preserve rather the parks natural character. in the past as many as 1,200 were allowed up the slippery granite. other options include removing the safety cables up the final 400-foot ascend. he was killed as he left

a bay area college student is gunned downright in front of his home as he was on his way to class. rob roth tells us the young man was simply in the wrong place at the wrong time. a grief stricken sabrina rage lit a candle for his boyfriend martinez. she says martinez had just gotten into his sister's car about to go to a computer class at the community college. >> i was in the living room when i heard a gunshot, so i

dropped to the ground. >> reporter: he saw martinez sister. >> she ran out and started screaming that he got shot. >> reporter: the gunman then opened fire on martinez and his sister who wasn't hurt. >> there was no indication he was involved in anything that would prompt this. there's no information that shows as to why their vehicle would have been fired upon. >> reporter: those who knew martinez said he was studying to be an automobile mechanic. >> great guy, great guy. you know, always happy -- always wanting to be around his family. >> always trying to make everybody laugh and if you're mad, sad, whatever is wrong he was there to help. police and the family are asking the public for help. >> please, please come forward. this isn't right. i shouldn't be here today. >> reporter: police call this shooting a classic case of

being in the wrong place at the wrong time. more than a quarter million expandable lunchboxes and their freezing gel packs are being recalled due to concerns that the gel packs are poisonous. the consumer product safety commission says the gel packs contain chemicals used in anti freeze which can leak out if the pack is puncture and ingested. a dog died after chewing on a gel pack. two more details involving children's toys. the super luchamania are being

new video just into the ktvu newsroom of a fire tonight at an east oakland apartment fire. the two story apartment is on bancroft. the first alarm came in at 9:22, a family had been living there and will now have to tpaoáeupbd -- find a new home. the red cross has been called out. everyone was able to get out safely. airline passengers in the u.s. have new rights starting today they include the ability to hold a reservation for 24 hours without payment. in certain instances a passenger can also cancel a

reservation within 24 hours and get a full refund. the cancellation must occur one week before the take off date. airlines must also let passengers know of delays of more than 30 minutes. the new service begins in april and allegiant says ticket prices will begin at $30 each day. another body was recovered today from that sunken cruise

ship. in iraq a wave of car bombings killed 14 people. the first bomb targeted day laborers, another car bomb blew up near a passion pastry shop. the last went off outside an elementary school. at least 170 people have been killed since the start of the year. many of them shiite's. in egypt people are gathering to mark tomorrow's one year anniversary of the start of the uprising. it ended the 21 year rule of mumbarak. today the coup treu's military ruler did lift some of the -- the country's military ruler did lift some of the country's reforms that stood for 30 years. the recordings include a mundane discussion about a meeting with the prime minister

due to whooping cough, a first in 16 years. a noon profit group has commissioned to trying to determine whether people who live near factories are breathing unsafe air. the studies were made by pacific steel casting. the group global community monitors says it will do drug tests on 17 children to measure the levels of heavy metals in their bloods. the nonprofit says its study was prompted by concerned residents. some small businesses will soon get a boost. 1-1/2 million dollars will be made available through the city's reinvolving loan fund for small businesses. the fund which was launched in 2009 is for business expansion and job creation. mayor lee says it now has to be replenished because it has distributed funds to 27 small businesses in the city. >> we need some immediate help,

because the very successful reinvolving fund loan program that our office has been administering with working solutions for the last two years has been so successful that we tried up on these funds. $1 million of the funds will come from a supplemental budget association. the rest will come from contributions from wells fargo. a big honor today for some east bay firefighters. they were honored by the contra costa board of supervisors for saving the life of two people in a house fire back in october. christopher christianson, engineer chris lanpeter and nicholas long. the three men are credited with saving the life of an elderly woman and caretaker from a burning house in concord on october 14th. and you may have noticed a little bit warmer out there these last couple of days. that weather system came in.

the rain showed up, the frost has gone away. temperatures outside are on the mild side. low 50s in the santa rosa area. and out toward daly city and redwood city. a little bit warmer. the moisture content. the relative humidity in the atmosphere is up. the dewpoints are up and that leads to fog. fog back in the forecast, there'll be plenty of it. we had a big morning. visibility will be a little bit less than they were today. as we head into the long range forecast dry. we're dry this whole day period. the most will be the fog in the morning and then this warm up as we go into the next couple of days. so check it out. these are the highs from today. the numbers bump up. tomorrow look for some mid-60s, even some upper 60s in santa rosa and morgan hill. a little milder as we head through the weekend. the pacific is active, very active. but the jet stream is taking all this energy and going north

and that's the big difference this year. normally they say the energy is here but the jet stream is pointing the wrong way. as long as it's pointing north, we're out of the rain zone. looks like as we go into next week, this thing will bump up a little bit. and a chance for rain will roll in here toward the middle of the week. right now we go back into the fog pattern. we go back into a chilly night. some of the overnight lows a little chilly. mostly sunny in the afternoon tomorrow and we get back into the mid-60s. 63 in antioch. 63 in brentwood. i have fog out toward davis and woodland and some of those areas up in the valley. but not a lot of fog showing up in the bay yet. but look for it in the morning. you know where it'll be too out in the east bay.
