>> reporter: just yesterday a homeowner here on carrollton arrived home to find a strange net house trying to steal items. police say the teen ran off the. it's feared it's only a matter of time before he and others try again. >> know how to protect ourselves. >> reporter: that fear could be felt among the crowd that packed the meeting, called after a spike in home burglaries in the past three weeks. >> able to get into a house, they are able to into spy things of value and leave quickly. >> reporter: police told the over flow crowd since january 15th there have been 20 burglaries in southwest berkeley, most during the daytime but some of them have taken place with residents inside. >> i was cleaning around the house and heard a horrible noise from the back. >> reporter: dill said he came face to face with a would be intruder. >> i went out and there was a

couple is one of two plaintiffs challenging proposition 8. a year and a half ago a judge ruled it not constitutional. tomorrow a three judge panel will issue its ruling on the appeal. through it all the couple has been the face of same sex marriage in california. >> we are very aware of the responsibility that we have taken on but at the same time we know we are one couple and thousands of couples that would have done the same thing. . >> reporter: whatever tomorrow brings the court battle will not end year. >> obviously we hope that the court will up hold the vote of the people. >> we are getting closer to the final step. >> that step over the broom

tow iding bells. i was in the courthouse last year when the three judge panel was hearing the appeal. at the time legal experts saying you can clean where they were leaning based on their line of questioning to the attorneys. it seemed they were leaning toward striking down proposition 8. that doesn't mean they will continue tomorrow if in fact that is their ruling as there are a lot of legal roads still ahead. reporting live. >> more details now the appeals court is set to rule tomorrow on possible conflict of interest by a former judge vaughn walker. he ruled proposition wasn't constitutional and then revealed he is in a relationship with a man. opponents say he should have stepped aside. another judge ruled that he didn't need to receus himself and that decision was appealed. stay with us for continuing coverage of the ruling. we will bring it to you on air

and online. >> supporters of a millionaire's tax kicked off a campaign today to get it on the ballot. it's backed by the federation of teachers and calls for a 3% income tax increase. and. 60% would go toward education. the people that can most afford to be taxed right now, this latest proposal has competition. there is already two other competing tax measures trying to qualify for the ballot. one with race income tax, another would use a sliding scale. more names can be placed until

march 29th. there is at least one surprise. rose an barr registered as a green candidate. the party with the most candidates on the ballot is the litertarians. there are two more contests tomorrow in the race for the republican nomination. in nine minutes the latest on the campaign and some less than e couraging news for romney. >> in berkeley firefighters say they are investigating and have confirmed a fire that destroyed a huge building in the corner of telegraph was accidental. firefighters say that fire on november 18th started in an area where electrical com opponents for the el vitter were located. it smolders for three days before firefighters were able to declare it out. it ended up gutting the build, telerans were on the first story. now the city is reviewing an

application to reopen them. the fire destroyed raleigh's pub, and two others. other business owners in the area welcomed the idea saying business has dropped off dramaticly since that fire. >> a group calling itself stand up for oakland took the steps of city hall to denounce the occupy movement's influence on the biggest city. as rob reports they say occupy has cost oakland $5 million. >> reporter: about two dozen resident, merchants stood in protest on the steps of city hall today. they say oakland is being trashed by many of the demonstrators, and that enough is enough. >> they are just destroying children's art in city hall, it makes no sense. >> reporter: as soon as the protest started members of occupy oakland started shouting at the counter occupiers. >> you can't walk down this

they will have no tolerance for breaking the law. in oakland. >> following that it testy confrontation about a hundred protesters march from city hall to a nearby courthouse. >> that's where another protester was scheduled to be arraigned. they said their goal was to fill the courtroom but once they got inside they learned the hearing had been postponed until next month. also today 11 were arraigned on charges of clocking the sidewalk during a january 4th event. >> the san francisco sheriff named his top aides today. the new under sheriff is ellen brent. she joined in 1986 and would be in charge if he steps aside during his trial. the job of assistant sheriff goes to paul -- he ran against the sheriff in last fall's election. activists for domestic

cost. we just learned the man of a man shot. mcdaniel was a wrapper who performed under the man tuta boy. he was on 106th avenue near ninth street when a gunman came up to him and opened fire. no arrests have been made. early this morning, another homicide in oakland it happened at 83rd avenue. a man was shot today just after 1:00 a.m. still no word on his name but police say a 37-year-old man is under arrest. here's a look at the wave of violence in oakland since last thursday. now to the race for the republican gop nomination. tomorrow there are two more states up for grabs, colorado

the results showing a definitive change. his closest rival gingrich at 29%. meanwhile, santorum and paul say they are playing the long game. >> we've also done well in colorado, i'm not predicting wins but i think we're doing well. >> people in the west are sometimes more freedom oriented than in some other parts of the country. >> reporter: while mitt romney may be leading the west, all of the news is not good for him. according to an abc washington post poll, if the delegation were chosen today obama would have a lead under registered voters. the latest poll show a split in the caucuses in minnesota and colorado. rick santorum has a narrow lead

minorities are afraid to oppose. >> they have winter may have actually arrived. >> reporter: in syria more bloodshed. >> people think assad just like water. >> reporter: one syrian said it's so bad gunfire is falling like rain. rita williams, ktvu channel 2 news. a man suspected of killing a woman in sonoma county over the weekend is now dead after he stepped in front of a truck this morning on interstate 5 in stockton. police say carol marie brooks was fatally shot at her home yesterday. neighbors tell ktvu they heard a gunshot then saw a man running away from the home. >> i saw a gentleman run out of the place, hop into a car, it was a nissan versa. my guess is he went for the highway. >> the suspected gunman is identified as 46-year-old john quincy ellis of stockton. police tracked him down this morning and pulled him over on interstate 5. they said ellis

got out of the car and told officers to shoot him. when they didn't police said he ran into oncoming traffic. it's not clear what his connection was to brooks. officials at cupertino high school say students should have known better. the school went into lock down this morning after a janitor saw the handle of this gun sticking out of the backpack. when sheriff deputies arrived they quickly determined it's a nerf gun. 30 students took them to the the áf school to play a game called assassin. they said he was hit over the head with a bottle of tequila. a badly injured man goes public with his story to try to help police solve

it's the case in which justice has not been served. the victim a livermore teen. kayla was her name. now a ktvu investigation reveals new information about her disappearance. in tonight's special report, kayla's aunt shares with mike mibach e-mails that sheds light on who might be responsible for her death. >> reporter: a bay area teenager with a big grin and big dreams at age 15, kayla reed's future looked bright. but in early december 2005 the light turned dark. young kayla disappeared. >> we love you and miss you kayla. >> reporter: in january 2006, it became very real. her body was found in this central valley canal and a homicide investigation was underway. two weeks later at this candlelight vigil in livermore.

there was angel sheets. kayla reed's mother. the same mother who police say initially reported kayla missing from their townhouse. naomi lived right next door. >> we told them that we heard, you know them screaming a lot. and fighting a lot. when i first heard about it, i thought that angel might be involved somehow. >> reporter: and so did livermore police. nearly two years after kayla's body was found, angel sheets and her friend dennis murphy were named persons of interest. investigators said sheets failed a polygraph when asked about covering up physical evidence from that night. they also said dennis murphy told detectives quite the story about the night kayla disappeared. murphy said he went to angel sheet's townhome to smoke meth. but when angel could not find the drugs she blamed kayla.

pushes her into the fridge saying, this may get me killed but it's not going to get me killed. it's going to get you killed. he says that's when he left. claudia is angel's sister. >> the only thing that i can add is there was concession. >> reporter: six years have passed no arrests, no charges, and twice as recently as last year jagel says the alameda county sheriff's office refused to charge the case. >> i honestly feel that this case is not being pursued because kayla came from a poor background. >> reporter: but today she took time showing us private e-mails sent from police to her. detailing clues about the case in one dated may 13, 2008 a captain now retired, talks about a cadaver dog alerting inside angel sheet's van similar to this one. inside that van detectives also found a police scanner, a map of the delta with three areas

near the canal highlighted in yellow. an anonymous person from livermore wrote, we all know you did it angel, you threw kayla against the refrigerator. then you and dennis put him in your mini van. police tracked down the ip address. it belonged to the woman who's boyfriend knew angel. that woman according to the e- mail said police angel confessed saying it was she. who pushed her body against the fridge and took her body to the delta. >> that story matches on both interest. >> reporter: we feel that as things stand we have enough information to pursue charges we just haven't gotten the case in front of the right d. a.

san francisco's san ignacious reopened after a noro virus. the bug hit about 500 students and 70 teachers. the school shut down last tuesday. it was actually ready to reopen on thursday after a deep cleaning but the school held

off until today in part because so many teachers were out sick. the nationwide real estate slump is reaching the upper end of the bay area's housing market now. real estate tracking service says more and more homes are going into foreclosure. that is double the number compared to 2008. there is a move in congress to save some postoffices that are scheduled to be closed and to save postal workers jobs. some 3,700 postoffices most of them rural are expected to close down by may. sanders of vermont says the efforts to cut costs are misguided. >> saving 220,000 jobs in the postal sector is something we should be focusing on. >> reporter: sanders wants the postal service to take

others are missing. 700 homes were destroyed or damaged. two larger dams are also on the brink of overflowing and are urging people downstream to prepare to evacuate. as part of california's 12th annual rosa parks day celebration, civil rights activists brought a 1950s style bus to the capital. the bus is a replica of the one parks was riding in when she refused to move to the back and give way for a white passenger. it was parked civil disobedience that sparked the bus boycott. those who brought the bus to the sacramento say they hope it and rosa parks day encourages other to take a stand when they see inequity. we're live in downtown walnut creek where bars and lounges are banning together to stop the violence. we'll tell

bar owners and managers in walnut creek say they are makers matters into their own hands to address safety concerns. lorane blanco is live to explain how changes are being made. it's a quiet monday night in downtown walnut creek. but when it comes to the weekend you will see more police patrols out here to stop what they call increasing violence. but bar owners today tell us they'll be taking steps of their own to police themselves. >> we're going to be hanging these in each of our accomplishments letting people know that we are a combined group and we are one. >> reporter: the owners and management of about one dozen walnut creek bars and restaurants sending a message

that violence like this has to stop. police arrested two men for a brawl. >> i don't want to go to where i know there's going to be violence and i might be hurt. so if this is going to be a town like that, later on that's not good. these owners agree but insisted the city touting itself as a place to escape the ordinary doesn't have these problems, ordinarily. >> it's a wonderful place, has a lot of businesses coming in. so we know that it's not really a major problem. still businesses are being proactive by posting these new zero tolerance signs, agreeing to all meet once a month to discuss all the issues and promising to -- >> make sure that each of our legislations are using the proper promoters and making sure that everything on our end of the line is all cheered you have and everything is good. >> reporter: they've invited city leaders and police to a meeting tomorrow morning here

at dan's where they hope to get the city on board with these ideas. tomorrow night, liz lounge will consider shortening hours because of problems they've had there. the food truck phenomenon is expanding now to alameda. now the city of alameda is hoping to provide restaurant service in isolated areas with food trucks. the city began taking applications and hope the food trucks will be out by next month. mcdonalds ran an ad says a chicken mcbite was less risky than petting a pit bull. a sacramento woman started a page calling the add reckless. mcdonalds issued an apology via e-mail and social media. the biggest football game
