tonight tapes of herzog who committed suicide. on the tapes herzog says his childhood friend shermantine is responsibility for more than two dozens killings. >> what kept you from going to the police at this point in time and saying look my friend is a psycho. here's what he just did. >> i was concerned for myself. >> to what? your safety? >> yeah. >> reporter: tonight ktvu's amber lee revealed more about more victims. she joins us with a story you will see only on 2. >> reporter: tonight i spoke with the father of a victim.

in one exert, herzog puts the blame only on shermantine and details how the crime occurred. >> her hand went over to the right. it was more like that. >> he continued to do that. >> yeah, he continued to put her toward the ground. >> reporter: herzoz called shermantine a killer, and admitted to being at some of the murders. >> which side did he walk up to first? >> the right side. >> okay. then what aned? >> he started shooting. >> how many times do you think he shot? >> i think he emptied the gun. >> okay, once that's, once he's

done shooting then what happened. >> he hook' em up. >> reporter: while those victims were identified many others have not been. shermantine recently revealed the location of an abandoned well in van joaquin county where authorities unearthed 1,000 bones and bone fragments. he also provided information that led to remains in calaveras. on the tape herzog says vertine pleated for help. >> did she ever ask you for help? >> yeah. >> what did she say? >> she was called my anymore make. >> what is the nickname she called you. >> slim. slim help me. >> reporter: shermantine and herzog were childhood friends. shermantine's wife told detectives that the pair grew up living across the street

from each other. herzog's attorney tells us herzog was shermantine's road dog. saying shermantine manipulated herzog and ruined his life. herzog expressed remorse on the tapes. >> that ain't something i like picturing, you know. >> reporter: cindy vanderhiten's father told us it was sheer -- watching the tapes. she and cindy's mother are still waiting for the return of their daughter's remains so they can give her a proper burial. they are not alone, other familys are still waiting for answers. >> and more tapes to go through. >> that's right. >> thanks, amber. herzog's friend shermantine is apologizing but not for the

killings that put him on death row. shermantine said he's sorry fornot telling authorities sooner where he buried the bodies of vandehein and wheeler. both remains were found in calaveras earlier this month by a map drawn by shermantine. >> amber has more video to look through and will bring us more details on what herzog told investigators following his arrest. a hell's angel on the run for months is in jail tonight for shooting and killing a fellow hell's angel.

the man hunt ended on this hotel. >> asked the person if he could you know surrender peacefully and he did. >> they just finished cleaning the room. >> reporter: steve perez had just checked? >> ruiz shot and killed former hell's angel steve townsend while both were attending the funeral of another hell's angel. >> for him to be caught where he was caught was confounding to us. because many times in homicide cases like these the suspect gets as far as way from the

scene of the crime as possible. he was found very close to the scene of the crime. >> reporter: tonight he remains booked here at the san jose jail on a separate charge. more details now on this case. it started last september at a nevada casino. the president of the hell's angels, petigrew was shot and killed allegedly by a rival motorcycle club. pettigrew's funeral was held october 15th. steven ruiz was identified as the suspect and finally tracked him down last night arresting him in fremont. police are asking for help in trying to find the driver suspected in a hit-and-run. the accident happened at 3:30 this morning. the male suspect was driving a

pickup southbound on battery street where he says he hit a truck. the driver of the lincoln was killed. police say the suspect got out of the truck and fled on foot right after the crash. anyone with information is asked to call san francisco police. authorities have identified a man found dead in the delta this weekend as an oakley man. they say the body of 24-year- old jeremy taylor was spotted on saturday morning around 10:00. it was in the sand mountain's slew near san mountain boulevard in oakley. they don't know yet if his death was accidental or intentional. police in walnut creek have arrested three men accused of major gift card scam. officers say the men listed here are all from southern california were using fraudulent credit cards to buy the gift cards at nordstrom locations around the state. they are arrested yesterday afternoon at the nordstrom and broadway plaza. they found more than $10,000

worth of gift cards in the suspect's vans as well as credit cards in other people's names. the trouble surrounding the alameda supervisor nadia lockye is beginning to grow. they say bill lockyer was given a sex tape of his wife with another man. supervisor lockyer has announced that she has stepped down from her postand entered rehab. >> the republican convention wrapped up, one of the most talked about politicians there isn't a republican. why there was so much attention focused on governor jerry brown. >> reporter: it was a slow day. delegates held a few votes but they did have something to talk about. thanks to a jab from governor

protection. the department of homeland security plans to provide it. santorum requested prevention after a rowdy rally in washington state last week. cnn also says that newt gingrich has also requested it but hasn't yet received a response. right now the only candidate to receive secret service protection is mitt romney. bay area syrian americans today have called to an end to the rule of assad as violence continued to claim lives in syria. about 50 people demonstrated in san francisco to bring attention to the crisis in syria. activists in syria say at least 55 people were killed by government forces today including 25 in homs. they say they don't want u.s. intervention but believe the u.s. and itself allies can use their powers differently. >> more pressure on iran, more pressure on china to help

fire crews rescued two people from a burning house in san rafael. the fire started in the three unit building on lincoln avenue right around 5:15 this morning. two dozen firefighters battled this fast moving blaze and had it under control in about 20 minutes. fire officials say they are still investigating the cause but they do not suspect arson. police in palo alto are on high alert after a rash of burglaries. within one day thieves hit five times. janine de la vega has the story. >> reporter: you need a key to enter the complex and get into

the indoor hall ways but that didn't stop thieves from burglarizing apartments here and in another area of town. >> burglaries are a crime of opportunity, people are going to go to where the money is. >> reporter: the neighborhood was targeted by thieves on friday. a home here and another on portola avenue were burglarized. >> i've never been as security conscious in my life as i've been in the last year. i hear little things about people's having things stolen from their yard, bicycles and things. >> reporter: police say the thieves stole jewelry and electronics, six apartments in two different complexes occurred in one day. detectives are investigating whether the crimes are connected. >> i would think there are multiple crews working in town because the geographical differences over the ones that occurred on friday would indicate they are not the same people. >> reporter: police suspect the

burglars rang the doorbell and when no one answered, they entered a side door. police recommend answering from behind the door if someone knocks. that's something richard gelman says he plans on doing from here on. >> i would stay quiet and pretend i wasn't home which now that i think about it would probably be an invitation to try to do something. >> reporter: police say they are dedicating more officers to patrol the north side of the town where most of the burglaries are occurring. reporting live from palo alto, janine de la vega, ktvu news. governor brown appeared on meet the press this morning to talk about his support for the immigration reform. >> we need immigration support with a path to citizenship.

>> reporter: governor brown talked about his first appearance on meet the press. during that appearance the governor said i do believe the mexican american has been too invisible in california and throughout the southwest. it is imperative that we in this country open our hearts and our minds to this culture and that we try to accelerate the melting pot and the assimilation process so that we can live together in harmony. jerry brown was one of many governors attending a black tie dinner at the white house. president obama hosted the meeting. he offered a toast of the governor saying they are doing outstanding work if what he called some of the hardest work in politics. the governors will return to the white house tomorrow for meetings with the president and vice president. >> the city of stockton is taking steps to avoid bankruptcy. the city council is set to vote this week on a financial rescue plan. that plan includes taking advantage of a new state law. that allows cities to seek mediation with creditors to

rework payment options outside federal bankruptcy court. stockton faces a $20 million gap. the city manager says that deficit could actually double if officials don't make changes. the 84th annual academy awards has come to an end but for some the celebration has just begun. the big winner, the artist. the black and white mostly silent film won three oscars for best picture, director and actor. other big winners include meryl streep for best actress. it's billed as the largest oscar party outside of hollywood. christien kafton is at the event. >> reporter: you can see the party in full spring, it's a little touch of hollywood right here everything from the paparazzi area to chilled champane on ice.

a birthday party at a downtown san jose restaurant and bar erupted into violence. it left one person dead and two others injured. allie rasmus explains what happened. >> reporter: behind the glass

of a patio, police officers gathered evidence. it's where three people were shot this morning. one of the victims died from his injuries at the hospital making this san jose's fifth homicide this year. restaurant managers didn't want to talk about what happened but customers tell us there was a party going on at the restaurant with a group of people celebrating a birthday. just before 1:00 this morning a fight broke out. >> everybody moved out to the patio area. there was a lot of fighting. the security tried to maintain it as best as possible. got everybody out. >> reporter: the brawl spilled out into the parking lot. >> the fight escalated into shots fired and officers responded to the scene. >> reporter: police found two men injuried at the scene and discovered a third victim later on. >> another individual walked into an area hospital as well as a result of the incident that happened at the bar. >> reporter: renteria and his band were performing at the restaurant last night when it happened. >> it was pretty scary. normally when i've played here before you don't have rowdiness

and a lot of out of control crowds like this. >> reporter: a violent night at what he says is normally a family friendly place. what exactly sparked the fight in the first place is still unclear at this point police are trying to interview more witnesses and determine who the gunmen were. in san jose, allie rasmusen. antioch police identified the man struck by a car. it happened as he was crossing the street at hill crest avenue and east rogales road. he died the next day at john mere medical center at walnut creek. that accident is under investigation. in news of the world tonight, in nigeria religious violence claimed the life of five people. a suicide bomber drove his car into a church in jaws killing three people including a child.

the radical islamic group took responsibility. in gahna, three engineers were all riding in the locomotive in front of the train. it's not clear what caused the train to cross the tracks. the guiness world record declared 72-year-old shandri the shortest man in the world. dangi was unaware of the world record title before a timber merchant visited his town and decided to measure him. dante said he felt happy and wants to travel around the world once he learned he won the title. many in african are relieved as nelson mandela is back home after a hospital stay. the current south african president said the procedure

declared a mistrial. that's because if a lawyer loses a case having evidence that a juror was found to use the internet for information will certainly mean a new trial. >> the jury should only go on what was presented in the courtroom. the reason for that is found in hundreds of years of juris prudence. i believe also with the advent of smart phones, that there's an instantaneous ability to put a lot of information out into cyber space as well as get a lot of information very quickly as jurors sit in the courtroom or in the deliberation room. >> reporter: just two months ago a florida man was kicked off a jury after sending a

facebook friend request, so he would get kicked off the jury and ask her out. there have been no such abuses reported yet so far in california but if both defense and prosecuting lawyers as well as judges get their way, the new judge will help ensure there won't be. mike mibach, ktvu news. a federal judge today delayed the state of the trial to determine the civil liability in the nation's worse offshore rig explosion. 11 workers were killed and the blast led to a 206 million- gallon oil spill t. trial was

and the slight chance of a shower first thing tomorrow morning. some changes developing out here in the pacific. here is the one the storm is going to move in tuesday night into wednesday. will be stronger. but the one setting offshore to the west, this will be a key factor as we head into monday. it'll reenforce the cooling so as a result the warmest low -- warmest location not too warm. it will be cold enough we could have snow levels down to around 2,500 feet. the main issue with this system there's not a lot of moisture associated with it. so we do have the cold air but not a lot of potential moisture. our cloud and rainfall forecast model showing you this first thing tomorrow morning. partly to mostly cloudy skies. not a lot of cover rang -- coverage. so bottom line throughout the day tomorrow, there is a possibility of a spotty shower. but the main thing you will notice the cool temperatures
