tonight we're doing some counting, we're counting up the delegates for the convention and it looks good and we're counting down the days until november and that looks even better. mitt romney celebrating an early lead this super tuesday. in the past 20 minutes he has won a key battleground state. good evening everyone i'm frank somerville. >> and i'm julie haener. mitt romney is picking up six states. romney wins the state of ohio

with 38% of the vote and a margin of 12,000 votes. we have live team coverage. amber lee has been talking to bay area voters. we begin with ken wayne who breaks down today's victory. >> reporter: there was no clean sweep tonight. elections were held in 10 states and each candidate expect ron paul claimed victories. mitt romney pulled out a win in massachusetts, vermont, , virginia and idaho. right now he's picked up eight additional delegates giving him a total of 351. let's move on to rick santorum. he gets an additional 68 delegates for a grand total of

156 delegates. we move on to the next candidate. newt gingrich he stays alive with the critical win of georgia. that gives him 52 more delegates today for a total of 85. and finally, the fourth major candidate, ron paul who is promising to go the distance winning just 14 more delegates today. for a total of 39. we're still waiting for the results from alaska where the polls just closed an hour ago. keep in mind these numbers do not include delegates from ohio where the count is just wrapping up. we'll have an update later in the newscast. all along the experts say ohio was the key state. and joining us now tori dunnan

who's been watching the polls in ohio. >> reporter: the big news of course is that mitt romney takes the state. this is going to be huge for his campaign in terms of momentum going forward. rick santorum kind of played this well earlier today. he had his campaign in lowering expectations saying if they came close to mitt romney they would consider it to be a victory. take a listen to what both of those candidates had to say about tonight. >> tonight we're doing some counting. we're counting down the days until november and that looks even better. >> this was a big night tonight, lots of states. we're going to win a few, we're going to lose a few. but as it looks right now, we're going to get at least a couple of gold medals and a

apparently broke lose . the winds are still blowing. let's go outside that wind advisory mainly for the coastal section and the hills and the wind today it was all about the coast. the great highway in san francisco as we already told you closed today. some peak gusts today, point ray 62 miles per hour. ocean beach gusting up to 36 miles per hour. the san francisco airport up near 44 miles per hour. we go offshore to our buoy readings and you can see right here it's gusting to 34 miles per hour. so it was a windy day. stories from san francisco's ocean beach of sand blowing up on the great highway and up into the avenues really creating a mess out there. the winds die down tonight. when those winds die down, it's going to get cold. i'll be back with details in a few minutes. drastic action in the city of hercules tonight. we'll tell you how a conflicted council voted just a few minutes ago in an effort to keep the public safe. students pepper sprayed and it was all caught on camera.

tell us the budget situation is so bad the city had to make a very difficult move. patti. >> reporter: a lot of tough choices today, the city council just voted to put a half cent sales tax on the june ballot. the $500,000 it's expected to raise will not fill that budget shortfall and it won't come in time to save those police jobs slashed just this morning. police officer john gallegos is maintaining a sense of normalcy with his family after he received a lay off notice this morning. >> start looking for work. i have a family so i want to make sure they're well taken care of. >> reporter: gallegos is one of three officers among the city employees who received these lay off pacts today. but gallegos is hopeful. >> we can try to you know try to bring back some of the public safety officers we have.

city just could not afford to wait. patti lee, ktvu channel 2 news. seeking an unbias jury is proving difficult for mirkarimi's trial. prosecutors and defense attorneys met with a trial judge about possibly moving a trial out of the city. mirkarimi's attorney says the jury's questionnaire shows obvious issues. >> people have formed strong opinions and they formed strong opinions in all different directions. >> reporter: there has been a great deal of publicity including the prosecution's release of photos of mirkarimi's wife with a bruise on her arms. oakland police identified the driver of a bentley who was killed last night in a shooting which led to a head on crash with another car. the victim was identified today as 33-year-old kelly sorel ii.

sorel was shot several times. he then lost control of his car and crashed head on with another car. no arrests have been made in connection with the killing. there are new details about convicted serial killer herzog who hung him in january. an autopsy report describes a number of tattoos on herzog's body. one in his leg read made by hate and restrained by society. and across his stomach two reinvolvers. herzog and wesley shermantine were known as the speed freak killers. they were suspected in dozens of killings in the 1980s and 1990s. a homicide investigation is under way tonight after a former oakland man convicted of beating a 2-year-old boy to

death was found unresponsive in his prison cell. damon valery was found in his cell and taken to the hospital where he was pronounced dead. valery was convicted of killing jones back in 1998. an autopsy report showed the child has burn scars from his thighs to his feet. and his ribs had been broken over a long period of time. the child died from bleeding. ktvu's rita williams tells us who wanted to keep a report from being released and why the judge agreed at least for now. >> reporter: this imagine went around the world, uc davis police officer john pike spraying occupy protesters on campus last november. >> this is an incredibly controversial incident. it's caused a black eye for the university. and for california itself.

we need to get to the bottom of what happened. >> reporter: uc brass agreed with students who were sprayed and ordered an outside investigation. today the 100 plus page report was supposed to be released. >> there are many many people waiting for this report. >> i have not seen the report. >> reporter: he hasn't seen the report but the attorney for uc davis police officers went to court in oakland today to block its release. the judge agreed at least temporarily. >> it's the court's intention to order that the report not be released. >> reporter: the attorney for police wants the judge to take the officers names and confidential personnel information out of the report. saying the information is protected by law. >> there's nothing that we're trying to hide, we're not trying to hold back the facts. >> reporter: uc officials and students want the whole report released now. >> i am a little disappointed. we need to begin healing our community. >> reporter: uc davis police chief and two officers remain on paid leave.

so all the parties will be back here in 10 days to find out if the judge releases all, some or none of the investigative report into the pepper spraying incident. in oakland, rita williams, ktvu channel 2 news. the chp said today they've now cited and released at least 66 demonstrators arrested last night in the rotunda of the state capital. in all officers arrested 72 people taking part in a protest about funding for higher education. a chp spokesperson said six of those arrested were books into sacramento county jail on charges ranging from passively resisting arrest to possession of a switchblade. and today was about a cooldown. it was about the wind. a wind advisory about to expire. but it was much needed especially along the coast. right now the winds offshore san francisco, near ocean beach sustained at 25. gusting to near 30. so it is still real windy. gusts out of point rays this morning got up to 51 miles per

belongs to mitt romney. with 99 of the precincts reporting, romney won 38% to santorum's 37%. gingrich has 15%, paul 9%. the polls closed at 9:00 where 27 delegates are at stake. gingrich 20%, former alaska governor sarah palin revealed she cast her ballot for gingrich. this is ron paul's last chance for a super tuesday win. he has not won a single contest and is 0-10 on this super tuesday. in the idaho caucus we're declaring mitt romney the winner tonight with a commander 67% of the vote. so there is plenty of drama on this super tuesday but the big headline tonight, mitt romney wins ohio. there won't be much rest for the republican candidates for the remainder of the month.
