consider it an emergency call. >> reporter: a routine call suddenly turns deadly. the question here, should police have responded quicker. emotions are high and questions overwhelming after this man was beaten to death by an intruder after calling 911 with these words. >> there's a man walking around, he seems a little spacey. >> reporter: there is only one person to blame for this crime

and that person is sitting in jail. >> you are lying, sir. you are a liar. >> reporter: but even his description of the march was challenged. and some residents say the incident raises questions about police staffing and mental health services. the man's parents say they tried in vain to get him into psychiatric care. >> i think this man desperately needed treatment and help and he clearly fell through the system. and peter suker is gone. >> reporter: we're live in berkeley, debra villalon. dozens of people are still evacuated from five buildings at this hour after an apartment

fire in berkeley. the fire tore through a building on dwight way. burning for hours and destroying six buildings there. residents of four other buildings can't stay there either. >> reporter: you can see some of the damage here, four surroundings buildings including this one have been yellow tagged. that means residents can't stay here tonight and possibly longer. maintenance workers put up a temporary fencing to avoid passage to the area. >> i have coats and textbooks and stuff. >> reporter: must be tough to be out of your home indefinitely. >> if it's until monday, i'll

confirmed if it is indeed linked to this investigation. in fairfield, police have identified the two young men shot and killed there yesterday. they are 234-year-old vedell jamar chew. police found their bodies in the parkway garden neighborhood of fairfield. witnesses reported seeing a black man with dread locks with a gun running from that scene. police are looking for him. san jose police have identified a suspect wanted in connection with a parking lot beating that was initially described as a hate crime. 21-year-old emilio romayor is accused of bating lual. at the time he said his attacker called him a terrorist. but police now say the evidence does not suggest the attack was actually a hate crime. investigators say this video shows the attack appeared to

have started after lual almost hit romer with his car. police say romer is now facing charges including assault with a deadly weapon. musician marcus russell was shot and killed as he was driving on highway 80 in richmond. the contra costa times says the jury found -- guilty of that and eight more shootings in the east bay. west contra costa school district is facing a state oversight. the state's superintendent saying adequate systems are now in place. a ceremony is now in place for

protest the third year of budget cuts. three seniors said they decided drastic action was needed and it is needed now. after the school board approved cuts. they stopped eating solid food. they said going without food is not so different for what students will be doing without in school. >> no programs, no arts, no sports, no counselors, no librarians. that's how it would be for me. because now i'm on the bare minimum, i'm just on water. >> reporter: the seniors said their class won't be affected much, but they're worried about what will happen to future students. the contra costa times reports the school exceeded a 28 student per class limit which jeopardized a $1.6 million grant. but the state board approved a waiver of class size requirements so that the district can continue to receive the money. the district has promised to

meet class size requirements in the future. and there's word that contra costa board of education says clayton high school has met its conditions to become a charter school. the school board made its finding last month. the school board is now negotiating a position to place the school on the charter board. the richmond city council tentatively agreed a new law that allows more medical marijuana dispensaries in the city. the limit would be increased from four to six store fronts with fewer restrictions on where they can be located. there was concern that pot clubs opening may be next to residential areas. so a provision was added to help that from happening. the new law could go into effect next month. today is international women's day. it was started back in 1911. since then women have come a long way especially in california, and especially here in the bay area.
