attack on president obama says he does not understand how to build a business. >> the president needs to spend time with the job's council. i guess in the last six months he's done 109 fundraisers. he found time for that. romney's aide says the two day trip to california brought $250 million to the campaign funds chest. new video tonight from san jose where a young boy nearly drowned this evening in a swimming pool at the west wind housing complex. the 8-year-old boy was pulled from the pool and ktvu was told a teenager began performing cpr. two witnesses also told us the child and others were playing a game in the pool. >> they were playing, let's hold our breath under water the

longest. >> the boy was resuscitated and taken to the hospital. at this point he's said to be in serious condition. a tense stand off is under way in east oakland where police have been at a home for two hours. two suspects wanted for shooting at a chp patrol car were in a home near 23rd avenue. officers then surrounded the house around 3:30 and evacuated several homes as a precaution. the men are wanted for attempted murder following a shooting on interstate 880 on saturday night. two other people were arrested earlier today in connection with that incident. no one was hurt when the chp car was hit by bullets. the suspect in the colorado movie shooting made his first appearance in court today. james holmes remained silent but his orange red hair spoke volumes. some of the injured victims and those who were killed looked on. >> reporter: without fire power

and body armour this accused mass killer looked anything but menacing in court today. james holmes' hair is comic book orange not green like the jokers. the powerful batman character he alleged to be when arrested. his eyed fluttered, they drooped, they closed. he appeared dazed, never spoke. family members of some victims thought holmes a once budding neurosciencetist was faking. >> he's a coward and a genius. he knows what he's doing, he's faking the system. >> reporter: the district attorney says she wouldn't be told if he was getting medication in jail. she said it was unlikely. >> it is a case where we're still looking at the enormous amount of evidence and we would never presume that it would be slam dunk. >> what's the appropriate punishment for this man? >> death. >> reporter: david sanchez left

court to see his daughter due to deliver her first child today. her husband shot in the head remains in critical condition. >> she needs to take care of her husband and everybody needs to pray for them. >> reporter: when james holmes left court today to return to his isolation cell, there were even more questions than before about what turned this doctoral student into an accused mass murders. rita williams. the mother of suspect james holmes is clarifying something that she said after the shooting and her attorney read a statement today. >> he asked if i was arlene holmes and if my son was james holmes. who lives in aurora colorado. i answered yes, you have the right person. i was referring to myself. >> reporter: attorney lisa domiani says holmes mother had no idea her son had been arrested until a reporter contacted her at her home in

a group from the bay area to washington, d.c. unfortunately he never made it past indiana. because that's where he was hit and killed by a car. patti lee talks to his family about what happened and what he was like. >> reporter: these are photos taken in may with andrew moore with other volunteers shortly before leaving san francisco for a pro-life walk. moore's father says his son was excited to travel and see the country but last friday, 20- year-old andrew moore was struck and killed by a car on a rural road 60 miles west of indianapolis. the tragedy ruled an accident by police. >> i think it was really hard for andrew. >> reporter: he is described as his only motivation was to help

come home on wednesday. also new at 10:00 tonight, family and friends of a missing 15-year-old girl from san pablo gathered this evening to ask anyone who may know where she is to come forward. family members held hands and prayed together. salazar was last seen 15 days ago. the family says she may have left home to meet someone but left her cell phone behind. >> we really want her to know we love her a lot. and we are praying constantly and we won't give up until she comes home. >>g era ldine's parents fought to fight back tears as they made a plea for information. firefighters raced to control a fire that started

this afternoon in the delgados state park in los gatos. crews quickly put out the flames. the fire department told us tonight it still has not determined the cause. computer problems made for very long lines at some bay area dmv offices including one in san francisco. the line in fact, wrapped around the building at the office on fell street this morning. state officials say power was out at all state agencies over the weekend because of a power system glitch at the state's technology office in sacramento. they said it took longer to get the dmv systems back online. the number of foreclosures in california is dropping. in fact, the number in the second quarter fell to the lowest level since 2007. one expert said this could mean the worse is over or simply the process has slowed. in the second quarter there were 50,000 notices of default the first step toward foreclosure. it appears a recovering real estate market may come

with a downside. tens of thousands of homeowners are seeing tax bills rise some by nearly 10%. a proposition passed back in 1978 along with prop 14 allows property taxes to rise more than 2% when assessed values go back up following a decline. another suspicion envelope with white powder showed up in a bay area police station this time it was in fremont. the hayward police department was one of five that received an envelope on friday. that is seven police agencies in all. so far the powder has been harmless. authorities are trying to determine who sent the envelopes. three young children are orphans tonight after their parents were shot and killed inside their home early this morning in san jose. ktvu's matt keller spoke with a neighbor who describes what he saw and heard before finding those children crying on the front porch of their home. >> reporter: the 911 calls came

right before 4:30 this morning. neighbors heard an argument and then gunshots from inside this home in downtown san jose. >> maybe three to four gunshots then not even five seconds later another three or four gunshots. and that's what i kind of thought, somebody killed somebody over there. >> reporter: ringo martinez was watching from across the street and says he saw a man dressed in all black run from the home and children crying. >> that's when we ran across the street and told the kids to come down off the porch because they were crying. >> reporter: they were not married but are the parents of three children. ages5 to 8. >> they have kids together, they've lived their life. >> she was really funny,

divers from napa county sheriff's department pulled the body of a drowning victim from lake bariesta today. kevin flynn jumped from a boat to go for a swim. friends say they saw him struggle but they were unable to save him and he disappeared. divers found his body in 55 feet of water. nummi received a federal transportation grant to replaced 55 of their boats. >> they're breaking down often, they're requiring us to invest a lot of our resources and to try to keep them running. and the way that manifests itself is in buses that are in

the water at steel head beach. friends say he had been in the water for several minutes. he was then flown to the hospital where he ended up dying. the coroner has identified him as eduardo corona. governor brown is calling on special funds after it was revealed that the parks department was sitting on $50 million even though parks were slated to be closed. this scandal could impact a key issue on the upcoming november ballot. >> reporter: save our parks a battle cry of park supporters who learned while they were raising money to keep parks open, the parks department was sitting on more than $50 million. >> we were shocked. we worked with the state for a long time and clearly this money could have been used for the crisis that's facing the state parks system. >> reporter: tracy torrez is with the california state parks foundation which runs the save our parks campaign. >> there's a real sense that there's some trust that's been lost.

>> we're going to do everything we can to make sure we right this ship. >> we're just as shocked and disappointed with this situation. >> reporter: the situation is that an internal audit found two funds. one a recreational fund with $20 million. another for off road parks for $33 million. the money had gone unreported for 24 years long before governor brown took office but he could face political consequences. opponents of his tax plan already have latched on to this scandal. >> the problem is right now voters can't trust that the government is going to be good stewarts of the money we send them. the legislature will decide how this money will be spent. most expect including the governor's office that it will be used to keep parks open. as for how this happened or who is responsible, the attorney general's office is

investigating. in sacramento, ken pritchett, ktvu channel 2 news. more details now on the fall out from this scandal. sonoma county officials are scrapping a plan for a quarter cent sales tax increase to pay for parks. tomorrow the board of supervisors is also expected to discuss a sales tax proposal. a just released study on hiv infection rates among black, gay and bisexual man is renewing long held fears of what one researchers calls a public health energy. the emoryville university study found that gay black men found infection rates of 2.8%. the authors of the study compared that rate to those seen in african countries hit
