she loved. in the coming days, restaurants will hold fundraisers for the family and no doubt this memorial will continue to grow. alyssa byrne's father released a statement that said in part, our entire family is devastated. we were still holding out hope that she would be found safe. we will miss alyssa and she will be in our hearts forever. the el dorado coroner plans to conduct an autopsy to determine the cause of alyssa byrne's death. she was quote messed up on new year's eve and quote partied harder than anyone i know, said friends with her. authorities said she always suffered from exposure to the elements. >> after three days of desperate searching by friends and authorities investigators delivered the sad news this morning. >> it is with deep regret that we announce that we have

recovered the body of alyssa byrne. >> reporter: utility workers found the body of byrne after attending a new year's party. it's now unclear whether byrne ever made it back. >> there's been some conflicting information about this case. if that person did see her, it is possible that she jumped on a shuttle or got a ride back to the snow globe area. so we've got a lot of leg work still to do. >> reporter: at this afternoon news conference, el dorado investigator said byrne was found clothed. but other people who saw her that night said that she appeared to be under the

influence of something. >> when they get to a certain point and can't function and think logically, if that may have happened to her she may have had difficult getting up. >> reporter: a tattoo helped identify that the body found here did belong to byrne. although some comments were found on her twitter page, they do not think it had a factor in what happened here. eric rasmussen, ktvu news. witnesses tell us they heard 30 to 40 gunshots. contra costa sheriff deputies say two men were found at the scene and taken to the hospital. a woman was dropped off at doctors medical center in san pablo also suffering from a gunshot wound. no word yet on a motive. investigators say they are currently trying to develop descriptions of the suspects. the 19-year-old man accused of speeding away from police

and causing a crash that killed two innocent people in san francisco's mission district appeared in court today. david morales faces two counts of murder and several other felony charges in connection with the deadly crash on new year's day. the district attorney says morales is a known gang member. >> when you look at the outcome in this particular case, you have two innocent people that are dead, that had nothing to do with anything to do with gangs and then you have a third party that is very seriously injured, absolutely no tolerance for that at all. >> today's arrangement was postponed. if convicted morales could be sentenced to 200 years in prison. the medical examiner has identified the victim inside the other car that was hit as 29-year-old silvi a truncan.

francisco gutierrez was also killed, he was walking by when he was hit and killed. a man crashed his bmw right into a power pole. officers tried to pull the car over but the driver refused to stop. it crashed into a parked truck, a fence and that power pole. the driver ran off and hasn't been found. pg & e has since restored the power. in the south bay the defense attorney representing a man accused of killing a possible burglary suspect is blaming san jose police for failing to respond to car theft. 26-year-old louis ricardo hernandez is accused of killing 36-year-old christopher soriano in the parking garage of an apartment complex on new year's eve. hernandez and others were apparently trying to detain soriano and make a citizen's arrest for burglarizing cars when someone shot him. residents of the complex say there has been a rash of car thefts and break-ins that have

taken place despite numerous complaints to san jose police. the chronically understaff oakland police department is in the process of testing new applicants. opd has started their physical testing. it's part of the city's initiative to hire more officers to help reduce crime this year. >> we want to definitely beef up our short staff. we're definitely shorthanded here and we definitely want to increase our numbers for 2013. >> applicants to successfully complete the agility test will be given a written test. if they pass that they will be brought before a panel. >> police say delays due to logistical issues and a limited number of field officers. each academy graduates about 40

cadets. a new report accuses top state park officials of knowingly hiding millions of the dollars for more than a decade. the california attorney general's office says park officials continue their quote intentional nondisclosure because they were afraid of budget cuts. the money may have been hidden as long as 14 years. at the time up to 70 parks were slated for closure due to budget cuts. there's some startling new information about last year's massive fire at chevron's richmond refinery. investigators are now suggesting that chevron's own first responders may have made the problem worse. >> reporter: the fire that incinerated and crippled the chevron refinery began with a tiny and visual leak that looked like steam. >> probably going to emit some kind of mist or vapor cloud. >> reporter: cooper says the

first thing, stop the leak. >> can you isolate the leak either by closing valves near by which is maybe difficult on a process unit. or do you try to either clamp it or plug it if the pressure will allow. >> reporter: plug a steel plug into the hole or wrap it with a pressure clamp. the pipe was punctured from the outside. the chemical safety board think that is the chevron fire department in trying to get the insulation off the pipe using a tool called a halugan bar may have punctured the pipe with this making the leak even worse. that's because the pipe seriously corroded was more than likely seriously weakened or brittle. >> in trying to plug the hole you make the whole much bigger, the pipe starts to fail. in which case you're not really losing control. >> reporter: within minutes a

sick. but they have taken every, every precaution. >> reporter: now six people from the redwoods went to marin general with norovirus. the last of those patients was released today. those two women who died had ordered previously on file stating they didn't want any life saving measures. reporting live in mill valley, noelle walker. more details now about common symptoms of norovirus. infected people become nauseous, people can experience stomach pains because the virus causes inflammation of the stomach or intestines. some people get headaches, body aches and fever. prosecutors have filed criminal charges against three workers at a marin county day care center in connection with the death of a 4 -month-old boy last december. the county coroner determined the boy accidentally suffocated on his bedding at the magic place children's center. the owner and two employees are

now charged with misdemeanors for failure to provide proper supervision and medical treatment after prosecutors decided against filing felony charges. three men charged with the murder of a south bay entrepreneur appeared in a courtroom today for the first time. lucas anderson, javier garcia and deangelo austin are all accused of killing kumra in his home during a home invasion robbery in late november. kumra's wife was badly beaten. prosecutors say they plan to try the three men together. >> one jury that you don't have to put all the same officers and witnesses and so forth three times. so for judicial economy you try them all together. >> a fourth person raven dixon faces charges of accessory to murder. they expect more arrests. two teenagers suspected of killing a castro valley woman then setting her home on fire pleaded not guilty in hayward

today. prosecutors say 18-year-old cody necosia and christian socra asphyxiated akra at her home. a fire at a cannabis club appears to have been purposely set. fire crews reported smelling gas inside the building. the club's manager told ktvu that surveillance video shows a man breaking a window. he says sprinklers kept the fire from spreading and that damage was minimal. last year was the worse year for whooping coffer -- cough in the united states. the number of deaths did not increase. 18 deaths were recorded. one reason for the increase in cases may be the vaccine which has been used since the 1990s

doesn't last as long as the previous one. whooping cough is highly contagious and mostly strikes children. the biggest change to food safety regulations in decades has been introduced. but as our health and science editor reports, the rules are still falling short. >> reporter: the new rules come down tothe day that congress required them. one rule requires farmers use clean water and food handlers wash hands. a second rule requires food companies submit detailed safety plans. >> to make sure that the food that you produce is safer and we will monitor your activities. >> reporter: although the center for food safety had sued to get the government to implement these rules activists today said they're not ready to party. >> we haven't quite popped the cork on the champane yet. this is a good first step.

san bruno congresswoman jackie speier has been named vice chair of gun violence prevention task force. you may recall she was shot several times and seriously wounded in 1978 during the assassination at the people's temple in jones town gayana. gabrielle giffords today visited newtown connecticut the scene of that school massacre. she met with officials and met privately with some of the families of the some of the victims. as a survivor of a mass shooting, giffords has become a strong advocate for gun control. intentionally getting pulled over by the chp.

superstorm sandy. on wall street, stock markets ended on the up mark. and the s & p500 gained seven and hit its highest close in five years. congress passed a bill today to help victims of superstorm sandy. the legislation easily cleared the house and senate. it provides $9.7 billion to paid for flood insurance claims. a broader measure providing $51 million is scheduled for debate later this month but is expected to face opposition by those who say it's filled with port barrel projects. >> barack obama the state of illinois has received 332 votes, mitt romney the state of massachusetts has received 206 votes. vice president joe biden released the electoral vote. the constitution says it's not official until the electoral college votes are counted. the new film zero dark 30 about the killing of osama bin laden is drawing high praise as

fly when a tsa agent reported smelling alcohol. airport police gave him a breathalyzer, they say he failed so he was arrested. lance armstrong may come clean about using performance enhancing substances. armstrong has been stripped of his seven tour de france titles and barred from olympic competition. but the new york times is reporting that armstrong is considering publicly admitting to doping in the hopes that anti doping officials would allow him to resume his career. armstrong's attorney says he knows nothing about the story. in news of the world tonight, in mexico authorities destroyed 7,000 fake guns in an effort to fight real crime. at least one out of every 10 crimes involves a fake weapon. many of the guns look real which is a violation of mexican law. it requires make believe weapons to be made of clear

plastic or brightly colored. in england, malala left the hospital today three months after being shot in the head in her homeland of pakistan. taliban leaders tried to kill her. malala was taken to england for specialized treatment. authorities say she has a good chance of making a full recovery although her injuries are unclear. a city made of ice and snow is ready for the annual festival one of the largest in the world. some 7,000 people have been carving and building sculptures and entire building while temperatures are in the single digits. the festival in china began 13 years ago and draws hundreds of thousands of people each year. >> wow. grays anatomy star patrick dempsey is causing a stir in seattle. >> morning. >> the actors investment group won the bidding for tully's

the head coach of one of the nation's top football programs announced his retirement today. bob latiser has been at de lasalle since 1979. as john sasaki reports he has compiled quite a report. >> reporter: it was a packed house for the announcement that a high school football coach is retiring. but then de la salle's head football coach is something special. >> it's the only thing i've known for the last 30 years, i've enjoyed every minute of it and i could not ask for a better career or a better life. >> reporter: latisser wins with 25 losses and three ties. >> all the effort that he put in kind of thought us to put it right back into it. so working 11 months for something is, i mean kind of lights the fire under you.
