departures follow budget cuts to police and fire. >> reporter: it has been a tough year for the san jose fire department. tonight we sat down with the fire chief to ask him what is behind his decision. >> reporter: mcdonald has been the fire chief for almost three years. today the 55-year-old husband and father announced he has agreed to take a job as a fire chief in las vegas. >> it's incredibly hard. i wrestled for it for a long time because i love the city of san jose. >> reporter: he served as a fire chief for fremont, san mateo, among others. i asked him if city budget cuts and tough negotiations had any impact on the departure. >> really my time here in san jose has been excellent and i will miss it. so no, it's more about an opportunity there than anything else. >> reporter: the decision comes on the heels of the police chief retirement in january. >> i think they're entirely

independent. we saw chief moore retire last year. here we have chief mcdonald pursuing a new opportunity in a different city. >> reporter: the city spokesman says there is no list of candidates for police chief. now san jose will be launching a second search for a public officer. the firefighters union has had bitter negotiations with city hall and suggests that city leadership played a role in the chief's decision. >> i don't know many organizations that can be successful when theyville identify their employee. i think he may be going somewhere where that won't be happening. >> i'll be looking back at it if i don't go. >> reporter: chief mcdonald is expected to stay until august. instead of the $200,000 salary that he currently makes, he will be making about $150,000 a year in his new role. reporting live tonight in san jose, ktvu channel 2 news.

>> new video tonight of a confrontation between san francisco police and occupy protesters fighting for an urban farm. one man was taken into custody this evening. he had spray paint. other protesters blocked laguna street. he claims police were the ones who gave him the black eye. >> they beat me up when my hands were behind my back. >> police moved in about 1:30 this morning to remove four dozen protesters who had been living on the land since june. the protesters want the property to remain an urban farm. the owner wants to develop it. and the fight isn't over yet. protesters are planning another session for tomorrow evening. >> we're following breaking news from south florida. dozens of sports fans were injured when a crowded outdoor

deck at a sports bar collapsed. the deck fell into the bay. three people were critically injured. they had all been watching the miami heat playing the spurs in the nba finals. a hostess said the collapse happened when the fans jumped to cheer a basket. there was so much broken wood along with chairs and tables in it that it was hard to get out. >> a woman riding a bicycle was killed when two trucks collided and one of the trucks fell on top of her. they crashed at about 9:45 this morning. investigators say the woman was riding a bicycle at the intersection when the impact of the crash caused the box truck to tip over and fall on her. >> this marks also the 12th pedestrian involved fatality in the city of san jose. in 2012, we had 12 for the whole year. >> investigators say both drivers cooperated and drugs

and alcohol do not appear to be a factor. we have learned the victim was a single mom on her way to work. her name has not been released. police in oakland are searching for two men involved in a minor traffic accident that escalated and ended in the shooting death of the other driver. the fender bender happened about 11:00 last night in north oakland. ktvu paul chambers talked to a woman who was with the victim when she died. >> reporter: this woman says she was there when he took his last breath. >> when he fell, i pulled over. i got out of the car and ran towards him and asked if he was okay. he couldn't talk. he was gasping for air. >> reporter: he would have turned 23 today. instead of celebration, these flowers are to mourn his death. >> he was nonconfrontational whatsoever. he was the one to back down and let it be or what have you. he never tried to pick a fight. >> reporter: that's why the family is shocked to learn around 11:00 last night, he was

in his car approaching the intersection of stanford and market street when he was rear- ended. he turned on to market street and pulled over. >> he got out of the car to check the car and two other guys came out of the car. there was an argument. and then they just shot him. >> reporter: the woman that stayed with him until the ambulance arrived said all day long she had his family on his mind. because while she was with him, he received a phone call. >> he had his phone and keys in his hand when he fell. and when i was putting pressure on his chest, he was getting a call from his mom. >> reporter: police are reviewing surveillance cameras in the area looking for a four door silver car with possible front damage. there is a reward to kind the killer. in oakland, paul chambers. ktvu channel # news. >> we learned more about the naked man who is accused of harassing passengers last month.

they are preparing to deport him. we showed you the video last night. he is identified as perez. he is seen pushing people around and doing handstands and flips at the station. police arrested him for battery but has been released. perez is being monitored with a gps bracelet during deportation proceedings. ahead in 9 minutes a packed board meeting as bart votes on a spending plan. why workers are prepared to walk off the job. >> a group of six people survived a frightening ordeal when a fishing boat sank near half moon bay. it was taking on water when it issued a may day call this morning. they arrived in 7 minutes to find that the boat was taking on water faster than they could bail it out. all of the people had put on life jackets and were safely

rescued. it only took two minutes before the boat disappeared. mechanical failure is believed to be the problem. crews rushed to a three- alarm fire today. they feared that flames would spread next door. deborah has the latest on the fire. >> reporter: there is a dog walker who routinely stops at this property to let the pets run off leash with the owner's permission. but today's stop wasn't typical. >> she was there so she got it right away. >> reporter: william loves dogs and lets them run in his front yard, which is spacious. but smoke is what a local dog walker saw today. >> i saw a fire truck coming this way. oh, my. those poor people. it was me. >> reporter: his home of 40 years threatened by fire. >> we had a dog walker that did

call it in. seeing the smoke and then the next-door neighbors, they smelled smoke, looked outside and could see the fire. >> i took the most important thing, which was my dog. >> reporter: that neighbor scooped up her 12-year-old dog and headed out. >> we are back in the house again. we need a new roof. >> reporter: her wood shingle roof has holes. it caught fire from embers blowing over from next door. this tree and dry vegetation were flaring up too. >> we did an extended search to all of the surrounding properties. >> reporter: looking for spot fires. with 11 engines on scene, the fire was kept it a carport and patio, attic and storage shed, with no damage to the main house. credit, a fast response and a dog walker sticking to her route. >> nothing happens by accident,

approved. last night, we got a first look at the new train cars that bart is calling its first priority. janet is live to tell us why during tonight's session workers said they are willing to walk off the job. >> reporter: i just checked, the directors are still up there meeting. earlier they passed this budget. it is preliminary because they still have union negotiations and union members said tonight that they are not afraid of going on strike. the bart board room was packed. and union members in purple shirts spoke with passion. >> you guys need to step up, do your job and be for the people and not for management. >> reporter: the local 1021 and 1555 combined represent more than 2300 train operators, mechanics and other employees. tonight, they told the board that they are prepared to walk off the job if they feel it's needed. prior to the meeting, bart

officials explained the 1.5 billion budget saying the top priority is investing more money in new trains to replace the fleet that is the old just in the country. costs need to be contained. employees pay $92 towards health care and nothing towards pensions. >> the equivalent of one percent a year raise. >> reporter: union members say pensions are needed because bart employees do not receive social security and they say they have done extra work during the four-year hiring freeze with no raises. >> our members gave up $100 million in cuts last year. a hundred million dollars in concessions and now they're saying not another pay increase for four more years. that's unacceptable. >> reporter: the union tells me that they have contract talks scheduled for tomorrow morning. the atu on monday. and the contract ends june 30th. but riders are hoping this all

ends without a strike. live in oakland, ktvu channel 2 news. >> a transportation project aimed at reducing traffic and giving commuters a smoother ride on 580 began today. the project will widen and repave roads and overpasses. it also includes new east and west carpool lanes. the project is primarily being funded by proposition 1b, a 2006 voter approved bond. >> stocks posted strong gains. the dow was up 1 # 0 points. the nasdaq added 44. investors responded to a drop in unemployment claims and an increase in retail spending. pg and e issued a warning about a telephone scam. hispanic business customers have received calls demanding immediate payment for what the scammers say are past-due bills. victims were told to pay with prepaid cash cards and threatened their electricity would be turned off.

pg and e says it will never ask for personal information or credit card numbers over the phone. anyone with concerns about a possible past-due bill should contact pg and e. >> 31 alleged members of a gang appeared in a south bay courtroom this afternoon. it was the largest gang case ever in santa clara county. the district attorney says each of the defendants was indicted earlier this week by a grand jury and each has ties to the notorious levi lent gang that grew strong in the 1960s and the d.a. says it operates 27 street- level gangs. there are still nine fugitives wanted in the case. we're learning new details about the gunman behind the shooting ram package in santa monica. he left a note expressing remorse for killing his brother and father. the three to four page note was found on his body after he was shot and killed by officers. >> the celebrity website tmz

has obtained video of the robbery of rapper two chains in san francisco. it says that two chains can be seen walking down the street this past sunday when at least two men approached with guns. two chains and his crew scatter after the -- and the gunman chased after them. police say 2 chains was then robbed of his cell phone and his wallet. smart phone robberies were the topic of discussion in new york city today where san francisco district attorney and the attorney general of new york both called on companies that make smart phones to create a kill switch. he said he wants it available within a year. it's estimated that one out of every three robberies across the country involve someone taking a smart phone. >> new at 10:00, on this graduation night, one east bay teen is turning his tassle and looking forward to attending his pick of the top universities in the country.

>> police in san francisco are trying to crack down on a ring of female shop lifters who are targeting high-end stores in the downtown area. the most recent robbery was tuesday at the burrberry store. they are described as young black women dressed in bright colors. some of them have bright braids in their hair. the shot of lifting ring has been dubbed the rainbow girls and they have been at it for three years now. >> we put out crime alerts to let people know that incidents like this happen so we can

alert the next merchant, okay, they're in the area or they have struck. >> store managers tell us the women grab expensive items and push right past clerks or security guards to escape. the businesses are now asking for more police patrols in union scare and they want more done to prosecute shop lifters. hackers managed to steal at least $15 million. they went after some of the nation's largest institutions including jp morgan chase, citigroup, e trade and pay paul. they hacked into customer accounts and stole crash and identities. four of the accused men are in custody. four more are at large. >> the u.s. supreme court issued a decision today ruling that human genes cannot be patented. it means that the biotech industry does not have control over information in the human

>> a jet crashes into a hangar while taxiing down the runway in san bernardino county. it hit the building after undergoing a test. the department evacuated the nearby structures. no reported injuries. the fire burning out of control in colorado has turned deadly. the remains of two people were found this afternoon. the fire has been burning for three days now and is just 5% contained. officials are calling it the worst fire in colorado history.

>> we have more pictures from the scene of tonight's breaking news. the collapse of a deck at a sports bar in miami. fans of the miami heat were watching the nba finals on the deck over biscayne bay. fire owe firms says everyone has been accounted for. they were concerned that people may be trapped under debris in the water. 24 people were injured. two in critical condition. a lot of peopleup noted into the shallow water to help. one man said it happened in a flash and no one had time to run. >> police in pittsburgh are renewing their call for help in tracking down a homicide suspect. they released this new photo of robert grant of san francisco. they say that he knows that police are looking for him and he should be considered armed and dangerous. back in january, 20-year-old tim knee smith was shot and killed at a gas station in pittsburgh. the killer got away in spite of a massive search.

>> jury selection is complete in the accused serial killer. the panel has been seated. the 79-year-old has pleaded not guilty to charges that he murdered four women between 1977 and 1994. he is acting as his own attorney and personally questioned many of the jurors. if convicted he could face the death penalty. in florida, the jury in the george zimmerman trial will be sequesters. the judge said that they will be sequestered for two to four weeks. the court has 20 potential jurors. they need 30 candidates to narrow it down to a juror with four alternatives. >> rebels fighting the regime may get weapons from the united states. president obama has reportedly authorized sending weapons but the exact details have to be worked out. the decision came after the

white house announced it has confirmed the use of chemical weapons by syrian forces. in argentina, a speeding commuter train slammed into a stopped train during the morning commute. three passengers were killed. more than 300 others were injured. the stopped train was in between stations at the time but exactly why isn't clear. officials are suggesting the conductor may be at fault. last year, 51 people died in a similar accident on that exact same track. and in hong kong, demonstrators rallied out of the consulate in support of snowden today. he leaked details about the data gathering programs. the protesters said the united states should not extra indict snowden. a representative listened to them but offered no comment. so far there have been no charges for that leak. >> an oakland mother watched with pride today as ceremonies honored her young son for making a call that saved her

life. he was only five when he called 911 after his mother suffered a seizure. he used a cell phone and the emergency operator coached him to use a land line and was able to determine the location to send help. >> i'm very proud to him. he saved my life. and it's just -- if it wasn't for my son, i wouldn't probably be here. >> when the fire department arrived, his mother got the medical attention she needed and you see here the happy ending for the story. reserving a parking spot in san francisco is turning into a major real estate transaction. that's no joke. a parking space inside a china beach building near at&t park sold for $82,000 last week. the real estate agent who made the sale didn't give us the details but told us that it's a good indication of where the san francisco market is headed. >> digging up secrets more than a hundred years old. the interesting artifacts unearthed by a massive excavation project.
