for charity? these people raising money night and day on the vegas strip say there is. they say they're collecting for the homeless. they were recruited from this online post. homeless and jobless, you must be both. includes room and board with cash paid weekly. your job, fund raising. the group is called the u.s. missionary corps. now when we donate, most of us would like believe the bulk of our money is going to the people who need it. is that what's really happening here? this woman's uniform along with her badge that says volunteer, makes her seem legitimate. she admits she isn't really a volunteer at all. this is her job. >> it's hard work. $7 a day.

>> she's one of the homeless people who answered the craig's list post has been hired to collect cash. where do all those dollar bills go? there's somebody else involved, the woman who runs the u.s. missionary corps. we wanted to know more about this boss and if the money being collected on the strip is really going to the homeless. to find out our producer replied to the group's post and was told to show up on the strip to await further orders. >> i would shake your hand, but my hands are filthy. >> our producer was led to this rundown van. the van picked up other u.s.

missionary corps fundraisers. we ended up at this house. that's where we saw the same workers who collected the cash out on the vegas strip counting it themselves. it looks like several hundred dollars. this is also where we found out something very interesting about the u.s. missionary corps. these workers get 20% of what they collect. some of them told us they make between 40 to $60 a day. they're given room and board. we're told up to 18 people stay in this four-bedroom home. what's the problem? >> it's not doing what it says it's doing. it's deceiving the public. >> would you call it a scam? >> absolutely. >> why? >> who is it helping? how is it helping homeless people in any meaningful way?

for madonna tickets at madison square garden in new york. a dateline producer and i set up a meeting to buy two of them. the seller tells us his name is eric. he suggested we meet at a train station in new jersey. >> how much? >> 350 each. >> eric gives us two computer generated tickets that look real to us. we tell him we need to get some more cash to pay him. >> i'm going to run to the atm. and our producer takes the tickets with her. in the meantime, i chat up our seller. >> how do you get the tickets? >> i bought them. >> where did you buy them from? >> ticket master. >> the online ticket merchant for thousands of events. our producer hasn't really gone to an atm. she's actually on the phone with

would i get the part in that julia robert's movie and would our staffers be cast in that sprite commercial? we wondering if there was even a sprite commercial to begin with. richard said he was taping our auditions to send to the casting director for sprite. only one problem. the button he's pressing isn't the record button. all he seems interested in is selling publicity shots and head shots of ourselves. that woman seemed awfully interested in selling us those head shots.

are they just a bait and switch? is the real reason for getting us here to sell us head shots? this woman wondered the same thing. she says she drove all the way from pennsylvania to audition. he says the man at actor's aid just tried to sell her photos. >> he keeps pressuring me to buy head shots. >> to find out more, we decided to play along and come back for the photo shoot. here's the forever now. >> nice to meet you, man. >> hold that pose. >> we ask him, who says he's a casting director, about that sprite commercial. >> what's the deal with the sprite commercial? >> you're not really submitted yet until i submit your pictures. >> soon he spots our hidden camera.

>> i'm going to go. >> and that's when the drama really begins. >> you have something in your bag. you're recording me and that's not leaving this building until i have it. >> sir, i'm going to go. i'm going to go. >> he refuses to let our producer exit the building. >> you're not leaving. >> so there's a little bit of a problem. i would like to leave the problem and you're not letting me. >> you [ bleep ] played me, son. >> listen, man, i'm not a private eye. >> who sent you? >> we have no idea who jimmy is and he definitely didn't send us. he finally lets our producer leave. that's when his imagination gets the best of him.

he decided to call the cops. >> i'm going to tell them you had a bomb in your bag. >> that's crazy. >> help. >> why are you yelling for help? >> police. >> eventually, he stopped following our producer. a few days later, it is time for me to have a chat with him. turns out he too is an aspiring actor and is working on a low budget movie in queens new york. >> we talked to the parent company, coca-cola. they told us that nowhere on the entire globe is there a sprite commercial being filmed. >> i need to speak to -- >> actor's aid has not been hired to do casting for any one of the listings we saw. >> why would you say there's a sprite commercial and cast for it when we know there is no sprite commercial.

>> he says all he does is pass on leads for acting jobs for people who come in with competitions. >> i supply people with leads. do i have to check their lead? >> do you have to take their money? >> i don't take their money. >> you're taking head shots and actor's aid is taking money from people and not placing them in any job. >> that's true. >> what does he say about that supposed sprite commercial? >> i submitted about four photos. i e-mailed them to the casting. >> turns out he sent them nowhere, just across the hall to his own half sister. the same woman i auditioned for. we wanted to talk to her so we went back to the casting office to find her. that day, actor's aid was holding auditions for a red lobster commercial. i had to tell these aspiring actors some bad news.

>> what if i were to tell you we talked to red lobster and there's no commercial being made for that company? >> i knew it. >> she wasn't there, but she agreed to an on camera interview the next day. when we met, she didn't recognize me from my audition. >> i sat there. >> yeah. >> across from you. >> from me? >> from you. >> i asked her why instead of holding real auditions, they were being sold head shots? >> he's no longer with the company. >> she told us she recently fired her half brother. she insists her company provides a legitimate service. the people who wait here for

hou hours don't seem to know most of her lisings can be found elsewhere for free. >> it sounds like a scam for a commercial isn't being shot. >> i don't think scam is a good word, chris. >> john advance is the commissioner for new york city's department of affairs. >> this is deceptive advertising. you walk in and rather than them getting you a job, they're trying to get into that you are wallet. they say what actor's aid is doing is illegal. >> we will shut their agency down. >> you're going the pull the plug on them? >> we're going to pull the plug, but we have to be frank on this. we pulled the plug before. >> remember richard? he's her partner. he didn't have much to say to us. >> he was fined $718,000 in new

york for running the same kind of bait and switch. what's the lesson? >> trust your gut and watch your wallet. you have to say to yourself the minute this guy asks me for money, i'm out of here. >> another reason to be careful to be out there on the wild, wild web. here's our next hour of dateline. i felt like it was my fault that she was gone. >> a new twist in a story of new love in one of the most romantic places on earth. he seemed to have everything she wanted in a money. looks, money, and he was crazy about her. >> that first day, he said i'm going the marry you. >> what she saw was not what she got. >> she was frightened enough to not go home. >> she had fear something would happen to her. >> when it did -- >> i didn't see it coming.

my sister is not answering her phone. >> it was monday, october 5th, 2004. a gray day. the car radio crackled at about 1:15 in the afternoon. a call had come in. >> she was supposed to leave and pick up my son at day care and she hasn't picked up her cell phone. >> it was a routine matter, or so it seemed. he met his partner at one hawthorn lane. >> i said, excuse me, are you ms. elizabeth lochtefeld. she said no and pointed toward it is cottage. >> i moved around to the bay window and i looked in at which

time i saw someone laying on the ground. >> he was looking at a crime scene. >> i told my partner we had somebody down inside. >> he kicked down the door and a body was on the floor, a woman stabbed to death. he had never seen anything like it and was hit by a wave of fierce emotions. >> from shock, to awe, then the police training kicked. >> with weapons drawn, we proceed to clear the house. >> it was all clear, but horrifying. there are signs of a struggle. blood in a bedroom and in the living room by the body. the officer radioed in. >> i made the comments, just get here.

>> it was his first homicide, but if he was a stranger to homicide, so was nantucket. there hasn't been a murder on the island for two decades. >> it doesn't happen here. it can't happen here. that's the way it was until that day. >> her name was elizabeth lochtefeld, but everyone called her beth. she was an unlikely victim. she was 44 years old. the successful businessman from new york who sold her company for profit and moved to nantucket. beth's brother, tom lochtefeld. >> i would be with her. we would go into the store to run an erranranerrand. she would be chatting up the store clerk. >> what tom remembers most is her way with people. >> it sounds like your sister madehe other person feel

barney. he seemed to have it all with charm to spare. >> she called me on some corner of manhattan. i have to say thank you. we're having so much fun. >> tom was smitten too from day one. >> he said she's an amazing gal. >> they started seeing each other regularly. beth at 44 was eager for marriage and a family. very soon there was talk of rings. although beth's brother says it was mainly tom doing the talking. >> it's my understanding that first day he said i'm going to marry you and she was like, yeah right. >> beth may have hesitated as she learned more about her new man. he told her he had had drinking problems. tom's drinking hardly seemed like a deal breaker.

>> i knew he had a drinking problem. i know a million people with drinking problems. >> other friends had misgivinmi. she said i met somebody. i said, that's great. but she smokes and drinks. that doesn't sound good for you. well, he's crazy. i'm a little crazy too. >> she said she felt good in his arms. she was so protective. >> besides, beth was a fixer. >> when she would date guys, a lot of times she would say to herself, well, he'd be really great except for this, but i think we can work on that. >> no surprise that beth decided

to work on his drinking problem with him. >> two weeks after they met, beth and tom flew to california together. tom had meetings there and beth decided to tag along. it was their first extended trip together. for beth, it was an eye-opener. now she saw things that she could not dismiss. >> she said he was a mess. he couldn't get on the plane. i said what do you mean? she said i stood back and watched him and he was walking in circles smoking a pack and was just a mess. >> beth wanted to introduce tom to her friends on the west coast. leslie lives in san diego and she was eager to meet beth's new beau. >> i didn't understand him.

>> the trip ended badly. >> they were in a taxi and he had a temper tantrum. she said let us off here. he turned and really yelled at her. she said it was a little bit scary. >> and he was drinking. >> she said he had eight beers before the time he got to the airport and got on the plane. >> tom asked beth what her friends thought of him. he said something chilling. >> he said what did they say about me? and she said they thought you were really sophisticated and charming and this and that. he said under his breath, boy, i really should have been an actor. that went right into her gut. >> it was at that point perhaps that she began asking who was the real tom toolan.

she told friends and family she was going to give the relationship the four seasons test. it was becoming clear that tom toolan was not inclined to let one season pass, let alone four. coming up, a troubled relationship becomes a terrifying one. >> she was probably in a state of shock. why she didn't leave that next day, i'm not exactly sure. . there may be more you could do for your asthma.

in october 2004, beth lochtefeld went to new york to be with her boyfriend tom toolan. by then the two had been dated for six weeks, but the relationship was fraying. beth was beginning to see a

troubling side ining side of th. >> he would start drinking and get really ugly. you need to decide between alcohol and me. he would apologize and say, you know, i choose you and i want you. i don't want the alcohol. >> that week, beth invited her brother to meet her boyfriend. perhaps she wanted his take on tom. >> first impression when you see him walk in. >> he had longish blond hair combed back and a double breasted blue blazer on. very pompous, very -- i don't know. he seemed fake to me. >> that night over dinner, beth's brother kept asking tom toolan what he did for a living. >> he couldn't really tell me what he did. oh, i'm an investor. what do you invest in? he couldn't really give me an

answer. >> beth's brother said toolan was drinking at dinner, but not in excess. beth said she had seen him drunk and angry, but she never had seen her new boyfriend like this. >> he put her into a headlock and was walking down the street saying, i want to beat your head in. she went back to the apartment to get out of there. i wonder if i shouldn't have left that stuff behind and left another that >> toolan had been aggressive with one other woman. >> becky hammonds dated toolan once. >> that's a nice date.

>> it didn't turn out that way. dinner was pleasant. then came drinks. >> that's when he accused me of being flirty with the bar tender. >> she says toolan tried to grope her. when they reached her street, she didn't wait around. >> i ran across the street. >> beth lochtefeld was in a frightening situation with the same man. instead of grabbing her stuff from toolan's apartment that night, beth stayed. beth told her things went from bad to terrible. >> then he got very violent with her that night. he sexually assaulted her. and i think that beth was probably sort of in a state of -- it's a confusing thing when it is somebody that you're supposedly close to that violates you. she was probably in a state of

shock. why she didn't leave that next day, i'm not exactly sure. >> by friday, october 22, duodays after the dinner with her brother, beth decided to leave new york. friends and family say it was clear that she intended to call it quits with toolan. she left a message with her brother saying she was coming to spend the night. tom toolan was not going to let beth go. >> he would not leave her. he followed her. she said i was standing there in front of this painting and it was incredibly dark and this painting reminds me of tom toolan. >> that's the moment tom toolan picked to propose to her. he chose the most public place

possible, the metropolitan museum of art. >> she didn't feel safe enough to say no. she said to him, i need more time. >> she was like, so upset because she sahe said it's now never. >> she said? >> it has to be never. >> toolan pursued her. >> he was screaming, i'm going to go get drunk with my friends. he hopped in the cab with her and they ended up back at his apartment. beth called her brother. in retrospect he says, she sounded terrified. >> her words were measured. she was talking very slowly and

enunciating very clearly. she kept saying, i'm here with tom in the city and we're trying to work things out. and i didn't even think to ask her are you okay or cough twice if you're in trouble or something like that. >> he had no idea his sister was in danger. >> i was sort of tired. i didn't want to deal with the breaking up making up kind of thing. >> later from family and friends, he would learn the horrifying details of beth's ordeal that night. >> it is my understanding he was holding her at gunpoint. >> he has no proof of that or other details of what went on that night, but he has pieced together stories from various accounts. >> he held her captive. she tried to get away. he was either drunk or tired. he ended up laying on her legs and going to sleep.

>> to prevent her from leaving. >> yeah. >> i understand she didn't even want to use the elevator because she was afraid the ding might wake him up. >> yeah. >> it was around 4:00 a.m. when beth managed to escape from the apartment. >> where was she going to go? >> laguardia to get back to nantucket, her home. >> at 8:00 a.m., beth called her brother. it would be the last time the two spoke. >> she mentioned she had broke up with him and he call ee eed 0 times since then. >> did that raise any alarm bells? >> no, since she had just broken up with him. >> tragedy was too short two days away. coming up, a surprise visitor and a panicked phone call.

lochtefeld managed to escape and get home to nantucket. she called her friend leslie the morning she got back. >> she did say he has a gun and i'm afraid he might use it. i'm not going to stay here tonight. i'm going to go stay at my brother's house. >> beth stopped by the nantucket police department to ask about filing a restraining order. >> for her to get to the point of stopping at the police department, that tells you all you need to know about what was going on inside of her. >> yeah. i think she had very well-founded fears, especially after the incident in new york where he held her captive. >> beth did not file the paper work. she spent the night and the next at her brother peter's home. >> she had fear that something would happen to her. >> on monday, october 25th, beth

returned to her cottage in the morning, collected tom toolan's clothes, parcelled them up, and returned them to him. >> she came in the yard and we were talking in the driveway. she was going to work on her computer. we were going to meet again around 1:00. >> beth went inside the cottage to work. >> that's the last i saw of beth. >> barbara continueed to garden. a short time later, she was filling a wheel barrel when she heard a voice behind per. >> the voice said is anyone there in that house? it was a man. >> the man dressed in a hat and long overcoat was inquiring about beth lochtefeld's cottage. >> i said i don't know. >> something about him bothered her. >> i knew beth has been seeing someone and she more or less

told me i think it's over. i guess this is the boyfriend that's come back. >> he moved toward the cottage front door. she was uneasy. >> it was an intuition. >> barbara says she called beth's brother peter but couldn't reach him. she called beth's parents, but couldn't reach them either. beth's car did not move. then she noticed the shades in beth's bedroom windows has been drawn. >> i had a bad feeling. had a bad feeling. >> she called peter lochtefeld again and this time she reached him. >> i told him there was someone in the yard and i said, i think it's beth's boyfriend. he said barbara, lock your door. don't come out. call the police. >> it was then the nantucket

police arrived at the cottage and made the discovery. beth lochtefeld's body on the living room floor. it was just weeks after she thought she found the love of her life and dreamed of a new beginning. for the lochtefeld family, life would never be the same. >> what did you lose on that day? >> i would have to say i lost probably my best friend and my confidant aside from my wife. she was my closest sibling in terms of -- i worked with her in her business, helped her run her business for three years. we always had a lot in common. we had the city in common. we had -- just we always got along really well. >> leslie costello got a call that same day. >> when you heard the news, how was it told to you? >> he killed her. and i remember just being in shock.

i didn't see it coming. i didn't know it was coming. i was -- it was shocking. >> you knew exactly who the he was. >> oh, yeah. i did. >> bernadette, the friend who played match maker, got the news from her husband. at first, she couldn't take it in. >> there was this big buzz going around that this woman in her 40s boyfriend flew in from new york and killed her. i'm screaming, what? >> tom toolan was arrested hours within the murder with bottles of beer and vodka with him. the rhode island state police videotaped his arrest and recorded his voice in the cruiser. >> toolan was held without bail

and arraigned a month later. bernadette could barely contain herself. >> it was the reality hitting me, sitting there, that this happened. this really happened. he walked in and it was like they were bringing in king congrekong, like a monster. i felt like it was my fault and she's gone. >> toolan was charged with first-degree murder and assault and battery with a dangerous weapon. he pleaded not guilty. ahead, lay a trail and explosive revelations about a man stripped bare of all pretense. coming up, what seemed like an open and shut case was anything but. >> it's like the perfect storm. you have all of these swirling together inside this man's head

in june 2007 while tourists wandered through old nantucket town, tom toolan went on trial for the murder of beth lochtefeld in a courthouse in the center of town. he pleaded not guilty. the defendant was as smartly turned out as ever. looking like the successful executive he always wanted to be. the defense would argue that toolan's polished exterior was nothing more than a facade. they would argue he shouldn't go

to prison for killing beth. toolan's attorney began by hinting at the turmoil that lurked within tom toolan. >> he looked good. certainly someone that doesn't look crazy to me. >> the master of the universe act was just that, an act. tom toolan was plagued by drug addiction too. >> his drink of choice would be a fifth of vodka a day. >> when beth broke up with him, reddington told the court that toolan snapped. >> the evidence will show that thomas toolan was suffering from

a mental disease or defect at the time of this incident. he was well within the legal definition of insane. >> who better to tell the defendant about his problems than the defendant's mother. she cited the sorry facts of her son's life. >> was it apparent to you that he had an alcohol problem? >> yes, when he was 16, 17. >> battle with drugs. >> he got some prescriptions from the internet. >> she told the court that she and her husband tried to straighten him out sending him to rehab several times beginning in 1999. >> did you at some point receive a phone call from your son? >> yes. >> she described a conversation

with her son two days before the murder. she was inconsolable over the breakup with beth. >> he said, she's gone. she's gone. she's taken all her stuff. she just -- he said i was asleep and she just left. >> the next day, sunday, the toolan's went to manhattan to see their son. he was in terrible shape. >> his whole body exuded the smell of alcohol. >> the defense believed that established toolan's state in the days before the murder. now for the day itself. when toolan was picked up in rhode island, he has been drinking. sobriety test put him at twice the legal limit.

carrying a ten-inch knife. when asked about the knife, he offered a series of stories. >> he said he forgot it was in there. >> he was having lunch with his sister in nantucket and she wanted him to bring a knife. >> the prosecutors presented evidence that toolan boarded another plane this time without a knife, but after landing, he went shopping for a knife. the prosecutor called witnesses who would testify that toolan didn't seem drunk. that's what the clerk who sold him the knives testify. >> i would say he was sober. >> and the rental car agent at the nantucket airport. >> was he intoxicated to you at that time? >> no. >> the prosecutor played a surveillance tape from the

airport in massachusetts. toolan flew into the airport after the murder arriving at about 1:15. jurors could see him renting a car, walking out to get it, and driving away in a gray chevy impala. >> you're able to see how he's walking. he's not falling or stumbling. >> there was audio of toolan in the back of the cruiser after he was arrested in rhode island. >> you want to tell me what's going on? >> the prosecutor argued toolan was coherent. he was capable of thinking clearly and of distinguishing right from wrong despite the alcohol. and the prosecution also had a forens

thinner than he had in the first trial and this time a new defense attorney argued the case. >> this is a why case. >> robert opened with an admission that the first defense team never made explicitly, that toolan did kill beth lochtefeld. what the jury had to decide was why. >> it's a difficult issue to look into somebody's mind and figure out what was going on in that mind. was he a common control or was he not? that's the issue. >> it was the insanity defense all over again dressed up a little differently. >> the real question is anyone willing to let somebody who's done something this horrific quote/unquote, off the hook. the problem with their drug

abuse, alcohol abuse, and underlying mental issues. >> in 52 days, 52 days from the time elizabeth lochtefeld met thomas toolan until he stabbed her 22 time ps. >> the prosecutor said tom toolan knew exactly what he was doing the day he killed beth lochtefeld. >> this time the trial was considerably shorter. >> is he not guilty or is he guilty of murder? >> the jury has found him guilty. >> guilty of what please? >> first-degree murder.

>> guilty again on all counts. beth's sister kathy read a statement in court. >> this verdict cannot bring beth back, but it does bring a measure of justice. >> for tom lochtefeld, it was satisfying even though the first conviction was the one that mattered. >> on that day we took a walk to beth's grave site after the conviction and i just remember feeling that was a beautiful june day and it felt like, wow, this is finally -- i'm finally not upset to be here anymore. it was good again. >> for those who were close to beth lochtefeld, there is a real sense of closure this time. the trial behind him, beth's father is back to work at nantucket.
