council. this shows they need more officers out on the street. we now know what caused this fire. it was target shooting. the fire is now 90% contained with full containment expectedded tomorrow. several neighbors told ktvu they heard target practice shooting at about 1:00 sunday afternoon right before the fire started. so far officials are not commenting on possible charges or identifying the people that sparked the fire. coming up at 10:45 we'll tour the burned area with a park ranger and learn of a silver lining. fire investigators learned of a fire. the flames broke out at 4:15 in a steep area. the fire burned a grassy area of the hill and eucalyptus trees. a federal judge refused to block the city of richmond's plan to take over hundreds of

troubled mortgages by imminent domain. wells fargo filed for an injunction. but a district judge said that would be premature. richmond city officials want to force the sale of 624 under water mortgages so they can be refinanced at lower rates. members of occupy san francisco have tried to set up a new camp but this time police wasted little time in clearing them out. some trash was all that's left at civic center the prozesters that set up there yesterday right outside of city hall. they told the san francisco examine they wanted to send a message to mayor ed lee for what they say is his dismissal of the homeless. the 77-year-old western span of the bay bridge serves

held in vallejo today. kai was last seen leaving with a neighbor. that neighbor is a 27-year-old man waiting to be arraigned. >> please keep an eye out for our son. a deadly crash on interstate 880 tied up traffic. the chp says a motorcyclists was killed when he rear ended a big rig. it happened just after 5:30. three lanes were blocked. no word on the name of the motorcyclists or what caused him to crash into the back of that big rig. new details on a man found

dead in a boarded home. police now say he has been identified as marcus brown of highway -- hawaii and his death was labeled a homicide. police were finally able to learn his name after a friend in hawaii reported him missing knowing he was visiting california. the measure by state senator lonnie hancock would have forced gun owners who already have such clips to get rid of them. california already has a law that bans sales of clips that hold more than 10 rounds. in california, the state legislature passed a gill allowing residents to get licenses. saying the license cannot be used for voter registration or public benefit. it would allow some 2 million people here in california to drive legally. governor brown has indicated he

will sign it. now to the possibility of another b.a.r.t. strike. tonight just 28 days remain before a 60 day cooling off period runs out in union workers vow to go on strike. b.a.r.t. management and union workers return to the bargaining table today to try to hash out a deal. both of the labor unions and b.a.r.t. say they will resume full negotiations over salaries, health care and pensions next week. today the two sides talked about work rules. negotiators with seiu have been saying they want contract provisions that want the system safer for both workers and passengers. >> safety is just a smoke screen. they don't want to talk about the fact they want an increase. >> i think it's unfortunate that when people think of those things that we're just trying to use them like bargaining chips. that's not the truth.

>> my husband couldn't find a job so we couldn't pay the rent. because we couldn't pay the rent we got evicted. >> reporter: staying here was supposed to be a temporary accommodation. it's been nearly two years now. >> they still talk about missing our house. they hate the move days. >> reporter: move days as they're called are the most dreaded. >> we don't usually sleep very well the day before we have to go. praying that we get another room. >> reporter: her hotel rules, every 28 days the family must clear everything out of their room and check out. they're allowed to check in after two nights. >> this is hard. i wouldn't wish this on anybody. >> reporter: we were there recently to witness move day as bag after bag was carried out. for the young boys moving is typical. but it takes a toll. >> it's hard.

>> i wish i could just stay in our house. >> bye guys. >> reporter: they will go to another motel and if they're lucky, get a room. the family waits in the parking lot of the near by motel 6 for a room to become available. which won't be until another two hours. >> sometimes it's been until 3:00 till we get a room. >> it's better than being homeless. >> we're not homeless, huh. >> reporter: this will be home for the next 24 hours, where the family will try to return to the easy 8-which has a refrigerator. he makes enough to stay in the rent by week motel which costs about $1,600 a month. that's close to an average rent of a two bedroom apartment. but the couple can't come up

with the necessary deposit. >> how is everybody doing? >> good. >> reporter: the ramirez family isn't alone in its struggle. school officials say there's 250 students identified as homeless and in need of assistance. >> just last year alone they served 350,000 meals free and reduced just in our school district. >> reporter: the department of education has identified 47,000 motel kids in schools around the country and say that the number of homeless kids in public schools has increased 38% since 2007. >> in order for kids to be academically successful and learn they need to feel safe. they need to have food, they need to have clothing, they need to have shelter. >> reporter: shelter is the room they'll have for the next 21 days. but there is hope the next chapter in this family's story will be one of change. until then another nightfalls

fun town is gone along with more than 50 small businesses along the jersey shore all destroyed by a fast moving fire this afternoon. winds spaned the flames across an eight block stretch between seaside park and seaside heights. that area near tom's river new jersey was just coming back after superstorm sandy caused so much damage last october. the boardwalk is set to be the life blood of the two towns and

a homecoming party two years in the making for a little boy who's brush with death has saved many lives. new at 10:00, ktvu's deborah villalon is live in antioch at the site of a special blood drive tonight. >> reporter: well most blood driving come away with some 30, 40-pints. this one double that thanks to some pint sized inspiration. like any toddler, matthew wematt has his favorite beat but he also has a feeding tube and a bald spot from so much time in a hospital bed. born with a liver enzyme disorder, matthew's liver failed at 2 months old until a double transplant finally came in june after some false starts. >> each time we thought he was going to get it and it just ended up being not a good enough match. when that fourth one came, we were a little cautious. >> hey, daddy. >> reporter: the fourth one worked. surgery in which matthew got

police from interfering on campuses. the woman accused of attacks lester chambers has been arrested. gina potters jumped on stage and knocked him down. potters is charged with assault and elder abuse. she surrendered to authorities today. four home invasion suspects are in custody one more still being sought tonight in the south bay. sheriff deputies and san jose police locked down the neighborhood in meadow road in east san jose. they searched and quickly found two suspects. they also recovered a gun. authorities say the victims two women and two infants were not hurt. three of the suspects are from san francisco, one is from hayward. they're all between 18 to 23 years old. a man is in custody tonight in oakland after he was caught on tape stealing a laptop from a t-shirt store. but then officers discovered he may also be responsible for several other crimes.

this is surveillance video from pure 510 on grand avenue near lake merit. it shows a man coming in last night, stealing the laptop and then running off. this morning police stopped a man matching the man's description and arrested him. he could be responsible for other thefts. >> that person we believe is connected to multiple crimes not only in oakland but in other cities and that ranges from robbery to theft. the suspect has not yet been charged, another man police say took part in the laptop theft has not been found. in san francisco's mission district people are banding together to try to stop the possible eviction of a pair of mom and pop stores. as rob roth reports it's a campaign that pits merchants against another group, the catholic church. >> reporter: the store has been selling statutes and other religious symbols.

the owner tells us he worried about being evicted. his agreement is being evaluated by his landlord, the archdiocese of san francisco. the same is true for his next door neighbor the craft store. if the owners are evicted the church can then charge higher rent possibly to a restaurant. many neighbors say they are disappointed in the church. >> you're taking away god and replacing it with coffee. >> reporter: a neighborhood of mostly latino owned businesses. >> the biggest thing is displaying two families who may have to move out of the neighborhood because everything is so expensive. >> reporter: we spoke to a spokeswoman, she said no decisions have been made that conversations aren't taking place and that money won't be the deciding factor but that rents do help fund a school at st. peter's church. here at el's cafe down the street from a possibly endangered store, the city says

the damage from the clover fire burning in shasta fire is turning out to be than originally thought. the number of the outbuilding has gone up from 74 to 128. authorities also say one man who refused to leave his home has died as a result of the

fire. some 8,000 acres have burned so far and as of tonight, that fire is still only about 65% contained. president obama has issued a local disaster declaration following flooding waters near colorado. the water have damaged and destroyed homes. and there's no let up. the heavy rain is expected throughout tonight and into the weekend. >> we know that we've lost lives. we anticipate that as the day goes on, that we may find that we've lost others. officials say the unpredictability of the flooding has been worried. the storm has dumped more than a foot of rain in just hours. dr. marty festershine's last day at work will be

oracle team usa has a battle if they want to retain their first place. they only need three more wins to take the trophy but oracle needs 11 wins after taking a cheating penalty. there are two races set for saturday at least one more will take place on sunday. investigators confirmed tonight that the fire that burned more than 3,100 acres in mount diablo was sparked by someone who was out target shooting. now we're getting our first up close look at all the damage. but john fouling tells us the mountain could reopen to visitors in a matter of days.

part of life here, expect amazing wildfires and wildlife next spring. >> to the public don't think that what you're looking at is unhealthy. because i think that this fire will end up being a great benefit. >> people love this mountain. >> reporter: although he knows fire is ultimately good here, after calling this home for eight years it's still difficult to see. he says, his crews will quardon off any unsafe areas and welcome them back to the park. a bill that would strip the boy scouts tax exempt status stalled today in the legislature. because the bill is a tax measure it requires a 2/3 vote in both houses to pass. the bill would deny state tax breaks to nonprofit youth groups that discriminate on the basis of gender, nationallalty or religious investigation. without that tax break the boy scouts would have to pay

corporate taxes on donations, membership groups and tax frees. the company that runs hillton hotel has announced it has plans for an initial public offering. it's hopeing to raise money from the ipo. it did not set a price target. the stock markets cooled off today. the dow industrials industrials dropped 25 points. historically september is the worse for stocks. mega retailer wal-mart is vowing to cut down or eliminate dangerous chemicals from several popular items sold at its stores. beginning in january, the retailer will start scaling back the sale of 10 chemicals and beauty products. suppliers will be required to

expect. the marine layers it's up over 1,500 feet. it's going to get up over the coastal hills. you'll have fog and low clouds as you get going. the current temperature 61 in concord and 59 in novato so it's pretty mild out there. a few low 60s as you look at the forecast for tomorrow, slightly warmer so friday temperature's peak maybe into the upper 80s to low 90s. as we get into the bay area weekend this low kind of comes up to the coast. temperatures fall off. it's not cold. it's just more fog. a little bit of drizzle coast side and temperatures in the 90s but mostly in the low 80s. in oakland, 69 degrees at lunchtime. 73degrees for a daytime high in oakland. a nice looking day for your friday. 92 in clear lake. 70 in richmond. these are the forecast highs for saturday. slightly warmer than they were today. and they will be slightly

win. the giants so far cannot deny the title they will get but they can delay that little champane party a bit. but tonight's game looked for a while like it was going to be a perfect example of how teams have done this year. hunter pence deep and gone. he may get a salary drive or what headed to the free agent lift. his 21st of the year comes up gravy. giants are up. blanco with a base hit and the giants have themselves a 2-1 lead and that is puig gets himself a home run double. and there's pence heading into the double play that gets the dodgers out of trouble. right now it is 2-2 in the 10th inning. and the giants bryan wilson is pitching for the dodgers. so that will be interesting. to see how that turns out when we continue with the rest of sports
