>> now. >> reporter: we are just two hours away from another possible b.a.r.t. strike. both sides have been meeting all days in downtown oakland and into the night. working to come to terms on a new contract. >> the good news is both sides are reporting some progress but as of right now no deal has been announced setting the stage for a second strike. >> ktvu's deborah villalon joins us live from downtown oakland. she has the very latest on where things stand right now. deborah. >> reporter: we're hearing words like hopeful and optimistic. for the last few hours both sides have been inside this building. we're going to assume they're having face to face time which mediators will call them together for that. this would be just the first the of proposals going back and forth between them.

b.a.r.t. workers are here they've gathered outside the caltrans building to show support and unlike everyone else they're wading for word. >> reporter: a day that beagains a gains -- begins like many other, but hopes that it will not end like them. awaiting the mediators call. >> we feel good about where we are in terms of what we're doing. b.a.r.t. without question trying to avoid a strike. a strike like the one in july that crippled the bay area for four days. halted by a month of new talks, that again led to the brink and again the governor stepped in and kept the trains running 60 more days. >> you're dealing with does -bs and dozens of people.

>> and clearly a number of other elected officials here with me. we came here basically today and many days in the last week and even before and our purpose for being here is because we want discussions to keep going. we want both sides to with get to yes. the only way people can get to yes is if things keep going. the gap has narrowed. so when b.a.r.t. management cut off negotiations today by putting forward a final offer at 4:00 p.m., we were disappointed. and we felt that it did a lot

of damage. because it impeded progress. if the line is drawn on the sand it's hard for there to be discussion. so we have asked labor to hold off on any strike action. and it's our understanding that they are willing that the b.a.r.t. unions are willing to take more time and that's what we're encouraging. we also want b.a.r.t. to be similarly responsive. and we want b.a.r.t. to withdraw that final offer so the talks can still keep going. the gap has narrowed and we believe that agreement is possible but both sides have to keep talking. >> do you have any implication what that last offer was?

state lawmakers concerned about the impact of a possible b.a.r.t. strike in the bay area. apparently they had given a final offer at 5:00 this afternoon. and it seems like reading between the lines here. the state lawmakers are offer to pull the offer off the table. they're indicating they're very close to a deal. >> reporter: the assemblywoman was a little critical of b.a.r.t. saying this last and best offer they presented to unions earlier this afternoon at 4:30 she said it was impeding some of the progress that the two sides had been making. live coverage of what's happening inside those negotiations taking place right now in downtown oakland trying to avert a second b.a.r.t. strike. we will continue to monitor the situation and bring you the latest. >> right now we want to go back to deborah villalon who has been listening in to this news

conference. let's check in with deb. >> reporter: we are listening and everybody he's as stunned as the state legislature seemed to be. the signs we've been getting all day that the two sides are pulling closer but in fact, they say they've been blind sided with a last and final offer from b.a.r.t. to the unions. when we saw the b.a.r.t. team coming back from headquarters and heading back into the building with a presumption that there was more face to face negotiation going on. apparently now they're at heads because if the union doesn't want to take that last offer and if there isn't any negotiating still continuing, this could push us into a strike less than two hours. again we're listening to state legislators who have been here and have been sitting in not

actually participating in the talks but on the sidelines trying to show support. trying to find common ground for the two sides. and trying to show that politically speaking there is no support for a second strike. it was crippling to the bay area. after the hardship for their constituents and economically damaging as well. so one by one we're hearing state legislators say to the two sides come back together, come back to the table. they're critical in part as we heard because they feel b.a.r.t. had put out a last offer and stopped negotiating. it appears we're back at the same brink where we have been for times over four months where the two sides just cannot seem to get past this number of high hurdles. we know the mayor issues they have been pay. they have been benefits, and pension contributions. they've made a lot of progress

coverage of the government shutdown now entering its thirds week. a rare sunday session today with senate republicans and democrats continuing to struggle over spending. there were some encouraging signs though from today's conversations but in the end lawmakers couldn't break the stalemate. as steve santani said, a gop overplayed its hand. >> the u.s. senate convened today in a rare sunday session. meantime harry reid and mitch mcconnel met yesterday and reid said the conversation continued today. >> our discussions were substantive and we'll continue those discussions. i'm optimistic about the prospects for a positive conclusion. the issues before this country today. >> reporter: senator lindsay graham suggests republicans overreached in trying to fund obama care as part of fiscal negotiations. >> for us to suggest to american people that we can

while employees were furloughed. the photo was first posted four days ago and has since been liked by 65,000 times on reddit. the statute of liberty reopened today after state leaders in new york agreed to shoulder those costs. that's about $61,000 a day. the popular attraction will remain open until october 17th. if congress still hasn't made a deal by then. state officials say they will renegotiate to keep lady liberty open. it has been almost two weeks since the state has shutdown. that feature appeared briefly before being taken down because what was called uneven performance. there's no word on when it will be restored. the glitch was one of many plaguing website s for the new

health care introduced by president obama. the shooting comes a day after afghan president and kerry reached a tentative deal to keep some american troops inside of afghanistan after next year. most of the post2014 force will work in training positions with a smaller number of special operations forces focused on killing or capturing al-qaida operatives. here in the bay area, volunteers held a packing party to get supplies to afghans in need. trust in education is a lafayette group that wants to bring aid to afghanistan. the founder of the group says

strike. we're only about 90 minutes, 95 minutes away from the deadline for the b.a.r.t. strike to take place. negotiations have been going on all day long. but the latest we have now is that management had submitted a final offer at 4:00 this afternoon. we just learned that about 20 minutes ago from state lawmakers who held an impromptu newspapers angry at b.a.r.t. management. they say they want that offer pulled so that both sides can get back to the bargaining table. we'll keep you updated on the b.a.r.t. labor negotiation. a party went wildly out of control last night in bellings washington. as police tried to break up the party that had spill on to the street. partiest started throwing bottles and cans at officers. it quickly turn into a full out

riot. at least three people were arrested, nobody was seriously injured. all right a dying father in ohio this weekend was able to keep a promise he made to his daughter to walk her down the isle -- aisle on her wedding day. yesterday a team of doctors and nurses volunteered their time to get him ready for his daughter's big day. they fitted him with a tuxedo and fit him on a stretcher that went down the aisle along with his daughter. >> i always dreamed of him walking me down the aisle and he did. >> there are no guarantees in life when you can do something like this. this is a bonus. >> reporter: nagey stayed for the entire ceremony. his doctors felt it -- felt

returning now to our breaking news. the ongoing b.a.r.t. talks the frustrations the two sides have reached a deal. state lawmakers call for talks to keep talking. we're going to head out, where you can see outside. b.a.r.t. management teams the negotiators for the management have returned and we're waiting to find out whether or not they're going to retract the offer what was said to be the best and final offer at 4:00 this afternoon. and get back to negotiating with the b.a.r.t. unions. the good news is people are inside that building. those are union members there that you're looking at on that side of the lobby and we're waiting to see what happens next. we do not know if there's going to be a b.a.r.t. strike at midnight. that's what we're waiting to find out. we will keep you posted if anything happens during the rest of this newscast. if b.a.r.t.

workers do go on strike, there will be a few options to getting around. those who aren't trying to get in and out of san francisco could have the toughest time. the train from walnut creek to millbrae has been getting mark to and from work. he's a chief engineer. a two hour commute for him on a good day. if b.a.r.t. strikes, he says a few extra buses will not be good enough. >> reporter: what's your plan. >> right now i have two feet and a thumb. >> reporter: and he's not kidding. tony says he had to go to extreme measures. >> i was actually hitchhiking.

ones who are going to decide whether they're going to carry out their strike threats. they don't have to go on strike at midnight tonight. but that is what they warned management and warned the public would happen if a deal was not reached. if they do get close to a deal, the unions can say we will continue to negotiate and not go on strike if we feel like we're close. we want to remind you our coverage of all of this continues tomorrow morning. we'll have the very latest starting early tomorrow. you'll have what's going on with the transit options. hayward police this morning arrested a driver on suspicion of driving under the influence after they say he drove a car at their house. it happened this morning at a home near terrell avenue. the driver was drunk and going too fast when he clipped a curve and went airborne right into a house. no one was home at the time. the crash was loud enough

though to wake up some neighbors. >> i was laying in bed and i heard what sounded almost like an explosion. the car was so far in the house i couldn't believe it. >> police say the newly purchased home was undergoing renovations. the damage from the crash though was so bad that the homes may have to be red tagged. the driver was not hurt. uc berkeley police are warning students and faculty to be on alert after two women were robbed on campus. the first robbery happened at around 7:45 near the beverly cleary apartmentings. the robber described as an african american, 5'11". the second suspect is also described as 30 to 35 years

old, 5'10" and 150-pound. we want to return now to our breaking news. the ongoing talks between b.a.r.t. and its union leaders. let's listen in now as one of the union negotiators talks to the news media. >> as well as the over 900 active and over 50 retired members of 1855 deserve better than what transpired today. the unions from the first day of bargaining may 13 have come to the table honestly, openly and with a full fair and equitable contract that should have been resoeverred on june 30th. unfortunately that was not the case for b.a.r.t. management. they have demonized workers and certainly undeserves of the members of 1555. we were at the table today ready. we were so close to get ago deal. when we came to the table at 4:00 p.m. the district unceremoniously yanked their offer, gave us a

last and best final offer. giving us a demonstration that they would no longer be willing to offer. when we questioned them if they understood what last and final offer meant they said yes. it was very disheartening. our members and riders deserve better than this. we're not going to go on strike because the public deserves to have a riding system that works and we want you to know that the union members of 1855 recognize and we will give the district one more day, one more day to get it together. we are prepared to get a contract. everything is on the table to get that contract. we are disheartened by the dishonesty and the obvious lack of respect not only for the members but the riding public. it is reprehencable that they have taken the actions they

real progress on the issues of pay, pensions. while there remains more to be done on economics, the area where we are still at odds is work rules which include in part a safety provision. while management has referred to safety, protections as a smoke screen. we want to make it clear to the public that they are very real. they affect the safety of workers and riders and cleanliness and on time performance to the system. in order to avoid a strike we ask to continue bargaining for one more day in order for the riders, our workers and the bay area to get the resolution to these drawn out negotiations they deserve. we give this notice at this hour so the public can know that the trains will run tomorrow and there's no need for them to make alternative commute plans at this late hour. however we want to be clear if we do not have a resolution by midnight tomorrow, we will be forced out on strike.

well the advertised warm up remains right on track. right now we have mostly clear skies out there. the fog is basically well offshore to the north and west as well. we're going to hold on to the clear skies for the overnight hours and basically right over the next few days. with the clearing skies, temperatures dropping off rapidly.

high pressure up here in the pacific we're going to continue to build into northern california. the winds will change. we'll have more of a northeasterly wind develop for monday, tuesday and wednesday. temperatures on track to reach the 70s. warmest locations approaching the low possibly the mid-80s. we'll talk about an increase in the fire danger. those winds do ramp up a little bit. not extreme but right around 25 miles per hour. so we'll be watching up for that later at least by tomorrow night at this time. forecast highs for tomorrow. you can see the 70s for santa rosa. lots of 70s for richmond and vallejo. right around the rim of the bay we're showing you 80s. forecast high in san jose 78. and san francisco just beautiful. look at that lots of sunshine. temperatures approaching the mid-70s. here is a look ahead. your five day forecast. temperatures continue to trend up tuesday and wednesday. we'll shave up a few degrees

thursday and friday. with your weekend always in view. a minor cooling trend kicks in saturday and sunday. this is the time of year that you will be celebrating the sunshine. it'll be back in full force tomorrow. back to our breaking news of the negotiating b.a.r.t. and the unions. unions have agreed to continue talking to b.a.r.t. for one more day. they were critical of b.a.r.t.'s attempt to give them a last and final offer which came at 4:30 this afternoon. they said though they were very close on reaching a deal and again they have agreed to continue talking for one more day. new deadline for a possible strike tomorrow at midnight. antoinette bryan, she's the representative of 1855, she used words like dishonest.

bring this to a close it's been long enough. we want to return to our breaking news and right now you are listening to b.a.r.t.'s general manager talk about the status of the ongoing contract talks. >> this is the last, best final offer but is something that you gave two weeks ago. >> this is the best and final offer which we give to the unions tonight. >> it's $7 million more than the offer we gave them on friday night. >> michael, anything. >> they said they are waiting, they're willing to hold off for one more day. do you know if you're going to continue negotiating in that.

>> i have two weeks, that they have until the offer is taken off the table. the retroactivity the taken off the table. it's 4% for pension and 9.4% for medical. i think it's good for them and good for us. >> that the general manager of b.a.r.t. in a very, very short statement talking about where management stands in all of this. she seemed to be holding very firm. she was indicating that union members had a 3% raise per year. that was the final offer. however we have 24 more hours of negotiations antoinette bryan is in with hughes let's listen in to them. >> no it does not sound like it. so once again, it begs the

question, who wants the deal here the unions or the district? we have been at the table every day prepared to get an agreement. and we have said one more day we're trying to resolve this. we will be here tomorrow morning ready to bargain. we would hope that the district will take that as seriously as we are and not keep the bay area and the riding public in jeopardy. >> you will take it to the members, will it happen. >> we can take the offer to the members but i need people to understand that the offer we were given today is a regressive offer. which is less than the previous offer and less for our members. it is regressive. we can take it to our members for a vote. but again we want to bargain a full fair equitable contract. the offer was received was not that. >> will this offer result in a strike. >> as i said earlier. one more day.

fate. you remember that we came for the 30 day, a 60 day cooling off period. there was no bargaining done. it was not because of the unions, we were ready to bargain. the first letter we got said we would bargain september 16th after an early august 60 day cooling off period beginning. then they backed it up to september 9th. that's not indicative of someone who wants to make a bargain. we've filed several unfair labor practice, issues where they've violated the contract and bargaining rights. we've done everything we can do. we're trying to get a contract

done. we could have walked out a long time ago and not come back. we care about the bay area. we have a vested interest in this community. we have a vested interest in the riders that ride our systems. we have a vested system in our members and we're going to do everything we can to ensure that they get a good contract. so we can take it back. we can vote it done. and what does that leave anybody? come to the table and get the deal. we were very close to getting an agreement. it's reprehencable that they would not go ahead and seal this deal. thank you. >> how quickly things can change in the fluid situation of contract talks involving b.a.r.t. and it's two largest unions. you have been watching b.a.r.t. managers say that indeed that is their final offer. and you also heard from

antoinette talking. both earlier today sounded optimistic including gavin newsom who has been on the sidelines of this. he indicated earlier today that they were just inches apart. >> we had a representative from the white house involved in all of this. state lawmakers watching all of this. no b.a.r.t. strike tonight at midnight. the trains will roll tomorrow morning. tomorrow afternoon and tomorrow evening for the commute. what happens tomorrow night, monday night at midnight remains to be seen. both sides are supposed to get back together 24 hours to try to hammer something out. so we will, we do know there will be no strike tonight and that's the good news and we hope that something can be worked out in the next 24 hours. we will get back to b.a.r.t. in a minute but good evening now and welcome to this late
