the evening commute disrupted by a b.a.r.t. emergency. smoke pours from beneath a train filled with passengers at the height of rush hour. >> it has been a bad week for b.a.r.t., still staggering from a bruising strike and the death of two workers, now a fire breaks out on the underside of a commuter train. that train stopped at the

orinda location. drivers started calling the ktvu newsroom. the fire was first reported at 6:08 tonight. the train was headed east beamed. the good new -- eastbound. the good news, everyone evacuated safely. heather, any news on what caused the fire? >> reporter: b.a.r.t. technicians have determined it was an electrical shortage. we've been watching them for hours now. you can still see some yellow tape blocking off the area in question. but again, a b.a.r.t. spokeswoman telling me they have identified the cause of this fire. the commute home came to an abrupt end for weary b.a.r.t. riders just days after a strike shut down service for four days. an equipment malfunction led to smoke and flames. >> they told us to get out and yeah, we smelled the smoke but seemed to get progressively worse. >> reporter: passing motorists

captured the scene. take a look as heavy smoke billows from the train. at one point, you can see flames. >> we had 23 firefighters respond. >> reporter: the fire chief says it was a challenge putting out the fire. >> there is a small fire that is proven difficult to get to. we're going to have to cut through with saws to get to it, but we had to shut off the circuit breakers. there's still stalled energy in the car. >> reporter: technicians determined the smoke was billowing from a semi conductor. >> when i got out of the car, i started noticing smoke. >> reporter: no one was hurt. everyone was evacuated safely, but for b.a.r.t. riders who just endured a bitter labor dispute it was another commute nightmare. >> what will you do now? >> i'm going to go back to

and jay martinez sent us this photo. again, you can clearly see the billowk smoke right underneath one of the car doors. in 15 minutes, the investigation into last week's deadly accident on that same b.a.r.t. line. the ntsb trying to re-create what happened, as they search for answers. community members in an tay rosa are demanding justice tonight. they learned the gun was an air soft. ktvu's ken wayne talked with a witness who says he saw deputies shoot the boy after he was already down. >> reporter: julie, a couple dozen people are still here at the spot where the 13-year-old boy was shot and killed yesterday afternoon while carrying what authorities say was a very realistic looking assault rifle. dozens of people marched through the west santa rosa neighborhood where the 13-year- old boy was shot and killed by

one of two sonoma sheriff deputies. deputies parked their patrol car, and told the teen twice to put down the gun, instead, they say, the boy turned with the barrel of the gunpointing toward them. >> the deputy fired several rounds from his service weapon at the subject, striking him one time. the subject immediately fell to the ground. >> reporter: one neighbor told me different. >> he was moving, like he was trying to go down. >> you're saying he was down on the ground after you heard gunshots and they shot him again. >> yeah, exactly what i saw. >> reporter: authorities haven't responded to that allegation. police displayed a real assault weapon and the air soft carried by the teen, to demonstrate how difficult it is to tell them apart. one neighbor said police should know the difference. >> if you're on law enforcement, your job is to know what's real and what's fake.

parole and had a prior warrant for resisting an officer. a 17-year-old boy is behind bars in vallejo tonight in connection with the killing of a 35-year-old woman. police identified the victim as shauntanai brown. the killing is vallejo's 19th homicide of the year. oakland police are preparing for what could be a tense protest on friday. they're expecting an occupy protest. protesters say they plan to protest peacefully outside of the oakland marriott. the event brings together law enforcement to train for disasters. friday also marks the second anniversary of the day police first removed occupy campers

the death of a worker at the 49ers new stadium site. two workers have died in separate accidents at the $1 billion construction project in santa clara. first, 63-year-old donald white, who he was on a ladder in an elevator shaft. earlier, telling the elevator company, there was no violation in white's death. now cal osha has decided to reconsider. >> some questions arose, and for that reason, yesterday a notice of no violation rescission was sent to schindler and the investigation is now ongoing. >> cal osha won't say what questions arose. the agency is expected to make a final decision about whether there was a violation at the work site by december 11. dave cortaze is throwing his hat into the ring to

announce his candidacy for san jose mayor. chuck reed finishes his second term next year. others in the ring include vance winn. police in oakland say they confiscated money, and drugs while breaking up a gambling operation. authorities say besides the guns and drugs, they also confiscated gambling machines and recovered high end bicycles, guitars, cell phones, and tablets all believed to be stolen, and being ready to be fenced. >> a lot of times people think it's gambling, what's the big deal? a lot of these gambling establishments have a lot to do with other crimes around. >> police say officers arrested eight people, and recovered

saw something new today. palm trees are planted on the oakland side, between the eastbound, and westbound lanes. jana katsuyama tells us this new landscaping is raising some questions. jana. >> reporter: julie, you can see here that there is landscaping near the toll plaza, but just on the other side, we noticed today that it was looking a little more like sunset boulevard, so we investigated. how much will these palm trees cost, and whether the falling frawns from the trees might cause a hazard. four new palm trees that popped up. >> these are canary island day palms. there the same kind of palm trees along the embarcadero. >> reporter: this artist

rendition shows the final plan to plant 30 of the palms. caltran says each tree will cost about $15,000 to acquire and plant. about half the budget for the $900,000 landscaping project. caltran says a palm expert scoured the bay area, and purchased mature palms from businesses and homes as far away as sacramento. the trees stands 20 to 30 feet tall, and can grow as high as 50 feet, and that worries some people. >> my main is concern is the palms falling off the tree, and causing trouble on the bridge. >> i'm sure the roads could be better. there's so much stuff to be improved in the city. >> reporter: a san francisco public spokesperson told us they are well suited to with stand the bay area wind and fog. >> we'll have a maintenance program to ensure they remain

healthy, and that they're trimmed properly, to ensure that in the event of a storm, or windy weather, we're not using them out into traffic. >> reporter: caltrans tells me, they plan to plant for more trees tomorrow, and have 30 more in place by spring. the last patient treated at san francisco general hospital for the asiana air crash has been released. the female patient went to a rehab facility. she was in critical condition when she was arrived a the hospital on july 6, doctors said she had a spinal cord injury that caused paralysis and a number of other injuries. during her stay, she underwent 30 operations. however, the doctor added that when the woman left the hospital yesterday, she was smiling. it was one of the most

memorable images of the occupy movement. a police officer pepper spraying protesters. today, the university announced john pike was awarded more than $38,000 in worker's compensation for suffering he faced after that incident. pike received 20,000 angry or threatening emails, texts and letters. the parents of two boys who were wounded in this week's shooting at sparks middle school near reno say they don't believe the 12-year-old shooter targeted their sons. the boy killed a teacher and then himself monday with a semi automatic handgun he brought from his home. some say the kid was trying to get back at people who bullied

him. but police haven't confirmed that. this is a look from news chopper 2 at the reenactment that was staged today along the same stretch of track where the two men were killed. the ntsb shut down the rails for several hours, so federal investigators could analyze the incidents. >> reporter: news chopper 2 was overhead as a four car train left the walnut b.a.r.t. station. at 1:50, the time the accident happened, it passed the spot where two men were struck, and the train hit the brakes. next to the track were two life sized mannequins. today's reenactment is the latest step in the investigation. he says the ntsb's methods are the same.

bike safety measures are being fast tracked in san francisco after a string of deadly accidents. noel walker is in the city tonight at an intersection where a muni bus rider killed a bike rider. >> reporter: we're learning that muni's director of transportation ordered all 800 buss in its fleet be inspected for safety guards that might have been missing from a bus that hit and killed a cyclist ere at the corner of bryant and 11th. >> reporter: a large vehicle and a cyclist dead. this last accident friday was the fourth deadly accident south of market this year. >> safety is our top priority.

designated crossing. an elderly san francisco couple has lost their eviction fight and moved out, despite a surge of community support. the lee family left their apartment at the base of knob hill late yesterday. that couple had lived in their two bedroom apartment with their disabled daughter for 34 years. the pending eviction grew angry protests, the building is set to be converted into tenancy in common units. advocates are trying to find the couple a new place to live that they can afford. people who enable this feature in google will be able to use a mouse or track pad to write words. it joins another feature that allows users to write a search correctly on the screen. the new function is geared at non-english speakers and is available in more than 50 languages. a coffee giant is branching out into tea. starbucks is set to open its

allen gardener was arrested. prosecutors say he took the 82- foot sail boat and told two friends that he owned it. the two spent a night eating pizza, and drinking beer on the yacht. his attorney claim he was a vietnam vet and was delusional, believing the boat had been left to him by relatives. as for the damage to the boat, gardener was supposed to pay $1.8 million to the owner. the mayor calls it a black day in lodi after four members of a family were killed in a crash. all of those killed were when an extended cab pickup truck. the dead include three children. a 4-year-old girl. a man and woman were also killed. she was 7 months pregnant. a 9-year-old survived, but is in critical condition.

police say they're still unraveling what led up to yesterday's accident. it happened on a city street outside of a middle school. advocates are hoping to chip away at a sad statistic with a safety week for teen drivers. the national highway traffic safety administration says car accidents are the number 1 killer of teens aged 14 to 18. distractions and experience and failure to obey traffic laws are blamed for many of those crashes. the campaign challenges parents to be good role models behind the wheel, and practice driving with their children. a city worker accused of running over, and killing a woman, accused of lying in the grass at holly park, appeared in court today to enter a plea to manslaughter charges. as david stevenson tells us, the defense offered its explanation about what led up to the tragedy. >> flowers and photos mark the site in san francisco's holly park, where christine was killed september 25. the recreation and parks person

accused of running her over heard the charges in court. >> gosh, that was an accident, absolutely. >> friends and family filled half of the courtroom, as his attorney entered not guilty pleas on felony vehicular manslaughter and hit and run charges. prosecutors said he recklessly veered off the path and ran her over. >> the dog scampered out from underneath the car, and he thought it was okay. but then he started to think that maybe he hit something else, because he mentioned that he had seen a baby about 45 feet to the right. >> reporter: his attorney says he left the scene, but quickly notified a supervisor, and cooperated with police. prosecutors said he told his supervisor, quote, i hit something, maybe a dog or child. >> the right thing to do would have been to come to a stop,
