dollars the oil dropping by $2.01.potbelly shares were up after the close on its on first earnings report. shares shot up 5% after topping estimates. starbucks owes kraft $2.2 billion after the coffee chain ended its grocery store deal early.bloomberg news reports-- j&j will spending $4 billion dollars to settle more than 7,500 lawsuits over its recalled hip implants that allegedly caused tissue damage. jim richter of performance trust joins us on this wednesday morning for a close look at the bond market. good morning to you. > >good morning angie. > >what will you be looking for in the market today? especially on the heels of that auction that we had yesterday in the market. > >the auction may have been relevant. i think bigger news that the bond market is still wrestling with is friday's non farm payroll. it came out much

larger than expected and it had a pretty violent impact on treasures. they had a pretty significant selloff across really anything longer than five year maturities and out. it was a painful day and i think the market is still wrestling with is the market gonna taper as a result of the news on friday. > >exactly. my personal opinion is there might be the possibility of some taper action before the end of the year. i know a lot of people probably disagree with that, but what is the bond market telling you? > >if you look at what happened on friday the 5-10 year part of the curve sold off 11-14 basis points---that's a big move. and the long bond was off about the same amount in yield. down about 2 and a half points in price. so clearly there is fear in the bond market right now that the fed's got enough information for them to begin to taper. > >what are you seeing as far as rotations between stocks and bonds? inflows and outflows? > >the main thing that we're focused on right now in the fixed income side is outflows and municipal bond funds. we've had about 24 straight weeks of municipal bond fund outflows.

but yo've also got other institutional investors that are stepping into that market that are creating liquidity where there's opportunity. we don't see major switches going on but there's definitely some disruption right now in the municipal bond market. > >interesting. good to know. thank you and have a good trading day. > >thanks angie. you too. corporate america responds to the crisis in the phillipines.as government donations pour in from around the world, companies are contributing millions in aid for the victims of typoon haiyan.hsbc, samsung and the nba have already sent large relief donations.royal caribbean, ikea and toyota are also offering help. the president of the philippines now says the death toll may be around 2 thousand, far lower than earlier estimates of 10 thousand. if you are looking to help -- donations can be made on the philippine red cross. in the u.s.a major hurdle has been overcome to create the world's largest airline. the justice department has reached an agreement with us airways and american airlines. before the two can merge, the airlines will selltakeoff and landing

slots in dc, new york, chicago and other airports. the slots will give competitors more access to those hubs.the government feared the merger would lead to higher ticket prices for consumers. now, officials say the merger should be set to fly by december, pending court approval.shares of both airlines took off yesterday, with u.s. airways closing up 1%.amr soared 26%. japan's mitsubishi makes what has to be a tempting offer to boeing.the heavy industries company says it could build the wing's for boeing's next jetliner, the 777-x, in japan. mitsubishi promises boeing considerable cost savings. the offer comes as 31-thousand union members are voting today on a boeing labor contract. the vote will determine if the 777x

will be built in washington state. dominic gates, aerospace reporter at the seattle times, has also spoken with mitsubishi. "i have talked to mitsubishi and they don't expect to build the triple 7x wing. if this votes goes "no" they may approach mitsubishi and see what the possibilities are, but i think boeing wants to build the wing in the united states. it wants to build it itself." boeing says publicly that if the union rejects the contract offer, the company's threat to take the work else where is "not a bluff" at least two major airlines will soon make it harder to use frequent flier miles.both united and delta are said to be raising redemption requirments. although, some flights need fewer requirements.changes to the programs start february 1st.

the federal government has fallen drastically short in its sign-up goals for the affordable care act.according to the wall street journal fewer than 50-thousand have successfully enrolled. the obama administration had hoped that by this time 500-thousand would have enrolled. the administration is expected to release its own enrollment numbers this week. president obama is naming a new head to the commodity futures trading commission. his pick is timothy massad, who spent the past three years running the government's troubled asset relief program, better known as tarp. the president used the nomination as a chance to call on congress to completely fund the commodity futures trading commission. the current cftc head is due to depart in january.massad's nomination requires confirmation by the senate. the supreme court will decide a case related to bernie maddoff scandal. according to usa today the high court will decided whether jp morgan chase and other banks should pay for not taking a more aggressive approach against madoff's multi billion dollar ponzi scheme. the securities investor protection corporaiton argues investors should be part of the funds that are recovered from the scam.

sea world is in the midst of a whale of a fight. the theme park is now asking a federal appeals court to overturn safety citations and a ban by the occupational safety and health administration.the osha ban restricts how trainers interact with killer orca whales during performances.the ban follows the death of a trainer in 20-10, which was documented in the film "black fish" . osha claims workers are exposed to a "known hazard" in the workplace.sea world has already successfully had the fine reduced from 75-thousand dollars to 12-thousand sea world stock rose 2% yesterday. sotheby's posted a loss in the latest quarter. but it was less of a loss than predicated by wall street analysts.third quarter results improved at the auction house on revenue growth from modern art and commissions.investors bid up the stock by nearly 2% yesterday. hedge fund manager daniel loeb tells cnbc-- the company has "hidden" value and is a remarkable global luxury brand.loeb is currently attempting to oust the ceo of sotheby's.

it sounds like men's wearhouse may be changing its stripes when it comes to an offer from jos a banks.the smaller jos a banks made an unsolicited $2.3 billion takeover bid for men's wearhouse that was flatly rejected as way too low.now comes word that hedge fund - eminence capital- has purchased a 9.8% stake in the company. eminence is reportedly urging men's wearhouse to take a closer look at the offer. investors seem hopeful -- men's wearhouse stock has been rising on the news out of eminence. fewer americans are falling behind on mortgage payments.transunion credit reporting agency says it's due to rising home values, low interest rates and improvements in the job market.in the third quarter-- late payments fell to 4.09% from 5.33% a year ago. that is still however, above the average historical range of 1 to 2%. a growing company proves 'honesty' is the best policy. "the honest company", which was launched by actress jessica alba in 20-12, makes non toxic products for infants and other eco friendly household items.

the line said this week its raised 52 million dollars in less than two years.it says it plans to use the money to expand overseas and develop new products. in just 3 years-- the u.s. is set to become the number one producer of oil--surpassing saudi arabia.the international energy agency predicts -- by 2016 the u.s. will be closer to no longer depending on foreign oil.it's a dramatic turn of events that is shaking up the oil market. "traders were waiting for this thursday's eia data before they sold ahead of options expiration not really making any big bets but now with this news breaking as well as the market violating technical levels you see the market sell off, traders are a little trigger happy you could say." that was bill baruch of ii- trader-- and here's the steep sell off.oil futures fell more than $2 per barrel tuesday. the report adds that by 2020 the oil boom will slow in texas and north dakota- and the middle east will be back on top. in two words, height matters.especially when the combination of money and pride seek to build the tallest

anything.our cover story takes a long look up at the competition for tallest building in north america. spoiler alert--the title won't be in chicago for much longer. at 14-hundred 51-feet, the roofline that caps 110-stores of chicago's willis tower renamed from sears tower in 2009, makes it the tallest building in north america. but next year, it's 40-year reign will end--- replaced by new york's new one world trade center---making chicago "second-city" again. "no, no no, no. nah,no." the council on tall buildings and urban habitat, an international group of architects and engineers determined that a spire that will hold a beacon one-thousand seven hundred seventy-six feet or 1776 atop one world trade center is a permanent part of the building.---unlike the numerous communications antennas that extend from the willis tower. "the difference between spire and antennae is all about permanence. a spire is integral, never to be taken away." "the spire is an accessory. this is an actual building...and

ours is the tallest because it goes all the way up." phyllis parker has a point. chicago's willis tower keeps it's title of highest occupied floor. in other words the roofline in chicago is higher than the one in new york-- which, some would argue, is the heart of the building's purpose. "so what's more important roofline or top of the spire? roofline. there's a space you can use for people." "you could have the highest office. you could look down on them. no. they still have an accessory. we still have the tallest." being tallest is, by definition, relative. once finished, one world trade center will be third tallest building in the world. a list topped by the 163-story burj khalifa in dubai---that pierces a-half-mile into the sky. willis tower--tenth, but still beyond measure on the fear-of-heights scale. "would you stand in one of those? no, no." "the reason we build so tall is not because it's efficient, it's to say something." "now, these buildings are being built to put cities on the map. just like chrysler put car companies on the map. they're used for branding." the competition for bragging rights was heated. just before

toy craze like "rainbow loom" that i've been so excited about. it really encourages children to get away from the tv, away from iphones and ipads and electronic devices." creativity and quality are top criteria used by 17-year business owner katherine mchenry... and other members of the american specialty toy retailing association... when they choose the 'best toys for kids award winners' that often sell well during the christmas shopping season.toddler puzzle "bunny boo" and building sets like "q-ba-maze"and "squigz" are among this year's top picks that aren't in any big box store. "thousands and thousands of products are made new every year. some never make it to a shelf. many hope to make it into a store like ours." katherine says toy makers can call her directly to try to convince her to order their latest innovation. "the most likely chance for a small company to be successful is to market to a store like us."

make this work for you? > >i was just like any other person in a corporate job that didn't like what he was doing---was frustrated and was trying to find another way to supplement his income and perhaps find a new career path. trading part time while i was working for a large company allowed me to eventually through frustrations, through trials, through experimenting. i eventually evolved my trading into a successful strategy that allowed me to trade full time. > >what do you reveal in your book? how do you make this work when you are just trading part time? > >i think it's important to recognize the office environment that you're trading in and depending on the type of office environment, it's gonna dictate your trading strategy. so if you have a high demand job that requires your attention 99% of the time, it's gonna be difficult to do a lot of day trading, so you're gonna be more like a position or a swing trader. that's what the case was for me. i was a swing trader while in corporate

america. > >is there a danger in doing this though when you're not full time into the market? > >absolutely and i think the danger is just as much as a full time trader. you have to have risk mitigation strategies. you have to put the stop losses in. you have to know where you're gonna get out of a trade before you ever get into it. you have to know where you're gonna draw the line in the sand. > >every trader that i know at one time or another has lost big money. did you ever have a really bad trade? > >absolutely. in fact, i had a lot of bad trades in the beginning and a lot of times it had to do with trading with too much capital. at first trading with more money than i was comfortable with. i came back from a meeting at one point and i realized i was losing on all these positions. i wasn't used to losing that kind of money and in frustration i broke my mouse. but after i broke my mouse i realized i hadn't closed out all my positions. so i had to go run across the street and get a new mouse, install that mouse, and then close out my losing positions. > >good advice though. know your risk and how much you are willing to lose. good to have you on the show this morning. ryan mallory and the book is, the part time trader: trading stock as a part time venture. thanks again. > >thank you for having me. just ahead a full-time trader tell us investors are in jolly mood over one sector. find out which one-- in chart talk!

show. it's been a while dan. > >thanks angie. > >i know it's early but we like to stay ahead of the curve. so are you feeling any holiday cheer on the trading floor? > >actually yeah, we are feeling some holiday cheer down here. the markets by and large have performed extremely well year to date so you're seeing pretty good satisfaction as far as the market's able to hold onto these gains. i can also tell you as we roll toward the holiday season, one of the sectors that's really outperforming right now is the retail sector. > >what are you seeing in retail stocks? > >you're seeing pretty good strength across the board. if you look at the etf which is based off the retail sector xrt. you're seeing that trading at basically all time highs. like i said, it's outperformed the rest of the market over the last couple of weeks. > >on monday we had yet another record run in the dow. so those are the big cap stocks. are you seeing any kind of rotation between small caps and large caps? > >actually yeah. that's an interesting question because over the last month or two, you've seen the small caps outperform the large caps--- where the russel was

outperforming the dow and even the s &p 500. but definitely seeing a rotation there in the last couple of weeks. where you're seeing the dow go to all time highs. yet you're looking at the russel and even the s &p where it's still lagging behind the dow right now. > >you know i have to ask you this---you're my resident bear trader. are you bearish or bullish on this market? > >there are some warning signs out there angie as we roll toward the end of the year. i think the market is probably going to be able to hold these gains throughout the rest of the year. but i have to say as we move toward next year there are some warning signs. i think the issue right now is you're seeing all these ipo's coming on and being swapped up and also secondary offerings as well being scooped up. it tells me there is a lot of oversupply in the equity markets right now. > >really? what other warning signs do you see? > >i think the fed is also indicating where you are seeing some of the news coming out of the fed where any inkling that they're gonna taper sooner rather than later has had a negative impact on the market. it certainly appears based on that jobs number that if we get another strong jobs number in december that the fed will probably start to ramp that up. > >thank you dan and come back soon. > >thanks angie. coming up tomorrow on our show.movies and money. our film critic will be here with his thoughts on the super hero scoring a win at the box office.plus a sneak peek
