administrators say they never intended to include an item that would provide eligible employees with six weeks of paid family leave. this contract release bid the board estimate that is if 1/3 of employees use the benefit it would use the district $44 million. a big mistake that raises the contract to $111.2 million. >> reporter: assistant general manager and another general last summer. a time line released tonight shows that the tentative agreement error was created by a temporary employee. b.a.r.t. says they caught the error november 4th. union members have already ratified the deal and union leaders told the board in public comment today they couldn't change the deal without starting all over with another vote. >> you must stand behind what

you sign. this was hard negotiations it was not done overnight. >> that is what you paid for. we have a signed tentative agreement that the district was full aware of what it contained. like we're fully aware of what their understanding was. and they are the same. >> reporter: board members say they want more transparency and account accountability around this mistake. and they say they just don't know if they'll be able to put this to a vote. jana katsuyama, ktvu channel 2 news. unbelievable they're at this point again. jana is there any talk about a possibility of another strike? >> i asked both sides about this and both of them said that they really want to do everything they can to avoid a strike. right now though there are so many questions, they're just trying to focus on how to bridge this last minute glitch that has come up when they thought everything was all said and done. >> all right, jana. thanks very much.

prepare the fourth bore to open in several hours. and so far traffic in both directions is flowing smoothly. around 8:30 tonight cal transmade what it calls a -- caltrans made what it calls a historic move. officials tell us this was the tunnel's final switch. chp warns drivers to expect delays in the next few hours as crews finish work to get the bore open. the open can't come soon enough for this driver. >> it's going to be bumper to bumper. hopefully this will change that. i'm praying. i hope so. >> reporter: the final stretch to a project that started four years ago to alleviate traffic back up. that's been a daily reality for the drivers in the area for decades. >> all this time i was wondering when they were going to open and finally they're going to open tomorrow morning.

through. continuing coverage of typhoon haiyan. the interior minister said this a situation such as this nothing is fast enough. helicopter crews from the u.s.s. george washington are delivering food and clean water to places that haven't seen any help since the disaster struck a week ago. in the heart hit city, a massive clean up effort is under way. the government raised the confirmed death toll to 3,600. more than 1,100 are missing and 12,000 have been injured. a vigil and rally was held for the typhoon survivors. people gathered in union square organizers with the national alliance for filipino concerns say the philippines is not prepared to handle disaster -- and they say there was a major

the robber used a scifi style gun and got away with an undisclosed amount of cash. he is described as a man with white hair weighs about 200- pound. a stolen suv that was used as a mobile teaching lab has been recovered but sadly the materials inside the vehicle are still missing. the vehicles owner peter mcgolles uses a lap to be and lego pieces too teach students. mardoles has since had to cancel all of his classes. continuing coverage of that little boy that turned into a super hero today in san francisco. and thousands of people showed upturning san francisco into gotham city. such a great story here so many people talking about it. it was all for 5-year-old miles who has spent most of his life

the courtroom. >> reporter: supporters of 16- year-old richard thomas attended this morning's hearing. the oakland junior is charged as an adult accused of setting fire to a skirt 18-year-old luke sasha fleishman was wearing while riding on a bus. his attorney described him as some what overwhelmed. >> remorseful. he has written some heartfelt letters to the families of the young man who was burned. expressing his extreme regret over the entire incident. >> reporter: police have said that thomas admitted to setting fleishman's skirt on fire because he's homophobic. his attorney says that he cannot everyone spell homophobic. >> there's members of his family that are gay. he cannot everyone spell the word homophobic. >> reporter: we spoke to thomas's cousin who is gay who

came to support him in court. adding the current charges could put him behind bars for the rest of his life.fleishman identifies as a gender, not male or female. fleishman's parents say all of the support really means something to sasha. thomas' attorney is going to file to have his client charged as a minor. the assemblyman who was shot and killed died from a single gunshot wound to the stomach. the los angeles coroner's office made the announcement today after an autopsy. police say 78-year-old joseph gotto may have interrupted a home burglary when he was shot. t joseph gotto's son mike gotto is a democrat who represents

los angeles in the california assembly. so far police have not announced an arrest or suspects in this case. the city council of toronto voted overwhelmingly today to strip the mayor of some powers. mayor rob ford has admitted to buying and using illegal drugs and driving drunk but he has refused to step down. the city has no legal way to remove him unless he has been convicted of a crime. ford says he plans to run for reelection. china has announced a major change to his unpopular one child policy. this is the first significant change in nearly 30 years. the communist government says parents can have a second child if one of the parents is an only child. couples living in rural areas are allowed two children if their first born is a girl. china's birthrate has falling and the country needs to increase it's young labor pool. an update on a little boy who brought thousands of people

story may have a halo effect on organizations involved in childhood cancer. reporting live in san francisco, deborah villalon, ktvu channel 2 news. san francisco supervisor eric marr apologized after an early instagram kid. marr wrote he was waiting for miles the bat kid and wondering how many thousands of san francisco kids living off of snap food stamps could have been fed by the dollars. his comments were interpreted by some to be criticism. his comments later said, he didn't want to diminish today's event but wanted to find for children living every day in children living in dire situations. and more on an attack on a woman in san francisco. it was a horrible attack and police have now arrested a suspect after watching this video that ktvu first aired one week ago. a 28-year-old man from oakland is now facing seven counts of

aggravated assault. ktvu's david stevenson says police say that system has now confessed to that horrible beating. >> reporter: the attack was sudden and vicious. an attack on a homeless woman is sleeping on a sidewalk. the attacker approaches and beginning stomping on the woman's head before walking away. >> we didn't realize there was an assault until ktvu found the video. >> reporter: san francisco police say a 911 call brought them to the site. but the victim told them that nothing happened and she left the scene. investigation prompted the investigation. police say he confessed to the crime. >> what did he tell the investigators? >> i don't have the exact nuances of what he said. he did speak to our investigators about the assault, about the crime that occurred. >> reporter: chase is charged with seven counts of aggravated

assault with force. police say they located and reached out to the unnamed victim this week. >> i don't believe she is in the hospital, at this point she is refusing services. >> reporter: an estimated 20% of san francisco's homeless population are women. >> it does show that the streets are dangerous for people to live on and really focuses on our efforts to get people to go into shelter. >> reporter: timothy chase is being held in jail on a $350,000 bail. police sources say he also has a criminal record in alameda county. in san francisco, david stevenson, ktvu channel 2 news. san jose police say a motorcycle officer suffered serious injurys in an accident involving another vehicle. it happened at around 11:30 in the intersection of north fourth. the officer was hospitalized and is expected to survive. there's no word yet on exactly what happened.

trike -- bird strike forced a plane landing. that strike damaged the engine and forced the pilot to return to san jose. >> then all of a sudden a big deceleration. and you could feel that things, the engine was running down. it was just stopping. so, a little bit harrowing really. >> a federal aviation administration reports from february to july of this year there's been 46 bird strikes at the airport in san jose. officials say they are using techniques to try to keep birds away from the area. those techniques include using sirens and pyrotechnics to scare the birds away. some serious questions are being brought up after the death of a tsa officer. the gunman was in custody for all by five of those minutes. it's not clear if hernandez

could have been saved if paramedics could have gotten to him sooner. police say they plan to investigate. >> in washington, the measure would allow americans with cancelled policies to have them reinstated even though they don't meet the laws retirement. and it goes further letting insurance companies sell similar policys to new customers. minority leader nancy pelosi said it would pull the plug on health care. >> the idea that it was helping consumers who the trojan horse who's underbelly is poisonous. >> reporter: president obama did offer a similar plan for those with cancelled policies. but it was limited to one year. today he met with insurance company executives to try to convince them this will work

despite their skepticism. california's health exchange says it's unclear how the president's directive will affect people here who have had their policies cancelled. they're analyzing the options. stock markets ended the week with more gains and new record highs. the dow set a record after increasing 85 points and is now getting very close to the 16,000 mark. the nasdaq reached its highest point in 13 years adding 13 points. a judge in san francisco ruled that a billion dollars lawsuit against standard and poors can move forward. the lawsuit is aimed at recovering money the state's pension system lost in the collapse of the housing market. attorney general camala harris claims pension officials bought mortgage backed securities because standard and poors had rated them as aaa. but s & p argued their rating is simply an opinion and that they are protected by state law. according to business week,

ktvu newsroom tonight from richmond. that's where two passengers were injured when a stolen car hit another car. the driver took off running it was captured a short distance away. police tell us that officers started chasing the car a few minutes earlier but backed off because it was going too fast. the crash happened at third street and barrett avenue. one passenger suffered moderate injuries and was taken to the hospital. the other had minor injuries. problems for hundreds of city employees in the east bay. now the city of richmond is trying to figure out what went wrong with its direct deposit system. john sasaki tells us of the quick work done to get everybody paid. >> we didn't receive our direct deposits. >> reporter: we learned that the city of richmond's direct deposit system is out of order.

>> it didn't hurt me so much because i have an appropriate amount of savings to pay my mortgage. but i can see how it could affect people that don't have the back up plan like i do. >> reporter: no one got their money automaticically. but to make sure that everyone got paid the city worked overtime. chris magnus is acting city manager. >> the finance employees and hr officials worked overnight to make sure the officers got their paychecks today. >> reporter: anyone on vacation or other wise out of commission could have had bigger problems. >> we work together and if they are aware of it and they know they need to have it deposited we can go deposit it for them. >> reporter: if the city had not turned the check over quickly, the situation could have been a lot worse. >> we value our employees.

it's important they get paid in a timely and predictable way. when that doesn't happen. no one likes that. so we're very sorry this happened. >> reporter: they plan to have it solved and fixed before the next payday. in richmond, i'm john sasaki, ktvu channel 2 news. a toll increase is in the works for the golden gate bridge. the board of directors today received four options aimed at helping close a $142 million budget gap over the next seven years. each option uses a different formula to raise the tolls but all take the fast track toll to $7 and the nonfast track toll to $8 by the year 2018. the public will have a chance to offer input. the first toll increase could come in april. a nice day out there today. temperatures in the 60s and low 70s. continued cooling as we head into the bay area weekend. not as warm as tomorrow.

these were the numbers for today. they were pretty nice. we've had a nice run of weather as you know. we've been dealing with temperatures that were in the upper 70s. tomorrow's highs mostly in the mid- and low 60s. so there's that cool down. and the cool down comes to us i pointed out earlier in the form of this. you can see where it's coming from. straight down the pike here. this thing is a northernly system. it's pretty cold. it's chilly. it shouldn't bring rain but it'll bring some rain into the area. it'll bring breezy conditions. tonight's temperatures are going to get down there. we're going to look at upper 30s and mid-40s. mid-30s and upper 30s. as we get into sunday morning and we get into monday morning we're going to look at the temperatures into freezing levels in a lot of the inland bay valleys. tomorrow morning when you get going you'll notice it's cool out there. the forecast for tonight mostly clear. cool there's no fog along the coast. there's no valley fog to speak of. tomorrow's temperatures still in there but not as warm as they have been.
