more information about the death of a patient at a stairwell at san francisco general. but a key question remains, could her life have been saved. good evening everyone i'm frank somerville. >> and i'm julie haener. it is one piece of a puzzle. we now know the official cause of death of a patient. the medical examiner issued it's report on lin spalding today. it links her death to

alcoholism. spalding likely died after becoming becoming delirious and liver damage. tonight we have continuing coverage. ktvu's patti lee is live, and spalding friends are far from satisfied. patti. >> reporter: the spalding camp tells us this medical examiner report is so incomplete it will be calling for a grand jury investigation. she was missing 17 days. now after two months of waiting, an official report on her death. probably electrolyte inbalance

with deliria or dehydration. but the report found no evidence of alcohol or drug use at the scene. and no signs of trauma. the spalding family spokesman is furious. >> the calls of lin spaldings' death is neglect and malfeasance on the fault of the san francisco hospital and the sheriff's department. >> reporter: david perry had hoped to learn if she suffered long on the stairwell. the coroner did not supply time of death only that she was deceased for days before being found. >> reporter: dr. shevon read the coroner's report. her infection increased her

need for water. >> dehydration means one thing to me. lynn spalding had access to water, and food, and medical attention inside the san francisco general hospital. when we were told outside the hospital for her means she died of neglect. she starved to death. >> reporter: the spalding family's lawyer also blasted the medical examiner's report. questioning how he was able to determine that spalding's death was due to chronic alcoholism but not able to pin down her time of death in the stairwell which is information that investigators have also been waiting for to move forward and finish their reports on what happened here at san francisco general hospital. live in san francisco, patti lee, ktvu channel 2 news. more details now the san francisco sheriff's department handles security at the hospital. and we're still awaiting the results of its internal investigation. preliminary findings suggests when spalding first went missing the deputies were

confused about her race. no one ordered a full inspection of the hospital until nine days after she disappeared. and even after someone reported spotting a person on the stairwell, that stairwell was not searched. new information about the two b.a.r.t. workers killed by a train during the b.a.r.t. strike. according to the oakland tribune the autopsy report found that the men were facing away from the train and that they were ignoring procedure that one of them act like a look out. they were inspecting a dip in the track when the train hit them. b.a.r.t. has since tightened procedures as a result of the accident. the ntsb is still investigating. another week has passed and there's still no resolution to

the contract dispute. resolutions did continue yesterday. the sticking point is disputed clause in the contract that provides union workers with six weeks of paid family leave. b.a.r.t. says it was accidentally included in the contract. the unions say both sides agreed to it. we have new details tonight about a shooting at a high school in colorado today that has left a community stunned and saddened. >> it's the holidays. it's christmas time. this doesn't happen to people. this just doesn't happen. it hit way to close to home. >> reporter: the teenage gunman is identified as 18-year-old carl hoberson pierson. he killed himself. carl went to the school looking for the librarian who kicked him out of the chess club. the incident occurred in the denver suburb of centennial near columbine.

as alicia acuna tells us, a teacher may have saved lives. >> reporter: a student came to look for a teacher, when that teacher left, he opened fire on the school. >> every student was confused. like we heard two more shots and all of a sudden we booked it. we ran to a sprinkler room and just kind of hid in there and locked the door. >> we heard the gun -- gunshots. we all got in the corner. we all tried staying as quietly as possible. >> reporter: the teaching being targeted exited quickly to stop the loss of life. >> in my opinion the most important tactical decision that could have been made. that he knew he was the target and he left that school in an effort to try to encourage the

shooter to also leave the school. >> reporter: arapaho is just 8 miles from columbine high where 13 students were shot to death in 1999. and saturday marks one year since the sandy hook elementary school shooting. both incidents on the minds of anxious parents as they waited to get the all clear from first responders. >> scared to death. scared. we moved here right before columbine so, i'm very nervous. >> reporter: the sheriff's department says the shooter was likely acting alone. there's still no word on the motive. in centennial colorado, alicia acuna, fox news. more details now, members of a squad car went to a home. two molotov cocktails were found at the school. officials are looking at his car and another house he had access to. there are events around the

country around the somber anniversary of the sandy hook massacre. at a bay area gathering, people asked why more has not been done to stop the violence. >> charlotte bacon, 6 years old. >> reporter: each name. each child lost, a reminder of that horrible day. 26 gunned down at sandy hook elementary. >> we were all so saddened and upset about the new town tragedy. but what have we done? >> reporter: not enough according to the grady campaign. they and their coalition plan to rally today. news of another school shooting this one in colorado. >> today, of all days we have another event at centennial. we need national policy. we need a national result. >> these kind of rallies, these kind of events just simply

police released this picture of the assault rifles, ammunition. they say they found the guns at a home on the 600 block of caroline street. they arrested 32-year-old howard of vallejo. j era mone howard and kiano hodges both of san francisco. -- do you have a second to talk about environmental justice. administrators stop an effort to start -- the group say it is sierra group violates its own environmental process by serving the evictions.

exceed federal limits and be ready because there could be more next week. an earthquake rattled the bay area late this afternoon. the epicenter with 7 miles west northwest of cuperitno. there are no reports of damage or injuries. federal aid is now on its way of communities in mariposa counties devastated by last summer's rim fire. governor brown repealed the decision that denied the state's request for aid. the governor asked president obama to intervene and he did. the wildfire was the largest in state history. it started in august and burned 1,800 square miles. a fight on the san mateo bridge led to a man jumping from the bridge right into the water. news chopper 2 took these

pictures while the man was clinging to a rope and then swam to a rescue boat. he and his wife were arguing inside their suv when it crashed into a guardrail. the couple then got out of the car and the argument turned physical. the man was so upset he jumped 15 feet into the water. rescuers were so busy getting a man out of emeryville. a good samaritan pulled the man out of the water while fire officials secured the boat. paramedics said he was cold but in good condition. city crews in milbrae are trying to figure out why a half dozen water lines burst overnight leaving dozens of people without water. the pipe failures may be a sign of a deeper problem. >> reporter: the first water pipe broke around 11:30 last

night and by early morning, millbrae reported dozens of broken lines. while the crews were replacing the pipes. bruno was just returning home from the market. >> i have live crab here. >> reporter: she had planned on putting them in a pot of boiling walter but there was a problem. she had no water -- boiling water but there was a problem. she had no water. >> i can't imagine myself going to work without washing my hair. >> reporter: officials say the pipes are 65 years old and were only built to last 50 years. but why so many breaks in a short time span. >> it's not easy when you don't have your water. you appreciate it. >> reporter: the millbrae mayor says it may be time to replace the system but there isn't money to do that. >> 65 year old pipe. we really do need to look at

we are learning more tonight about the man killed in the fiery crash on interstate 580 in livermore. and the man accused of causing that fiery collision. the drunk driving suspect is no longer behind bars. >> reporter: 53-year-old garcia walked out of jail today free. the sheriff's department says on $125,000 bail. yesterday morning chp says garcia failed a sobriety test and was arrested on suspension of vehicle manslaughter. he crashed his hummer into a

jeep cherokee. killing the jeep's driver 25- year-old reed whitacker. tonight the jeep barely recognizable as it's been kept. reed was dedicated to his job and will be missed and shep -- she was not the only one to say that. >> reed was always an incredibly caring, compassionate and devoted human being. >> reporter: eve grau owns royal ambulance. >> he was all about helping others. he was about helping his community. he was about helping those who needed the help the most. >> reporter: while garcia is free on bail. whitaker is being mourned by those who loved him. his friends and family. at their home today his family through a family friend declined to speak to us about the loss of her son.

new video tonight from east oakland where police are searching for a man they say robbed a woman at gunpoint. it happened around 7:45 at the bank of america at the east mont mall. we're told the victim was using the atm there when she was robbed. the victim was shot but her injuries are said to be nonlife threatening. the weapon may have been a pellet gun. bay area police departments are launching their holiday dui crack downs. it comes as restaurants and hotels are seeing a resurgents in book ins for holiday parties. debora villalon live in san francisco where police just put up a checkpoint screening for drink drivers. >> it's been going about an hour. we're on the engle side.

this checkpoint is located in order to intercept impaired drivers before they get to the freeway. tonight we crashed a company party and we found everyone well aware of the dui risk. >> more than friday's happy hour, these are happy attorneys. shedding their coats and briefcases for some bubbly as the law firm hosted the first holiday celebration out of the office in six years. >> what we would like to say, we appreciate the work you do. with the recession well done. we decided to step out and have the party outside of the office, again. >> reporter: hospitality workers are happy those hungry years are over. this party space is booked every night in december.

getting home tonight. >> cab. >> my husband is picking me up. >> reporter: everybody very aware. >> absolutely. >> reporter: we counted at least a half dozen of these checkpoints around the bay area tonight. and this one in engle side will be running until 4:00 a.m. twitter did an about face after a public outcry , twitter restored a feature that allows blocks. it twitter said on its blog it never wants to introduce features that make users feel less safe. a carjacking led to the arrest of a boy that isn't even old enough to drive.

and that arrest is one of many in the area. >> reporter: racing down adeline street but stopped with a pit maneuver the stolen honda crashed through the front steps at oserine scott's home. >> i heard this boom, boom. >> reporter: it also damaged a car parked on the street and another in the driveway. this woman's mother owns the car on the street and says the crash could have been much worse. >> oh my god. yeah. so scared. because it's a new car. you know and about the people too. >> reporter: this faux toe -- photo was taken by a near by worker. >> i was 13, i was thinking about trying to get to high school. >> reporter: some police sources told us they had previously dealt with that teenage suspect. the carjacking happened this morning to a 78-year-old man. >> was the victim hurt? >> no i think he's shaken a little bit but i think he's fine. >> reporter: yesterday morning just three blocks away at sixth

and alice was another carjacking. and residents who didn't want to go on camera said earlier this week there was also a street robbery of a female resident. >> recently we have seen an increase of carjackings. we believe some of those have been related to robberies. >> reporter: now invest investigators are trying to see if they are connected to today's crime. >>s in the hol -- this is the holiday season. we typically see increased crime. >> reporter: in oakland i'm john sasaki. ktvu channel 2 news. $1 million. that's what it'll cost alameda county and its jail health care to settle a lawsuit. martin harrison died in the infirmary at santa rita jail. his family sued alleging the 59-

year-old was beaten, tased and improperly treated. only on 2 an exclusive ktvu field poll looks at california's opinion of congress and they're pretty dismal. the poll finds 11% of voters approve of the job the u.s. congress is doing. 84% disapprove. congressional republicans get a 20% approval rating. that's compared to a 72% disapproval rating. democrats fair a bit better with 34% approving of the job they are doing and 55% disapproving. about 100,000 mourners tried to pay their final respects to former south african president nelson mandela. but the crowd was too large and police ended upturning away about 30,000 people. today was the final day that mandela was lying in wake. his casket was taken away at the end of the day. it'll now be taken to his

the fbi says it's arrested a u.s. citizen for plotting an al-qaida style suicide car bombing at the wichita airport

in kansas. officers say they set up a sting operation to watch owen. he worked at the airport. owen wrote a letter to his family saying he wanted to carry out violent jihad against the u.s. the fbi described him as a lone wolf domestic terrorist. the public works board in sacramento approved the imminent domain request for a 2- 1/2 acre parcel in fresno. according to county records it's worth $2.4 million. new information tonight about a deadly offer involved shooting in saratoga. a sheriff shot and killed a victim on tuesday. we know learned that the deputy who showed him was aldo groba.

deputies were responded to a call about an attempted suicide and when they arrived marshall got agitated. >> he became agitated and came out with this 5-1/2 inch metal spike like object that struck the deputy in the arm. >> reporter: deputy groba is on administrative leave. another deputy was also injured her name has not been released. brandon marshall was taken to the hospital where he died later. san jose police say they're not sure if the bank robber suspect is the so called cotton ball bandit. the suspect was shot and wounded after a bank robbery and chase. he's identified as 60-year-old christopher wooten. police are still trying to determine if wooten is the cotton ball robber. that robber wore a distinttive hat. wooten reportedly spent 15 years in prison back in 1978. now that joseph naso has

been convicted and sentenced to death for killing four women. a marin county judge wants him to pay. the judge ordered naso to pay the county nearly $175,000 for expenses incurred during his trial. naso represented himself but there were costs for investigator, the public defenders office and making copies. while the game isn't over just yet. as san skro -- jose tries to lure the oakland a's. but it appear this is issue is going to be tied up in court for quite some time. a judge said he will likely rule that an -- san jose cannot approve an order. that anti trust clause gives major league baseball the power to decide whether teams can play. >> we want this decision to move up the chain to the appeals court ultimately the supreme court because we know

the mountain lion jumped over a 6-foot fence around a home and was checking out a large coy pond. the cat left the property and no one was hurt. months of training, hard work and dedication all paid off today for firefighters in san francisco. >> congratulations. >> 43 men and women were sworn in today. the fire chief says this graduating class is one of the department's most diverse and most qualifying. and for many of the graduates today's commencement ceremony is the fulfillment of a lifelong dream. >> growing up they were superhero. so i remember being younger and thinking i could never do that. after a while i started going toward my goals and finally reached it. another class of 36 recruits is said to begin in 17 weeks of training at the

academy in january. some south bay volunteers have given themselves just 48 hours to give a san jose middle school a total make over. ktvu's robert handa shows us the work in progress and tells us why organizers say it will benefit the whole community. 22-year-old herman gruel is back at his home and wants it to look for. gruel is one of the volunteers working on his school. >> i saw less and less resources. books and equipment like that was decreasing as i was going to school. >> reporter: tough time led to the effort. with materials and labor supplied by san jose, community groups and envidia. >> this is families and different disciplines. different communities and we're all here for the same purpose. >> reporter: the goal is not

just beautification. >> renovating the school is important for the kids to want to stay in school. >> if we don't reach them. other groups will reach them. >> we're doing a whole field for soccer, football, little league, for the community to come and use with lights and bleachers. it's just an awesome awesome thing going on today. >> reporter: gruell doesn't think kids will believe it. >> i think it'll be a shock to them because they're used to being overlooked. >> reporter: when students return they won't see a school that just looks different they'll see a different school all together. in san jose, robert handa, ktvu news. san francisco has settled with a senior care facility on accusations it grossly underpaid its employees. sunset gardens is an assisted living community. it settled with the set for $320,000 including back wages

and interests. the city's lawsuit addressed that the management forced the workers to work more than 10 hours a day. the fog is coming back in. a few patches along the bay. that could impact some of the viewing of the meteor shower for tonight. but if you're in the clear you may want to check out the meteor shore with one to two meteors a minute. as far as current temperatures as i mentioned it's cold outside. santa rosa 39 degrees. a few more neighborhoods up in the north bay to show you. we do still have some 30s to show you in parts of the region. and if that does come up i can show you here for san francisco. actually for the east bay. inland spots, concord 42. more temperatures inland. livermore 40 degrees. san ramon 37. all these neighborhoods on track to reach most spots back

down to the 30s. san jose right now 45 degrees. forecast for tonight partly cloudy and chilly. this weekend a warmer forecast here is our live camera looking out toward san francisco. and you can't see here in fact. those are oakland cameras switched up here. tomorrow morning in san francisco 42 degrees on track to reach the upper 50s by 3:00 tomorrow afternoon. and then the extended dry weather pattern. temperatures do eventually cool off between now and then a much warmer forecast for the afternoon highs. no rain clouds at least over the next five to seven days and possibly longer as high pressure in the short term is building in and strengthening. so we're going to warm things up for saturday. sunday will be the warmest day of the weekend. monday the warmest day of the week. by that time frame we could have a few spots flirting with the 70-degree mark. so here's the same patchy morning fog. hazy sunshine. possibly more spare the air alerts right into the weekend and into early next week because the weather pattern is not changing too much our air
