breaking news tonight reports of a 7-year-old girl kidnapped at gunpoint. an amber alert was just issued within the last 45 minutes. good evening i'm ken wayne. frank somerville is off tonight. >> and i'm julie haener. an amber alert just went into effect tonight for a 7-year-old girl missing from antioch. police say they're investigating reports the girl was abducted from in front of her home around 7:00 tonight.

debora villalon is live from outside the home. >> reporter: antioch police released this photo of 7-year- old natalie calvo kidnapped by a stranger from in front of his house here on humming bird lane just before 8:00 as she arrived home with her mother. now natalie had just gotten out of the car when police say an armed man grabbed her. >> the mother attempted to stop the male from abducting her daughter. and when she approached him, the male produced what's been described as a rifle. and the mom stopped, he was able to force the child into the car and then fled the scene. >> reporter: it's believed the mom and daughter were followed tonight from the antioch wal- mart store. that's how the kidnapper targeted them. natalie's mom is at wal-mart

looking at surveillance video in hopes of identifing the man. an attempted kidnapping almost identical happened last night at wal-mart. >> last night the mother in that incident reported similar suspicious circumstance. and was approached by a male kind of matching the description again of this evening's male. and the effort was unsuccessful. >> reporter: a statewide amber alert has been issued and the best description we have on the kidnapper car right now is that it is a gold older model four door toyota camry. natalie is filipino, 3'tall, 53 pounds. she was last seen wearing a pink scarf, pink sweater, gray stretch pants. it's also worth noting that the would be victim in last night's victim where the man met the same description, that little intended victim was also a 7- year-old girl and filipino.

now police are here in the neighborhood. they are canvassing. they are going door to door in hopes that neighbors might have surveillance system that is may have picked up a license plate. because as you noted the amber alert so far has a car description but it does not have a license plate and as everyone knows the hours after an abduction, a stranger abduction are so critical. and it's been more than two hours now. reporting live in antioch, debora villalon. we're going to stay on this story all night long. so stay tuned to ktvu and ktvu.com for the very latest on this amber alert. meantime two officers are on leave tonight after an officer involved shooting that left two people in the hospital. one of those men had a knife and refused to put it done. >> the officer had no other choice but to go ahead and discharge her firearm in the direction of the suspect. >> reporter: the man was shot

at least once and is expected to survive. police say both officers on scene were placed on leave which is standard protocall following any officer involved shooting. and new information tonight on san jose's first homicide of the new year. the victim has now been identified as 36-year-old juan rios sanchez of san jose. he was found in the driveway of a home on east san antonio street at 1:30 yesterday morning. sanchez was still alive at the time but he died at the hospital a short time later police say he was shot at least once. they do not think this killing is related to gang activity. health officials in the south bay are confirming the bay area's first death from the flu during this winter season. ktvu's jana katsuyama is live now in san jose and tells us this particular strain of flu is cause for concern. >> reporter: flu season has rolled in with the new year. and brought new concerns about

the spread of h1n1. >> it died down for a while and now you're hearing about it again. >> i received an e-mail from my manager. he said my whole family is kind of sick. >> reporter: today the santa clara county health department announced that a 49-year-old woman died on december 23rd. the county's first flu death confirmed to be from the h1n1 virus that was responsible for the 2009 pandemic that swept throughout the u.s. >> it's been circulating since. this year it's the predominant strain. >> reporter: this year two deaths including a 69-year-old woman in sacramento county and a woman from orange county. a the deaths jumped from eight to 59 from last week. every year influenza does cause deaths. >> 36,000 deaths every year across the country from flu is

the estimate. many of those deaths are people over 65. >> reporter: but the h1n1 strain is particularly dangerous. >> young healthy adults are more likely to become really sick from this than they would be from other flu strains. >> obviously it's a concern depending on how widely spread it becomes. >> reporter: health officials now are urging people to get flu shots and take precautions. >> if you have flu like symptoms and you're sick don't go to school. don't go to work, don't go to social occasions. stop the spread to others. >> reporter: more details now, the cdc recommends the flu shot for anyone six months of age or older. this year's strain protects against six strains. in other next half hour a spike in flu activity in another bay area county. and the age group most susceptible this season.

clean up crews are repairing damage to the chinese consulate in san francisco today after someone set fire to the front entrance to have the building on wednesday night. the entrance to the building at laguna beach was scorched. the lobby was damaged as well. a spokesman for the consulate said someone splashed gasoline on the steps then set it on fire. there is security camera video of the incident from across the street. and the fbi says it has obtained other video from the consulate. at this point no one has claimed responsibility. in san francisco's lower knob hit a car hit a pe -- pedestrian today just a block from a similar accident last night. he was hit by an suv making a left hand turn. police say the victim was taken to the hospital and is expected to recover. the driver stopped and is cooperating with police.

last night another pedestrian suffered a life threatening head injury while jaywalking a block away. happening now one of b.a.r.t.'s two largest unions is tallying up the vote on the revised labor deal. members of atu local just finished voting. the new agreement drops a granted clause that b.a.r.t. says was mistakingly included. instead workers would get extended bereavement the áf and bonus. tonight at least 16 deaths are being blamed on the weather mostly from accidents. take a look, this is what it looked like at cape cod in massachusetts this morning at the tail end of the nor'easter. the snow as you can see is blowing sways almost two feet of snow fell in some places. new york city got almost a foot and residents were advised to stay home if possible. some are out by necessity others by choice. >> i think it's kind of cool.

it's the first snowstorm and i'm originally from arizona so this is always kind of fun for me. >> i love snow to death. but this is not what i'm asking for and not when i'm going to work. >> reporter: the winter weather isn't over yet. a blast bone chilling arctic air is expected to come in tonight and last until sunday. thousands of air travelers found that they could not get where they wanted to go because of the storm. officials at san francisco airport tell us nine departing flights to the east coast have been cancelled. san jose airport said it had about 25 delayed flights and 13 cancellations. oakland airport reported no problems. nationwide there's about 23 cancellations. california is in dire need of snow and rain. but the experts did go to the sierra to see just how bad things really are. ktvu's ken pritchett tells us the numbers and what it could take to bring things any where

back now to that breaking news that we've been following tonight. an amber alert now in effect for a 7-year-old girl from antioch. debora villalon now near the girl's home. >> reporter: take a look at 7- year-old natalie calvo. an amber alert is out for her. it is a man hunt right now

because a man with a rifle took her from in front of her home tonight. it happened just before 8:00 as she and her mom arrived home from some shopping. a man in his 30s to 40s a complete stranger surprised them. he had a rifle. and he abducted natalie as she got out of the car. it's been a frantic 2-1/2 hours for police and they say it's absolutely essential that the public be looking for this 7- year-old girl. >> the reason we're meeting right now and giving out the photograph of natalie right now is we want anybody who may have seen natalie, her mother, this suspicious person involved in this to call police immediately. time is of the essence. >> reporter: natalie and her mom had just come from the wal- mart on lone tree way here in antioch. it's believed they were followed by the kidnapping and as it turns out there was an attempted abduction at that

same wal-mart last night. the description of the suspect and the car were a match. that abduction was not a success. there is a car description, a gold four door toyota camry. and natalie the description on her. 7years old, 3'tall, 54-pound, she was last seen wearing a pink scarf, a pink sweater and gray sweat pants. now there were actually two men involved in this abduction. the mom because it happened so fast only got a good look at the one that grabbed her daughterment he's described as in his 40s, mixed race, wearing a beanie possibly a mustache. reporting live, deobar villalon. >> thank you, and stay with us and ktvu.com for the very latest. we'll be posting and tweeting updates on this investigation as they develop. pleasanton police are searching tonight for a missing teenager who is considered at

risk. investigators say 16-year-old samuel brisk was last seen between midnight and 5:30 this morning near chardonne drive. brisk is 6'tall and weighs 145- pound. police say he might be wearing a purple hooded sweatshirt. dark sweat pants and running shoes with zip ties instead of shoe laces. phil everley of the everley brothers died tonight at his home. the everley brothers are best remembered for their harmonies. phil was the younger brother that's him on the left of don. his wife told the los angeles times he died of chronic obstructive pulmonary disease after a lifetime of smoking. the everley brothers had hits in the early days of rock & roll. and were inducted into the rock & roll hall of fame in 1976.

new developments tonight in the case of jahi mcmath the girl's family and children's hospital oak land reached an agreement about the possible transfer of the 13-year-old girl to another facility. cristina rendon is live outside the courthouse after hearing from family members. >> reporter: the two court hearings today were about clarity. tonight jahi's family know the

exact path they need to walk to get her into another facility. jahi mcmath's family is celebrating a small victory in the fight to keep her alive. >> it's been up and down and up and down and now we finally have a blueprint to accomplish our objective. >> reporter: christopher doland says there need to be contact between children's hospital and the receiving facility as well as an exchange of paper work. they plan to move jahi in an ambulance with a portable ventilator. >> the court will give jahi to us. >> they went to top portion of the body now it's the head movement. you can just, go in there and talk to her and she'll move. she definitely responds to touch. >> reporter: that's why jahi's mom doesn't agree with the alameda coroner issuing a death

certificate today but she says it's one of the requirements to move jahi. hospital attorneys say the certificate reflects reality. >> it's one more piece of evidence that confirms that jahi mcmath is deceased. >> reporter: the family will not say where or when they will be moving the brain dead 13- year-old. but they're confident it will be before tuesday. they're now asking for privacy in this very public fight over life and death. >> and just know that she's going to be in a much better place than children's hospital when this is all said and done. >> i will fight for jahi every day. until her heart stops. i will always fight for jahi. >> reporter: another federal court hearing is scheduled for tuesday. that's where a judge could extend a temporary court order. but the family hopes to have her moved before then. we now know the name of the pe -- name of the pedestrian struck and killed.

olga rodriguez of nevado was struck at the intersection of heatherton and third street. rodriguez' companion suffered broken bones and injuries. one man saw the truck hit them. >> it wasn't like he was trying to run them over. it was like he didn't even see them. i ran over there trying to help her. and she was face down the whole time. not moving. >> reporter: the truck driver was focused on making the turn and didn't see the couple in his path. the intersection is one of san rafael's most congested and some say most dangerous with turning cars and pedestrians using the green light. in 15 minutes new information about that pedestrian accident involving an oober driver in san francisco tuesday night. what we've learned about the insurance policy that covers oober drivers and why some say it needs to change. the marin county district attorney is filing more charges against a suspected bank

those other wise healthy adults end up in the icu. >> icu is where they're going to need more organ support. >> reporter: marin county health officials say flu season is clearly here and that h1n1 is the culprit in 10 to 20% of the cases we see. >> healthy adults and children can be at risk. as they are with any flu season or any strain. but more so with h1n1. >> i wouldn't panic. i wouldn't start running, but i would definitely get my flu shot. >> reporter: health officials say there's no shortage of flu vaccine here in marin county they have plenty of flu shots and nasal mist. and while she wasn't planning on it. lindsay fogan got her own vaccine today. >> is it a big deal? >> no not at all. i honestly didn't feel it. >> reporter: marin county has a
