to sidestep those who get in the way. that was part of his state of the union speech. we have highlights with ken pritchett. >> if there was a threat running through tonight's state of the union, it was the president vowing to go on his own if he cannot get cooperation. >> speaker, the president of the united states. >> reporter: president obama began on an upbeat note, siting an improving economy. >> a rebounding housing market, a manufacturing sector that's adding jobs for the first time since the 1990s. >> but he gave credit to the american people not congress. and said he will go it alone if partisan stalemate continues to dominate washington. >> america does not standstill and neither will i. so whenever and wherever i can take steps without legislation to expand opportunity for more americans families that's what i'm going to do. >> reporter: the president did not lay out a bold new agenda

for congress but asked them to take care of unfinished business. >> let's get immigration reform done this year. let's get it done. it's time. >> reporter: the president challenged republicans opposed to the new health care law to come up with a better idea. >> but let's not have another 40 something votes to repeal a law that's already helping millions of the americans. >> reporter: the president did not acknowledge the troubled roll out of the health care plan. on foreign policy he started with the war in afghanistan. >> together with our allies we will complete our mission there by the end of this year and america's longest war will finally be over. >> reporter: the biggest applause for the night was for sergeant cory winseburg, his process to recover an anology the president seemed to make for the country. >> i know it is within our

reach. believe it. god bless you and god bless the united states of america. >> reporter: arguably the president's window to get anything accomplished with congress will narrow as we get closer to november when all the house seats and many in the senate are up for grabs in the midterm election. frank, julie. >> there were a lot of notable people in the audience including san francisco mayor ed lee. >> we did see major lee very quickly in a cut away shot as he sat with other guests with mrs. obama. the mayor was not referenced but in a statement he said he was honored to represent san francisco and will double down on some of the issues mentioned in the president's address including raising the minimum wage. >> all right, ken, thank you. our coverage continuing with jana katsuyama. she watched the speech with republicans in contra costa county and is here now with their perspective on the state of the union, jana. >> reporter: this group meets every month here at mosimos at walnut creek. today it included a veteran,

democrat turned republican and some who said they were surprised by the president's speech. a few dozen republicans settled in for the state of the union speech. >> steps made in the u.s. >> reporter: with some drinks, food and a bit of political catch phrase bingo. republicans represent nearly 25% of registered voters and we asked this diverse gop group how the president's speech played to them. >> i thought the speech was, good in principle but a little superficial. >> reporter: young is a young republican and he says the president didn't do enough to address the issue closest to his heart. >> for me what matters most right now is personal privacy. and how the nsa seems to be utterly out of control. >> reporter: others say the president seems to be speaking out of his policies. >> i think this administration will be deemed a failure.

their own frustration with stalemates in congress and president obama's vow to go it alone. and at ktvu.com you can see more of the president's address tonight. we've posted exerts in the hot topic section as well as our interview with san francisco mayor ed lee. oakland mayor gene quan was unpleasantly surprised last night. the mayor left a community meeting to find the rear window of her car was broken. the mayor was at a community meeting when the apparent break- in happened. it's not clear if someone broke the window on purpose and we're told nothing was taken from the car. quan's assistant said the repairman said it is possible the window broke when someone back into the vehicle. three years ago quan was the victim of a purse snatching. the search for a young boy with down syndrome ended this afternoon with tears, hugs and

a hamburger. 23-year-old luis zepeda says that there's no words to thank those who helped find her son. around 4:30 he was spotted, hungry and sitting outside a restaurant. >> glad you're okay. good luck. >> thank you. i'm sorry. >> all right, you take care of your mama. >> okay, i will. late today the san francisco city attorney released his own report on the asiana plane crash at sfo last july. over all the report characterizes the crash as a terrible accident and say it is airport isn't responsible. it also suggests that the victim was dead. in a search the trauma of the

impact may have killed them. the report also offers some investigation. airlines established lines of communications for family members to find their loved ones at hospitals. the bay area water district is calling for customers to start conserving. tonight the santa clara county water district improved a 10% cut in water use. anne rubin is in san jose and tell us that threshold is just a goal and to get to that threshold is still in the air tonight, ann. >> reporter: it's actually drizzling right now but not to impact water levels. before we start seeing change, those changes will have to be voluntary. at the nursery they're seeing a shift to what they call water

wise gardening. using plants that drink less. >> it's more of an awareness now. there's more people talking about it. >> reporter: the water district is hoping to encourage that even more. they are considering doubling the rebate they offer from such a switch from $3 to $4 a square foot. >> we've always had that choice, but now we're adding to that. >> reporter: public outreach that may include such incentives. they also pledged to reduce over all water use by 10%. the water district plans to create a committee and how best to address the public. >> don't tell me it's too early. >> reporter: county residents say they're looking for guidance on how to cut back. >> we're trying to find other ways to survive the next four

or five months until we make our way through this. >> i would like to see the community come up with some really good solutions. but not break the bank. because it doesn't get you any where. >> reporter: at the nursery they said they would welcome new customers looking to switch out their plans. >> more business isn't going to hurt us, so. >> reporter: a spokesman says this kind of voluntary reduction can work. back in 2009, they asked for a 15% reduction in water use. they actually got an 18% reduction. live in san jose, ann rubin. and here's a map now that shows the water districts with voluntary water restrictions in place. they include the santa clara valley water district and the san francisco public utilities commission service area. they're both asking customers to cut water use by 10%. customers are being asked to cut 20% in the alameda county water district and in the zone seven water district which includes dublin, livermore and pleasanton. and in marin county, customers

are being asked to cut 20%. bill martin is in the weather center now tracking what we can. >> reporter: not doing anything to damage this drought we're dealing with right now but it will drop some showers. it will also change the pattern to a moisture flow which could mean more rain down the road. that's where the rain is. northover eureka and -- north of eureka. just light stuff not a big deal. right now it's pretty much dry throughout at least the central portion of the state. as we go into the next 24 hours that jet stream is going to drop south. and it's going to bring us some showers and it will have an impact as we move forward into the morning and afternoon commutes. when we come back we will time out these rain showers and how

a procession of police vehicles and limousines leave the chapel of the chimes following a viewing for sergeant smith. tomorrow hundreds are expected to attend the funeral. tonight ken wayne is in hayward with a show of support that's already coming from thousands of miles away, ken. >> reporter: frank the public viewing ended a little bit more than an hour ago here at chapel of the chimes in mission in hayward. earl littler the smith family attended a private service. before their midnight shifts began, one by one hayward police cars stream into the chapel parking lot so officers could pay their respects to a fallen brother. the flag outside the chapel was lowered to half staff. smith was shot and killed after

michael mays performed a probation search. >> i think everyone is still overwhelmed and disbelief that this happened. >> reporter: after the family left, the doors of the chapel were left open. although it appears it was mostly officers. one officer came all the way from massachusetts. smith east death is the first. >> tomorrow is going to be especially hard for not just the smith family but also for the mays. >> reporter: the funeral will begin with a procession about 8:00 a.m. the service will start about 10:00 at the neighborhood

church of castro valley. that funeral service is open to the public. ken wayne. thank you, ken. tom perkins apologized for his remarks comparing progressives to nazis in a letter to the wall street journal. he quote deeply apologized to everyone when he drew parallels between criticism of the super wealthy and jews in nazi germany. but perkins said he stood by what he called his main argument. that patriot against minority can end nonviolence. she says she intends to get all of last year's minutes filed by the end of next month. some residents have praised her for her work reaching aout to

voters but others were frustrated that she had not filed any minutes during her entire first year in office. by more than 10% as it responds to an unusually high number of early fires in what is typically the state's rainy season. today calfire announced that it's fired 125 seasonal firefighters to work statewide. some 300 seasonal firefighters were never released from duty in southern california because the fire season didn't really end. the state has about 4,000 permanent firefighters who work throughout the year. calfire says it responds to more than 400 fires in the last three months when usually there are only about 70 during that period. the rain expected in the bay area tomorrow could make for slick roads and dangerous driving conditions. and ktvu's claudine wong got some pointers from san francisco police about how to keep your car under control if it starts to skid. & % f0 >> reporter: it hasn 't rained

yet. but today the hydraulics on sfpd skid car shows us just what can happen when it does. >> most drivers don't understand what it is to skid. or what causes the skid. >> reporter: sfpd says the number one cause of a skid is speed. but following close behind is weather. we've seen it happen before. when it's been this dry. and this dusty. for so long. the first rain can mean big problems for drivers. >> there's been a build up of oil and gravel. during the first set of heavy rains all of that material that is embedded in the roadway will rise to the surface and that's where it's going to meet your tires. that's where you're going to potentially run into a skid. >> reporter: drivers who have experienced it said you don't forget it. >> i was raining, i had a car full of people. i was getting on a freeway ramp and then the tire just started slipping. >> reporter: but what you do if you run into trouble can make

the difference. >> panic. most people when they get into a skid really don't know what to do. most motorists will experience the back end sliding out. >> reporter: and if they do the wrong thing, this happens. police say get your foot off the gas, keep your eyes on the road and steer into the skid. there are ways to get out of the skid. but sfpd says the best advise to drivers is drive safely so you don't skid at all. in san francisco, claudine wong, ktvu news. it's cloudy out there right now. throughout much of the bay area. a few light sprinkles showing up in parts of the north bay. it's mild, a warm air mass. 60 in san francisco, 60 in livermore right now. so lots of cool warm mild air moving in. the forecast for tomorrow as we go through the night. the cloud pick up. we get around santa rosa. i wouldn't be surprised to see that around san jose and san rafael. it's not showing up in the

only on 2 tonight. south bay medical marijuana clubs targeted by a mystery mailer threatening eviction. the letters are being mailed to the landlords of pot clubs using city compliance orders that have been forged. >> robert handa show us the phony letters and also looks into who might be responsible. >> reporter: the medical marijuana shop in san jose is thriving and is not one of the shops that got a city order to close by january 31st since it is apparently in compliance with city codes. but yesterday the landlord got what appeared to be a new compliance order telling him

medimarts is a public nuisance. >> i got the letter and read the penalties for allowing him to stay here which was $2,500 per day after february 15th. >> i was a little in shock. >> reporter: mini mart's president was stunned when he was told he faced convictions. >> i gave him my case number, he said that doesn't exist in our system. you must be one of the 12 or 13 clubs that have gotten one of these fraudulent letters. >> reporter: the motive is not easy to figure out since the bogus letters do not ask or demand money. it may be a strategy to get pot clubs not slated for closure to shut down. sent by upset neighbors or pot clubs slated to close looking.

only one of the clubs that got this phony letters has been ordered to shut down. police say they're not working with the police department on the investigation. robert handa, ktvu channel 2 news. newly released surveillance video shows the three men responsible for a robbery at a chipotle restaurant in pinol. all three men are wearing dark hoodies. they can be seen entering the back of the restaurant just before closing time. the robbers pistol whipped four employees and took off with cash. the video shows them leaving from the same door. the suspects then took off in a tan sedan. bieber has a date for valentine's day, a date in court. prosecutors may have problems making that dui charge stick. bieber's breathalyzer test was well below florida's legal

an intruder breaks into a home and shoots a defenseless 81-year-old woman. and tonight police are still looking for the suspect. christien kafton is live, fortunately here the woman was able to survive. >> reporter: her family tells us she is spending the night in the hospital recovering from her injuries. meantime we did talk to neighbors in the area they tell us there's been burglaries in the area recently and they are concerned that crime is escalating. police say 81-year-old beverly concanan was home when a man kicked in the front door. concanan heard the noise and went to check it out and surprised the armed robber who ended up shooting her. the bullet went through her shoulder and kept going. >> the bullet went through the wall, went through the fence here and the bullet struck

here. and then fell to the ground right there. >> reporter: garrett chen was next door, he heard the bang but thought it was a phone book being dropped on her front porch. he says he's relieved that his neighbor is expected to survive but says he's worried about crime in the neighborhood. >> one of the neighbors tells me other homes have been broken into but nobody has been shot. >> reporter: three robberies and one assault in the area so far this month. councilwoman shaft represents the district and says she's asking for more police officers. >> because it's very clear that some of these burglaries are becoming robberies and now a shooting. >> reporter: crime scene technicians went over today's shooting scene and at this point still looking for the shooter. >> the suspect is described as an african american male. he's 6'tall, about 175 pounds. he was wearing all black clothing, he is armed with a

handgun. >> reporter: late this evening i received an e-mail from a neighborhood organizer who told me that there is a neighborhood watch in the area. but that this particular area is not monitored by a private patrol that monitors the near by diamond district. we're live in oakland, christien kafton, ktvu channel 2 news. san francisco police say a man is being held without bail tonight for killing a homeless woman. the suspect is identified as 30- year-old maron testemarion. police say he killed mary testamirion. officers from mission station knew meron and gave police information. the man is wanted for arson for setting a man on fire yesterday. shortly after 6:00 at night. department officials say he is heavy set, bald and was wearing a red shirt and black shorts.

if you know him the santa cruz sheriff's department wants to know from you. the civil lawsuit filed by san francisco's giant fan bryan stow has been delayed. stow is suing former dodger manager. stow was beaten after the opening game between the giants and dodgers. stow suffered devastating brain injuries in the attack it has left him permanently disabled. two dodger fans are awaiting trial. a $12 million government drone was deliberately crashed off the coast of san diego

after it delivered equipment. continuing coverage of tonight's state of the union address. the president said the country is ready under his watch for what lays ahead. >> after five years of grit and determined effort the united states is better positioned for the 21st century than any other nation on earth. >> reporter: the president challenged congress saying lawmakers must decide if they will help or hinder the progress going forward. republicans chose cathy mcmorris roger says that the republicans have a different agenda. >> the president's policies are making the people's lives harder. republicans have plans to close the gap. plans that will focus on jobs first without more spending, government bail outs and red tape. >> reporter: three republicans gave responses to the president's speech. utah senator mike lee offered

the tea party's rebuttal and senator ren paul gave his own -- rand paul gave his own speech. >> i think the american people have had it and i've had it too. if congress can't do the job they just want the job done. >> reporter: if the president can do it legally, jackie speier says she's all for it. the president also had the support of eric swalwell. >> they're hurting at home and they want to see the opportunities. >> lee said legislation is moving forward in the house but needs republican support. it could soon be easier for first time voters to cast their ballots in california. a bill approved today by the state senate would allow future voters to preregister to vote at the age of 16.

but they'll still have to wait until they turn 18 years old to cast their first ballot. the idea is by registering young people early they'll be more likely to become lifelong voters. the bill now heads to the state assembly. a new california law allows illegal immigrants to legally obtain a driver's license and at a public hearing in sacramento today, dozens of illegal immigrants lined up to get the questions answered it's estimated 1.4 million illegal immigrants will apply for driver's licenses in california over the next three years. thieves targeting bay area mailboxes. think you've got nothing to fear from a little missing mail? the one envelope that could be a gold mine for criminals. i'm tracking 2014's first significant rain. when it will arrive and the totals expected. >> and coming

was compromised then they were billed $9.84. the better business bureau says there doesn't appear to be a connection between the scam and the security breach involving more than 100 million target customers. wall street bounced back today from three days of declining the dow gained 90 points thanks in part to gains. yahoo's latest earnings reports shows it still has work to do. revenue slipped for a fourth consecutive quarter. it reported a larger than expected decline in revenues from display advertising. still yahoo executives say they see growth this year. yahoo's shares fell about 2% in afterhours trading. billionaire investor carl icon is buying more apple

thieves targeting mailboxes specifically at this time of year. one bay area city is reporting several thefts in recent days and it appears those thieves may be targeting your tax information. ktvu's john sasaki with more now on the warning going out tonight with anyone with a mailbox. >> reporter: postal carriers make their rounds six days a week. but in affluent belmont, they're targeting the mailbox. >> taking other documents they can take to commit identity theft and discard the rest. >> reporter: this time of year around the bay area deliveries

can be especially bountiful for thieves. >> they're getting different tax documents in the mail. >> reporter: street after street we saw mailboxes by the roadway for easy delivery for the carriers but also easy pickings for the bad guys. >> you can have your check, your w2. people are going to steal your identity that way. >> reporter: the best way to avoid this is by getting a locked mailbox or get a po box. >> it's weird, because nothing really happening many belmont. you never think your mail is in trouble. >> reporter: one resident suggested another reason, with the target breach, a lot of people are expecting replacement cards in the mail. the city council approved a controversial resolution allowing some residents to play employees less than the city's

living wage. those opposed with the change met with the media outside of city hall today. one council members sees it as the beginning of the end for san jose's city wage ordnance. >> i think what they're doing is making a huge step in gutting the living wage policy. including the airport where we have a very successful living wage policy. >> today 7-4 vote allows businesses that rent their locations from the city to pay less than the living wage unless that business is getting a rent subsidy or has a city service contract. the city's living wage is $15.78 an hour higher than the wage of $10.15 an hour. some critics of high speed rail are questioning the timing of a -- that company has more than $1 billion in contracts with the california high speed rail authority.

three days after the donation, the governor -- some are questioning if the timing suggests a conflict of interest. >> the governor has ignored the dust bowl. why isn't he building a high speed water way that gets finished in less than 15 years. >> a pokes person for the governor's office says there's no connection between the campaign contribution and those two high speed rail rulings. grape growers in the bay area's wine country are hoping for rain but preparing for drought. farmers say they should have enough irrigation water to make it through the year. but those who rely on rain they could be in a lot of trouble. this is the driest winter on record and growers are now banding together to share water saving tricks. >> there's the exchange of

information and technology in the vineyards is at a level that helps everyone. >> reporter: in the meantime, warm weather is confusing the grapevines, some of which have started to send out shoots that could fall prey to frost if cold weather returns. there's plenty of precipitation in the deep south. alabama is under a state of emergency as a wait a minuter storm moves through the winter region. governor benton made the designation today as snow fell. the freezing weather is expected to stick around until thursday. all of that ice is becoming a safety concern especially out in the roadways. drivers are asked to avoid unnecessary travel. forecasters are calling for sleet and freezing rain overnight at temperatures there drop. transportation crews are preparing for icy roads and have ordered extra sand. the worry is freezing rain could make roads and bridges impassable. we had some cloud today.

even a few sprinkles showing up in parts of the bay area. this plume of moisture driving into the pacific northwest would be nice if it were visiting us but it still stays north. as we go into the next 24 hours or so these showers are going to drop a few. and if they do we will get a sprinkle thursday night into friday morning. you can see the clouds streaming in now. these clouds aren't bringing any moisture. this time last night we had a few showers showing up but not right now. we have a winter storm watch that will go into effect. they could see one or two feet of snow. as we head into tomorrow, patchy drizzle wednesday is a transition day. as this low moves closer to us on thursday. that's when the best shot for rain is. that looks like it'll be thursday morning early. you're going to see that in the computer model. temperatures going to be mostly in the 50s. rainfall accumulations .25 in most heavy locations.

in the north bay a half inch. wednesday at 9:00. that's tomorrow night. tomorrow afternoon showers maybe sprinkles north. then we get into overnight wednesday into thursday morning. there it is. so there's your thursday morning commute. looks like it could be just a little bit wet. kind of moves out. there will be some scattered showers in here. there's a break and then here comes this weak system thursday evening for an opportunity for a chance any way for some more showers possible. so we'll be tracking that. then it clears out friday evening. so it's sort of a short-lived deal moving through pretty quick. these are the forecast highs for tomorrow. 64 in concord. these numbers you know cooler than they had been. because we have a lot of cloud cover out there. 64 in san jose, 64 in pleasanton. mostly cloudy day. maybe a few sprinkles out there. and then as we get into wednesday night thursday, that's when it goes on. this is when this goes on. the football game coming up out in the east coast new york. met life stadium. it'll be 32 degrees and mostly
