ktvu channel 2 news starts right now with breaking news. >> a lottery ticket sold at a bay area chevron station hit all six numbers in tonight's powerball drawing, and a late search in sales sent the jock pot to a whopping $425 million. evening everyone, i'm frank somerville. >> i'm julie haener. someone in the bay area bought one of those winning lottery tickets and they should be yelling jackpot. in just the last 90 minutes, we learned a winning ticket was south at a south bay gas

station. live at the dixon landing site in chevron. lottery officials tell us that lucky ticket was sold. tell us what you've learned so far. >> we've learned we might be standing in one of the luckiest gas stations in the bay area. the winning ticket sold in this machine right over here. some of the chevron employees here, lottery officials tell me that ticket was sold sometime since saturday. they confirmed it marched all five numbers and the powerball. the winner may not even know. there are still a lot of outstanding questions, but lottery officials confirm it does appear there was only one winning ticket, and it was sold right here. people are starting to drop by the chevron, just to see where the winning lottery ticket was sold. they're already saying that this might be be their new hot spot to buy their tickets. >> is this going to be your spot? >> it might be.

i usually go to the 7-eleven. >> no word from the winner who bought that ticket here. i did ask if there was any indication of when that rining ticket was sold. all they can say is that it was sold sometime saturday in the evening. the owner here will also take home a nice prize. a cool $1 million. workers say they were selling a lot of lottery tickets leading up to today's drawing. they expect to be busy when the word gets out. the winning ticket was sold right here. >> yes, after this, people are going to be excited. >> reporter: again, we are still waiting for that, the person who bought that winning ticket to step forward. maybe they'll come here and share some of their luck. maybe they'll come forward in the days to come. the last minute surge in

opening of this safe way. now 8 months later come buyout talks from the ceo himself. razor thin margins, safeway may be losing this round. >> we've undertaken a strategic assessment of our current business. >> safe way is like my number 1 store. >> reporter: we found plenty of loyal customers. it continues to fend off tough competition in the grocery aisle from our player, including wal-mart, and whole foods. today, safeway president robert edwards revealed in a conference call what had long been rumored. >> we are engaged in a possible transaction involving the sale of the company. although discussions are continuing, we have not reached an agreement. >> reporter: if and when a deal is reached, it could impact

thousands employeed at the more than 250 stores in northern california. not to mention those working at the pleasanton headquarters. andre hopes the deal doesn't wind up costing his family more. >> they're saving on food and gas. those are like every day things you use. those expenses and savings really add up every month. >> reporter: safeway stock rose more than 4% in after hours trading on this news, and word that 4th quarter revenue ticked up slightly. sales fell short of expectations. more details now. safe way operates more than 1300 stores in the united states, including hundreds here in northern california where safe way first started. the company also employees more than 170,000 people. new at 10:00, the university of california berkely has a reputation for being progressive and accepting. but tonight, a 19-year-old

student is under arrest, accused of making homophobic remarks before beating up a fellow student. joseph donner was walking with an acquaintance last night, when donner asked the victim for his cell phone. when the victim refused, officers say donner punched, kicked, and choked him. donner was later arrested at home. students were sad to hear about the dip. >> i was surprised when i heard about it, coming from the east coast, you kind of always here of berkely, particularly being very liberal, very accepting. so it's not something i expected to hear for sure. >> donner remains in custody on $130,000 bail. he is scheduled to be arraigned tomorrow. california governor jerry brown issued a call to action today as he pledged hundreds of millions of dollars to help the state cope with a serious drought. >> this is a time to pull together as californians first.

to rise above a lot of divisions. >> governor brown and top democratic lawmakers are proposing to spend $687 million of unspent bond money on projects to help communities that have been hit the hardest by the clout. for example, money would go to recapturing storm runoff, or funding local water conservation measures, or recharging ground water supplies in areas that are running dangerously low. >> our job will be to expedite, to focus on shovel ready projects, that can be implemented as quickly as possible. >> most of the money would come from bonds already approved by voters, but the spending would be expedited. governor brown also says this will not raise taxes. lawmakers say they can have a bill ready in a few weeks. four water districts in the bay area are giving notice for when they might impose mandatory water restrictions. marin could enact 25% mandatory cuts after april 1. san

francisco says it will have a better idea by april 2. east bay mud tells us it's looking at april 8 for a decision. contra costa says it's earliest start for mandatory rationing would be sometime in may. residents are accusing the company of misusing funds. now they've gone to court to try to get the money back. jana katsuyama is live outside palo alto, where she be has been talking with residents, and digging into this class action lawsuit. >> julie, we got a copy of the lawsuit. take a look at this. 600 pages that alleged that d is violating contracts with the seniors who live here and taking their money. >> i was astounded. >> reporter: berten victor is a nobel laureate. he and his wife paid an entrance fee of more than $1

million. >> that contract says they were going to pay back 90% of of what i paid in. >> reporter: he and other residents learned last year, that v at palo alto was in the red. it sent more than $190 million to its parent company, cc chicago. >> they found out that the money had been going in the front door, and going out the backdoor to chicago, which was hidden from the residents. >> reporter: residents became alarmed when they inquired about the funds. v's corporate office responded with a letter last year, stating it would make refunds, but had no legal obligation to do so. >> it emphasized the financial security. >> they simply say, sorry residents. we don't have the money to pay your estate. >> reporter: today, richard and others filed a class action lawsuit that alleges financial abuse of elders, code violations, and breaches of contract. it also includes a letter by

the state, expressing concern about v's financial liability. not so, according to a spokesman. >> the allegations are completely unfounded, v is going to vigorously oppose these in court. >> reporter: the parent company has nine other locations nationwide. they have the right to move money between entities. the lawsuit is seeking damages for the residents at this site. a candlelight vigil was held tonight for a san lorenzo man shot and killed by sheriff's deputies this week. >> i love my father so much. i know he's looking down on us. >> a large crowd gathered to remember david goins. the 60-year-old attacked deputies with a baseball bat, forcing them to open fire. deputies say they had been

called to the home 19 times in the past. family members said goins was in poor health and the use of deadly force was not necessary. today police identified the victim as 23-year-old eric vallejo. he was found on the ground, badly injured at capitol and snell last saturday. police say he was struck by a car and the driver took off. it happened following a fight between two groups that started at the capitol flee market. two other men later showed up at a hospital. one had been stabbed, the other apparently hit by a car. no arrests had been made. now to the east bay, a judge sentenced a former contra costa county sheriff deputy today to one year in prison. convicted for his role in dui stings that targeted three men in danville back in 2010, and 2011. prosecutors say former private investigator christopher butler arranged the arrest in an effort to damage the men's

change. >> reporter: it only works for users who have the application. which is free to try for the first year. after that, it will cost you 99 cents a year. shares of tesla soared in after hour's trading, when the company announced plans to boost production. in its quarterly report, tesla predicted it would deliver about 35,000 model s sedans this year. that's an increase of 55% compared to last year. the tesla plant in fremont is expected to boost production to 1,000 cars per week. tesla shares climbed 12% in after hours trading to a new high of $218 per share. the broader markets closed lower. the dow dropped 89 points. the nasdaq gave back 34. investors appear to be worried that the federal reserve is going to raise short term interest rates sooner than had been expected. san francisco clothing chain gap is raising its

minimum wage to $10 for employees next year. the increase will effect about 65,000 store employees at all gap incorporated stores. the wage increase is slated to come in two steps. a raise to $9 an hour this june, and $10 in june of next year. in mountain view, demonstrators sang today as they called on congress to approve a hike in the federal minimum wage. pushing legislation that would raise the federal minimum wage to $10.10 an hour. a top official overseeing the new bridge span says he is frustrated with caltrain. he learned of water leaks from reporters, not from caltran. he says it's happened before. as a result, he wants caltran to provide a complete list of problems along with how they will be fixed and at what cost.

the mother of jahi mcmath has send word about her daughter. jahi was declared brain dead by doctors after complications from tonsil surgery in december. her family never accepted that, and moved jahi to an undisclosed care facility. in a letter, despite people saying she must be dead, and how i must be ignorant. i can tell you she is much better physically, and i can see changes that give me hope. read the mother's entire letter at ktvu.com. new security concerns are raised at san francisco's general hospital after an elderly woman was assaulted in her room. as david steveson reports, that was just one of several incidents. >> reporter: the family of 93- year-old mary perez, says she is recovering well after being assaulted. >> she is doing well, she's getting better.

she's having trouble swallowing because of throat injuries. >> reporter: investigators say a 29-year-old is being transferred to psychiatric unit. he ran away and attacked perez in a room. >> he closed the curtain behind him in a closed area the two of them. he started doing what he did. >> reporter: in a statement, the hospital apologized for the injuries to ms. perez, and says the assailant was quickly subdued. >> we're devastated about what happened here. i've never heard of this type of think happening before. >> reporter: still, the emergency room rn says he had his nose broken by a patient last year. nurses say there were 34 injuries to staff reported to osha in 2012. they have just begun negotiations with the city. and says abe tacks are --

firefighters in contra costa county say they're changing their strategies by illegal marijuana grows. how firefighters say they will only enter the homes under one condition. >> you can see the remaining charred marijuana plants.

probably in excess of 1,000 plants in this grow. >> reporter: contra costa county fire investigator. >> some of the equipment is being used. >> reporter: showed us the rubble inside what he says was a marijuana grow house. the contra costa county fire protection district, the fire inside this pittsburg house was the last straw. fire officials say in the last two years, they have fought 30 fires at so-called grow houses. after this blaze, firefighters change their tactics. if they say it's a grow house, they won't go in until pg and e turns off the power. >> when they need to escape, and everything goes to hell in a fire, and they need a quick way out, they look for windows, they're trapped in here. >> reporter: now firefighters will work on protecting the neighborhood. also looking for warning signs that the house next door could be an indoor pot farm. >> they'll notice that people who do come to the house,

usually will open the garage door, drive right inside, stay for a few hours, then leave. >> reporter: they usually bypass electric meters which start fires. the problem isn't just in contra costa county. in san francisco, two years ago, an explosion sent two people to the hospital, including a 12-year-old boy. authorities say the house was used to distill marijuana into hash oil. a process that uses flammable material. >> we'd like to see more of these grow houses identified before they catch fire and endanger the neighborhood. >> reporter: firefighters are asking neighbors if they see a house that looks suspicious to call authorities and let them check it out. in pittsburgh, rob roth, ktvu, channel 2 news. charges have been filed against a burglary suspect, shot and wounded by a private security guard last week. the guard says he confronted two men after he spotted them haking off with stolen items. authorities say at the time,

ward was free on bail in a robbery case from last year. neighborhood residents had hired the security company that the guard worked for. also in oakland, an alert about an uptick in street robberies in the montclair neighborhood. a woman who works there, told us about her frightening experience, but didn't want to appear on camera. >> i looked down, and i saw the ground. i'm so scared. i cannot do anything. >> now the head of the mount claire village authority says if people see something suspicious, they should call the guards who patrol the area. the guards can provide an escort or help if police are tied up elsewhere. a group of san francisco tenants get a reprieve at least for now from being evicted. the owner of a building on market street had planned to demolish it, and build an office there. the owner dropped his request

are still burning, even after the declaration of a truce. ukraine's president offered to start negotiations today after 26 people were killed and hundreds were injured yesterday. today, protesters stoked the claims of the ring of fire. it's a line of protection from police in independence square. the government has pledged police will not try to push out protesters. on a visit to mexico, president obama warned that the u.s. and its allies are not going to stand by and watch. >> we'll be monitoring very carefully the situation. recognizing that along with our european partners and the international community there will be consequences if people step over the line. >> the opposition is made up of several different factions with different objectives.

most are fed up with rampant corruption. a warning today involving a potential threat involving shoe bombs. the department of homeland security is asking airlines to give extra attention now to passengers on flights from oversays into the u.s.a. many overseas airports don't require passengers to remove their shoes. officials said there is no specific threat and the warning is not linked to the winter olympics in sochi. a trial date has now been set for an east bay elementary school teacher accused of molesting more than a dozen students. we have previously told you about 45-year-old joseph martin, and claims that the mount diablo school district failed to report suspicions of child abuse dating back for years. tonight for the first time, we hear from two of the alleged victims. amber lee tells us, their parents encouraged them to talk about what happened to help them heal. >> reporter: two brothers share

a game of air hockey, and a unique bond, but one that comes with the loss of innocence. both say they were molested by their 5th grade teacher. >> he just started getting way too friendly. i thought it was really creepy and weird. >> reporter: carson is 12 now. he says it was 11 when it started. his older brother jordan had the same teacher and a similar story. >> he would constantly tell us that he loves us. >> reporter: he is joseph martin. both boys said they thought the man they called mr. martin was their friend. >> he picked me to sit right by him. or on the ground right by him, up against his legs. >> reporter: he would select a small group of boys to sit closest to him in a class when they gathered in a circle. their mother showed me a hand written note from the teacher saying, i adore you, love mr. martin. >> it made me feel special to

be one of his favorites. >> reporter: alleged victims say martin repeatedly put his hands down shirts, sweeping their growns and penis. and continually coming up from behind them and giving them long hugs. >> he always had the windows closed, and put posters over the windows, so you couldn't see. >> reporter: mom said the abuse happened here at wood side elementary. the teacher became friends with not only the two boys, but her as well. >> i missed the warning signs as a mom. >> reporter: she and martin would text each other on facebook to talk about how the boys were doing at school. he became a family friend. >> i felt tremendously guilty that someone was able to manipulate me so much. >> reporter: she says more than

a dozen school officials had suspicions about martin, but did not report him to authorities. court papers reveal allegations of inappropriate behavior with students first surfaced in 2006. at that time, the district hired an outside law firm to investigate malice aforethoughten, but at that time, never reported the abuse to police. mount diablo officials declined our request for an interview, but martin's attorney spoke with us. >> there was no sexual intent in what he was doing. >> reporter: the teacher sought boy s who were disruptive. >> he would be patting here. it would be skin to skin, but it would be in this area. >> reporter: martin agreed to restrictions that included quote keeping his classroom door open, and having more than one student in the room. in court papers, parents of the

alleged victims claim the district failed to enforce the restrictions. last april, the mount diablo school district put martin on administrative leave, when a student accused the teacher of touching him inappropriately. two months later, concord police arrested martin after the investigation turned up additional students saying he had sexually abused them. martin is held at the jail in martinez awaiting trial. >> there is no sexual abuse that took place. he is completely denying that. was there some touching? yes. >> reporter: more students have come forward to accuse martin. >> what are you feeling towards him now? >> taken advantage of. >> is it anger? >> yeah, a little anger and sad. >> reporter: marie says her boys have received individual, and group counseling. she says she is sharing her story with us, because what happened to her sons, and our

students could have been prevented. >> what do you want to happen to him? >> to end up in jail. >> reporter: marie tells me she encourages her sons to talk openly about what happened, as the family finds the road to recovery. we agreed to the mother's request to change the names of family members to protect their privacy. joseph martin is facing 115 counts involving 14 boys. his attorney told me he expects the trial to last eight weeks. i did visit the detention center twice to try to talk to martin myself. he declined both times. >> those boys are so brave for speaking so openly about what happened. >> reporter: absolutely, i was very concerned about the boys in our report, so i reached out to experts for advice. they told us it's important that the boys receive therapy for any trauma, and that in interviewing them, we refrain from questions that would cause further trauma. the mother told me that the

breaking news from milpitas. lottery officials say this store is where the one and only winning ticket was sold in tonight's powerball. the jackpot is estimated at $425 million, and just one winning ticket. the owner of the store should also be getting about $1 million for selling that winning ticket folks have been coming to the station at this hour, just to look at where one powerball player struck gold. here are the winning numbers. 1, 17, 35, 49, 54, and the powerball number is 34. >> a lot of smiles in that store right now. activists in san francisco are using a new tactic to try and thwart private communitier buses. the buses hurt air quality. last month, san francisco's mta approved letting the buses use city bus stops for a small fee. google, and other companies

provided the buses to shuttle their workers. access to googles high speed internet service could be coming to parts of the bay area. invited to discuss joining google fiber. google days its service is up to 100 times faster than existing broadband services. the expansion could grow. a judge in nebraska has dealt a set back to the exxon pipeline. some of the construction has already been done. today, a county judge ruled the governor of nebraska overstepped his authority by approving the route. decides that nebraska's public service commission south dakota make the decision. delayed a crucial vote on whether to go ahead with plans for a controversial surveillance center. the council's decision on the

domain awareness center came midnight. many in the crowd expressed privacy concerns. and some appear to be souring on the idea. supporters say it could be a valuable crime fighting tool. the facility would integrate cameras at the port of oakland, and be monitored around the clock. a youth summit to discuss ways to prevent dating violence among teenagers. the group, safe place organized today's event, which included teenagers sharing some of their own stories. bay area rapper e40 was also invited to the forum to discuss healthy relationships. he told the awed yens, he's -- audience, he's been married 22 years. he said communication is the key. >> let each other know you appreciate each other, every day. >> safe place says the goal is to create a generation of

san francisco, 52. san jose, you're 53. the forecast, in the upper 40s. you end up in the low and mid- 60s. that's san francisco tomorrow. we take a look at san jose, 53 degrees. san jose tomorrow, same thing, starts off in the the low to mid-40s. you end up at 65 at lunch time. 70degrees at 3:00. a pretty nice day around the bay, despite the high clouds. those clouds are going to linger, and they'll be there most of the day. i'd call it hazy sunshine, partly cloudy, mostly cloudy kind of a set up, as we go into tomorrow, we're looking for temperatures to continue warm despite these increasing high clouds. the continued warm weather lasts into thursday, tomorrow, friday. saturday and sunday it kind of levels off. by the weekend, temperatures are back into the upper 60s, and low 70s. i think we'll see a couple of 7s. 70 in napa. 70 in antioch. 70 in concord. these forecast highs clearly warmer than you would expect for this time of year. 70 in san jose. 70 in mountain view.
