police string evidence tape throughout a business parking lot this evening as shots ring out. good evening i'm frank somerville. >> and i'm julie haener. we get the developing news now from healther holmes. she's live at that mcdonald avenue shopping center that has a target store and other businesses. we have new information about

the suspects tonight. >> reporter: i'm told that the two men knew each other. one is 17 years old the other a man in his 20s. both of them shot right here in this parking lot as you said just feet away from several businesses and lots of shoppers. >> guys were screaming, hollering like somebody was about to throw some punches or something. >> reporter: tax preparer devin knew there would be trouble but not like what happened next. >> i heard four shots. >> reporter: at this shopping center off mcdonald avenue. we saw a trail of evidence. the third piece of evidence another bullet casing. the fourth a white sneaker also believed to belong to one of the victims and the fifth a bullet hole in this suv. >> i got up and went, you know, locked my doors as best as i

could. a big window isn't going to stop anything. >> reporter: indeed a frightening night for those doing business here. the hope is they capture the shooter. because there's not an awful lot to go on. no suspect information, no word on a motive. you heard michael mention he heard arguing but we just don't know what that arguing is about. in regards to that suv that was shot. police tell me they don't believe that it was involved it just happened to be parked in the line of fire. reporting live tonight here in richmond, i'm heather holmes, ktvu news. more developing news that we're following tonight. a massive rescue effort is under way this evening off the coast of south korea where a ferry with almost 500 people on board sank. the ferry was on it way to the resort island which is south korea's most southern island. that's when something went wrong and the ferry sent out a

disstress call saying it was in danger of sinking. the boat then turned upside down. among the passengers 200 students. the rescue operation is still under way. however at this point it is not clear what has happened to the other 300 people on board. the ferry was traveling in heavy fog and reports are that it may have hit a reef. here in the bay area, there were frightening moments this evening for two people on board of a single engine plane. it was forced to make an emergency landing. it happened at 7:00 in a field east of livermore and not far from the lawrence livermore lab. neither of the two people on board the cessna 152 was injured. no damage to the aircraft was reported. it appear it is plane ran out of gas.

the faa is currently investigating the incident. investigators say the apartment building fire likely started on the top floor or the deck of a penthouse but tonight everyone who lives in that building has been forced out. the fire broke out in a six story building in the castro building at dolores and 14th street. patti lee with why neighbors were so worried about this one spreading. >> reporter: you can see it was filled with new construction. 15 people in this building had to find a new place to stay. the building instructor department is yellow tagging it. finding it uninhabitable at least for now. billowing black smoke could be seen across san francisco after a fire broke out around 4:45 at this 30 unit apartment building at dolores and 14th street. >> i just moved here from

tahoe. >> reporter: neil patrick dominguez was coming back from a job interview when he saw the smoke. >> everything was on fire. >> reporter: dominguez biggest concern was his partner's cat. they both watched until the cats were rescued. for now there's no word on what started the fire only that the location had the chief worried. >> it's a windy day, a couple of half a block down you have a construction fire very close to the bay. >> and 73 firefighters and 23 apparatus got the fire out fast. in this case within an hour. >> reporter: folks who live in the building were thinking they would be able to return to their homes tonight.

1021 said they picked today for the rally because it's tax day. they called on high tech forms operating in a tax free zone in san francisco to pay up. they say that twitter is getting a $56 million tax break at a time when city services are fighting for money. >> the workers don't matter, we matter to the city and we matter as much as these tech corporations and it's time for them to pay their fair. >> reporter: 911 operation services and san francisco general hospital have staffing problems they claim because of budget shortfalls brought on by those tax breaks. it's not clear how many people were detained tonight. raymond "shrimp boy" chow appeared in court today. chow faces eight counts of money laundering and one count each of conspiring to traffic

liquor. the charges against chow are not directly related to the charges against yee. two other men also entered not guilty pleas. sullivan and jackson are accused of a never completed murder for hire charge. jackson is the son of another defendant, former superintendent keith jackson. there was an uncomfortable reminder tonight of the deadly boston marathon bombing that happened exactly one year ago. police found two unattended backpacks near the finish line. the bomb squad detonated the back pars as a precaution neither turned out to be a bomb. one person was arrested and will be charged with possessing a hoax device. the backpacks were found just hours after boston paid tribute to the booming victims. and as molly line reports there were survivor, first

>> reporter: then under a gray sky a moment of silence near the finish line the flag raised. the montra boston strong was said again and again and promises to run again. this year the boston marathon is this coming monday. in boston, molly line, ktvu news. one of the victims was from the bay area. he has undergone a long period of recovery. aaron hern was waiting for his mother at the finish line. she writes i don't think he's stopped since he got out of the wheelchair last may. he's hard to hold back so i stopped trying. he's boston strong. fighting to keep these rolling hills green. what makes this land so special and the push tonight to keep this prime property untouched.

some tough water restrictions have been enacted because of the drought and now they are even tougher in one bay area city. the city of livermore has taken

a dramatic step to avoid running out of water this summer. outside water use will have to be cut in half. new at 10:00, jana katsuyama is in livermore with details on what is perhaps the bay area's most drastic measure yet, jana. >> reporter: frank, i want to show you something across the street there. that white stretcher usually has a fountain that's going well into the night but today they shut it down early that's because they want to save water. today the city implemented mandatory water restrictions. >> stuff in the ground doesn't need it every day. stuff in the pots needs it every day sometimes twice a day. >> reporter: today the city of livermore announced its

previous call for voluntary 20% cuts resulted in only 4% savings. so the city is implementing a 50% mandatory cut back for outdoor water use. >> we need to stop our irrigation demand by 50% or we'll have to run out of water and go to more draconian water short restrictions. >> reporter: bay area water districts say outdoor water use is the biggest source for savings. >> it's not the ends -- end of the world but it's certainly unfortunate all the work that went to keep it up. >> as i mentioned the city of livermore is calling for a 5% mandatory the water usage. livermore is in zone seven and there's other cities such as pleasanton, dublin and san ramon which could also be facing hands toy cuts soon due

to a shortage of water -- facing mandatory cuts soon due to shortage of water. jana katsuyama, ktvu news. new details on livermore's new water restrictions. a new violation will only get you a notice. the polls show 67% of california voters favor voluntary cut backs of 20%. 27% believe there should be mandatory rationing. these opinions really don't vary much among the voters in different parts of our state. the field poll also asked about agricultural use of water. 54% said farmers can reduce the amount of water they use by changing crops or using water more efficiently. 24% disagree. agriculture using 25% of the state's water supply. farmers feeling the pinch means

the drought is going to hit us all in the pocketbook. as the produce stands, there's new evidence that prices are soaring higher. investigators show these pictures show the man an hour after the robbery. the robbery happened around 1:00 in the morning on april 1 at the bank of america branch at fremont boulevard. both men spoke hindi and may have been from india. they're described of being 18 to 20 years old. if you go to ktvu.com you can watch all three surveillance videos in their entirety just go under the web links tab. a robbery suspect who was shot and killed during an alleged jewelry store heist in antioch has now been identified. police say 20-year-old david carter of antioch was shot to

death about 4:30 last friday afternoon. investigators say it happened during a botched robbery at hardy knicks jewelry store on delta fair boulevard. a second suspect is still at large. uc berkeley students who say they were victims of sexual assault delivered a strong message to university leaders today. ktvu's paul chambers tells us two bay area congressmen are promising to take their cause to washington. one by one these women came forward. >> i was raped and assaulted, spring semester of my first year at cal. >> reporter: sharing their stories of alleged sexual assault against them at the university of california's campus. >> i felt violated, emotional and confused. >> reporter: the women say they've made reports to the university but nothing has been done. that's when barbara lee and

speier came to the university. >> one woman told me that she was told to wear sneakers so she could run away from her attacker. >> reporter: there's 42 sexual assault cases dating back to 1975. >> i graduated in 1975. and not much progress has been made. >> we are not indifferent to this issue. we take it extremely seriously. >> reporter: cal has placed numerous new positions to deal with sexual misconduct. new legislation will require schools to track sexual misconduct nationwide. paul chambers, ktvu. a few high clouds starting to move in. we will see fog trying to move in tonight. it's clear right now. the fog on the computer model tries to form about 1:00 in the

morning. it shows off in pacifica. that goes away. in monterey that's at 6:00 in the morning. this morning we had fog to start with. but it went away. tomorrow it's gone most of the day. forecast highs tomorrow oranges are 80s so these oranges 80s are starting to come further this way. so we're going to see more upper 70s and low 80s. tomorrow a warmer day than today by 5 degrees. we'll talk about the warm up and then we'll talk about the cool down that's soon to follow up. the coast guard says a capsized boat discovered near pigeon cove may have belonged to drug traffickers. crews launched the search and didn't find anyone in the water. the coast guard describes the boat as a pena which is used by drug traffickers who usually travel north to avoid detection. i'm angry about this and the community is angry about this. >> the promise that neighbors say is being broken and what they're doing to try to stop

a victory for san francisco's district attorney who led a campaign to put kill switches in smart phones. ktvu's ken pritchett now live in san francisco with more on the fetch problem and what major cell phone makers announced today they'll be doing about it, ken. >> reporter: the trade group that represents major smart phone makers says anti theft technology or so called kill switches will be coming to smart phones in 2015. it is a victory for san francisco's district attorney albeit a partial victory. eyes down and typing while we walk. our ears plugged, the world drowned out around us. it's no wonder smart phones are

stolen so often. >> i've seen it myself. on the munni bus. someone snatches it right out of a girl's hands and off they go. >> reporter: amanda has lost her phone several times but never had it stolen. 65 robberies involve cell phones according to district attorney george gascon's office. he's been urging the tech business to install kill switch technology. today the trade companies say all phones will soon include anti they can technology. >> really happy, right, this is a long departure from where they were even two weeks ago. >> but gascon says the industries announcement falls short. he wants new smart phones to have the kill switch turned on from the start giving customers to have the option to turn it off if they want to. >> if the crooks believe that a

quarterly earnings. google glass went on sale today for one day only. google was offering them in five different colors and the white version sold out. as of this afternoon though, the black, blue, gray and red versions were still available. the computers were sold online for $1, $1,500 each. google is not saying how many were sold or how many were available. today's tax deadline just over 90 minutes away for both your state and federal returns. the irs said that last year about 83% of individual returns were filed online. they expect that figure to rise above 90% this year. now if you haven't filed yet. there's just one option for filing a paper return on time here in the bay area. that's the postoffice at san francisco international airport it'll be open until midnight. some big changes for commuters in san francisco. also ahead tonight, some new information about that huge

if that happens the city's last open space will be gone and that will give way to traffic and parking problems. amber lee is live where opponents today handed over a petition to try to stop that project. amber. >> frank, the planning commission meeting wrapped up about an hour ago, no decision yet but homeowners may get their answer in less than a month. >> that's the west side of the project then it continues all of those hills all the way to the water tower. >> reporter: to many neighbors, this open space is a field of broken promises. >> i'm angry about this and the community is angry about this. >> reporter: robert clinger tells me 16 years ago when he and others bought their homes in this area they were promised that no more than 200 additional homes would be built here on the rolling hills of feria ranch. but they say a proposed development project is breaking that promise.

at tonight's meeting, clinger turned over petitions he says are signed by 300 home openers who oppose the project. >> these are all the residents. coalition of northwest neighborhoods. >> reporter: the development company that owns the land is proposing to build 740 residential units, they include single family homes, townhouses, condos and senior housing. >> we manage to move on to conditions of approval and hopefully in the very near future. >> reporter: while pat community inc. spoke briefly, he tells me his company has a policy of not talking to the media. the proposed development will cause traffic and parking problems it will also burden schools and infrom structure. >> go out on 680 at 5:30 in the evening and see how long you will sit there. we're not adding infrastructure. >> reporter: opponenting say a project that building no more

than 200 single family homes is palatable but a far cry from what the developer is considering. amber lee, ktvu channel 2 news. changes are coming for a san francisco drivers and commuters. the san francisco municipal transportation agency voted unanimously to stop charging for sunday metered parking. to make up for it. munni cash fares are going up. clipper card sales will stay the same. these changes take effect july 1st. b.a.r.t. is set to unveil their new train cars. the first new fleet of trains is expected to go into passenger service in 2017. the san francisco fire

department today issued a preliminary report on that massive five alarm fire in mission bay last month. the fire destroyed an apartment complex that was under construction just a few blocks away from at that time park. it caused $40 million in damage. smoke and flames could be seen from miles away. dust and particulates in the rubble are still causing problems in the neighborhood and people are concerned about what they're breathing. john fowler explains the brewing battle over air quality. >> reporter: the bimma la furniture store is still having problems. for safety he's had to restrict customer access and is losing thousands of the dollars a month in business. an environmental firm analyzized particles, he's sure irritants are from across the street.

>> as you can see there's workers up there now. and there's dust plumes that go into the air. our air ducts are directly across the street. >> reporter: from an insurance attorney denies responsibility. >> we cannot be sure the alleged particles in your store are from the bre properties project. >> reporter: the attorney did not return my phone calls today but in an e-mail offered air testing next week. the attorney claims tests already show no hazardous material at the burn site. >> this is how they're treating their community members. shame on them. >> reporter: after cleaning up this burned out structure, bre properties plans to rebuild the apartment complex. that could take 2-1/2 years. john fowler, ktvu news. tomorrow especially trained dogs will be going over a former california news station destroyed by fire. today heavy equipment tore down what was left of that building on park avenue that caught fire sunday: we're told as many as 30 homeless people were living there and crews want to make sure no one was killed inside.

there are reports it may have been a cooking fire or arson. but fire officials say it will probably be weeks before they determine a cause. ac transit's chief financial officer is free on $100,000 bail tonight stemming from embezzlement chargeless. lewis clinton jr. is accused of embezzling $100 million. clinton was the head of three church organizations. but authorities say he used the money instead to pay his mortgage, a golf club membership and his children's private schools. ac transit though says it has no sign that clinton did anything wrong there. >> we are very confident that there are no financial irregularities with regard to mr. clinton and ac transit. we have three separate audits every year. >> reporter: clinton is currently on paid administrative leave from ac transit. he's scheduled to appear in

police in san francisco are investigating another pedestrian accident. this one involving a taxi and woman in a wheelchair. it happened around 3:00 this afternoon at the intersection of levenworth and mccallister

street. a woman was in the crosswalk when she was hit by a taxi. she refused treatment at the scene. everyone so more funding is needed to fix dangerous problem spots. >> either some of our high injury corridors. these are the same streets where the same issues are happening over and over again. >> if not for the woman's wheelchair her injuries would have been much worse. the cab driver was sited for not yielding. the drought is going to cause price hikes across the board. >> reporter: melanie snow who took her kids to the alameda farmers market today knows the drought will soon affect prices. >> it wouldn't be surprised if

illegal dumping. turns out the prompt -- project may have been a little too successful. bins were overflowing with debris because people from other city brought their trash into oakland. the city told us it's no longer accepting any bulk trash at any of the sites and that the bins are not going to be replaced. the program was designed to help clean up oakland streets and was set to run through tomorrow. it may soon be illegal for people who live in san francisco to lease out their homes on websites like b & b. a person could only rent out their apartment short term if there are permanent -- they are a permanent san francisco resident and live in that apartment for more than nine months a year. the person putting up the apartment for represent must also be free and clear. >> we are not going to allow

vacation homes or allow owners to use their homes for temporary hotels. >> opponents worry that the apartments will be used as de facto hotels. nice looking day out there today. temperatures got up there. we had lots of 70s and low 80s. it's going to be warmer as we head into your bay area wednesday. 83 was the warm spot today in fairfield. 80 in concord. 79 in livermore. the forecast highs tomorrow as i mentioned are going to come up a few degrees. there's just high clouds. along the coast, we're fog free. it was not that way last night. we look around and there's no fog to be found. winds are blowing pretty steady tonight but they've backed off. earlier this evening the winds were blowing pretty strong.

especially in the golden gate bridge. the winds have died down and the winds now are relatively calm. an indication of the warm up we're going to see tomorrow. a little less on shore push of wind. will increase the temperatures by a few degrees. calm in nevato, calm in santa rosa, and temperatures accordingly are going to come up novato. san jose is 56 degrees. clear in san jose, clear in san francisco. you start off pretty warm. you start off mild. you start off at 54. lunchtime you're almost 70 degrees. wednesday afternoon you're coming up on 80 degrees in downtown san jose and parts near san jose you could easily see low eight -- 80s. through the bay area microclimates. you're in the mid- and low 70s over the hills into livermore, into danville. you're into the upper 70s and you go a little further east to the fringes of the east bay and

south edge. you're going to find low 80s and even mid-80s. a nice looking day. a lot like today. except no fog and slightly warmer. then tomorrow's temperatures warm and then it starts to cool. you'll see that in the five day forecast. i mentioned this yesterday. none of this is extreme. these changes, these fluctuations are gentle and minuscule at best. so up to 82 or 83. down a little on thursday. down a little on friday. up toward the ends of the weekend. high clouds will be accomplished at the coast. some patchy fog tonight but there you go. no rain in this five day. maybe a little something out beyond this but, still the models aren't quite sure about it. so enjoy the week because it is spring in the bay area and you can see it on the five day. >> i was so bummed about the fog. you nailed it. i live up in the oakland hills and could not see a thing with that darn eclipse. i was really looking forward to

it too. all right, thank you mike. the morgan hill reservoir is the largest in the bay area. it was initially supposed to stay closed to boaters. but the santa clara water district began pumping in federal water to boost water levels. and that was enough for officials to open the 7-mile lake for at least part of the season. >> it's great. it was everyone better this year. the fish look really good. nice healthy fish. rangers and the fire department began check. for now the lakes are expected to be open through most of the summer. mark is here with sports. >> a couple of great games still in progress as they say. we don't know for sure it's going to work out for the giants. reason to believe they could be in the end and that's because
