they changed the way that we nominate appellate judges down to a simple majority. 50 plus 1 and that is something that now is going to come back i think and bite the democrats because they're not going to roll over with 60 votes. >> let me ask this. almost immediately after the death of justice scalia. this president should wait and sight unseen. we're not sure who he's going to nominate. he could nominate a liberal judge who will run into trouble in the senate but shouldn't we wait to find out before we declare this president should not do it. >> he can go ahead and do it, i agree. i would wait because he's not going to get anything through probably a liberal judge. >> are you not prejudgeing what's going on? >> i look at this guy not only the last centimetre years in office.

i don't think that is necessarily them being this left wing extremist. the other thing is what i thought miss mcconnell did was callus. as soon as they found out scalia had passed away. he put out a statement, we're not going to pass anybody through. i think why not wait a day and let the family mourn. let us process what just happened and i thought it was the wrong time to do it i. >> there was plenty of arguments of some of these other issues. what's next on the rundown here. >> perhaps it's the deja vu all over again. trump continues his attack on jeb bush on how to that i deal with sois and overall policy in the middle east. >> jeb is so wrong. obviously the war in iraq is a big fat mistake george bush made a mistake. but that one was a beauty.

know there's a person vying for the presidency of this country who has an approach that any time that you oppose him, oppose his views, that he attacks you. >> these guys don't like each other obviously, right? there is legitimate bad blood there no i'm going to agree with fernando. every time tuvrp is attacked he goes after that person with venom. he said something bush said something back. trump started to interrupt bush and it was bush who said, grown-ups teach to calm down while other people are quiet. >> that was cruz. >> adults learn not to interrupt. >> he went after everybody just about on the stage tonight. and the thing that we've all agreed to that is amazing about donald trump more than anything at all is this guy has more teflon than anyone i've seen. i knew bill clinton had testify ron. he could say anything and

and he had teflon but nothing paramedic compared to what donald trump has. >> what do you think? >> i i can't believe i actually agreed with donald trump on something. i agree we never should have been in iraq, and i agree that you know there was no weapons of mass destruction there and i agree gob should have been impeached for all that. i fwrooe with donald trump which is surprising for me. however the exchange between him and jeb or cruz and rub row i think is incredibly juvenile and i feel like they're just dumbing down politics. they're dumbing down our democracy and i don't think it's healthy for the republican aert. i think that kind of debate and that level of debate is just uncalled for. >> but you know two things, one, we're not going to get to this by debateing about weapons of mass destruction again. but saddam hussein wanted us to believe that they were

>> welcome back, immigration has been front and centre today. john kasich came out as the more mod are the of the group. did anyone make any ground today? >> let's start there. of all the plans john kasich, very moderate but george -- i'm sorry, jeb bush also had a fairly moderate plan. so who came out on top? er if than do? >> i thought rubio came out on top but kasich is all supportive and governor of ohio, he is daning the right way. he's proven he wants to do it and best of all, he's proven that it can be done. obviously trump and ted cruz are very negative in their aspect and they're not being sensitized by anybody.

at all to the issue of just throwing out 12 million people from this country without taking regard anything else. contributions, et cetera that the immigrants have given to this country. >> just a quick follow-up before we get to another panelist, you mentioned rubio you thought he did the best. seems to me when he talks about his plan, that he is sim pa netic to the people who are already here and finding a solution to the deal with them. that it doesn't involve deportations. but he tiptoes around it. >> i think he tiptoes because of the abuse the if you will that came from his own republican cohorts. if you stop and think this his contribution to the gang of eight were very valued and good, and he contributed to what's accepted in the past because it did pass. someone said that the bill did not pass. it did pass, unfortunately it only passed. >> but that was his contribution.

>> rubio said clearly that we should not be rewarding people who break the law. he said that very, very clearly tonight. and we all heard him say that. and we should not be rewarding people. are we going to take 11.5 million people and send them out? the chance are probably not. eisenhower had a plan and got rid of hundreds of thousands as a matter of fact millions of illegals back in the early 50s. and worked back then and should we be deporting people who are criminals? yes. should we up the borders? yes. i think rubio came across well, problem with trump not cruz, he says things in a way to attract headlines to make people feel like you know, they've got to react to him. so. >> all right, we've got more coming up. let's find out from papa trick. what's next for us some. >> next we'll talk about the

> >> announcer: you're watching "politics now." >> most of the candidates laid out their tax plan tonight. >> i'm going to have a tax plan that is pro family because the family is the most important institution in society. >> rubio hit on the family angle and there were differences including ted cruz pitching what is close to a flat tax, so the question on this part, who comes out on top and is it donald trump? >> it's a good question. and let's start with you. of all the tax plans, ted cruz, that's 15% kind of surprised me . but what do you think? whose tax plan has the most chance of appealing to the broad middle? >> that's a great question, steve. and i wish i knew the answer to that. when i was listening to these folks tonight, they were all over the place frankly on this particular

and specifically i felt like cruz, he wants to just get rid of all the taxes. let's just get rid of all the taxes. but there's never an answer. how are we going to pay for real things then? how are we going to to have a great society? how are we going to have great citiess if we just do away with all the taxs? i mean that sounds like utopia but it's just not going to work. so i want to see real specifics because they will ask them these questions about taxes is say the typical republican talking point and then they stop talking. and the moderator tried to get more out of them and he was pushing them and it wasn't coming out. so i want more. >> alan seals to have found his tax plan. >> well you know, i said the great society. that's what linden johnson started. that's when we went to hell in a handbasket. that's when we started to say to people, if there's no man in a house we will pay you more for each child you have as long as the man stays out of the house. i'm not so sure about all

government doing it for us. flat tax, yes, getting rid of waste and all the other problems, absolutely right. i also was a little bit amazed that trump was talking about how he was going to you know fix the economy and bring businesses back. but when he was asked specifically about how he was going to pay for the stuff he never quite had the answer. but again, he's got teflon. so he comes off looking good. >> he never answers any question properly. and with any deep support. but i kind of appreciated what rubio was saying that it's got to be friendly to the family. and of course if the family has money in their pocket, they're going to spend. and spending obviously the economy is going to grow. and it's unfortunate where we have these debates where they're giving with one minute to answer a question. >> i agree. >> but i would lii to know, go deeper into that.

>> steve: that is a great question who won? start with fernando. >> i think rubio won and he can did come back from that slap in the face he got last week. i think there's some insecurity on immigration, on above at thety, on taxes, we're all right on. and i feel if we did have more time with him he can go more in depth and give a good feeling but what i heard from him i liked him and i liked him on all those issues. >> the format was kind of constraining. who won this one some. >> if there's going to be an honest headline will be rubio redeemed. he came across looking very good. i think the bush didn't look too bad tonight and i think can kasich is taking the kristi votes and owning them, and i think he's going to begin to grow more. he has in the numbers anyway. he's second in the south carolina right now. so, trump somehow is going

but the others are starting you see movement coming on. >> what do you think? >> kasich was the least offenceive, i think. i think marco rubio while he was in his robot self tonight, he proved that he was incredibly insensitive on immigration as a latino. and ted cruz the same thing. ted cruz and marco rubio as latinos don't have more compassion for the people dealing with the immigration system in this country. >> no one mentioned dr. carson. if he doesn't do well in south carolina and maybe here in nevada, he's going to have to drop out, right some. >> he said i'm not a politician. i never aspired to be one and he's right. and he's a nice guy and maybe one of these guys will be elected god willing this coming november, maybe he will become the next surgeon of the united states. he probably would be a great one.
