rumblings that some republicans are preparing for a third-party candidate and that's because it's not just the nomination at stake, but they say a trump win could affect races in the future and some republicans are even embracing an anti-trump social media campaign using the the #nevertrump. anne-marie? >> weijian jiang in washington. weijian, thank you. the secret service is investigating a physical altercation between one of its agents and a journalist at a trump rally in virginia. as black lives matter protesters were being taken from the rally, "time" magazine photographer christopher morris left the designated press area to take pictures. the agent confronted morris and morris admits cursing at him. the agent grabbed morris by the neck and put him in a choke hold and then slammed him to the ground. later morris touched the agent

morris was led away by security, but says he will not press charges. coming up later on on "cbs this morning," we'll discuss the implications with cbs political analyst john dickerson and our political team will bring you election results at 10:00, 9:00 central. well, apple won a legal battle against government efforts to force it to break this involves a drug case in new york city. the judge ruled apple is not to have to. this is not related to the case regarding the san bernardino shooter. and the dispute between capitol hill today. apple's chief lawyer are scheduled to testify before the apple is arguing in court that if it complies with the fbi request it would set a dangerous precedent.

is under arrest charged with murder after allegedly opening fire in his school cafeteria. the trouble started at madison high school about 30 miles north of cincinnati yesterday morning. two students were wounded, and two others were injured while trying to escape. >> i looked to the left like what's going on, all of a sudden, bang, bang, bang, bang. i thought, okay, that's a gun. i ran back into the library. >> one of the kids who got shot, i grabbed his leg and then fall down, and then the kid that's shooting like run out. >> the student gunman ran out of the school, dropped his handgun, and was captured. police say they have a motive but aren't saying what it is. in california a woman and her two young children are safe after being kidnapped by her ex-husband. her husband lead a chase yesterday afternoon.

refused to surrender. the chase continued into the night. he stopped again, got out of the car and made a run for it. his children and their mother are in good shape and the suspect remains on the run. well, a watershed moment at the supreme court. justice clarence thomas asked a question. this is the first time thomas has asked a question in ten years. he has said he relies on written briefs. the case involves the federal law that bans people convicted of domestic violence from owning guns. president obama is schedule yumed to meet with senate leaders today to discuss the vacancy left with the death of justice antonin scalia. senate republican leaders say they will not consider a obama nominee and want the next president to fill the vacancy. funeral services will be held today for the virginia officer who was shot and killed on her first day on the job. a long police profession accompanied ashley guindon's body to the cham.

doing his job. another honor for patriotism, this one for the women known as real life rosie the riveters. california lawmakers honored eight women who worked at shipyards during world war ii. it was part of women's history month which officially begins today. and he was the inmate who nicknamed paul newman cool hand luke. it was a typical tough guy role for george kennedy and earned him an oscar. he died sunday. he had more than 180 film and tv credits. george kennedy was 91 years old. well, the family of a famed character actor feels he was snubbed by hollywood. he died less than two months ago but he was left out of a tribute sunday night during the academy awards show. vig go da also had a long tv career and could still be honored during the emmys. ratings for the oscars show before the lowest since 2008.
