acting peaceful and walking into the sally port. marshal's attorney says he stands up and that's an officer marshall doesn't sit down right away and the officer goes hands on in a matter of seconds, more than 4 officers tackle him, his family believes that the officers used excessive force. >> uncle didn't do -- my uncle didn't do anything. `asn't threatening to anybody. he didn't try to hurt anyone. he wasn't threatening. and for them to forcefully restrain him the way they did, and brutally murder him. >>reporter: now, marshall's family says that they wanted the deputies to be prosecuted, but since no charges have been filed in this case, they will seek other means of justice including a potential civil suit. marshall's attorneys called on

investigate this case and the denver department of safety. reporting live in denver tonight, jennifer kovaleski, denver7. >> tonight, our denver7 investigators are looking into the backgrounds of the deputies involved in the case. there were two separate previous lawsuits filed against one of the deputies involved here. records indicate that the city settled them both. we'll let you know if we find out anything else. and with this decision comes some confusion especially after marshall's death was ruled homicide by the denver coroner. >>reporter: mitch morrissey was clear because the coroner used the medical term homicide, doesn't mean that anything criminal occurreded. he says there's a big difference between homicide and criminal homicide. morrissey said that michael marshall tried to go into an aaea of the jail he was not supposed to go in, that's why the deputies tried to stop him. they say that marshall suffered from mental illness and he had a psychotic episode in the jail

>> he was not choked, he was not gagged, he was not suffocated. and there was really no force used on him other than that force it took to restrain him, so nothing to indicate excessive forre again, there's no tasing, there's no striking, there's no choking. there are sixxsheriffs holing different parts of his body -- holding different parts of his body, so no one has to have more force thap anything. >>reporter: the deputies were holding him down by his arms and leg, one had a knee on his backside, and then one had his hand on his shoulder but none of them were on top of the suspect. he also said that the officers used the appropriate force to keep everyone safe that

lead to a heart attack, and deputies ask nurses reviefed him before he -- revived him before he was taken back to the hospital. lance hernandez, denver7. >> two different perspectives. right now, on thedenverchannel.com, the denver7 app, we have a full report of the district attorney office into maashall's death. police are looking for a man who grabbed a woman near the campus late last night. a woman says shes was walking home and says a man walked by her in x grabbed her. it happened near high and wesley. police say the suspect is about 6 feet tall with light skin, and about the age of a college student. one of the 16-year-old girls accused of planning a deadly attack in mountain vista high school has new lawyers, not clear why the change was made. brooke higgins is charged with conspiracy to murder. right now, littleton school officials are facing criticism after the 2013 shooting at arapahoe high school. claire davis died and the

failures in the system when it came to preventing the shooting. denver7 reporter mark boyle is in littleton tonight, and the superintendent admits that the school did not follow procedures. >>reporter: that's right, it was talked about when he was discussing this report that came out earlier this week. now, right now, board members are questioning him as well as some national safety experts, about what could have been done differently then in 2013 and what can improve now. now superintendent brian -- began this meeting tonight, by admitting those shortcoming and safety procedures and in documenting the mental health issues with the shooter leading up to the december 13th 2013 shooting. linda cannon, who authored one of these studies also spebt quite a bit of time talking about the importance of data collections on students, to uncover the risks of the students and deal with them. she also spoke about how critical it is to report

>> so we must make sure that students and staff and our communities and families understand the warning signs to look for, how to report them, where to report them, and the importance of timely reporting. >>reporter: now, right now, a safety awareness expert is addressing the board, talking about in his exact findings with regards to this shooting. some of those very pointed at the district. he's also making some recommendations, the board really wants to make sure it's clear they're not going to continue -- or they are going to continue to try to improve the safety plans that they have in place. live in littleton, mark boyle, denver7. this person has coofessing to do after stealinggfrom a church. the forefront church on south paten court. this person broke in there last week in denver, if you think you know this person, call the police. in arvada, police need your help.

christmas eve, the store on wadsworth and 58th. if you know something, call the police. and an audit has just wrapped up looking into whether the denver police department is guilty of racial profiling. the answer isn't too clear. denver7 reporter marshall zelinger is breaking down the report. and it is proposing changes here. >>reporter: one that dpt is against for sure, collecting data on each person they contact, whether they ticket that person or not, and that includes birthday, gender, race, reason for contact, and any action taken against that person. the audit found that denver police does not collect ennugh information when an officer has contact with someone that they don't ticket or cite. this makes it difficult to demonstrate that the department's bias policing policy is implemented and to determine whether or not the officer are engaging in racial profiling. >> my job is to point out the areas that we think need change and it's up to the police department, it's up to the

17, that cold air hanging in there, the gunnison valley. typical this time of the year. i want to show you the jet stream winds at 25,000 feet. we have a ridge over us for right now, look at this big trough out here, that means trouble with a capital t, that's a big low pressure system, causing the massive eastern storm, rain, snow, sleet, not pleasant at all. mild and dry through saturday for us. then this front is a minor little storm that will arrive on sunday afternoon. but it's not a big deal. tonight, clear, cold, and 20. tomorrow, the high temperature, expected at 50. sunshhne, mild, lloks very, very good. looking ahead, we'll put the bright spot on saturday, 55 degrees the third week of january, looking pretty good. sunday, a little front come s in, rain snow showers or flurries possible, but not much. monday is cooler and still tuesday and wednesddy. here's the look at the broncos forecast. we'll have perhaps a touch of light rain or snow during the game.
