has dismissed oscar pistorius's appeal of his murder conviction. he had appealed saying another court made a mistake when it overturned a manslaughter conviction and declared pistorious guilty of murdering his girlfriend reva steenkamp. the court's dismissal of that appeal clears the way for him to be sentenced next month. a white police officer in alabama is now charged for the murder for the death of a black man. lawyers for officer aaron smith say the charges are politically motivated but the dead man's family is calling for justice. abc's steve osunsami reports. from montgomery. >> reporter: this is the face of a young white police officer arrested in montgomery, charged with murdering a black man. 58-year-old greg gunn. police say 23-year-old aaron smith was working third shift last thursday, patrolling a black neighborhood, when he stopped mr. gunn, who was unarmed, and walking home from a card game. >> there was a slight struggle that continued for about a block or so, at which time the officer fired and shot and killed the suspect. >> reporter: smith's lawyer says
