we want to get started with jennifer hill in for rob. take a look at the heat coming for real. >> it's going to be very hot this weekend. when you walk out the door, you can't imagine it will be that hot. temperatures in the 40s and 50s at 8:00 a.m. it will be in the 50s by noon. the east bay hitting the 80s and the mid 70s. at 4:00, 90s being felt in livermore and concord and 78 degrees. 85 in redwood city. i will have a look at the hot weekend forecast. >> excellent. just in time for the fall the heat comes in. just in time for the friday. a sigalert starting after 3:30. overturned big rig at the columbus parkway from westbound 80. the direction coming through fairfield and slowing. distractions and all lanes are open, but the columbus exit and off and getting over towards highway 37 and redwood parkway through the streets of vallejo. 6:00 for the earliest clear up.

we will follow this as the commute builds. back to you. >> new this morning in just a few hours, a federal judge will decide whether all ex-cougs in california can resume. if the judge rules in favor of the death penalty, convicted murderer albert greenwood brown will be the first in line. he was found guilty of killing a 15-year-old girl in 1980 and scheduled to die wednesday at 12:01 a.m. brown would be the first to be executed in california in almost years. executions were halted in 2006 because an inmate claimed the process was cruel. the procedures have been updated. >> court proceedings could come to a stop for the rapist accused of kidnapping jaycee dugard if a judge ordered a mental evaluation of phillip garrido. the sacramento bee reports his public defender could argue he is not mentally capable of

standing trial. he and his wife nancy are accused of holder her captive in their home. they have been held in a placerville jail for more than a year. a community will come to mourn the loss of a family killed in their home in the san bruno pipeline explosion. greg, his mother and son are among seven people who died when flame devastated the neighborhood two weeks ago. the memorial starts at 4:00 at the first presbyterian church of burlingame. crews will clean up the torched area and spray homes with water trying to prevent dangerous materials from getting into the air. >> it's difficult. it's two weeks after the event and now we are going in and removing their home from them, but for the most part, they have been positive and they have been thankful. it is taking it off of their heads. they have enough to worry about.

>> clean up is expected to last through the end of the month. >> for looks like the state may be on the way to sealing a deal on the budget and while it sounds boring, scholarship money and senior services and the state offices like the dmv, parks and roads are all tied up because of the process. today in the bay's christie smith is live in oakland with more on when we could see a breakthrough. christie? >> reporter: good morning. it looks like the framework includes about $7.5 billion in cuts, much less than the governor and republicans were backing. they were looking for a number closer to $12 billion. it's slightly less than democrats were looking at which is closer to $8 bill glon cuts. the so-called big five spent a second day in los angeles. the governor was not feeling well and unable to fly to sacramento. they are trying to solve california's $19 billion budget

deficit. some of their plan relies on federal dollars that haven't quite been promised yet. the lack of a budget meant stalled project for cal trans and teachers not getting paid. certain checks are not going out. >> it's a good sign for the venters who are not getting paid by the state and college student who is don't have the loans to pay for the books. we are far from a final agreement. >> reporter: the state has been without a budget for 86 long days, that's the longest in state history. we are told negotiations should return to sacramento with details being ironed out this weekend and possibly a final agreement wrapped up by monday. live in oakland, christie smith, today in the bay. >> we will check back with you. >> a city received a million dollars in federal funding and not protecting kids like it's supposed to. the police department received

money to fight illegal methamphetamine. it included a policy to protect kid who is abuse or manufacture meth. the policy is not in plate. police say that's because meth production happens in more rural areas and the money is needed to fight traffickers and dealers. >> take a look at the man on your screen. he tried to rape a jogger on sunday. they think he's the same man who raped a woman in morgan hill last year. flyers are posted on the trail near snell avenue and colleen drive where the jogger was attacked. she fought him off by kicking and screaming. people who live in the neighborhood say it's shocking to hear about. >> surprising. >> it's kind of a gentle neighborhood so i'm surprised. a lost crazies running around. >> i don't want someone like that to ruin my way of my life every day. >> police say if you jog, partner up with someone who

keafrs carries oi whistle or pepper spray. don't carry an actual weapon that could make it worse. a student was assaulted this morning. a woman was on the second floor and a man grabbed her and swung her into a wall and pushed his body against hers. the woman was able to escape in her car. he was tall, white or hispanic and around 40 and 200 pounds with wrinkles cheeks. uc berkeley said they will lay off 200 people in january. that will be in addition 600 positions cut last year when the state forced the university to reduce ex-pens by $140 million. uc berkeley said the cuts will save an additional $20 million. >> your morning commute could look different if a new proposal gets under way at bart. they're considering several

proposeals, including advertising ramps on trains and corporate sponsorship of stations and billboards above bart's right of way. the plans are more stop and go. none have the full board support. the board said while bart needs the money, they don't want the rail ways to be an eyesore. >> we want to check in with mike inouye. >> good morning. no delays for the bart system and anyone named bart driving on 880 as well. the tail lights past the coliseum through downtown. the bay bridge not showing issues right now. friday light shows the lights closer to 6:30 and building during the course of the day. the traffic will build here quite a bit over the next couple of hours. we haven't seen problems so far. the transition off of hayward and over towards the foster city

side. back to you. >> we'll join jennifer king with the hot weekend forecast. >> hot in the 40s and 50s starting off right now. it feels so nice outside, but it will be this afternoon. many of us in the 90s. now that things are heating up and the air is stagnant, air quality is going down. we see lower air quality in the east bay and down through the santa clara valley as well. if you want to cool off, head to the coast over or towards the mountains. the inland areas in the 90s and some cases in the triple-digits. the heat wave will last not only through the weekend, but next week as well. not happening on the radar and the satellite in terms of clouds or rain. today's highs will get 92 in livermore. 90 in santa rosa and 83 in santa cruz.

welcome back. 5:13 and a live look outside. san jose with lots of mild temperatures to start. look what's ahead. upper 80s and we are heading well into the 90s. we will be sorting out the forecast as well as the morning commute in a minute. the bay area businesses use a lot of effort things. some of them are good and as scott said, some of them not so good. scott? >> sarah lacey of the popular tech blog, tech crunch, wrote the book on mark zuckerberg and other young billionaires on a book called once you're lucky, twice you're good. she interviewed mark several times. you told me once you have been covering mark for so long, the first time you called him, he picked up the phone. >> here did. he was so unmedia trained, but he proceeded to me the details of the round he closed.

>> he has got more media train and much harder to talk to. we have to speculate for a bit. what do you suppose his reaction is to all of this about the move he? >> i know because when i was working on my book that the movie is based on and being written, i talked to him since, he was hurt by it. even though he is say billionaire and leaving the company, she not a two-dimensional character and a human being. i don't think any of us would want a book or a movie made about our lives and the source material was angry ex-friends and ex-girlfriends and people you knew in college. he had no recourse. it is widely publicized this is mostly fictional. my hunch is he got over it a bit. >> even the author himself said this is largely a work of fiction. >> yeah.

i was telling you earlier i ran into mark's cofounder from his dorm room last weekend in san francisco. he hadn't had a chance to talk to him. he's an interesting person to ask because he's not at the company and doesn't have the investor or employer scrutiny that mark and the others do. he was laughing about it and didn't seem as worked up. i said what is the truth on how fictional it is? he's the guy who was there from the beginning and he said 95% fictional. >> start up entrepreneurs are usually not that interesting. we know a few. they are smart, but not that movie makingable. >> other than steve jobs and bill gates with pirates of silicon valley, there is not many movies made about these guys. when i moved here in the late 90s, it was sexier. mark say boring guy which is why they had to make a fictional movie about him. a real movie would not be that

interesting. >> thanks for being with us this morning. >> thank you. >> the movie comes out friday october 1st. >> while we are talking about it, a new documentary film is sparking conversation and debate across the nation. it hasn't really been released in most theaters across the country. it's called waiting for super man and it premiered in new york. the film takes a critical look at education in america. what the country needs to do to reform the way we teach our kids. the documentary is critical of teachers, but it also highlights the education success stories. director davis guggenheim said he was apprehensive about tackling the topic until he drove past three public schools while dropping his kids off at private schools. >> the idea that my kids were having a great education, but the kids in my neighborhood were not. that idea haunted me. >> that are may be a focal point

like inside the prison. >> some soldiers approached you? >> yeah. before i knew it, i was torn apart from shane and josh and thrown into a cell. that's where i have been for 14 months. the important thing to remember is that's where shane and josh still are. they are in the same size cell i was in, crammed in for no reason, committing no crime and they don't know when they will get out. they have to exercise on the space the size of a towel. there is little sun light and time out of their cell and no communication with their family. >> you can see the rest of the interview at 7:14. the president is in new york addressing the united nations and he sparked a u.s. walk out when he said the u.s. government planned and staged the september 11th terror attacks. time now is september -- indeed and 5:19. september 24th. good morning, mike.

83 in oakland and 93 in fairfield. the seven-day forecast looks like this. obviously it's going to be warm today and it's going to be warmer tomorrow and hot on sunday. i have to say wicked hot on monday with the forecast high of 97. if you are sensitive to bad air quality and remember, i gave you and everybody out there the pass this weekend for mowing the lawn. it will be too hot. >> that are makes you king of the hill. lindsay lohan is had headed back to court and could be walking out in handcuffs. her probation was revoked after she failed a random drug screening. the 24-year-old admitted to the set back on her twitter post. a judge released her from rehab and told hershey would go to jail for 30 days if she failed or missed a drug test. we will find out today is the judge is true to his word. 5:26 and an alleged cop killer brought to justice.

time is 5:30 and it is friday on today in the bay. we want to get you start and we want to get you started with the forecast which is a hot one. >> we are forecasting warm weather, not right now. it feels great outside. temperatures in the 40s and 50s and we will hold on to the 50s. by noon in the 80s in the east bay. 70s in the city and redwood city 82. at 4:00, it's getting hot. especially inland. 92 in concord. coming up hotter temperatures for the weekend. >> thanks a lot, jennifer. a bay area man is convicted of killing a san francisco police officer. a jury found steven patrely guilty of killing an officer with special circumstances yesterday. the officer had parked his cruiser in the middle of the road, trying to stop the man leading officers on a high speed chase in 2006. patrely slammed his stolen van into the cruiser, killing the

39-year-old officer. his father said he forgives patrely. >> mr. patrely, we forgive you. we are just human and we make mistakes. to your family, we bear no grudge. >> the jury did find him guilty of 10 counts and he could be sentenced to live n prison without the possibility of parole. sentencing scheduled back in court in october. >> a trial date is set for the young man who ordered the killing of chauncy bailey and two other men. an alameda county superior court judge ordered the man to stand trial november 8th. this trial has been delayed many times. jury selections won't begin until after january 5th. bay is accused of ordering the shooting of bailey working on the story of a bakery's financial problems.

oakland is getting an infusion of cash to fight violence. it's going to three programs that are a key part of measure y. the largest is $2.2 million going to the ceasefire program providing alternatives to gangs and violence and includes street outreach, case management and job training. they will help fund a program to reconnect children with school after release of juvenile detention. there is another 750,000 that helps them release from jail find jobs. the san francisco mayor campaigns in what's a very close race for lieutenant governor. newsom launched a radio ad that attacks the candidate for voting to raise taxes. the ad accuses him of cutting a book room deal with arnold schwarzenegger. maldonado defends his vote saying it was necessary to deal

with the state's huge budget gap. he will begin running his own and radio ads. the big five met at the governor's home in los angeles and worked out a tentative agreement. christie smith is live in oakland with a look at what the deal means. we are not quite out of the woods yet. >> reporter: good morning. there a lot of ifs in the equation to solve the $19 billion budget deficit. lawmakers relying on federal dollars to boost the bottom line even though the dollars haven't quite been promised yet. it is believed the framework includes $7.5 billion in cuts which is less than the governor backed. he was looking at $12 billion in cuts and dismantling the state's main welfare program. democrats have proposed six billion in higher taxes and $8 billion in cuts. the long stalemate, 86 days led

to the state controller saying he might have to start paying bills with ious. caltrans announced it had to freeze $1 billion in funding on the projects. the student programs for college students with financial aid and teachers have gone unpaid. >> that's a good sign for the state workers and a good sign for the venters not getting paid by the state and a good sign for college student who is don't have the loans. we are far from a final agreement. this delay of 86 days is actually the longest budget delay in state history and the constitution said lawmakers have to send a budget by june 15th and apparently this is kind of surprising. they only met that deadline times in the last 30 years. reporting live in oakland, christie smith, today in the bay. >> thanks for the update, christie.

good morning. we will take a look at the travel getting into the city. about 5:00 a.m., folks moved the cones on the golden gate bridges. four lanes with the headlights into the city. no problems as far as fog. visibility is great. when you are in the city, the remainder of the day and we have san francisco with oracle world continuing south of market. howard street closed around the convention center. tonight is critical mass that. may play into the commute that starts in justin herman plaza. watch out. caution for all. no major issues and you see the eastbound yellow chicklets, but that's typical. no major incidents and things are moving at 68 past ashby avenue. the toll plaza shows why. a light volume with traffic. the flashing lights at the

bottom in the approach to the area that is closed. that lane is close and they are redoing the toll plaza and no problems getting past the scene. an easy drive with fog earlier in the week and changes coming up for the weekend. >> clear and sunshine that will heat things up. right now it feels great. we have 45 degrees in santa rosa. 56 in san francisco. 59 in oakland and 56 in hayward and 51 right now in gilroy. unfortunately we have the air quality getting worse. earlier we had the strong onshore flow with great air quality as air gets stagnant. the quality gets worse. heat wave this weekend and it looks like the coast and the mountains will be the place to be. they will heat up into the 90s and some cases you might see triple-digits occurring sunday into monday. remember that when you make your plans. we don't have clouds to talk about and no rain on the satellite or the radar.

volunteers come out and we picked up almost 1.4 million pounds of trash. it's happening tomorrow on saturday, september 25th for a clean up location, visit our website at coast for you.org. it's the one time of the year where we invite californians out to the coast to clean up the creek and the beach and the local waterway to pick up the trash accumulated. >> even if you don't live near the coast or want to make the drive over, there is lots of waterways you have to take care of. >> there indeed. one of the big initiatives is to get people in the inland areas. we noticed a lot of debris comes from further up the water shed in these areas. if you can't get out to the beach, get out to the waterway and the creek, even if you see it on the street, that's a part of a larger effort. >> what do i need to bring? a pair of gloves and a trash

bag? >> in years past, we provided all the supplies for you. we are requesting that people bring their own. it's a new campaign. bring your own. we are asking people to bring their own bucket and gloves and or bottle. the reason for that is last year we actually used a lot of single use disposable items to put on the event. we used the 130,000 trash bags and single use gloves. the result is there is a lot of trash made on coastal clean up day. that goes against the mission of the event itself. we are asking people to bring out their own supplies so that we don't make more trash for the event itself. >> give us the website? >> it's www.coastforyou.org. thank you very much. >> meantime, it's 5:39 and congress is set to serve up a

run out. today in the bay's tracy pots is live in washington, d.c. with what lawmakers are trying to do about it and how they are trying to make school lunch healthier in the process. >> good morning. the house is expected to vote today on a bill that the senate already passed that would provide $4.5 billion over 10 years to reauthorize school lunch and breakfast and other programs and most importantly to boost nutritional standards to get junk food out of schools. this is expensive, but the obama administration said it's necessary. congress helped everyone else in the economy and time to help kids too. >> we find the political will to help small companies and small banks and now we are trying to ask them to find the will to help small children. >> most of this money would be used to give local school districts like yours a six-cent increase for every school lunch they provide. they haven't had a raise in the

rate in over 30 years. here's the challenge. the administration wants to pay for this with money from food stamps. by cutting back a program that was supposed to end later, they want to shorten in and end it in 2013. there democrats here on capitol hill who don't think it's a good idea with unions, teachers and the congressional black caucus as well. tracie potts today in the bay. >> we will be watching that next week. >> meg whitman may have trouble raising funds today in fresno. under fire for supposedly insulting the city in a campaign stop. >> what i was trying to communicate is the central valley and fresno is hard hit as places like detroit. >> whitman called into conservative radio stations in fresno and drew comparisons between fresno and the motor city that were both hard hit by the tough economy. neither liked the comparison.

marijuana is not legal for general use. how do you keep the expo itself within legal bounds? >> fairly easily. the california medical cannibis laws are clear and we have a consumption area for medical cannibis patients segregate and pleased and by the book. we are expecting a huge crowd and a beautiful weekend. we had absolutely no problems in april. 15,000 people in april. not one incident at all. >> when people get together to talk about cannibis and hemp, what issues are they talkeding about other than legalization. what's the talk? >> there is a lot going on. the movement for industrial hemp. north america, the united states and the best place to grow hemp in the world. we can't do it because it's related to the cannibis plant. there is the movement in oakland for industrialized growing.
