the roads. a lot of money. >> a lot of work needs to be done. california entered the record 100th day without a budget. they worked trying to hammer out differences and end the budget stealimate. the assembly passed the main part of the legislative package to close a 19 billion dollar deficit. they voted 54-1 in favor of the measure, but overall it was just barely enough support to reach the required 2/3 vote. the bill moved to the senate and lawmakers failed to pass it. they again began to work into the early morning hours. >> this is done. this was a hard negotiated agreement that is months late. that's not a good thing. >> while senate leaders are confident they will muster the 2/3 they need, the delay has the

state on the drink of issues u ious and cutting off funding for things like road projects. it includes no new taxes and cuts spending by $7 billion. new this morning, a chinese dissident who struggled for human rights for more than two decades is the nobel peace prize winner. the-year-old is the first chinese national to be awarded the peace prize. he is in prison serving a sentence for plotting to overthrow the ruling party. he was jailed in december 2008 for helping to organize a charter '08. this just in. chinese government is denouncing the committee. the peace ties violate the principals who they call a criminal. plous in southern california this morning are searching for two children who they say were

kidnapped from an apartment complex. 4-year-old jacob and 2-year-old justin were abducted while walking outside with their mother in anaheim last night. the 2010 silver or pewter dodge caravan pulled up and two men jumped out and grabbed the children and took off. 10 people are recovering for minor injuries after an amusement parks accident. two cars collided at the loading area at knot's berry farm. nine people on the cars and one person standing nearby was hurt. no injuries are serious, but they are trying to figure out what caused the accident. a big win for the giants, but little time to celebrate. game two is tonight. tim lincecum was sensational. he tossed a team postseason record. 14 strike outs that allowed two hits so the giants went on to win 1-0 over the braves. game two now tonight.

francisco of 79 in places like los gatos and 75 in danville. just about perfect. we will check in with him in a little bit. >> are new this morning, an american astronaut and two cosmonauts are on the way to the space station. they took off late last night and will spend six months on board the space station helping out with construction on the complex. the work is supposed to be finished later this year. the toxic sludge spill in europe could be just as big as the oil spill in the gulf of mexico. new figures show as many as 184 million gallons of sludge escaped from the reservoir. some of the that sludge already reached the danube. officials hope the immense size of the river will be enough to blunt the impact of the toxic spill and avoid environmental damage. it flowed south through a number

we are hearing that at the game there were like 44,000 fans and just about everyone digging in their pockets to buy something. that doesn't include the people at bars and restaurants and other places. what does this mean from the city. bars and straups and cabs and hotels? >> for the 44,000, about a third come from out of town. they spent about $175 each on average. that is directly into our economy and people who wouldn't be here otherwise. it's a great boom for the city. you throw it on at the beginning of fleet week, hopefully they want to stick around and stay throughout weekend. really get to see what industry is. on top of that, you get national coverage. all those georgia peaches get to see how beautiful our city is and they will vacation and if

using or stealing drugs from the lab. that said an investigation was conducted and the allegations are not true. he looked at the lab when he started a year ago and it passed an audit. he believes tle no wrong-doing, the investigation is continuing. that's not the only problem. dog training 101 will begin for the oakland police department. they will tour the spca and made the move after complaints about officer who is shot and killed an old and arthritic family dog. the tour is a pretraining set to begin in november. officers will be taught how to recognize signs of aggression. oakland police killed a lab as they were responding to a burglary call and a lot of people are critical of that shooting. it's 5:35 and news just in, the last jobs report shows the private sector added jobs and the unemployment rate stayed the same.

that's because of widespread government layoffs and unemployment at 9.6% as was expected. vallejo's six flags discovery kingdom will try to repair ay is lion's muzzle. the sea lion's name was sergeant neves and shot twice in the face. vets worked to make him strong enough for surgery. because of how badly he was injured, he cannot ever return to the wild. he is already moved into seal cove at six flags and in may made the debut. this was video. the man accused of shooting him will number court on october 19th. he pleaded not guilt to animal cruelty charges. >> area of contra costa county should be better protected from the west nile virus. crews roll in the trucks and coming up quickly the mosquitos on the hol ant track.

there were jobs create and the private sector created 64,000 jobs and we are losing all the temporary census workers and additional state and local government jobs too as cities and states around the country deal with tight budget crunches. there was a revision from the summer. another 15,000 jobs lost there. the biggest decline in construction and manufacturing. how would the democrats and republicans spin this. this was the last report before we go into elections. democrats and president obama will focus on the fact that we are not getting significantly worse. we are slowly picking up the private sector jobs. they will talk about the census effect as temporary. emphasis on temporary. republicans will emphasize the fact that we are losing jobs in the country. 95,000 in the last month and the construction remains depressed which has been a big part of this economy and a big part of the recession and the recovery. the bottom line, 14.8 million
