around lunchtime and popping off at 76 degrees in san jose. 73 in oakland and a nice 67 today in san francisco. new this morning, it is up to the senate to get the state budget passed. they improve a plan with a 54-1 vote last night. it's a $19.1 billion deficit. they count on tax collects as well as more money from the government. we will have more in a live report in a few minutes at 6:05. >> the last job numbers report shows the private sector did add jobs, but the unemployment rate stayed the same at about 9.6% because of widespread government layoffs. we will have more on the impact of this new report in a bit at 6:45. >> tens of thousands of tourists are adding to the normal number of visitors coming into america's greatest area. the giants, the raiders and

and two hits and no runs in that game. we want to remind everyone, it's time for game two. that starts at 6:30 in san francisco. matt kaine will start for the giants and tommy hanson gets the start. >> candidate jerry brown is apologizing for a phone call recording where a campaign aide called meg whitman a derogatory name. >> hey, scott. give me a call. jerry brown. love to talk to you. >> you will be able to hear the rest of the call coming up at 7:05 on the "today" show. brown was reportedly calling a police league to ask for an endorsement. apparently he thought he hung up the phone. the voice mail recorded the conversation where brown and his aides talked about pension reform that whitman agreed to exempt public safety officials and it implied she will cut secret deals with unions. it was released by the police

union. brown's campaign released a statement saying this was a jumbled and inaudible recording of a private conversation and at times our language was salty. we apologize to ms. whitman and anyone who may have been offended. whitman's campaign said this was an appalling and unforgivable smear against meg whitman. >> next tuesday brown and whitman will square off in the third and final gubernatorial debate in the bay area. tom brocaw will moderate. protesters are expect and security say concern. the job of making sure that everything goes smoothly falls on security director harry barber. his security team is unusual because they are all family. >> my son, evan owns the company. i work for him. his wife works for the company as well and my daughter works for the company. >> the retired san rafael police officer and his family said the

one vote shy of getting a budget, a main budget passed out of the senate. they have tried this roughly four times at least. the latest effort was about 5:15 this morning. a big swing and a miss as they came up that one vote short. just moments ago, i talked with the leader and said what's the sticking point? what is the thing that is keeping this one vote from switching? he said "it's a myriad of issues. it's not one thing." it doesn't sound like we are getting close to getting that one vote to switch sides yet. however just in the last two minutes, the democratic side went into caucus to discuss things. perhaps there is movement and discussion on possibly coming up with some kind of an agreement to get that one vote they need to pass the budget. again, we are 100 days late. this is a record marked by triple-digit days we have been without a budget here at the

capital. what has got to be the further blow is the fact that the assembly not only passed the main budget, but got through all the trailer bills that go with the budget. they got done with the entire package and they are on the way home. the senate have yet to get the main components of the bill passed on one of the trailer bills. senators struggling to do what they are electioned to do. get a budget pass. live here at the capital. we will bring you the latest as it becomes available. >> as you mentioned, 100 days late. thank you very much. >> police in southern california are searching for two children who they say were kidnapped from an apartment complex. they say 4-year-old jacob and 2-year-old justin were abducted while walking outside with their mother in anaheim last night. she said a 2010 silver or pewter dodge caravan pulled up and two men jumped out and grabbed the children and took off.

it is 6:09 and i want to check the commute closer to home. >> good morning. we will take you to the bay bridge. we have an incident on the incline as you get past that toll plaza where there not yet any metering lights. folks were heading up over the entrance to treasure island. we will show you the camera and the back up at the toll plaza in the cash lanes that moved from the incline up out of this area. these are now better because the vehicle has been moved over towards the treasure island exit and off of the access roads up at the upper deck. things are starting to back up as the volume increases. a wider look at the maze shows no major slowing and the earlier accident at 580 and 24 cleared up. we have the slowing westbound at highway 4. that shows up on a friday at about 5:30 and continues a through l street. again through pittsburgh and bay

awarded him the peace prize for the long and nonviolent struggle for fundamental human rights. china said it's blasphemy. >> allegations of misconduct is shake-up another bay area city. oakland police chief said internal affairs got a call a couple of weeks ago from somebody claiming misconduct. they did not give specifics, but a source said it involves allegation that is a lab technician is using or stealing drugs from the lab. that said an investigation was conducted and the allegations are not true. he said he looked at the lab when he started a year ago and it passed the audit. even though he believes there is no wrong-doing, the investigation will continue. another controvercy to solve. he will keem up with the east bay spca today after officers shot and killed an old arthritic family dog. officers will be taught how to interact with animals and recognize aggression.

that training will begin in november. >> 6:18 and 10 people are injured after a roller coaster accident at a popular amusement park in southern california. two roller coasters collided at knot's berry farm. one person standing nearby and nine people on the cars were hurt. none were considered serious, but they are trying to figure out what caused the accident. >> police think a father used his kids to break into cars. security cameras caught a man at a casino in atlantic city. at first it looks like the man is walking with his three children, but you see him carrying one child and the kids, the oler kids run off with a package and police think that he used the kids to steal a couple of tvs and a laptop. they hope the video will lead to the suspect. >> an american astronaut is on the way to the international space station today. scott kelly hitched a ride on a russian rocket. they will dock at the space

coliseum. they are coming off a loss to the texans and the kickoff is 1:00 sunday afternoon. the 49ers will be on late on sunday. they are still trying to pick up their first win. the eagles will be in town for sunday night football. you can see that here and that game starts before 5:30. a very important note and the metering lights turned on earlier, especially for a friday. that is moved off the bridge, but the back up formed and going back towards west grand avenue. by the time you leave the house, that's one of the big slow downs. another issue may be the giants playing. look at the bart system. that's a great option for this morning and this evening.

contribute to the pension plan as well. in fact the new budget we are talking about counts on the pension savings and the governor is going to be in san jose late or this morning to talk about the plan. we expect that to happen at 9:00 this morning. >> tensions with the people of afghanistan are rising. nato helicopters fired on afghan militia killing six people. nato said the men fired first. the explanation wasn't good enough. hundreds marched in the street shouting death to america and long live the taliban. nato is looking into that shooting incident. a country in the mideast is backing off from a threat to cutoff services on blackberry smart phones. the united arab emirates was planning to shut off messaging because of security concerns. that service will remain. giants fever is spreading across the bay area, especially after last night's big win.

they beat the braves and fans are ready for game two. it is tonight at at&t park. christie smith has a look at how this is boosting the city's image. >> estimates are that last night there were 44,000 fans out there watching the giants win at at&t park. a third are not even from san francisco. the math here is great. they are spenting about $175 each. this has a ripple effect on bars and restaurants and hotels. about 8-10 people are even ordering out at restaurants here just too nervous to cook at home. we have fleet week going on and for many on the east coast, it's a rare chance to see the giants in action on tv on a national stage.

>> bank of america, gmac and jpmorgan chase stopped evictions after employees admitted to robo signing. signing the documents without reading them. halting the foreclosures is a temporary fix because many say a lot of homes end up in foreclosure anyway. >> people are having a tough time because the latest job numbers are a mixed bag. they added jobs, but the overall unemployment rate stayed the same. tracy pots is live in washington, d.c. with the impact of the news on the campaign trail. good morning, tracy. >> good morning, everyone. it's still 9.6%, same as last month. compare that to 12.4% you see in california, the situation is worse. a lot of people are looking for jobs right now. almost 15 million of them. last month we lost jobs. 95,000 of them. there jobs as you said being created. private sector jobs and the

health care industry adding jobs. they are being canceled out by two things. the loss of temporary census workers which we have seen in recent months and also now the loss of a number of government jobs. 159,000 of them which includes those census workers, state jobs and local jobs. in fact the local job losses. we are talking about local government jobs, education jobs and many of them teachers. they were the highest in 28 years last month. that's going to have a huge impact as democrats and republicans try to keep their seats here in washington. this is a big election issue. expect the spin on both sides as they try to explain the numbers. republicans say it's because democrats have not done their job. democrats say we have done our job. they left us a really big hole to big out of. live from capitol hill, tracie potts, today in the bay. >> thanks for the update, tracie.

good morning. 6:46. get out of there. it's almost 7:00. we have the volume of traffic continuing to increase. northbound 880 where the warriors are playing and further north you find this. the maps with debris reported in two spots along the nimitz free. a reporter around the embarcadero. a crew heading out as well as another towards the broadway exit. reports of a haller or a truck might be partially block the off-ramp. we ought to see major slowing heading through downtown through the toll plaza. the slow down is on the berkry curve through berkeley and emeryville towards the toll plaza where the metering was turned out early. that will affect the morning commute. keep in mind this weekend brkly is playing ucla.

there thousands of fans estimated to spend about $175 a pop here in the city. more than half the fan who is don't go down to the game today are ordering food in. too nervous to cook while the games are going on. we have fleet week and the city as you said on the national stage. fans feeling good about the smoking hot giants. >> what do you think is does for the city? >> serve pumped up and we want them to win. it does a lot. >> are they going to do it? >> yes, definitely. >> it is estimated that about a third of the fans come from outside san francisco. >> everybody is geared up for the game.
