seven-day forecast coming up. first breaking news with respect to the morning commute with mike. >> good morning. the deadly accident i told you about, let's get a shot of northbound highway 87. the flashing lights, the entire freeway is closed between capitol and kurtner. this is northbound 87. the alternate is to get over to almaden expressway getting back on to northbound 87. this closure will last up to five or hours. there a number of accident scenes that force people over to 101. we are watching for the ripple effect. this won't be good for san jose, folks. back to you. >> thanks a lot. the two candidates in the race for governor will battle it out in the final debate. meg whitman and jerry brown are dodging controversy. we expect to hear questions about whitman's former house worker and brown's staffer using awful language in reference to whitman and charms that foreign money is being used to fund the

attack ads. christie smith is live in san rafael with more questions they may face. >> dominican university is certainly ready. they will have 800 people in the audience for this last televised debate. folks here on campus thinking of a lot of questions they would like to see answered. california has at least 1/5 of voters undecided and that's who they are going to probably aim for. republican meg whitman is under fire for her treatment of her undocumented housekeeper and democrat jerry brown is under fire for his staffer's use of a sexist remark when discussing whitman. the dominican university event allows the candidates to reassure their base and democrats are not as

he is not on the witness stand, but he told his lawyer he wants the jury to hear his side of the story. garcia is accused of hiring a middle man and a hit man. if convicted, garcia could spend the rest of his in prison. >> a story out of the south bay. a substitute teacher is charged with sexual assault on minors. police say 64-year-old most recently taught at mckinley elementary school. they say he could have worked for san jose unified. if you have information about the case, call crimestoppers. california is selling off property and that includes four buildings in the bay area. it's a move to close the state budget. they made a deal with the private companies to sell 11 state buildings for more than $2 billion. among the buildings, the civic center, public utilities commission and the harris

building in oakland. the judge joseph a. ratigan building in senta rosa. ownership will change hands, no government offices will move. the san francisco district attorney is now getting a big endorsement in her run for state attorney general. president obama is supporting harris over republican steve cooley. the president and harris are old friends. she cochaired the campaign for president two years ago. president obama said harris understands the needs of all americans and he needs allies like her fighting for change across the country. meanwhile coolly is getting support from papers up and down the state. the bakersfield californian, fresno bee, l.a. times and sacramento bee endorsed him. the president will make a california stop on his list before the november election. he said he will be in los angeles october 22nd to support barbara boxer's senate campaign. she is in a tight race with

republican carly fiorina. on october 27th, michelle obama will be in los angeles campaigning for boxer. >> politics to a little baseball. giants riding high this morning as they wake up closer to a world series title. >> a real battle in atlanta. the braves took the lead twice. the jin his to fight back. they did it big in the seventh inning. another one of the braves's scores right here. this is the final out of the game. anyway, the giants go on to win it, 3-2. after a little champagne, they flew back to san francisco. today in the bay's bob redell is live at the pine crest diner, hoping to catch up with a few fans who might be up early this morning or staying up late. >> good morning to you. you have a lot to watch here. they have been watching the highlights and know this will be the talk of the town this morning. the giants will have the first

accident that occurred early this morning. northbound 87 has closed in the last half hour. fully close friday capitol expressway to kurtner. that will remain in place, that closure for five hours. that will be a major impact to the morning commute and highway 87 as it gets congested. the alternate with monterey highway and highway 101. it's early right now if you get on to the roadways. light volume and get over to almaden and take that north and up on to the 87. the reason for this length of closure is because it is a deadly accident, a number of incident scenes and possibly five or six related incidents in the area. the chp has to investigate. we will follow it closely and it does not look good for the south bay commute. >> sounds like it could be a tough one. >> yesterday was warmer and it could be warmer today. >> it will be out to the coast. we are talking 92 in san

francisco. 90 in san jose and 95 in livermore with a red flag warning. excessive heat warning up and down the inner bay. oakland and san francisco and hayward and fremont. hot temperatures through thursday and we cool off for the weekend. >> time now is 5:10 and a northern california principal is in trouble for the unique way she got a student to stop talking. 40 u.s. states won an investigation into the recent foreclosure scandal. scott will explain why that may not be in your best interest. eastern ukraine killing 40 people and leaving 10 in critical condition. the accident happened as the bus tried to cross the track, ignoring a siren that an on coming train is coming. they ordered the government to pay each family of the dead victims $12,600. >> it's a showdown with the government. we will plan to raise the retirement age by two years to 62. it would raise the age of eligibility for a full pension from 65 to 67. france would still have among the lowest retirement ages in the world. secretary of state hillary clinton not doing any campaigning for the mid-term elections. she is spending the week ahead doing administration business. that hasn't stopped rumors that she will still go after joe biden's job in 2012 or even another white house run in 2016.

reports that american soldier may have accidentally killed a british woman in a failed rescue attempt in afghanistan. british aid worker was held captive by the taliban. u.s. and nato tried to rescue her, but the grenade exploded. she died friday. president obama has called british prime minister david cameron to express condolences. they say the rescue attempt was necessary. it is essential to try to get to the bottom of what went wrong. >> an elementary school principal got creative with duct tape in the classroom. she used it to take over a first grader's mouth. it happened in the sacramento suburb. elizabeth is accused of using duct tape after the child refused to stop talking. the parents say they support the principal's actions. the school board decided to refer the matter to the legal

counsel. >> attorneys general and as many as 40 states are going to announce a huge investigation into bank foreclosures today. california is deciding whether to join in. they want to know if lenders broke foreclosure laws when taking back homes from delinquent borrowers. it's an issue process being called robo signing. bank employees and affiliates sign off on paperwork on foreclosures without reading or reviewing the thousands of required do you means. >> the fear is that if this practice is taking place at a couple of servicers, it may be taking place at all. >> investigators want to know if people that are losing homes are losing them for legitimate reasons. a big issue going on. >> a slow down in the number could sound like a good thing, but if you are a regular homeowner making your payments, this can hurt you. >> the housing market is a mess.

not because of low prices and very little buying, but because of high uncertainty. if you take the homes that were likely to be put on the market due it foreclosure and hold them off the market by not foreclosing on them, that is going to adto the uncertainty and depress prices. it's an imperfect analogy, but you want to take it off quickly or slowly. the housing disaster is the biggest obstacle to economic recovery and jobs. the problem that the banks once again created is extending the length of suffering. >> more pessimistic news. a well regarded group called business economics expects growth to slow down. put another way, while they think things will get better, the speed at which things will get better will slow to a crawl. they expect housing prices will gain about 1%.

well under the rate of inflation. it may be up to the fed to solve the problem. they will talk about buying more assets. the fed is one of the biggest legals now that there is. we live in a world in which the government owns home mortgages is a strange world indeed. >> lots of things changing. you can call it as the silicon valley turns. here the new ceo will start his job by testifying in court. he is a witness in the corporate espionage trial of oracle. that's why where he works for more than 20 years. the fight is over damages that they stole customer support material from oracle and allegedly tried to steal it for customers. the peninsula humane society said they lost more than $2 million in private donations and a contractor ran into a series of problems and has been holding

the money. the new center at burlingame should be ohm. it will have a two-story indoor dog park with sky lights and cage-free living quarters. nearly $20 million in private donations have been raised, led by larry elson. the humane society has filed a lawsuit against the contractor. good morning. it is 5:19. we have an accident. a deadly accident shows you here northbound 87, all these flashing lights in towards downtown san jose. this freeway is close friday capitol expressway because of an overnight deadly accident and a number of others at that scene or along that stretch. we will take you back to the maps to show you what's wha i'm talking about. this is where we see slow downs around 6:15. a lighter volume of traffic and folks are getting by almaden expressway and back north of kurtner.

that is getting by, but over the next hour or so, the volume increases and as it moves past the 6:00 hour, we will see the impact on the rest of the freeways. get on the roads early. more traffic on monterey highway. highway 101, you will see slowing and we typically see this in addition northbound 87 as well. to stay clear, you might want to take 85 to northbound 17. that's a lot of extra miles. keep in mind the south bay will be thrown into a jumble because of this investigation that will continue because of a series of accidents between capitol and kurtner, the most severe is a deadly accident between a car and a motorcycle about 4:30 this morning. the rest of the commute is shaping up smoothly throughout the maze and the vicinity. northbound 880 and the map i showed you had speed sensors showing you close to the limit as you approach the toll plaza. northbound coming up past the colise

we have an update on the developing news out of antioch. firefighters now say they do have a fire knocked out at an apartment building before 4:00 this morning at a large complex on gentry town drive. we are told there was a gas line feeding the fire, but it has been capped. seven unis are so badly damaged that nobody can live in them now. it happened near buchanan road and no reports of jurisdiction, but we are checking into it. there is a breathing support unit to help just in case. what started the fire is under investigation. because of the dry and at times warm conditions.

69 now and 67 in san francisco. the flag is pointing off to the west over the buildings there. 59 in oakland. further inland out towards the trivalley and livermore starting off to 70 degrees. we show you the temperatures and 75 in napa. look not too far away. the incredible temperature difference seeing the winds this morning and seeing dry continues and higher up in elevation. the north and east bay, also a heat warning, eszive heat warning in san francisco over oakland, hayward and fremont into the afternoon for today and tomorrow. two days of low 90s. we suspect even near the water line. satellite view is impressive with a storm missing us to the north. we are being baked under this high pressure and we should start seeing changes. low 90s inland, but finding the

closed or just about 4:08 this morning, we had an accident involve ag i motorcycle. reports are there is a deadly accident. in the meantime, a number of other beings between capital and kerner. an investigation for each one. at least three and possibly five. we are looking at possibly five hours before that opens. you see no cars and just the emergency vehicles. you are looking at highway 101 that causes the ripple effect. we will follow this close to the 6:00 hour. watch as it happens on the other freeways. we will follow this closely and send it back to you. we are watching the winds chloely. red flag warning into the afternoon. an excessive heat warning for highs around san francisco and oakland approaching the 90s. mid 90s further inland.

back to you. >> thanks a lot. meg whitman and jerry brown will meet face-to-face for the final time before the election. the latest average of the polls shows brown is pulling ahead. he now has the lead of six points. tonighty gubernatorial debate will take place at dominican university. that's where christie smith joins us with more on how the university is getting ready for this. it will be a big event. >> it is. hundreds of people out here. i wanted to say we had a chance to talk with a couple of students up bright and early this morning. they are going to be watching this very closely. what they are telling us is their decision comes down to the economy and education, specifically education funding. they want to hear from republican meg whitman and democratic challenger jerry brown on what they would change as governor. the state has a $19 billion deficit and they want the leader

who can take the state in a new direction. here's what a graduate student just told us. >> i have left leaning tendencies so i say brown, but if meg whitman has a strong debate, i would not rule her out, especially on the education issue. >> a spokesperson for the university told me they have been feeling a number of e-mails from people hoping their questions might be passed on so they can be answered in the debate. live in san rafael, christie smith today in the bay. >> thanks for the update. >> the debate will be moderated by tom brocaw. >> approximate are scott joins us and brocaw will get the questions to the canned days and ask them tough ones. >> shake them up a little bit. we are tired of hearing the same message, politicians speaking

without specifics. he thinks politicians are too rhetorical with no conclusive answers. he is going to ask pointed questions. not necessarily ask the same question of both candidates which should give them less time to prepare a stock answer. >>. >> do i have a kind of inventory of the issues i think are most important and i want to get to them, but i want to address exactly the frustration you have just voiced. we can get to a beginning, middle, and end and try to get to a solution. >> hoary got his start in california in l.a. and has known every governor since 1966. in 1966, would have been pat brown. >> a lot of browns in politics. thank you very much. voters in the east bay will weigh in on a big decision. that affects women. measure bb is considered by some a crime-fighting tool to keep the streets safe.

measure bb is a revision of measure y. a bill that brings in $20 million a year. programs like street outreach depend on the money. >> when there is a shooting in oakland we are in the hospitals and the funeral homes because that's a part of the violence in oakland. >> those who are against measure bb said if it passes, they are not sure if it will be properly used because a lot of problems were made with the measure y money, promises that were not kept. >> a new traffic light is about to be turned on and people in the community hope it will save lives. oakland councilmember brooks will flip on the switch on the new signal at the corper of 64th avenue and foothill boulevard. it's near a school zone where a girl was struck and killed by a driver as she walked through the crosswalk on her way to class three months ago. brooks helped secure funding for the stoplight and a lot of

drivers speed in that area. the signal is set to be activated at 10:00 this morning. 5:35 and nurses plan to picket outside a hospital this morning, protesting they haven't had a contract since july. the hospital's proposal would cut benefits. live from oakland this morning with the latest on today's strike. good morning. >> the strike doesn't officially begin for another hour 1/2 or so, but folks started gathering outside the hospital under a welcome sign that you can see behind me. the problem is that the nurses want a contract that does not include a pay freeze or a contribution on their part for their health care benefits. the hospital said they cannot afford to do that. they lost $69 million over years and can't afford to pay nurses a raise or fully for their health care benefits.

although the nurse's union said 700 members are agreeing to strike. they will be out here today, tomorrow, and into thursday to prove the point at the hospital that they could lose more than just money if they can't come up with an agreement. >> this hospital being able to provide the kind of care it has been, it needs to have the nurse there is to do it. >> children's hospital in oakland said they had replacement nurses ready to step in. if you need to bring your child to the hospital, you get the care you would have gotten yesterday. more 700 nurses say they will be out here picketing and striking come sunrise. they expect to see all of them out here lining the streets near martin luther king and 52nd avenue. we are going to go inside and talk to a representative to get their side of the story for you this morning. live in oakland today in the bay. >> thank you very much, chris. on to the next round. the giants getting geared up for

the national league championship. the team landed in san francisco just a few hours ago. most likely tired. they are headed home to get a lot of sleep. much-needed before getting back to work. the team has a few days to prepare for filly and it's back on a plane and off to pennsylvania. here's how the series will work. two games in philadelphia, on saturday and one on sunday and they are back in the bay area in san francisco for game three and four. those will happen on tuesday and wednesday. so far we don't know when the games will be played. as soon as we know, we will let you know. . good morning. it's 5:38 and take you out there for a major issue. i have the motorcycle on the map there. that's on northbound 87. the freeway is currently closed between capital expressway and kerner. we will continue to be closed for possibly another four or five hours. that's well into the morning commute and pushes folks over to

classroom when is we have to do things in front of our peers, we have a fear of being judged. that is what people are most afraid of. the fear of being judged and saying something wrong or being caught in a lie. a lot of politicians have to choose their words carefully for that very reason. >> they are measured sometimes. you can see the thought process. >> absolutely. they are processing a bunch of different things. mostly how is this going to affect this wide swath of listeners i have to address and how am i going to please all of them or make sense to all of them at the same time? >> what do you think you should look for when watching a debate? >> i completely separately from public speaking, you are looking for the things that affect you and are important to you. if you are looking from a technical point of view and a speech teacher's point of view, you can see where they are on and off script. they are straying from the

preparation. that's one of the things you can control in your public speaking when you are afraid of speaking in front of people. the thing that helps is preparation. >> being ready. you are saying there breathing exercises and things that can help. the whole mental thing. >> absolutely. again, i'm a teacher of theater and dance so one of the things we have to train is that ritual of warm up and preparation and breathing and being able to inspire your creativity and your thought with a series of exercises and stretches and deep breathing exercises to keep you on voice the whole time you are speaking. a lot of politicians suffer from vocal exhaustion and you hear it over the course of a campaign. they start off strong and they have a completely different voice all of a sudden. it has a lot to do with breathing and keeping voices healthy. >> there is a way to get over it. we thank you for joining us.

new this morning, clean up continues on the toxic sludge that spilled in hungary. workers are trying to build a war to protect the area in case there is a flood. the damaged reservoir where all of this came from has several millions of gallons in it. it's not leaking though. the government took control of the company that is responsible for that spill. in chile, final tests are taking place on the capsule that will bring the 33 miners back to the surface. we don't know exactly when the rescue will begin, but the team coordinator did tweet "the miners sleep their last night together." means they could get out by tomorrow. medics will go down into the mine first to determine who gets to come out first and last. 5:55 and closer to home, nurses at oakland's children's hospital will be walking the picket line. they haven't had a contract since july and they don't like

the proposal in front of them. it would cut health benefits. chris sanchez joining us live from oakland with more on what's happening this morning. >> good morning. you can see the folks that started to gather for this strike that's going to begin in about an hour or so. 700 nurses will walk the savement outside oakland children's hospital to protest the contract that they say they just can't swallow. here's what we are talking about this morning. the unionized workers and nurses got raises over three years and the hospital wants to put a freeze on it for the next contract negotiation. they want nurses to pitch in to support the health care costs. one option requires the nurses to pay between $11 and $311 forever the coverage of their families. the hospital over the last years, this is a lot of numbers, but over four years they lost $69 million. they just can't afford to cover
