conditioning turning on. 60s and 70s and upper 80s in san jose and mid-70s in the forecast today around oakland. >> are new video of fire crews mopping up an early morning blaze at the 7-11 on almaden expressway in san jose. fire officials told or photographer that the fire was contained to the attic and the roof of the building. probably started in the back of the building. the laundromat next door suffered damage and will be closed today. luckily no one was hurt. >> the hot weather is forcing allen rock park to be closed again. the city said it's too hot and there is too much wind to keep the park open. it is too dangerous. if the weather conditions change, the park could reopen as soon as tomorrow. >> a warning for residents on the peninsula this morning about gas line work. pg&e will work on a gas line near hills borrow to improve the gas supply before the winter

according to the u.s. geological survey, there is a 63% chance an earthquake with the magnitude of 67 or greater will occur before 2031. in and around the bay area, schools and highways have been retro fitted. the bay bridge is being worked on with construction expected to be done by 2013. in the last two decades, a lot has changed and thousands of private homes and apartment buildings are still vulnerable. most of these buildings were built before state building codes were upgraded and others were built on landfills that could cause buildings to collapse in a major quake. hospitals and some of which have fallen behind to retro fit their buildings because of the high cost to do so. an earthquake emergency preparedness drill is going on at pier 45 in san francisco. that's expected to start at 9:00

record of assault and making criminal threats. >> a string of holy heists in san francisco. chiefs are ransacking everything from donation cashboxes to computers from religious centers. police say church looting, particularly in the city's southwestern districts are happening at an alarming rate. there have been nearly a dozen robberies at six churches between august and september. investigators say a few thefs seem to be linked to one person. the others could be homeless people taking advantage of outreach. parishes are trying to work with police to get more security. the wait is almost over. the giants will hit the field for another work out in philadelphia. the team arrived yesterday and took part in a short work out. they couldn't go on the field. the tarp covered it because it was raining. baumgartner will pitch game 4 and not pitch tim lincecum on three days's rest.

>> a boy scout who wants to help a south san jose elementary school will try to get through red tape. ryan bird will have to file the proper paperwork to build benches and tables near the soccer field so they can sit during recesses. it got stobbed by the oak grove school district because the union wouldn't approve of the idea. the district superintendent told us there was never a formal request. >> i feel really good. i thought it was just dad and i had to find a new project. all my work may not have gone to waste. >> his mother said she will file the paperwork later today. >> the first group of rescued miners are out of the hospital in chile. they went through a full day of tests and all 33 are in surprisingly good health given they were trapped a half mile underground for over two months. they plan to release more miners later today.

the only miner who is not working. they are talking about o livian guy. the 24-year-old was the fourth to get out wednesday morning. a neighborhood drugstore for is sm and a meth making superstore for others. those are the federal accusations against cvs and they will pay $75 million in fines. they allowed repeated purchases in pseudoephedrine without monitoring buyers. they add the lack of safeguards lead to a spike in trafficking and it violated drug rules in more than 20 other states. hard to detect and often untreated, there is a blood test that can help. head injuries are easily missed because they don't show up and

just ask jerry brown. he gave california state employees collective bargaining powers. since then the unions have grown stronger and stronger. now state employees can retire at 55 with much of their salary for life. and taxpayers are on the hook for one hundred billion dollars in unfunded pension liabilities. no wonder those unions are 100% behind jerry brown. he'll just spend, and spend, and spend.

monday is the deadline to register to vote. if you want to vote in the november election and if you want to do more than vote, you can. the alameda county election department is looking to hire about 4500 poll workers. jobs range from attendance to precinct inspectors. pay ranges from 85 to $180 a day. you need extra training to do the job. oakland, berkeley and san leandro will have vote this is year. instead of picking candidate, you pick out several. here's the top and the number two and number three. >> interesting. let's check the forecast. it's been a hot week across the bay area. i think change is in the works. >> we have seen summer in october. another day into the 90s and today the coastal fog is back spilling into the inner bay. that means even the inland spots cool down a little bit and we are talking more than a subtle

you know it's bad when the press asks if you'd take a lie detector test. meg whitman didn't tell the truth about not voting or about how long she lived in california. she got caught in insider deals at goldman sachs. she changed her story about physically abusing an employee. she campaigned as tough as nails on immigration knowing her housekeeper of 9 years was undocumented. her tv ads have been condemned as false and misleading. and even her hometown newspaper said meg whitman has demonstrated "a loose relationship with the truth"

and san jose near the mid- to upper 80s. 76 in oakland and by 4:00, san francisco is cooling into the 60s. >> just into the newsroom, a sketch of one of the men police say was attacking people at a court tower back in august. take a look. officers say this man and another one attacked two people before 2:00 on august 21st. both of those men took off. if you know who this man is, call san francisco police. it happened at a 7-11 in iron wood. inside the store, here is the brand-new video you can see. the firefighters are inspecting the ceilings. it probably started in the back of the building and a laundromat

next door was damaged. they are closed today, but nobody was hurt. >> a curveball could cost the city a plan to win the oakland a's. live at the oakland coliseum, she joining us now with the details. it's all about the money. >> that's right. it all comes down to the money and the possibility of not having enough to secure those last couple of parcels of land needed to build a stadium in the south bay. it appears the redevelopment agency is feeling the effects of the recession. a bit hearder than well over a year. there have been talks of moving the a's to san jose. the redevelopment agency is buying up pieces of land in downtown san jose hoping to get major league baseball's approval to build a ballpark there. there reports of the agency that represently has been cut nearly in half personnel-wise. it hay not have enough money to seal the deal.

there is speculation that lou wolf may step in to help buy some or all of the land. he said "whatever issues we run into, we will figure out a way to get them done." the mayor chuck reed deeply committed to the project saying there multiple ways to put it together. we got word that the san jose city council and the sant sa clara board of supervisors are meeting this morning and one of the items is the stadium. live in oakland, kimberly terry today in the bay. >> thank you very much, kimberly. >> giants fever is back and this is when it kine of gets nerve racking for the fans and the big name players too. by the end of the day, the giants roster will be finalized and the big names may not make the cut. philadelphia is greeting the giants with a major noreaster rain storm. the field was closed and the giants had an optional batting practice at indoor cages.

san francisco, we have all lanes of northbound 101 blocked at caesar chavez as a result of an earlier injury accident. the ex-at the present time is unknown, but the freeway is closed. getting folks over to 280 northbound, that is causing slowing as well. we will follow thisdaley and closely as we hope it clears, but the back up is starting to form out of south san francisco into the city. we will look at the bay bridge from the east bay. we have the metering lights curned on, but the fast track lanes are slowing. we still that have repair work blocking the far right lane. here's the shot. here the cars for yesterday yet. it's going to result in back ups

gas supply before the winter months. people will likely smell gas and hear loud noises. work is going to wrap up around 8:00. pg&e is not going to interrupt gas or electric service, but we definitely wanted to pass it along so you wouldn't be concerned about the sound and smell. >> the city may be running out of steam in the quest to bring the a's to the south bay. kimberly terry is live in oakland with the latest financial set back. >> reporter: later on this morning a meeting is set to discuss the future of the oakland a's. a joint meeting between the council and the board of supervisors scheduled for later on this morning. for well over a year, there have been talks trying to lure the a's to move to their city. the eamgs has in fact been buying up pieces of land in downtown san jose, hoping to get

major league baseball's approval to build a ballpark. there report that is the redevelopment agency that has been cut in half personnel-wise may not have the money to seal the deal. city leaders are looking over the redevelopment agency's finance as the agency continues to work on securing the final parcels of land they need. the mayor chuck reed has been deeply committed and hopeful about it and saying that there multiple ways to put this thing together. while all of this is going on, the commissioner of major league baseball is still waiting on a report for the viability of the move. beyond finances, there is a way to go before any stadium is built. today in the bay. >> thanks a lot, kim. >> new this morning, whether you are wearing ice skates or throwing a football or strumming a guitar, there plenty of things to do or watch. live at the shark tank in san jose with more on what he is

calling the feast of fun. good morning. >> good morning, laura. it will start here tomorrow night. the sharks with the home opener for the tent 102011 season. they will have a pregame rally outside hp pavilion and the game is at 7:30 versus the atlanta thrashers. the sharks are not the only major franchise. the giants are of course in philadelphia and kicking off the national league championship series and taking on the phillies. you can see them yesterday. the players boarding the bus at at&t park to take the trip to philadelphia where they are at, warping up for the first two games. first is tomorrow at 4:30 and the second is sunday at 5:00. over to candlestick on sunday when the 49ers will host the raiders kickoff at 1:05. we checked on line and the single game tickets are sold out. by the way, the raiders are 2-3

and the 49ers are hoping for a win at 0-5. in the south bay, the san jose state spartans will take on the broncos. tickets are still available for that game at 5:00 tomorrow at spartan stadium at san jose state. if you have too much sports on your mind, you want to chill out with october fest. it's in historic downtown from 10:00 to 6:00 tomorrow and 10:00 to 5:00 sunday. in other words, there is pretty much not much to do this weekend. you will be sitting on the home bored to tears. >> i will come to your house. that's why we love the bay area. >> the weather should be better. some of these events they are talking about it being hot. not so much now. it will cool off. >> good timing. the two golf tournaments in town with danville and san martin. today is the last of the warm days inland. we have the fog near san francisco as we go through the weekend.
