we can talk weather or how awesome the giants are. your choice. >> the giants are awesome. >> the weather could play a role. right now in the east bay, 60 degrees approximate a south wind at 9 miles per hour and concord is 57 degrees. southwest wind at 6 and we have clouds inland this morning. 54 degrees and southwest wind at close to 5 miles per hour. here you see the clouds on the approach. closer to 5:00, we may have drizzle for the morning. the showers look to hold off until we head towards night time. you may see isolated showers into maybe extra innings at the ballpark. east bay and beyond, 68 degrees in livermore and 60s across the board from the low 60s around the inner bay to mid 60s in concord. today a slight chance of showers late. a lot of rain in the forecast.

support since september. prop 19 would tax and regulate cash crop making it legal for people over 21 to have the drug. the group's mom say yes to prop 19 believe carding for pot would help keep it out of the hands of teens. we talked to sociologist mom about why she is pushing for legalization. >> i am supporting it as a mother because i could see when my kids were growing up that number one, they had more access to marijuana than anybody. i could see a system that was anything but controlled. >> the mommy supporters admit there a lot of details that have to be worked out. prop 19 legalizes pot under state law, but the feds are promising legal action if prop 19 passes. an indian tribe with plans to build a casino are a step closer.

had onmental groups that opposed construction plans reached an agreement with the tribe. under the new agreement, 3/4 of the proposed 400 acre site near the san rafael bridge will be preserved as open space. the casino project includes 4,000 slot machines and 1,000 hotel rooms, a convention center and housing for 114 members of the tribe. new this morning, a lot of simulated shaking going on. simulated because it's only imaginary. an earthquake that teaches people how to drop, take cover under a table or desk and hold on. the entire state will take part newscast drill called the great california shake out. eight million people are signed up to take part. it starts at 10:21 this morning. bob redell has a live report at 5:05.

bart trains are putting the brakes and grind to a halt for one minute at 10:21. they encourage people to participate on the 142nd anniversary of the last major dwik shake the hayward fault. east bay commuters prepare for back ups to improve the water system is causing big problems for drivers. construction on a section of pipeline through fremont is expected to create traffic delays at several intersections across the city through mid-december. right now construction is under way at the paseo padre parkway. the work is part of a program to replace older pipelines with new lines designed to with stand earthquakes. the pipeline is part of the water system that supplies water to more than 2.5 million people. let's join mike. what does it electric like out

bay and south wins through oakland bring temperatures up to 60. in livermore and 57 in hayward out of cal state east bay. low clouds. 53 in san jose. southwest winds at 17 through fairfield, but this morning we are talking drizzle. later on we could see showers coming and the system is falling apart as it approaches the coast. we will have enough lift as we head through the evening and overnight hours. scattered showers closer to 9:00 to midnight carrying us into early tomorrow morning. bay area temperatures around the east bay with upper 60s and 65 for dublin. cool for richmond and oakland and south winds making for a mild start, but as clouds spill this, we won't warm up a lot. the seven-day forecast will show when the showers shut down, we catch a brief break, but more rain on saturday and sunday and some of it could get heavy around the north bay. >> coming up, a chance to pay it

welcome back. as you take a look from the bay bridge this morning, a charter school is a step closer to winning approval. the board of education members voted to conditionally approve the k-12 flex academy charter school yesterday. supporters say the budget and education program are sound. the school will draft conditions for the county education board to review next month. if the board does not agree, trustees can reject the school's application. it will be easy for you to make a difference in the east bay this weekend. make a difference day is saturday. do-gooders have a choice of more than 20 volunteer projects in fremont, pay ward and union city. volunteers can clean up the homes and yards and prepare weed and soil at an organic vegetable

morning, they heard several gunshots. i asked how many and this person said 40 to 50. driving through this area, we have seen a lot of police cars buzzing back and forthright now at waverly and king which seems to be at least part of the focus of this activity where a lot of squad cars park and a lot of police here standing by. it's hard to tell what is going on in the actual further into the neighborhood. an active scene here at waverly and king. san jose police very busy dealing with a situation of shots fired. >> i want to clarify that you say you heard shots while you were there? heard two sets of shots. >> we know of at least two sets of shots. that the neighbor told me about where there were several shots, 40 or 50 in his estimation and i would say at around 4 time 40,

the united states. the newest problem for america's number one car is a fuel pump and brake fluid. toyota recalled more than 10 million cars and trucks worldwide for problems ranging from faulty gas pedals to floor mats that can trap accelerators and brake problems in the prius. if your car is impacted, you will get a notice. they will fix another problem for free. the full list is on our website. nbcbayarea.com. the deep water horizon rig exploded and 11 people died. millions of gallons of oil spewed into the gulf of mexico. it was the worst environmental disaster in our nation's history. now a happier later, the region is trying to get back on their feet. >> people were back on the beaches. the six-month anniversary of the

gulf oil disaster. oil is no longer gushing into the sea and people are returning to white sandy beaches, bp continues its deep beach cleaning operation. >> if there is buried oil, we go in with the tillers. >> even though the well is permanently sealed, oil is still coming ashore. 560 miles of coastline have oil on them across four states. 93% of gulf waters are open for fishing, but louisiana shrimp catch is down 52% through the first six months of the year and then the rest of the gulf coast economy. >> seems like groundhog day every day. >> businesses crippled by the spill continue to pile up claims. only 76,000 have been approve and paid. >> we are pulling teeth to get things done and fight a battle it seems like every day. there is so much to be done.

the therapy would be targeted towards patient who is don't respond to anti-depressants. the current depression therapies are treating the symptoms of depression and not the underlying cause. they think the cause may be in part a missing protein responsible for the feelings of reward and pleasure. scientists are testing gene therapy with a small number of patients. >> babies born in november and december face a higher risk of food allergies which could be in the first three months of development it's the spring when pollen is at an annual high. researchers studied 6,000 children and found those whose first trimester ended by april or may were three times more likely to have milk or egg allergies. they all lived in one area so broader samples are needed to finish the study. >> the giants are inching closer to the world series. they are one win away and preparing for today's crucial game.
