6:01 am
apparently not responding to police thus far to their requests for him to come out. they want to figure out if he was hurt in a shootout that took place around two hours ago. this developed yesterday when police tried to arrest this man on a warrant. he got away. around 4:00 this morning, they found him here a couple of blocks away from where we are at right now. he is at tampa and seminole. they approached him getting out of his car and then it was the shootout. he has been in the car ever since. one resident we spoke to said there were about 40 to 50 shots. that's what he estimated when he heard the shootout after 4:00 this morning. around 4:40 as we were pulling up on the scene, we heard three more gunshots. haven't heard anything since. one officer was hurt by flying glass. he is going to be okay. one of the colleague told us he was taken to the hospital, but he is going to be okay.
6:02 am
there several police officers out here in the neighborhood. they do have the man surrounded. they have evacuated some of the residents in the immediate area where the car is parked. they are waiting to figure out what the next step is. they figured out we are waiting to see what their next step is going to be. reporting live in east san jose, today in the bay. >> she is alone in the car and alive, but they don't know if he was hurt and shot in the earlier shootout. he is moving. they do have their eyes on him and have him surrounded right now. it's a standoff. no more shots being fired in the past hour and 20 minutes. >> i asked if he was alone. i think bob is having trouble hearing us. we will figure that out. i believe the man is alone in the car and appears to be alive. the first reporter on the scene

this morning. >> we are following how this is going to impact your commute in the south bay. that is a pretty big street. mike has the latest on that. >> king road is the major street through the area and close to actually. it's close to 1 very 1 as well. these are major roadways. bob was at the interaction of tampa and waverly. avoid tampa for sure and the entire area. a lot of activity affecting king road and may potentially affecting actually as well. that's the black line and capitol expressway is a grit wi to stay clear of the incident. the 680 and the 101 or take you over to story road that will take you past the scene as well. we are looking at an early slow down north of the interchange that may be an issue. we will track that and the rest of the south bay commute is moving nicely and south down towards the santa cruz mountains. thick fog and it hasn't had time to burn off yet.
6:04 am

6:05 am
instead he will be attending a fund-raiser at the home of google exec marissa myer. instead of her apartment on market street. this is not for everyone. the $third,000 a head fund-raiser and the committee reception in atherton. looks like there won't be a huge traffic clash. this morning at at&t park, obama might have an eye on the game despite him being from chicago. >> he is a white sox fan. we don't need that bad mojo. we are all bandwagon jumpers. even president obama can jump with us. he is more than welcome. >> apparently he doesn't do this very often. he is holding a photo op. a $6500 a person fund-raiser for the candidate and san francisco district attorney who worked very hard for him during his
6:06 am
presidential campaign. we are told he is going to be spending the night in san francisco. reporting live in san francisco, christie smith today in the bay. >> thanks a lot, christie. a reminder to get the best election coverage on the web at nbcbayarea.com/prop zero. you can read up races that matter to you. >> the military's don't does don't tell policy is still in place. the ninth circuit court of appeals should keep the policy in place for the time being. the judge froze the policy last week. approximate prevents openly gay people from serving in the military. the obama administration argued while it favors repeal, doing so would create tremendous uncertainty about the status of service members who will reveal their sexual orientation. the appeals court supported the request. so the policy remains in place until the appeal process.

6:09 am
>> it's halladay versus lincecum. if the giants win, they move on to the world series for the first time since 2002. tonight's game starts before 5:00 p.m. you don't want to miss anything. >> for has been fun. >> last night is fantastic. >> 6:0 mine and good news about the economy. scott is here with that. >> we don't normal low focus on weekly jobless claims because the dita is too fine to draw conclusions. it's good news. fewer people walked into the unemployment offices last week sending the jobless claims down 23,000. we are seeing most of the people that do apply for benefits for the first time coming out of the government. as private industry laid off earlier, the tax base fell and that forced the lay off of teachers and firefighters. it's their turn. facebook is changing again.
6:10 am
you can now drag and drop your facebook photos, moving them around any way you want, helping you organize. one of the way it helps is you can move photos you want to keep and don't want to see down to the bottom. most specifically ex-girlfriends or ex-boyfriends. you will be able to get the photograph to hold in your hand. >> you are not supposed to keep that. >> time now is 6:10. he has a snapshot in the morning smut. >> let me take you out to the maps. northbound 101 off of 680, one reason might be because we got reports of debris. the washer, i don't know if it's a dish wash or or clothes washer, not a washer you might use with the bulb.

6:12 am
as the clouds fill in, it won't be a warm day. jacket weather and keep the umbrella if you head out late in the evening. we expect the showers to hold off until tonight and early friday. rain off and on on sunday to wrap up the weekend. >> that's fun. triplets. >> locked inside. cabin fever. >> 6:12 and winning a lotto jackpot once is nice. how one man did it seven times. >> there is a shift in the race for governor. see who is taking the lead in a new poll. >> we're will update breaking news in the south bay this morning. shots fired and an officer is injured in a sand off. we will have the latest up next. >> a live look outside in san francisco. a great evening for baseball. only if you are headed out to at&t park. [ male announcer ] carly fiorina.
6:13 am
she's against banning assault weapons... and that's reckless and dangerous. she's for risky new oil drilling that could threaten our jobs. fiorina's plan would mean slashing social security and medicare, which would devastate seniors. and she'd make abortion a crime. no wonder fiorina is endorsed by sarah palin. carly fiorina. just too extreme for california. [ boxer ] i'm barbara boxer and i approve this message.

6:15 am
. we continue to follow breaking news. officers are briefing us. this is ronnie lopez, a spokesperson for the san jose police department. >> are you block him off so he couldn't get away. >> it's tough for me to comment on the tactical methods. we did what we could to prevent him from escaping. there was a plan developed. shots were fired. >> did you know of an officer taken to the hospital. >> it was nonlife-threatening, basically glass cuts and scrapes to his face.
6:16 am
he was treat and pretty much released. that was probably due to the exchange of gunfire. >> there were 40 or 50 shots. does that jive with what you are hearing. >> it's way to early to hear how many rounds are fired. i hate to speculate at this point. >> is he wanted for attempted murder? who was murdered? >> it was attempted murder so no one was murdered. it was a prior incident and not something that took place today. >> can you describe the scene? >> i can't you the exact proximity. i can paint a picture of the parked vehicle facing southbound on tampa near the intersection of seminole. officers probably directly behind in several positions attempting to make communication
6:17 am
and not necessarily responding to our commands. >> why not take them out? >> he already exchanged gunfire with an officer. we are trying to do this asly and securely as possible. >> are you injured? >> we are not contacting him. he is not responding to our verbal command. >> we heard he is yelling help, help. >> say that one more time? >> he was yelling help, help. >> i can't confirm it. no one hold me that. >> has his car been struck? >> i'm certain -- i haven't seen the vehicle. they have been struck. how many times, i don't know. >> can you give us an idea of the police presence? >> we would consider this to be pretty much full tactical call out at this point. we are trying to take this individual who is obviously
6:18 am
armed and has exchanged gunfire with an officer as safely and quick low as possible. multiple officers are on scene including special operations units. >> there was a call for more ammo. are they short? >> it's different types of ammunition. when you hear the word rounds, it's not necessarily bullets. it could be less lethal. requesting more ammunition. it doesn't have to deal with it. >> 40 rounds? >> 40 millimeter rounds. >> it's a different -- it's not -- it's completely different. they are not requesting for more bullets. >> you releasing information about the suspect? >> not at this time. >> that's sergeant ronnie lopez with an update on the standoff. they this man surround and we did hear from another officer that he was screaming out help, help. police are trying to coax him
6:19 am
out of the car and yet to comply with the order and could be because he was injury and being stubborn and refusing. meantime reporting live here in east san jose. >> this is going on on king road in san jose around 5:00 or just before. bob redell is one of the first reporters on the scene gagering information. he was hearing from witnesses there were several shots fired, maybe 40 or 50 and he heard two or three himself. the scene is still ongoing and they are working on getting the man out of the car. >> a new poll shows jerry brown is in the lead in the gubernatorial race. they found brown with an eight-point lead over whitman. 44% to 36%. margin of error is throw.1%. 16% of voters are undecided. looks like the difference could be women and latino voters.
6:20 am
when it comes to latinos, brown had a stunning 51% to whitman's 22% despite strategy targeting them. women also favor brown 47% to there%. it shows men and white voters are divided. californians are souring on the ballot measure to legalize the use and cultivation of marijuana. the poll found 44% of likely voters support proposition 19 and 49% opposed. that is a decline from last month when 52% supported it. we started to see the traffic evening out on northbound 101. now about 55. we will see it bringing down as more folks head to the area.
6:21 am
some of these folks will get hamper hampered. we told you about the washer report and it's a washer and a drier in the middle of lanes. the southbound side as you come past de la cruz. avoid the area and the area of south king near seminole way. he just did his live report and on scene for the shooting. officers in a standoff situation. avoid king and actually. if actually takes you past king, don't do that. use capitol expressway 101 to the south and story to the north. it takes you over to 680 to stay well clear. we will look at oakland as traffic pszs smoothly through the area. a lighter volume is starting to pick up past the coliseum and speeds around 60 or 55 at the worst as you head up through downtown and the bay bridge toll plaza where we see the back up. the metering lights may have
6:22 am
been turned on. the cash lanes are backing up and start to slow down as well. you see the clear shot with 18 minutes and closer to 19 off the bridge. we will look at more news after this break.
6:23 am
6:24 am
>> start an stadium and the head coach mike mcintyre is here with us talking a little bit about a football. we will get to the big game and the rivalry with fresno state in a minute. i wanted to ask you about the new talk about the big hits and the nfl has been cracking down. there were some of the big hit this is past sunday and trying to get rid of them. what's your take on the situation? >> concussions are serious. we found out more and more about it. it's the second concussion that you get after the come back from a first too quick. a lot of procedures you go through and the head to head contact is something we realize causes problems later on in life. it's important to take care of.
6:25 am
>> can you talk about the way it hits? some of these are against what we call an indefensible player. >> you put your face in the guy's number and wrap up. they are coming in like a missile and hitting guys, especially guys wo can't defend themselves. that's what they are talking about. >> you want to put it on the football. when the ball is in the air, you are jumping to the ball and you turned to hit the guy. sometimes they are not viciously trying to hit them high and end up having the collision. sometimes they are trying to go for the hit to not jar the ball loose. it's a tough man's game and it's tough, but i agree. >> initially the helmets and face masks were designed as a protection. they are a weapon.
6:26 am
it's interesting. we have something from penn state head coach and he said for years i have been saying get rid of the face mask because it's a weapon and gis are fearless. if you go back to the old leather helmet days, in a sense you will be much more hesitant to deliver a blow like that. what do you think? >> when they first started playing football, you couldn't put your face in there. then people break their noses and different things like that. the face mask protects. i agree that it's become a battering ram and that type of thing. they need to curtail it to understand and protect the other players. >> fresno state is up and you have a couple of injuries because of that? that's a rivalry? >> we have two young men out because of the testing procedure and they will be back and we are excited about playing fresno's big time rifle. there will be a lot of people here for the game. >> with a lot of the changes, some of the rivalries are still there. thanks as always for coming by.
6:27 am
appreciate it. laura? >> good morning. we are watching drizzle in spots and later on, we could see scattered showers dropping back into the bay area. highs only 60s for pretty much everywhere. low 60s and oakland is upper 60s. around game time for the giants, it may have misty skies and most of the showers should hold off until friday morning and plan on rain off and on through the weekend. back to you. >> are president obama's west coast swing brings him to the bay area. where he will be and how it will affect you. lincecum versus halladay. fans getting ready to see if they can punch their way to the world series tonight. cut a backroom deal that will give our state's wealthiest corporations a new billion dollar tax give-away, a new handout that can only mean larger class sizes
6:28 am
and even more teacher layoffs. but passing prop 24 can change all that. prop 24 repeals the unfair corporate give-away and puts our priorities first. vote yes on prop 24, because it's time to give our schools a break, not the big corporations.
