nancy pelosi and held at the fair mond hotel. it is expected to wrap up around 8:00. >> bell beaches closed because of a deadly shark attack. a 19-year-old student was body boarding with a friend off the beach north of santa barbara when a shark pulled autopsy r him out of the water. scientists think it's a white sha shark that attacked. >> the sports complex that will be named in honor of a police officer will be decided tonight. the soccer field will be located behind st. francis church on bay road. the planning commission will decide whether to approve or reject the project. the supporters say without approval, the project could lose critical money. the officer was shot in the line of duty in january of 2006 and last february. alberto alvarez was sentenced to die by lethal injection for

highest alert earlier this morning. the volcano is classed at a red code. almost 12,000 people will need to leave their homes in case that volcano erupts. richard is now a tropical storm this morning. it's over guatemala. it was a hurricane when it passed over belize yesterday. the national hurricane center said richard may drop as much as six inches of rain. it is expected to weaken as it moves further inland. >> here's a little insight to what teens say about sex and their sexual orientation. a study out of new york city and the high school students reveal nearly 1/10 of sexually active students have at least one same-sex partner. they had sex with males and females report higher than average rates of dating violence and teens with at least one

same-sex partner claim they were heterosexual or straight. the study is published in today's medical journal of pediatrics. this is the last full week of campaigning. polls predict republican wins in a lot of races and a possible house take over. the gop is confident they may take the senate, but democrats say don't count them out. >> what are democrats specialize in is the turn out. the more people turn out, the better we do. >> if it continues over the last few weeks, you can see the senate as well. >> turn out varies. there is a lot early voting turn out and other parts, numbers are double what they were in the last mid-term election. >> president obama is making the rounds as the last full week of the campaign gets under way today. he will travel to rhode island to talk about the economy and raise more cash.

the president spoke in minneapolis over the weekend, telling democrats not to lose the faith. democrats are making a difference in the economy and the nation. he will deliver a similar measure in providence. a canadian man charged with conspireing and killing a u.s. soldier years ago will appear before a war crimes tribunal. he is behind bars at guantanamo and his attorneys are trying to work out a plea deal. he was 15 when captured in a bombed out compound. he faces charges cladding spying and throwing a grenade that killed army first class 50 for spear. >> economic forecasters are lowering expecting as and say the economy will still grow, but they are more cautious in the 3rd quarter. more than half surveyed expect growth are more than 2%. the national association for business economics survey

reveals that fewer firms expected to drop in employment through attrition or layoffs. >> all kinds of housing data will come out this week and scott doesn't like any of it. >> we get existing home sales today. tuesday it's case schiller, the very respected look at a number of different cities across the united states. home prices and then wednesday we get new home sales. two things we are looking for. the number of homes sold obviously and the price of the homes. the general bet is we will see solid numbers on quantity, but another slip in the actual prices themselves. remember back on friday, bank of america said their foreclosures were error-free. a few days later we find out the opposite. b of a found hundreds of mistakes in the first 1% of the pile of foreclosures it plans to file. earlier you guys were reporting

good morning to you. 5:23 and a live look at san jose where we have patchy low clouds. for the most part the rain moved on. the temperatures around the bay area in san jose, 56 degrees and a big change from the weekend with all the wind and rain. san francisco looking good this morning. 54 degrees. patches of low clouds and misty skies around the bay. what's left of the showers in the south bay moved on. you can see the one cell around

fremont and moving off to the south and east. offshore with a few showers here. we may see approaching the coast at times and maybe around the hilltops of the north bay. a stray shower and that's about it. most is heading off to the east and chain controls up around lake tahoe and interstate 80 and highway 50. we are sort of in an in between pattern. just a lingering shower or two around the hill tops and clearing skies and cool temperatures and highs mostly in the 60s. for tomorrow, another system across the coast, but this one far enough to the north it should miss us until about wednesday and thursday the chance of rain is dropping further south. around the bay area, not much in the way of microclimates. mid 60 no, sir san jose out fors livermore. 50s on the coastline today. to the east bay hills, lows in the mid 50s.

and more will be showing up in the seven-day forecast. >> we look forward to it. the rain is moving out, but the clean up is just getting started. christie smith is live in oakland with how things are shaping up right now. >> considering the nasty storm we went through, things are looking good in oakland. about 15,000 pg&e customers are without power. on broadway it was dark for hours, but the street lights and everything seemed to be back on again this morning. the evenings still lingering. we have new video for you from highway 84 near skyline boulevard where there was a road closure and live wires across the road. our cam ares couldn't get close to it because the wires are live. pg&e transformer blew and lines were shuting it down.

we are hoping to have it here. back to oakland at the height of the storm, 15,000 customers lost power sunday. 12th street bart station left in the dark and what happened is trains rolled through and they didn't stop for hours. this morning i spoke with the agent and she said that all trains rolling again and also the oakland fire department's dispatch center had to operate with a generator for a couple of hours and the oakland police department left in the dark for about six hours. there were no reported problems. pg&e said the equipment failure was due to wind and rain. the good news though is that all power according to pg&e has been restored. live in oakland, christie smith today in the bay. >> thanks christie. new this morning, activists will stage an exorcism against

live with a look at what it could mean for your kids. we knew that school is a place where they caught germs, but we know where they get them now. >> no big surprise that germ are in schools other but you might be surprised where they are congregating most. as the 6.3 million california students head out to class this morning, here is information your parents might want to know. the university of arizona did this study and went to an undisclosed school district and tested six school surfaces all over the school. here's what they found. the five germiest spot are the cafeteria table where your kids are eating lunch, the computer mouse, paper towel handles, water fountains and sink faucets where kid guess to clean up are those with the most germs. they're congressigating throughout the day in the morning about 13% of those surfaces had significant germs. by midday and afternoon, it was up to 50%.

investigators said they set fire to trace elementary causing more than $10 million in damage. today marks the start of a transformation of oakland hospital that has been in the works for more than 10 years. the summit medical center will break ground on the new 11-story building at 11:00 this morning. that project will include 238 private patient rooms, a new emergency department and a 1,000 space parking garage. sutter health is funding the project expected to be completed in 2014. >> if you were to search for a company having a bad month, the result would be google. >> all kinds of trouble. they are apologizing for the google cars that reported pictures and passwords and e-mails from unsecured wi-fi. an engineer had programmed the cars to do that even though it

brown gets a big lead over meg whitman. 52% of likely voters would vote for brown if the election were today. 39% said whitman is their choice. this is an l.a. times poll released yesterday and shows the lean towards brown in another poll last week. whitman appears to be losing women, latinos and voters who declined to say their party of choice. another goes counter to the up tick in republican support nationwide. a recent political poll shows republicans are getting 47% of likely voters and 42% said they are voting democratic. the interesting thing is 14% more independents say they are going republican this time around. that could have an impact on the race many are watching across the country. barbara boxer is in a tightening race with hp executive carly fiorina. the out come could determine which party is in control and
