an accident. they are perpendicular with the center divide, blocking the fast lane. that may be an issue in the next few minutes before crews get there. the east shore freeway moving smoothly. a 19-minute drive off of the bridge down through berkeley and emeryville. they will see the construction on the north side of the bridge and the tower being assembled as it was yesterday. focus on the road because others might be distracted we are showing you the pictures and more crowds for the world series and bart is adding trains for tomorrow and that's weather-dependent. back to you. >> early voting is under way and a race was left off of the mail in ballots. christie smith is live in martinez with more on the ballot blunder. >> reporter: good morning, brent.

the elections department here was not even aware that there was a problem until a voter phoned in on friday to say that a sanitary district issue that he was watching was not on the ballot that he received. the elections department then spent the weekend investigating and found out he was right. nine precincts were apparently miscoded. these are sample ballots and mail in ballots. the district selects sewage for 465,000 homes and businesses. the elections department then issued an apology and a statement accepting responsibility and promising to review the coding issues that are in the future. new ballots expected to go out today and corrected ballots will be at the polls on election day. this affects more than 2700 voters in alamo, danville, martinez and pleasant hill. the clerk reporter said if you submit a second corrected

ballot, unopened ballot will be held and destroyed. otherwise the first one will be counted. reporting live in martinez, christie smith, today in the bay. >> i murder trial could begin for two teens suspected of killing a san jose boy a year ago. in a hearing, a girlfriend of the suspect said the two talked about wanting to kill. the testimony opened the hearing yesterday in the case against randy thompson and jay williams accused of stabbing michael russell in the back yard of his south san jose home. the girls dated both suspects and would show her videos and photos of animals being tortured. at least six people will testify and a judge will determine if there was enough evidence for trial. >> two people allegedly prevending to be victims of the pg&e explosion face arrest and hefty fines after failing to appear in court.

they did not show up and accused of getting fake ids and said they are trying to get free services for victims. they posted bail last month. taylor may be in custody in san francisco on an unrelated charge. pg&e's extensive evaluations throughout northern california show some 300 manual shut off valves need closer inspection and found at least 38 gas leaks. four are in large high pressure pipes similar to the 1 that ruptured in san bruno. the rest were found in northern california, including more than a dozen in the bay area. pg&e said most can be turned off manually, including the ones located in san bruno neighborhoods. the utility said 300 valves should be replaced or retro fitted. the federal government is trying to crack down on bullying

throughout the country. live outside san jose state with more. >> reporter: good morning. the u.s. department of education is expected to be sending outleters to schools like san jose state. other universities and schools throughout the country to remind them that they have a legal responsibility to prevent bulling on their campuses. if a school turns the other cheek to ethnic, sexual or gender-based harassment and don't try to stop it, the government is warning educators they could be violating federal laws. the department of education said this bullying is a growing problem. having received 800 claims of harassment over the past year, involving students who are muslim or homosexual. last month, tyler clemente was an 18-year-old student at ruetkers and submitted suicide after his roommate secretly videotaped him with another man in his room.

that roommate and another student, a girl, faced criminal charges. the state of new jersey is being called the toughest anti-bullying law in the country. they want to establish a bill of rights that would require training for educators and how to spot and prevent bullying and mandate and investigate any incidents of bullying. the department of education is not just sending outleters to deter this bullying. will hold workshops to help them assist and deal with these types of problems. reporting live in san jose, bob redell, today in the bay. >> thank you, bob. 6:06 right now. a big step forward with their nuclear program. we have a developing story. >> a program that ron said is entirely peaceful. america and israel suspect otherwise. they said engineers have started loading the core of its first nuclear power plant.

the fuel was on site, but this was the first step to start up the nuclear reaction to make electricity. the problem is the byproduct in the reaction could be used in nuclear weapons and america and israel said they will not allow that to happen. meanwhile the australian broadcasting corporation reports the head of afghanistan admits to taking in his words, bags of cash from iran. iran said it has given assistance to afghanistan. karzai said he has been up front about the donations for years, telling then president bush his country was getting iranian cash. >> we are grateful for the iranian help.ñbcq!áeáu$áupáes i same thing, providing dosh some of our offices. if you like to have the details, we will give you that too.

time and a lot folks hitting the roadway. off the bridge heading over from san rafael. get off the bridge and there was an accident as you approach the merge with the east shore freeway. updated location, it's a little bit further back to the west and there is glass reported across all lanes of the two-car accident where they are perpendicular with the center divide. two lanes are reported blocked. this is counter commute right now at this point in time. things are moving nicely and still 18 minutes for the east shore freeway. off of the bridge down through berkeley and emeryville, no metering lights just idea, but we have the construction that will be a distraction on the north of the bridge. out of the city is off to the left. we will look at the flow with no major issues. the upper deck shot with the metering lights turned on any

unemployment, but good news. moody's economy.com said the job outlook for retail in the bay area is going to go up by about 7/10 of 1%. it may not sound like a lot, but it's hundreds more jobs for people who need them. they lot of them are starting this holiday season. toys 'r us are hiring 45,000 people and macy's 65,000 and kohl's 40,000. the list goes on and on. 2/3 say they will be hiring more people this holiday season than they did last year. >> they used to like me, but not now. they see me. the strollers. exactly. good news for the economy and workers looking for jobs. >> it is and folks trying to get around the bay area. traffic not looking too badly. slowing in the east bay though. >> things are slowing because of the volume building. looking good like you said for a

tuesday. we have more slowing showing up here. south of san leandro into hayward. because of the folks heading over to the bridge, reports that on that connector from southbound 880 into hayward, you have a disabled pickup truck on the shoulder. it was in lanes causing slow downs, but watch for that if that is your connection. if you are heading off of 880, we will have a live look with the taililates and a nice easy drive, holding up nicely across the high-rise that is visible today. peninsula not showing any more slowing. building along the east to the palo alto area. keep that in mind starting to build back over on the east bay, we talked about 880 north of the san mateo bridge past the coliseum. building up the volume and seeing the gentle slowing because of the volume of traffic. no incidents. what is a big deal is sunol.

ballots are expected to go out in the mail today. it was actually a voter who first noticed it. he called in to complain on friday that a contest involving the central contra costa sanitary district was not on the ballot. they are sample and vote by mail ballots. the department looked into it and found that nine presinkts were miscode and promise to review the coding procedures in the future. the correct ballots will be at the polls on election day in addition going out today. more than 2700 voters will likely have the bad ballot in places like alamo, danville and pleasant hill. the department said if you submit a second correct ballot, the unopened ballots will be held and destroyed, otherwise the first one will be counted. reporting live in martinez, christie smith today in the bay. >> thanks for the update. >> today supervisors will look at expanding the influence beyond the bay area when it

comes to lighting up. they are considering a resolution urging the food and drug administration to ban menthol flavoring in cigarettes. the fda banned other candy flavors because they are considered starter products for teens. they say menthol is a candy flavor. supervisors meet to talk about the proposal at a meeting in martinez. >> your retirement may not be in the bank after all. a report reveals a county pension fund may run dry in 15 years. that would leave the county and taxpayers responsible for $795 million in annual payments. the two professor who is authored that study say as the county tries to maintain the pensions, the retirement system will be forced to sell off assets, leaving the investment portfolio dry by 2025. the professors examined 77 pension plans in 50 major states. >> the suicide of a homosexual college student is turning the

spotlight towards bullying on campuses and classrooms. this morning that light is now shining on your kid's school as well. bob redell is live in san jose this morning with more on the story that matters to so many. >> reporter: good morning. today the u.s. department of education is sending outleters to schools and university campuses reminding them they have a legal responsibility to try to prevent bullying on their campus. if a school turns the other cheek to gender-based and harassment. if they are aware of what's going on and don't try to stop it, they warn that they too could be violating federal anti-discrimination laws. the department of education said it's a agreeing problem, having received 800 complaints over the past year, involving student who is are muslim because of 9/11 or who are homosexual.

tyler elementy was an 18-year-old student at ruetkers university and committed suicide after as roommate videotaped him with another man in his room. roommate and another student, a girl, face criminal charges. the state of new jersey is considering what is being called the toughest anti-bullying law in the country. legislators want to establish anti-bullying bill of rights that among other things require training for educators on how to spot and prevent bullying and mandate and investigate any incidences of bullying in the state of new jersey. federally the department is not just sending outleters to deter this type of thing from happening, but it will hold workshops for schools and beginning of next year to help them to assist them dealing with this type of problem. live here in san jose, bob redell today in the bay. >> thank you, bob. . >> are good morning. talk overnight that apple could
