new this morning, the clock is ticking to win over voters in the race for governor. where the top candidates will be stumping for votes the day before the big election day. oakland police asking for the public's help after a gunman opened fire at a halloween party, shooting nine people. we will fill you in on what happened tonight in the east bay.

good morning. it is 4:30 and the 1st of november. later in the year, but the temperature is actually going up. >> over the next few days out towards the trivalley and the east bay, temperatures warming up and close to 80. right now 53 degrees and oakland with patchy fog. the only thing showing you down, chilly towards fairfield. 47 in livermore and hayward at 53. you can see here, the clouds are moving to the north. high pressure building and day one of a warming trend that will put us mostly into the 70s. 72 degrees and highs in the mid 70s around livermore and oakland. we will see temperatures in the upper 70s inland and soaring into the low 80s. starting tomorrow in the seven-day forecast in a few minutes. >> thank you much. we have trouble on 580. >> we will take you to oakland. eastbound 580 and 98. an earlier accident after 2:30

was reported, an overturned vehicle and the ambulance was called and now it's just a lot of chp activity. a couple of reports being taken over. no major impact to the commute and westbound is your commute direction for the morning as it builds up. 880 going past 98th and a live look shows the lighter volume so far. it will pick up over the next hour. hour. kyéx%ó let you occurs. good past the coliseum.nv2qr >> the man accused of shooting a fremont police officer is expected in court. she charged with attempted murder in the shooting of officer todd young august 27th. he pleaded not guilty. his mother testified in court last week she could not remember what her son told her after the shooting. originally she described the

conversation that ended with her son admitting he shot a police officer. officer young is now recovering at home seven weeks after he entered the hospital. >> a manhunt is on for a shooter who hit nine people. christie smith is live with what happened. good morning, christie. >> good morning to you. the doors opened at 9:00 p.m., three hours into it. police say a gunman started shooting into the crowd. that sent people running for cover and into the streets or the bart station on 19th and broadway to get away. two of the victims were found. of the nine people shot, none were believed to be life-threatening and most of the wounds were to the arms and legs. this was inside of suite ballroom at 19th and broadway billed as the annual fright

fest. the biggest college party in the bay area. according to the tribune today, police believe the gunman may have initially fired at one man in the back. the others were apparently hit by stray bullets. the majority were women. people were searched at the door and it's unclear how a gun got inside a party and there were more than a dozen security guards working as well. there was a small fight before the shooting, but those involved had apparently left the party. police are asking for the public's help. there is a 45,000 reward for information leading to the arrest of the gunman. live in oakland, christie smith today in the east way. candidates across the country and the state are working overtime to pick up last minute votes before tomorrow's elections. jerry brown will continue his tour across california, visiting san diego, l.a., and salinas

before returning to oakland for a final rally. barbara boxer will join him and sunday brown was in riverside talking about his experience as a loyal public servant in his words. the form are governor and current attorney general speeches focused on his talking points. jobs, innovation and bipartisan cooperation. >> i'm ready on day to get this state government workinging together. republicans and democrats. while here today is democrats, we can't make anything work unless we think as californians first. before this event in riverside, brown joined other democratic candidates including gavin newsom at a rally in downtown sacramento. today's rally starts at 5:15. meantime we learned meg whitman will make a stop in men low park and she attended her last

full-scale rally yesterday. the scene here in burbank looking more like a victory rally than a push to the finish line. she talked about her talk points as a proven job creator and successful business woman. >> in two more days, we will start bring good jobs back to california. one of the first industries that we are going to keep here in california. we are going to set an objective of note losing a single entertainment job. >> whitman gave little credence to a field poll that shows her trailing democrat jerry brown by 10 points. other polls show the race is a dead heat. you can get a better idea as to how the voters plan to mark their talk because a director will have an update at the institute for governmental studies from 4:00 to 5:00 in

berkeley. don't be surprised to have an election volunteer at your door. they will be fanning out to talk to voters, part of a union effort to support candidates for work families. they will be pushing for jerry brown and barbara boxer. they will be phone banking for 4:00 to 8:00 in oakland. if you are planning to vote ob centee, the best bet is to turn the ballot into a polling place in person tomorrow. it must be received by 8:00 p.m. election day. no guarantee that will actually happen. tomorrow at 8:00 is when the polls close and we will start at 9:00, the nbc political news team will begin coverage and a special 11:00 newscast with your complete bay area and california

election coverage. an oakland company that employs 200 people wants to hire 1,000 more. city leaders will join four season homes products to announce the creation of those jobs. they make sun rooms and other products. today's announcement will be at 2:30 and we will get the details for you. one game is all it takes. this time tomorrow morning, the giants could be world champions. this after they beat the rangers in texas to go up three games to one. do not expect the rangers to roll over in front of the home crowd to give up the series. this would be a matchup of aces. cliff lee will try to make up for his melt down. the giants's tim lincecum will try to close out. tonight's game, potentially the last starts at 4:57. the waiters are on a roll. they are getting ready to face kansas city in oakland. more than that, they are looking

thanks to high pressure moving in and temperatures looking outstanding for this time of year. mid 70s necessary livermore and dublin. out towards the coast, the numbers are closer to the 60s. 71 degrees and oakland and berk low in the low 70s and upper 70s around fairfield and pittsburgh. the seven-day forecast will boost temperatures up and 80s inland and clouds spilling in and it looks dry as we head to the start of next weekend. >> a weird november. coming up, the giants focus in bay area baseball and the a's are making headlines. raj mathai caught up with baseball commissioner about the a's possible move out of oakland. why you want to allow extra time to make an airline reservation today. the information you will need to provide.

1070, the attempt by arizona lawmakers to crack down on illegal immigration in their state. president obama took the arizona law to court last summer, claiming the legislation interferes and violates the u.s. constitution. the case is held in san francisco because the ninth cirque out court handles federal appeals for nine western states including arizona. good news for tens of thousands of california parents. they get to keep their child care benefits temporarily. the cuts to the welfare to work program were supposed to go into effect today, but on friday an alameda superior court judge put the cuts on hold and said the state must wait for them to look at the merits of the lawsuit filed over the funding cuts. the hearing will happen on thursday. the welfare to work program helps low income working families afford child care.

about 56,000 kids are in the program. . good morning, folks. 4:45. you have another hour. 4:45 and early slowing is the question. that's why i was mistaken on the hour. we don't normally see this kind of slowing until about 45 minutes to an hour from now. we will watch for the early sign, but the travel time which was about 15 minutes is now creeping back down to 14 minutes and the average speed is closer to the limit. a smooth drive moving over towards that dublin interchange. after you move through sunol, no major issues. another 15 minutes or so for that. an easy drive and early accident, 880 has cleared from the roadway. that's better news for all. turning to rob, you think fall and think crisp air. not this week. >> not this week.

we are starting off the first week in november with cool temperatures, but the afternoons will be feeling warm. 47 in livermore and 46 in novato where we have fog down to about a quarter mile in spots. the radar view is dry and it will be staying that way for a while. high pressure and storm track off to the north and the temperatures starting today warming up nicely for any of the outdoor plans. mid 70s and into the inner bay, q+enw will be climbing into the upper 70s where you see where we are going. starting tomorrow. first week of november looking toasty and we will cool off through the week. election day nothing getting in the way of voting and as we watch for the weekend, cooler and still very dry for this time of year. >> thank you. new this morning, all the political ads you are probably sick of seeing are helping television stations get healthy.

at the week overall average, the nasdaq up a fraction to open at 2507. we have a squirmish in the cell phone business. apple claims that several motorola device including phones that run on the android software copied the display and technology. last month they sued for patent infringement. they were innovative, but now they are a common feature with smart phones and there was a fight over who owns the patent technology. we seal how things play out. >> we will watch. in politics, a fresh look at what voters are thinking one day before the election. a new "wall street journal" poll out overnight said tomorrow will be like a hurricane for the democrats. today in the east bay's tracie potts has the latest from the campaign trail.
