you will find it around the north bay and san francisco this morning. >> we will check for the effects of that and traffic so light it's not impacting anything. we have a slow down and traffic is light, but over the last 15 minutes, it's marked at 62 miles per hour, much more like what we are expecting to see. a 14-minute drive and closer to the speed limit and over the next half hour, this will start to slow and we will have an update in about seven minutes. new this morning, you may notice a lot of smoke near 101 in the south bay as may mop up a four-alarm fire in a nightclub. flame were shooting out of the roof when they arrived near 3:00 a.m. crews are working to put out the hot spots and a lot of smoke in the area. the center recycles plastics and metals. it burned the nightclub next door.

massive effort who champion working families. they will be pushing jerry brown, barbara boxer. they will be door knocking and phone banking from 4:00 to 8:00 in oakland. speaking of last minute campaigning, the governor is in town today running to hold on to the position and will number san francisco to host a rally. he will also make stops in redwood city, san jose? and salinas. gavin newsom will be in southern california trying to stump for votes there. in the meantime, we learned meg whitman will make a stop in men low park. she will be at men low park cafe. she attended her last rally yesterday. she kept her talking pointing, casting herself asconstitution. the case is being held in san francisco because the ninth circuit court handles the cases in nine western states including

according to this poll that support is actually fading. this was released days before the election. prop 19 is of course the state initiative that would legalize marijuana. .y voters are starting to change mind getting more details on what legalization means. it is a touchy subject and a lot of people are not that comfortable telling a stranger they support legalizing pot. here's how the numbers stack up. in the latest field poll, this was in late october, 49% of those poled say they a oppose pop 19. that's a complete about-face from september. 49% were in favor in july. 48% were opposed. those with the field poll say opinions tend to shift on issues that get a lot of media attention as the election draws near.

live in downtown oakland, today in the bay. >> thank you very much, christie. it's 5:33 right now and as you get ready to head to the polls, check out prop zero. we have all your election coverage and you can use the website to get the latest results as they come in. >> nine people are recovering after being shot at a massive halloween party. they opened fire at the fright fest event in oakland. the event was billed as the largest college costume party in the area. up to 800 people turned out and all nine are expected to survive. police are questioning them as well as witnesses. so far no suspects. the motive is also unclear. >> the man accused of shooting a fremont police officer is expected to be in court later today. he is changed the with attempted murder in the shooting of officer todd young august 27th. the 20-year-old pleaded not

guilty. his mother testified in court that she could not remember what her son told her. police say she described a conversation that ended with her son admitting he shot an officer. officer young is now recovering at home after seven weeks in the hospital. >> capitola police are looking for a bank robbery who does not keep a low profile. the trouble is police say he forgot a get away car. less than a block from the bank, he started offering people $1,000 for a ride to santa cruz and he got it. somebody gave it to him. police are looking for the robbery and if you gave somebody a ride and someone paid you a lot of money for it, call an anonymous tip line. >> san francisco's day of the dead will be different because of tight finances. the mission neighborhood wanted to commission public altars by local artists.

as of today, muni will no longer accept the a fast pass. many used that from muny and bart rides into san francisco. now they will need an electronic clipper card instead. muni said they are in the process of eliminating paper. the fast past that can only be used on muni is slated to be eliminated in about six months. ac transit is also changing. the agency has retooled about 70 bus lines and many of the changes went into effect yesterday. routes are being changed to save about $11 million a year. for a list of all of those changes that you need to know about, go to ac transit.org. >>. >> time to check the rails to see how things are rolling on caltrain. >> since we are on the transit note, we will check caltrain as well. it is moving without delays reported for the system down from gilroy and morgan hill. the early trains are moving up

alone and bay area women are leading the way. they are not getting a lid on a lot of bang for the buck. today in the bay's tracy pots is live from washington, d.c. with more on the political season spending spree. >> good morning, everyone. so much money has been spent on these races, not only in california, but around the country before it's all over. according to the center for responsive politics, nearly $4 billion will have been spent, most of it on television advertising how candidates get the word out. the senate race in the lead of the races where people are spending so much money. barbara boxer spent $26.2 million, hoping to keep her seat. her challenger, carly fiorina, $17.8 million. does all of that make a

difference? is it might. barbara boxer spent a little bit more and according to the poll completed over the weekend, see is up by four points and only four points. that's less than the polls we saw last week where she was up by a little bit more. we have less than 24 hours before the polls start to open. a lot of money being spent, but is it going to make a difference? that is will be up to the voters to decide. >> we will been by about this time on wednesday morning. >> the man accused of master mining the kidnap of elizabeth smart. more than eight years after she was kidnapped, brian david mitchell will go to trial. he kidnapped smart from her bedroom in salt lake city in early june of 2002. she is now 22 years old and expected to take the stand to testify against her accused

kidnapper. >> closing arguments in the case of tom delay. he is accused of helping to illegally finance texas legislative rates in 2002. the once powerful republican is expected in an austin courtroom. delay and two associates are accused of funneling $190,000 in corporate money to elect a legislative candidate in texas. if convicted of money laupdering, he could face live n prison. delay denied wrong-doing. it's 5:45 right now and good morning. >> we will update your forecast and the commute coming up in less than five minutes. the fight over immigration moves to the bay area. arizona's controversial new law cracking down on immigration will go before the ninth circuit court of appeals based in san francisco. chris sanchez joins us with a look at the argue ams and what's at stake. >> 30 minutes is all the time

that each side gets to make the case before a panel of three judges. while the law, sb 1070 is in arizona, people across the country and other countries are watching this one. regardless of what happens, many experts figure this will end up before the supreme court. this is a two-fold deal we are talk about. the senate bill was intended to help the state crack down on immigration. the law makes it a crime to hire, transport, or harbor an illegal immigrant and cars can be impounded. they would allow people to arrest or detain people they suspect was in the country illegally. they were put on hold the day before they went into effect by a judge. president obama took the arizona law to court, claiming the legislation interferes with federal immigration prerogatives and violates the u.s. constitution. the case is being held in san francisco because the ninth

circuit court handles federal appeals in nine states including arizona. the u.s. court of appeals is set to hear arguments for and against senate bill 1070 starting at 9:00 this morning. proponents will argue that the law is not about immigration, but it's also about state rights to enforce the laws and deal with immigration within their own borders. >> the fight will likely not end here. thanks a lot, chris. . >> good morning. it's 5:14. an 18-minute drive off of the bridge down the east shore freeway through berkeley and emeryville. the calm before the commute. no problems and off of the bridge, we have two issues i will point out. heading over through castro valley, westbound 580, reports of a disabled vehicle and a tire blowout on the right shoulder. you should be already on the westbound direction, but eastbound we are seeing unusual

slowing for about the canyon towards that dublin interchange. watch to it see if it shakes out. this is not going to shake out. this is the slow down and slow ivermore and past the westbound direction. the two sets of yellow making the travel time about 16 minutes through the area. this is a smooth drive from what i can tell. we have fog in the area, but not today. >> we are probably going to see offshore winds around livermore over the next couple of mornings. fog towards the north bay and san francisco this morning. lots of 40s. take the jacket with you and no worried about the jacket today or tomorrow or the next few days. the storm track is off to the north, high pressure is building and a starting warm up that will take us into the 70s. how about 76 in livermore. 74 in san jose and even santa is low 70s. san francisco close to 70. no matter where you look,

tomorrow, wednesday, and thursday, inland temperatures could be as warm as the low 80s. just slight cooling as you wrap up the week and head into the weekend. back to you. >> thanks, rob. >> the woman accused of being the mail bomber is speaking out. scott has the latest. >> good morning. the 22-year-old woman was an engineering student and was released from custody after a clerk in a mailing center in yemen was not the one who gave him the packages. yemeni television said this is the woman, apparently the woman of identity theft. there was a rally to show her support. at least two bombs were sent via airfreight destined for synagogues. they were intercepted before they were detonated. the investigation continues, but this morning we hear that germany ended all passenger flights coming out of yemen. that's the latest. apple has filed another lawsuit
