this morning we have extended election coverage. a few races still close to call. we'll have what's happening right now on the races that matter to you. and san francisco mayor gavin newsom is moving to sacramento. we will tell you who is now in line to take control of the city. "today in the bay" november 3rd on wednesday. from nbc bay area, reporting what matters to you, this is "today in the bay." good morning. thanks for joining us. it's 5:00 right now. i'm laura garcia-cannon. >> and i'm brent cannon. what's old is new again. jerry brown is the governor and barbara boxer wins again. we'll have results coming up in just a minute and all morning

long. >> keep an eye on the bottom of your screen. we're covering all the races that matter to you. in the meantime we want to get a check of the forecast with rob. it was a beautiful day yesterday and we expect more of the same today. >> you can dress in layers as we go through the morning. we've got chilly temperatures at least for the moment. look at these numbers ratcheting upward into the 70s, even low 80s bay areawide and then cooling some as we head toward the evening hours. the only thing that may slow you down, maybe some patchy fog around the peninsula this morning. >> all right, rob, we'll walk for that fog but the fog is much less of an issue than if you run into this. there's big pieces of tire southbound at brunell avenue. we see slowing on our sensors but it's so dark i can't show you anything there so very few cars heading through the area. i'll watch this but right now it looks like an issue with the sensors. lever more very clear right now. well, the polls may have closed hours ago but there are

still elections that are too close to call this morning. >> we're keeping a track on congressional district number 11. representative jerry mcnurny trying to fend off david harmer. these are the latest results. it looks like at this point with 98% reporting in, david harmer is looking to upset jerry mcnurny. that would be in line with the national trend in the congress right now. republicans taking seats away from the democrats. but it is too close to officially call. he does have the lead but it's too close to call. just a few dozen votes separate these candidates. now we're on to alameda county superior court judge. >> in the race for alameda county superior court judge it appears victoria kolakowski is leading john creighton by 1.5 percentage points, 51% to 49%. with this she'll become the first transgender woman to

become superior court judge. the race for attorney general is still too close to call. 89% reporting in and there you see it, virtually a dead heat between san francisco district attorney kamala harris and gop candidate steve cooley. but look at that, a dead heat with 89% in at this point but we will still watch out and keep you posted all morning long as that goes away. >> harris winning the race in the bay area and is leading on cooley's home turf. if elected, she will be the first african-american elected as california attorney general. this morning jerry brown clinches the race for governor over republican challenger meg whitman. the 72-year-old will return to his post nearly three decades after he first held it. brown's election keeps california established as a blue state despite the republican surge we were talking about tipping the balance of power across the rest of the nation and on capitol hill. brown says the race against billionaire meg whitman shows the limits of money in politics.

>> i think it says that it's not a bad idea to work your way up. you know, i worked my way up pretty fast as governor and then went back and became a mayor and then attorney general. so it's honorable to work your way up. >> now, in her concession speech, whitman said she hoped that the election would be the first step in a new era of bipartisanship and problem-solving. >> we've come up a little short, but certainly not for lack of hard work, determination and a clear vision for making our state better. >> whitman spent more than $140 million of her own money on her campaign, but came up short. >> this morning senator barbara boxer is claiming victory, but republican challenger carly fiorina still insisting that race is still too close to call. right now the race stands at 52 to 43%. boxer is projected to win a fourth term in the senate despite a multimillion dollar ad

campaign launched by fiorina. voters had a number of propositions to sort through, including legalizing marijuana, but prop 19 failed. "today in the bay's" kris sanchez joins us from our election center. she has a look at several measures that are still undecided, a few of them still pretty close. >> reporter: a lot of them are too close to call, particularly in oakland where we talked about them doing the ranked choice voting for the first time in this election. we'll talk about that coming up. but victories for the mayor of san jose, chuck reed, who was not actually working this election as a candidate but had a lot to lose by backing two measures that put him at odds with police and fire unions. let's look at san jose measure d which limits how much arbitrators can award to police and firefighters. measure d passing with 68% of the vote. another measure, measure w, which limits the compensation and benefits for future employees of the fire and police department, that one appears to be passing as well, 74% of

voters saying yes to creating basically who is a system of new employees getting different benefits from existing employees. let's talk about proposition 25 which was meant to change the vote to pass the state budget to a simple majority. you can see voters there obviously expressing some frustration with the fact that a two-thirds majority vote to pass the budget just puts a strangle on the budget so perhaps next year we could see a budget maybe on top now that it's a simple majority. prop 19 which would have legalized marijuana for recreational use. that one fails. verts say not ready to legalize and tax marijuana just yet. christie smith will have reaction to that one coming up in just a pitt. now to san francisco and measure l, the sit light ordinance. that appears to be passing. that was put on the ballot by mayor gavin newsom on behalf of merchants who are tired of folks loitering and creating a

difficult situation on their sidewalks there. voters agreeing with that. coming up in about a half hour, i'll show you the results from the oakland mayor's race. again, the first time for that ranked choice voting, what it means for the results coming up. laura. >> thank you very much, kris. for san francisco gavin newsom torture doesn't just apply to giants baseball. he unseated moldonado for the state's number 2 spot. >> i've got to tell you, there will be few days in my life more extraordinary than sitting with my baby and my wife in the parade celebrating the giants. >> lieutenant governors primarily are a stand-in when the governor is out of state. lieutenant governor also breaks the vote as president of the state senate. his departure for state office means shakeups in leadership for san francisco. board of supervisors will elect his successor and already there's jockeying for the top

spot. it is possible that the board president will take over in the interim. the next full board meeting is next tuesday, november 9th. an odd election heist in san francisco. a polling inspector made off with up to $75, a voting roster and other election materials. the polling inspector broke into the ballot counting machine about 4:00 yesterday. he also stole the cell phone of a teenage poll worker. police say they know the poll worker's name and they are investigating. now to national politics. there's a lot more red on the election map this morning, but west of the rockies still democrat blue. that's thanks in part to senate majority leader harry reid edging out tea party challenger sharron angle in nevada. he will hold on to his leadership post in the senate. the same can't be said for nancy pelosi. while she has managed to hold on to her san francisco seat by a landslide, she'll no longer be speaker of the house since republicans are now in control. that position is expect ed to

good morning, efbd everybody and welcome back. the time is 5:13. here are more of those important races we've been following this morning. proposition 23, the effort to suspend the pollution law, passed in a previous election but it has failed. that means that state laws regulating emissions are going to stay in place. prop 21, which would have funded state parks by adding an $18 tax on your car registration also failed. as we reported, prop 19, the effort to legalize marijuana, has gone down in defeat. new this morning, people in serbia are bracing for aftershocks after a deadly quake rattled the central part of the country. the 5.3 magnitude quake hit 75 miles south of belgrade killing two and injuring 50. serbia's interior minister says the two who died were a couple

who were struck when their home collapsed. many towns in the area are now running without electricity, water or telephone lines. also new this morning, two countries in the north pacific ocean are on high alert after learning of terror attacks. the united states and australian officials issued warnings. both countries are boosting police patrol. the phillipines defense minister secretary says the military has not monitored any specific threat but the government is taking no chances. while you were sleeping, indonesia's most dangerous volcano started sending ash and clouds back into the air. it's erupting again. that eruption is the latest of several to force more than 70,000 people from their homes. since the mountain began erupting, 35 people died and more than 70 injured. two firefighters are recovering from injuries as a brush fire continues in southern

california. riverside firefighters say 12 adults and five dogs are under mandatory evacuation orders. a 100-acre fire is burning at the bottom of the santa ana river and has already destroyed one outbuilding. one firefighter is in the hospital recovering from chest pains and another was treated at the scene for heat exhaustion. right now that fire is about 40% contained. for several years now we've been told clean energy was the new help. it was projected to be the industry that would employ thousands of laid off workers. >> this morning the poster child for clean energy itself is the one laying off workers. scott has more on that. >> understand what has gone wrong here in silicon valley. there are two kinds of solar cells. the traditional cells you think of, the ones you've seen on rooftops and a more revolutionary one called thin film. companies like the one in fremont started building new factories to make these super thin cells.

they had such promise the company got a visit from the president of the united states and it was going to be the future of silicon valley and solar. >> we were standing on what was an empty lot. but through the recovery act, this company received a loan, they expanded operations. >> but along came china. china is making the old style cells, the ones you're more used to seeing. they're making the cells for far cheaper so silicon valley is getting undercut on price even though we may be thinking farther ahead on technology. so they are laying off and this is the second time we've seen a gamble on thin film solar not pay off in california. earlier this year applied materials had to layoff. so we understand from "the new york times" that they will layoff 40 workers, probably close one of its plants. just months after the president of the united states came to say how exciting this was going to

be. >> so it's a great development but bottom line, the old style are cheaper. >> the old style are cheaper and china is undercutting us in price. in the meantime turning to a little baseball, the beard and i hate to say it and thong wearing -- you know, when you're talking baseball in san francisco, hey, the crowds are going to be out there for a party that is 52 years in the making this morning, and they have been waiting for this one. >> bob redell is already out there this morning where the world champion giants are going to march in a victory parade and the crowd are already gathering, it looks like. >> reporter: absolutely. this is going to be the centerpiece of the celebration. the giants team will be parading down, a ticker tape down market street and the celebration will end right here in front of the civic center. you can see they have already got the pbanners up, the orange glow of city hall. mayor gavin newsom will hand the key to the city to the players

and there's already a few hundred people out here. some came out here around 9:00 or 10:00 last night. what time did you get out here? >> about ten minutes ago. >> reporter: why did you feel the need to get out early? >> because i was too young -- i missed the five super bowl parades. this is it, this is for my dad, my uncle and who took me to my first games at the stick. this is for all them and missed out seeing the world championship team for the san francisco giants. >> reporter: what about work today? >> that's the best part of being unemployed and laid off. >> reporter: best of luck to you, all right? so the parade starts around 11:00. i was looking at the rundown. judging by the way they have it stacked, it looks like the actual celebration shouldn't be until actually 12:30, 1:00, which means you guys only have about ten hours to go. if you're thinking about getting down here, obvious low these people seem to have the right idea. they could be a predictor of the

crowds. you might want to show up early. how are you going to get down here? >> we'll start off with the negative. you're not going to drive if you absolutely don't have to. if you do drive, avoid the fourth street off-ramp. this is where it is. this whole area with the parade route, montgomery and then down onto market street, both of which will be closed for the duration so you can't cross market traffic there either and that's the reason i'm avoiding fourth or 9th off-ramp. bart is a great option. it takes you under all the backup. it takes you over to the city where you'll get off at key stations. montgomery, powell and civic center. that's the station that takes you to the celebration. metro gets you underground as well. you'll come up right onto that parade route. caltrain from the south bay or the peninsula is a great option as well. takes you all the way up. a lot more parking at the caltrain stations than the bart stations. that might be the big problem. if you transfer at millbrae, you

good morning to you at 5:24. let's take you out there live around the civic center plaza. san francisco, the building all lit up in giants orange as you'll see throughout the morning getting ready for the big victory parade which you can catch live right here on nbc bay area. all the coverage gets started around 11:00 this morning. it's a little chilly outside if you're going to join the folks already gathering. we have 50s in the south bay. currently in san jose it's 55 degrees, in oakland 56, and in san francisco we're seeing temperatures in the upper 50s this morning. not much in the way of fog around san francisco, though we will see low clouds approaching the coast later on this

afternoon. we'll see temperatures in the 70s, so the chance of paper showers as we see some of that flying through the skies around san francisco today should be just outstanding. low 70s throughout the parade and mid-70s for highs in some spots around the peninsula. so some of your weather headlines this morning. we'll see temperatures climbing up, 70s and low 80s inland today. today and tomorrow probably the warmest days we'll see for a while because come friday we'll see big-time cooling and scattered showers rolling on in. for now mostly clear. we'll have a few high clouds drifting on by. the big change comes up later on this week. high pressure right on top of us. 70s and 80s inland, main he clear skies, low clouds approaching the coast. thursday a cooldown starting off on the coast. then all areas, as we head into friday, a chance of showers arriving late in the day friday. we'll see temperatures dropping into the 60s as we head into the weekend. for now enjoy the warm weather. we're talking 80s inland. look at morgan hill, 85 degrees in november. that's pretty incredible. 82 for san jose.

on the coast near 70 around pacifica. half moon bay 73 degrees. about 75 around 1:00 or 2:00 in the afternoon for san francisco. in the east bay 80 around san ramon. for the north bay, 70s and 80s today. that should carry over at least one more day. then friday a big drop in temperatures. scattered showers friday evening and another round of showers arriving late on sunday. laura. >> thanks so much, rob. in the battle for airline passengers, wi-fi is the latest run. southwest is scrambling to put wireless internet on every plane in its fleet. american airlines is wiring dozens of 737s. but with prices jumping from $5 to $13 depending on the length of the flight, some passengers have been slower to jump on board. one study by an arizona research firm says only about one out of every 50 passengers even uses wi-fi, but airlines believe it's a worthwhile investment because business travelers, the customers who may the most for seats with the biggest wi-fi

approaching the low 70s around parade time. and around san jose today, a high close to 80. some low 80s inland before a late-day sea breeze cools us down. we'll talk about cooler changes ahead and rain in your seven-day forecast coming up in a few minutes. the push to legalize marijuana in california is up in smoke, at least for now. voters shot down prop 19. "today in the bay's" christie smith is live in oakland. although the voters have spoken this time, the fight is not over yet. >> reporter: yeah, good morning to you. despite the defeat at the polls last night, supporters of prop 19 are really seeing the silver lining in this, that it was actually taken quite seriously by the voters overall. here with me this morning is dan rush with yes on 19. good morning. what happened? >> well, we see that there is a clear movement in california to end prohibition and to create these jobs and to create the tax income. i think we did pretty well, even

though attorney general eric holder and his really irresponsible message threatening people that are going to form jobs, private industry that's going to create good, dignified jobs that are going to put people back to work. california is hurting and we need to get creative. one of the things we can do is tax and regulate the 500,000, 600,000, unregulated, untaxed cannabis transactions that happen in california every day. and there's a clear coalition going on here and we're going to follow up with it. >> reporter: and real quickly, what's next? what's next on this issue? >> well, we're going t.o. some campaign meetings today, we're going to follow up on the request from democratic party leadership around the nation that is clearly recognizing that our top of the ticket walked in pretty easily and they did it because of the young voters that we turned out on prop 19.

there's a real interest in that. >> reporter: all right. thanks very much for being out here with us this morning, dan. that's the latest from here. reporting live in oakland, christie smith, "today in the bay." people in oakland used ranked choice voting for the first time. while we didn't get any reports of problems the election for mayor is still not decided. kris sanchez joins us with who's the front runner so far. >> reporter: good morning to you, laura. one of the challenges of that ranked choice voting is that it can take a little longer to get those final results and we all know we like to pop the champagne corks by the end of the election night but that's not what we're going to see this morning. for the mayor, don perata is in the lead this morning but not by enough to declare victory. he has to have 50% plus 1 of the vote in order to say that he will be the next mayor of oakland. now, the other candidates, jean quan, rebecca kaplan, they don't have the majority either. the second and third choices

will be counted up, but that is not going to happen until friday so we won't be able to say exactly who will be the mayor of oakland. also this morning in oakland, proposition x -- or measure x, which is a $360 parcel tax to help fund safety -- it looks like democrats are firmly in charge despite what it looked like across the rest of the country in california, it stays blue. jerry brown meeting republican meg whitman for governor, one of our marquee races.

this will be brown's third term as governor. his number two man will be san francisco mayor gavin newsom. it appears he will win the race for lieutenant governor although republican able moldonado has not conceded. john chang and the state treasurer, all are democrats. the race for attorney general, that one is too close to call. san francisco district attorney kamala harris is battling it out with los angeles district attorney steve cooley. he is a republican. the last numbers i saw was 45% to 45%. when it comes to the race for insurance commissioner, democrat dave jones is the victor there and tom torlickson is the new superintendent. >> taking a look at proposition 23, it's failing 61% to 39% with 89% of precincts reporting so far. it would have suspended

pollution control until statewide unemployment fell below 10% for a full year. the air pollution law was signed back in 2006. greenhouse gas emissions must be reduced to the same levels as 1990. the time is 5:35. we also want to check your morning commute this morning. mike inouye said it's kind of getting crazy. it's like a wild animal farm out there. >> it is. sometimes when i talk about deer on the roadway it's not good news, but we do have reports that deer are wandering around the on-ramp of southbound 680. chp will help get out and escort them off of that on-ramp. if you use it from the eastbound direction onto southbound 680 that's your issue. the rest of 680 and 24 through the walnut creek interchange as you see close to the limit. antioch shows typical slowing right on schedule. eastbound heading out of pittsburg you have construction blocking one lane. consider taking the ferry and

then metro. the weather looks outstanding. once again starting off with 40s, patchy fog around the north bay and signs of an offshore breeze. fairfield showing us high pressure will hang out one more day today. right now san francisco 59 grows so jacket weather if you've getting out extra early for the 11:00 start of the parade which, by the way, should see temperatures in the low 70s. a chance of paper showers flying around san francisco today. lots of sunshine. 70s today and maybe some low 80s inland in parts of the bay area today. the satellite view shows you high pressure acting like a wall for incoming weather systems. friday is when things will start to change around here. we'll see highs about 85 in morgan hill, 82 in san jose and look at san francisco, 75 degrees. so giants sunshine today. 70s and 80s across our north bay valleys despite the chilly start and foggy start to a few spots this morning. so the warm weather will last till about tomorrow. friday temperatures really start

good morning, everybody. the time now 5:40. a live looking shot. look at the civic center plaza all lit up in giants orange. you see lots of folks gathered out there already, many of them have been there several hours. they are ready for a ticker tape parade today. we'll have a live report coming up on that in just a bit. it may be orange in san francisco, but this morning california for at least the time being is still a blue state. for many parts of the country, they're seeing a lot of red this morning as republicans once again take control of the senate. "today in the bay's" tracie potts is live in washington, d.c. with big changes on the political map. good morning. >> reporter: laura, good morning. so what we have now come january is a democratic senate and a republican-controlled congress. the big question, will they be able to work together as we move into these last two years of the obama administration. the president very likely to be asked about that and talk about that in a news conference in a

couple of hours from now. but the big story overnight perhaps was the one person who was not on a ballot. john boehner, who is the head of the republicans in the house, he will now likely become the speaker of the house, taking over for nancy pelosi, who was embattled, who had been criticized very much by republicans for the way that she was leading that chamber. boehnor saying this was a mandate by voters. a repudiation of washington politics and big government. there are still some races that we're watching very closely this morning, some that are too close to call. patty murray trying to fight off a republican challenge up in washington from dino rossi. that very interesting three-way senate race in alaska where lisa murkowski was the write-in candidate. she is leading in that race, but that one still we're told too close to call. and very interestingly, as we look at changes here in washington, there will now be no african-americans in the senate.

the only one, roland burris, is retiring. there were three from georgia, florida and south carolina on the ballot. neither of them won their races. interestingly, the senate will now not have one single african-american as they move forward into this new republican-controlled congress, at least the house. laura. >> interesting to see what's going on there. thank you very much. as we mentioned earlier, it does look like california will remain a blue state, but in some key races, republican candidates have either won or they are in the hunt. >> for more on the races that are too close to call, we turn to joe matthews this morning, contributor to the prop zero blog on nbcbayarea.com. thanks for joining us, joe. >> great to be with you. >> senator barbara boxer already celebrating victory, but carly fiorina really hanging on to hope. why, do you think? is the race really too close to call? >> it's not. with -- i'm looking at returns from 5:15 a.m. from the

secretary of state, and fiorina has lost and it was not at all close. in fact the margin i was seeing was nearly ten points. it's strange sort of behavior. i mean this race was essentially over between exit polls and even some of the data by, you know, before fiorina spoke around 11:00 last night. it's very odd. i've been trying to find an explanation for why -- you know, both whitman and fiorina were slow to concede. you know, i don't really understand why. it's not good form and particularly for someone -- for those two folks who have invested some of their personal fortunes, whitman a record amount in the race, and might want to stay in politics or try again, it doesn't leave a good taste to wait to concede like this. >> let's talk a little bit about meg whitman. she spent a lot of money, a lot

of her own personal money. it was not enough to push her over the top. in fact even heading into the election she never closed the gap on jerry brown. >> no. the poll averages were in the high single digits and now she's almost 13 points behind with 94, almost 94% of precincts reporting. she's down almost a million votes. that reflects basically the divide in the parties, the difference between the -- of registration in the state. it means that she really didn't connect. i was talking about this with -- the cost of getting your message out in california. if you wanted to be very careful in a race, spending about $5 million a week, you know, for weeks that you're on the air where you need to reach people. say you did that for three months during the general election campaign and a month in the primary, you're still

talking only about $80 million. this person spent $160 million. it's not clear to me what that second $80 million buys. >> thank you, joe. thanks for joining us this morning. >> appreciate it. >> after a late night, no doubt. 5:46 right now. good morning, i'm laura garcia-cannon. >> and i'm brent can on. we'll look at traffic and weather coming up but first we have up-to-the-minute results on many of the races that were too close to call before you went to bed last night. we want to check in with kris sanchez. >> reporter: good morning. one of those races that's too close to call is the congressional district 11, which is -- represents part of the east bay. democratic candidate jerry mcnurney is in a pretty dead heat with republican david harmer. those numbers you can see. david harmer getting 58% of the vote, jerry mcnurney 47% of the

vote so this one is too close to call. another race of note is the alameda county superior court judge. this one it appears that victoria kolkowski has won. with all of the numbers -- rather the precincts reporting, she leads john creighton by 1.5 percentage points. the interesting thing here is with this win, she becomes the first transgendered woman to become a superior court judge in the u.s. now, for state attorney general, that one too close to call as well. look at that, 45 and 45, kamala harris of san francisco and steve cooley of southern california. kamala harris has been gaining on the gop candidate overnight and she's still holding out hope this one will turn in her favor. harris is winning the race here in the bay area and right now is leading the race on cooley's home turf, los angeles county. if elected, harris would be the first african-american elected as attorney general. now, scott has been watching some of the other things on the

ballot that we always bay attention to, because they affect our wallet. >> taxes, taxes and fees. voters in several east bay cities weighed in on sales taxes. antioch would raise the rate to 9.75%. that with 59% of the votes in seems to be failing. in concord, voters took a look at a sales tax increase and said sure enough to it, at least with 44% of the votes in. it's a 9.25% sales tax. measure q will expire in five years and this money will help boost concord's ailing budget. measure r in el cerrito also a half-cent sales tax. shoppers would pay 10.25% sales tax. that is the highest in contra costa county and the highest allowed by law. and it only has 9% of the vote in, but appears to be leading at

this time. measure aa in union city also a temporary half percent increase from 9.75 to 10, and i believe it's a half percent. all of the votes are in on that one and that one has passed 60% to 40%. union city, measure aa. and we got measure o in contra costa county that proposes a new $10 per auto registration fee for transportation projects such as road repairs, improving traffic flow, that sort of thing, and that one is looking like it's going to fall railroads a loft of the folks at the local level -- >> and if it stays local. if it goes and pays somebody else, the state or somebody else, it tends not to. >> reporter: we were seeing some of the state ballot measures, the state park funding, no for increasing that. but it looks like folks really want sacramento to spend their money a little more wisely. changing to a simple majority

new this morning, greece is temporarily suspending outgoing mail deliveries after parcel bomb attacks. they targeted embassies in athens as well as european leaders in institutions. the 48-hour ban tookd effect this morning after booby trapped packages reached a german chancellor. a package addressed to an italian premier also got fire. space shuttle "discovery" will not lift off as planned today. nasa delayed the launch after engineers discovered problems with a backup controller for one of the three main engines. officials then called for i last-minute review of all operating systems. it is scheduled to lift off tomorrow. if there is another delay, nasa has until sunday or monday to launch "discovery." otherwise the mission will have to wait until december. freed american hiker sar r
