it is 4:30, november 4th. we have breaking news to start with. one person dead following a chp chase in oakland. it happened after 2:00 this morning on mac arthur boulevard and 10 sixth avenue. the person who died was the suspect that chp officers were chasing. we have a crew to the scene and we will bring you the latest as it becomes available. in the meantime, let's go to mike inouye. mac arthur boulevard a busy thoroughfare. >> it sounds like the crew just arrive and they are getting set up. there is a closure for mac arthur boulevard for about a two-block area. mac arthur boulevard is closed. a major roadway between foothill boulevard south to 10 seventh street. stay clear if you can. access to 580 is clear, but the roadway is major. foothill is a good alternate because it takes you south.

keep that in mind. 880 is reopened through oakland into hayward as well. the lighter volume on the east bay freeways, but we will follow the deadly accident and investigation on mac arthur boulevard. >> another warm one around the bay. rob is joining us with an hour by hour forecast. >> kind of warm outside in oakland. 64 degrees. we have clouds on top of a warm day yesterday and that tends to keep the overnight temperatures up. fairfield we dropped down to 50. hints of an offshore breeze and more clouds in the afternoon. no rain-producing clouds, but come friday, deeper moisture comes in and increasing chance of showers approaching the weekend. from the east bay and beyond, highs mostly 70s out to the trivalley. livermore should be close to 80.

process. >> at a news conference in oakland he said he is ready to get lean and mean when it comes to cleaning up the state's big mess. brown does not take office until january. election leaders are sorting out unusual events in san francisco. an nbc bay area news crew found this. an electronic tabulator used to count ballots in the sidewalk in the tender loin. they believe it was stolen after the memory card and ballots were collected. deputies picked it up. finding the piece on the street is unusual, but it won't affect the election results. in an unrelated situation, there as many as 75 ballots missing. a poll worker stole them and he has since been arrested. the theft may cause complications. >> as we go through the process, if something is close, whoever is on the winning side of a close race wants to know what

this means. that becomes a legal question at that point. >> police arrested 50-year-old karl bradford nicholas for the strange theft. he is not telling police where the ballots are or why he stole them. also new, a couple accused of kidnap and raping jaycee dugard will face new charges. they have been indicted on 18 felony charges that include graphic unreleased details on what they did to dugard. there will not be a preliminary hearing and that spares dugard and her family from taking the witness stand until the actual trial. they were previously charged with 29 counts each and now face charges ranging from kidnapping, forcible rape, lewd acts on a child and false imprisonment along with eight others. san pablo police are trying

to figure out who the mother is of a toddler wandering on the streets. he is believed to be between 18 months and 2 years old. he was walking alone on valencia street. one witness said he saw a young woman in her 20s wearing a brown jacket and yellow backpack drop the boy off in someone's front yard and she jumped into a cab. >> the cab was yellow and we are currently contacting cab companies from vallejo to oakland. >> a man stopped by the police station last night and said he recognized the boy and knows who the other is. police are following up on his information. >> coast guard is working to contain a tug boit leaking diesel into the east bay. they are working to contain the spill from the partially submerged tug. this is near antioch. there is a hard boom on site to

contain the sheen. this tugboat may leak as much as 800 gallons of fuel. 4:37 and a rough day for oakland where a chp crash ended at mac arthur boulevard and person reported dead as a result. mac arthur is closed at 106 as well. use foothill boulevard. we have another deadly accident up in napa. activity there and the corner cleared the scene and traffic should be restored n. novato west of the city at copper hill, the power pull and lions. we will follow these accidents and send it back to you.

>> a tough day. meanwhile, november 4th is more like july 4th. >> felt like it yesterday. at the giants parade, we saw temperatures in the upper 70s and clouds spilling into oakland. 64 degrees to get things started over in concord. you can see 55 and here in livermore, 54. the wind is light and a bit of an offshore breeze zeechl clouds coming in. the sun will be hiding between the mid-and high level clouds. we will see a chance of showers into friday. a better chance on sunday. highs not quite as warm. we will have a few extra clouds, but pleasant. 70s around the peninsula and the inner east bay. the trivalley upper 70s to low 80s. let's go through the seven-day forecast and see a chance of showers late tomorrow. the best chance of rain on sunday. daylight savings time ends this weekend. there is the good news. an extra hour of sleep starting

one person is dead and following a crash in oakland. one other person may have been killed. it happened about 2:00 this morning at mac arthur boulevard. christie smith is live on the scene with the latest. >> reporter: what they are telling me is this started with the chp officers on westbound interstate 580 trying to pull over a car that was speeding. the driver did not stop and instead kept going, exited the freeway at foothill and mac arthur and basically kept going to 10 sixth. this was a lights and sirens

kind of thing where they were following the driver and he refused to stop block after block and got in a wreck with another car that was coming at that driver. his car, the person they were pursuing caught fire. they had to pull him, the officers who were after him had to pull him out of the car. he was taken to highland hospital and pronounced dead. the person we are told in the vehicle he hit, that person died as well. at this point investigators are telling me they don't wherein he didn't stop. he just didn't. i am looking@least five chp cars at 10 sixth and mac arthur where the intersection is blocked off. oakland police out here as well investigating. they are telling me oakland police are taking over the investigation. we are asked when the intersection might open. it could take several hours.

that's what we know right now live in oakland. >> christie, thank you. skipping school could get costly in one east bay city. richmond's daytime curfew allows a judge to fine truant students up to $500. vicki has an update on how the curfew is working and why some feel it's unfair. >> no one can argue that truancy is not a problem. the last time they conducted a sweep they picked up 425 students in three days. richmond becomes the last city in the school district to add a daytime curfew. we rode along with the officer to see how it works and how the program is designed to prevent repeat offenders. precisely 30 minutes after school starts. ray hernandez searches for students skipping school. >> you have students back here hiding in the bleachers and the

play structure over here. >> it doesn't take long to spot them. >> how are you guys doing? where are you going? >> these two, 14 and 16 years old tell the officer they go to the continuation, but they attend richmond high and were heading home. before the curfew, they would return the students to class and if it was close to the end of the day, they would go home. now they are taken here to the activities league. >> come on down here. >> a staffer checks the record of absences, issues a citation and counsels them as they wait for mom or dad. >> you need to pick them up and there will be forms to sign. >> officers pick up nine or ten students a day, always with an excuse. >> i am hungry and i have to eat something or i'm sleepy and i have to go home. i need to change. i don't like this outfit. i need new shoes. >> it's no joke for parent who

is have to miss work and spend a day in court to address the truancy. >> why do you think he is not going to school? >> i don't know. i talk to him a lot and encourage him to do good. >> the officer offers to make a home visit to talk to her son and students need to know their safety is sat risk on the streets. a national study found 94% of homicide victims under 25 had a history of skipping school, starting in elementary. >> i'm a teacher's assistant from preschool. i teach and i help students and i cannot help my own child. >> as tough as it may be, getting parents involved in tracking truants helps to stop the problem. >> we are trying to help them out. >> richmond is not alone. they instituted ditime curfews and police say not ohm has the truancy rate gone down, but so

new this morning, the dow starts the day at a two-year high. for more on news before the bell, let's go to courtney reagan. good morning, courtney. >> wall street's winning ways could continue. futures are higher and the dow closed on wednesday as investors digest the latest plan to boost the economy. they will buy $600 billion in treasury bonds. the pros are it drives the low rates lower and encouraging spending on equipment and consumers for goods and services. the cons, some fear it could make the dollar weaker, leaving traders to go higher into anticipation. europe is also opening stronger. still ahead, new filings for unemployment and productionivity and labor costs. wall street bonuses are set to rise according to a survey by

johnson associates. they will offset declines for stock and bond trading. despite the overall increase, this forecast is still about 20 to 30% lower than the high posted in 2007. back to you. >> thank you, courtney. all of qantas's six airbus a 380 with double-deckers are grounded after one of them blew out an engineer. the passenger plane had engine trouble after it took off from singapore, forcing an emergency landing. it was the most serious mid-air accident involving the a 380 since it debuted in october of 2007. this flight originated in london and was flying to sydney. the ceo of qantas said all of the 380s are suspended until the airline can ensure that these planes are safe. qantas flies out of sfo and los angeles. republican leaders will lay out

mike inouye has the world's busiest job. >> i do for folks heading to their jobs. an update. i got this seconds ago. southbound 101 is closed just south of the 880 to southbound 880. chp is arriving on scene and completely closed 101. diverting traffic on to southbound 880. you get back on to city streets and just after the interchange, you will have a jam up right now. they may reopen a lane or two. following this one. until that interchange, it's moving all right and get your way into san jose. following also the deadly accident in oakland, mac arthur at 106. it affect this is area of the
