of a couple of them. >> we will start with today in the bay's christie smith this morning with more on the chp chase. were they chasing the driver before the crash some. >> they were saying they were trying to pull this man over on interstate 580 westbound here in oakland. he was speeding and they had lights and sirens on, but it was a short pursuit. he got off the freeway and ended up here at 10 sixth and mac arthur. they are saying that he was speeding. he was supplying about 90 miles an hour down mac arthur. they stayed about a quarter mile back when they got on sur face streets. this was about 2:00 a.m. witnesses describe an incredible scene. they say you could hear the tires squealing as he came to the intersection. he didn't slow down at all or see what was coming at him.

>> as he was coming this way, he looked towards me as to maybe give a slow as he was running from the police and right as he turned around, the young late or maybe two were coming here and he never saw them. as a car it impact and blew up. >> the driver had to be pulled from the burning car. the chp said he was taken to the hospital here in oakland where he died. there was one person in the other car and that person was killed as well. i just spoke with the chp and oakland police is the lead in the investigation and taking measurements this morning. i asked when this intersection here at 10 sixth and mac arthur may reopen and hay don't know because of the investigation. live in oakland, today in the bay.

>> thanks for the update. we have another update on breaking news in the south bay. an overturned big rig is block lanes and bob redell is near the scene at the 101 in san jose. bob? >> good morning to you. blocking four of the five lanes on southbound 101 at the 880 overpass above the big rig right there. right now one lane is open, the number one lane fast lane moving slowly. the chp indicated it could be anywhere from 45 minutes to an hour and a half before they are able to up right the big rig. the good news is there two to trucks. they are working on getting it up right. are they able to get it up right and out of here are are they going to have problems because

it is a full load? the driver is okay. a little while ago. he was heading on southbound 880 off the ramp on to southbound 101 when he lost control, flipped over and he is doing okay. for people who are trying to go southbound 101 to northbound 880, that is clearly shut down. southbound 880 is also shut down. if you take a look, that southbound traffic, there is not many cars. there is a slow down, but not much in the way of back up. if you are heading in the southbound direction, you are looking at 30 to 60 seconds. it's not a make or break situation. heading in from gilroy into san jose, you can see there no looky loos and traffic is slow and go. today in the bay. >> thanks for the latest look

there. >> that can add to the problem when you have people who want to stop and see what happened. we have a look at the morning kmud there. >> a couple of huge issues. the biggest impact is for bob's report. right at the interchange there, we saw that just one lane gets by. the volume is picking up. there is 1 fusing closures off the southbound 101. stay clear. take 280 and jump on to northbound 101. off of 680, a little yellow chicklet. brocaw is a good option from 101 north or south and a little east of there. you see all the flairs and the to trucks and a couple of big rig tos. this will cause quite a interaction and over in oakland,

we are watching, but mac arthur boulevard close and food till hot north. i will give you an update in a few. a clear look at the san jose roadway and the activity there. making things worse over there. >> we are not seeing much in the way of fog through the south bay or san francisco. another mild day and mostly 70s inland and as early as lunchtime. the warmest places from san jose south making a run at the 80-degree mark and cooling towards the evening. more clouds filling in and a chance of rain as we head to the weekend. a look at that and the forecast is coming up. . we turn to decision 2010. people in oakland waiting to find out who their next mayor is going to be. all the ballots are in, but it could be about a week or so until the results are clear. the alameda county registrar of voters said the new ranked choice voting system is the big

delay. perotta has the most votes, but the second and third choices will be taken into could until candidate will get the majority. the race for attorney general is too close to call this morning. we check the website today and the latest numbers show kamla harris is leading, but by just under 10,000 votes. it's very close. all resirchths are reporting in, but the state needs to count several hundred thousand absentee and provisional ballots. the camp said they are confident that she will win, however not confident enough to declare victory. >> experts are trying to figure out who is abusing local birds. one bird was spotted with a beer can around its neck. at least two of three birds have been spotted near fisherman's

whatever, alcatraz and half moon bay. contact the wild rescue in monterey. they are trying to find whoever is submitting the crimes. >> the clock is ticking for my space. we have details on that. >> when was the last time you said my space? it's all facebook. they have a new guy in charge. two fellows. they have been warned by their parent company they have to get their act together. on the conference call between executives and reporters, they said my space a losses are not acceptable. the company will make a decision in a matter of months. not years. they run fox news channel and the "wall street journal." if you are an investor, my goodness, is this a pretty picture. the dow starts the day at a high led higher eye cisco systems. shares in the san jose company jumped and hewlett packard up as

well. we got the weekly jobless claims and they're up, but there is so much going on in washington and wall street that investors show the marks looking good this morning. >> die-hard fans are giving the city a boost when it comes to tourism. giants fever generated billions of dollars for bars and restaurants. tourism is the city's largest industry bringing in 8.5 billion a year. the board said panoramic views of the ballpark that everybody saw when they were covering it in the playoff and it is world series encouraged a lot of people to visit and they say that looks like a beautiful place. >> it is. such a boofl area. we are blessed to live here. the morning commute, we want to check in with mike. >> not as bad as getting into

the city. it was horrible. we are following the sigalert and i will update you on the accident. mac arthur boulevard is closed at 10 sixth avenue south of foothill boulevard. it's open as an alternate to mac arthur and accesses on to and off of 580 without incident, but not far from the freeway. 580 and 880 through oakland close to the speed limit about 55 at the lowest. the metering lights were turned on and just 18 minutes off of the bridge and the east shore freeway. this was an early on for the metering lights and they see a bigger volume or potential for back ups. you may want to head there sooner than later. >> thanks for the update. >> checking in with rob, it was

good morning. this is the scene of the accident near 880. a big rig overturned and causing a commute havoc on the roadways. one lane is at least closed. caltrans crews are on the scene trying to clean it up. we will have the latest. >> former bart police officer mehserle faces 14 years in state prison. a jury convicted him of involuntary manslaughter in july as he shot and killed oscar grant on a bart platform on new year's day of 2009. he said he thought he grabbed his stun gun. let's talk about this sentencing a little built and how much public influence could influence the judge's decision. is there kind of a formula you have to follow these guidelines or can you consider things like the public outcry we have seen in the case? >> the court cannot consider public opinion or prejudice.

it's one of the reasons we move the case from the bay area to los angeles. there a lot of people watching this case carefully and public demonstrations. does that have an impact? i think it will, but it shouldn't. i know the defense is going to be talking about that as well. trying to minimize that have having the court look at this as a sentencing case. don't think about the media attention. >> another thing that i'm wondering might influence things. another days in another state with another officer that thought he grabbed a stun gun and shot and killed somebody. mehserle's people said it happens that way. can the judge consider that? is that something to consider or not? >> that will come up in the motion for a new trial. no one knew about the case where an officer shot someone in a similar fashion to what happened here. they said this accident never happened before, but now they found a situation where an identical case happened. the court has to look at that. is that new evidence and

something that would have changed the jury's mind and that could be grounds for a new trial. >> is it possible that we don't get any sentencing and the judge said never mind that? we will start over again? >> that's possible and that's what the defense is asking for. they want a new trial and they say there was no evidence and mace takes made in the trial. that's a difficult thing for the defense, but they are asking for that. they want to attack the enhance for for the use of a gun. should that apply to the officer under these circumstances in light of the verdicts on the murder charge. here we are going to see what is right in tense situations. this could impact that. >> that's what the defense is arguing in the effort to get him probation. if you put an officer in jail

for 14 years for on duty activities, you are going to stop police officers and that's the big argument for a case as opposed to a stiff jail sentence. >> we're could be fair and a lot of people say this is just excessive force and a message needs to be sent. >> for will be a very emotional hearing. they will testify about the loss of a child. this is a very difficult sentencing case for the court. there is compelling arguments on both sides and it will be interesting to see what the judge does tomorrow. >> thanks again for sharing your perspective with us. we want to remind you, nbc bay area is going to be in los angeles starting tonight. mehserle's hearing is slated to start at 8:30 in the morning on friday. we will bring you the results of the sentencing or whatever decision they make tomorrow as soon as we get it.

country sometime tomorrow. government leaders are advising people to abandon camps and ride out of the storms in the homes of family and friends. the red cross said people are concerned about the spread of cholera made worse by heavy rain. >> the discovery shuttle will not launch due to bad weather at cape canaveral. the launch has been put off twice because of mechanical problems. the next launch is now slated for sometime in december. . >> scary moments on a jumbo jet. an airline that flies out of sfo is growning the largest planes. quant sas grounding all of the airbus 380 airbus super jumbo jets. the problems began from singapore forcing an emergency landing. it was the most serious mid-air

incident since they debuted in early 2007. they are making sure the planes are safe. >> we would suspend the services until we are confident that qantas's requirements have been met. >> the flight originated in london and was flying to sydney with a stop in singapore. all a 380 flights are suspended until they can ensure the planes are safe. we just checked with sfo and as of now, we don't know of any qantas cancelations here. >> here's something to think about the next time you book holiday travel that might take you through the east coast. flight delays are as bad as ever. scheduling rules put too many plans in line with bad weather. a as planes stack up, the delays

spread across the country and dozens of flights are disrupted. scheduling limits at jfk, la guardia and nuke airports are based on good weather conditions. when bad weather hits, air traffic controllers are forced to hold flights on the ground leading to back ups. just before 6:00, an update on the location. cph had the report on the decline updated to the incline. that's the reason for the lights and the slowing starts at the berkeley curve. down through berkeley and emeryville, about a 19 to 20-minute drive through the area. 880 moves nicely and the slowing over the next half hour or so. a look at san jose.

this is the big issue for the san jose area. an overturned big rig on the right of the screen just before you get to the 880 interchange. if they can look at the big rig and get it overturned, a half hour to 45 minutes. if there is an issue, that could mean another of couple of hours. we will show you on the maps ways around this. southbound 101 only one lane is open at the scene. because of the dramatic activity and the northbound side will show slowing. use 280 or brocaw over to 880 or southbound bay where things are moving nicely on the freeway itself. >> thanks a lot. two people are dead after a crash in oakland. you willee s what's happening at the scene right now coming up in a live report. ha

a crash that killed two people. live to show us what's happening. christie? >> reporter: good morning. i wanted to let you know the car at the center of this investigation is finally being towed out of here this morning. this is the same car that the chp said was speeding down interstate 580 westbound. the driver refusing to stop with lights and sirens behind him. an officer said that the driver got off the freeway near foothill. kept right on speeding down mac arthur boulevard. one chp cruiser about a quarter mile back. witnesses say they heard the loud school of the tires and revving engine and at the intersection of 106th and mac arthur, he didn't see what was coming at him. >> as he was coming this way, he looked towards me as to maybe give a show like he was runing for the police. as he turned around, a young lady or maybe two were coming

out of the light and never saw it. as the car came across, it im k impacted and blew up. >> the officer had to pull the driver out of that burning car and he was take tone highland hospital here in oakland where he died. the person in the other car we are confirming just one person was killed as well. the chp is still on scene and don't know yet if drugs or alcohol were involved. certainly that's something investigators will be looking into. this is the jurisdiction of the oakland police department. i asked when this intersection might open back up and they tell me soon at best. earlier they had no eta, but they say it looks like things are progressing. live in oakland, christie smith, today in the bay. >> thanks a lot, christie. now out of the south bay, an overturned big rig is blocking lanes.

bob redell is live at the scene in san jose with the latest on conditions there. bob? >> reporter: good morning, brent. four of the five lanes and 101 at the 880 overpass of shut down. the fast lane is the only lane open. it's because of the overturned big rig. the good news is that the to truck operators are starting to lift it back up to get it back into the up right position. chp tell us that it looks like things are going good and they will get an idea within five minutes to get the big rig off the road and get all the lanes back open. they are sticking with an estimate of 45 minutes, but maybe in five machines they will be able to revise that. southbound 101 to northbound 880, that transition is shut down. southbound 880 to southbound 101 the same. that ramp is also shut down. the big rig was coming down the ramp when it lost control and flipped over. the driver is doing okay.

as far as for traffic on southbound 101, this is the number one lane. headlights are heading southbound towards morgan hill and gilroy. we are starting to see a slow down because the commute is picking up. in the northbound direction, the headlights beyond the overpass heading do san jose. it is moving just at the limit. maybe below the limit. we have a slow down within the past half hour because there is nor traffic and more looky loos and more people slowing down. the bottom line is this should be clear within 45 minutes if not sooner. reporting live here at the 880 overpass, bob redell, today in the bay. >> want to see how it's affecting the morning commute, let's check in with mike. >> there is a bit of slowing even though the incident blocks most of the lanes ach remind they're southbound 101 is only one lane getting by at the 880

interchange. avoid the area completely if you have to use the area. take 280 north on 880 or 101 to the area south of the accident or better yet, take brocaw and get off north of the incident and take it over to 880 and your transition is clear there. as bob showed you, mild slowing at the scene because of spectator slowing and we expect a heavier volume. 880 coming into downtown. highway 87 show this is slowing heading into san jose. oakland where christie is on the scene, we have the intersection blocked. mac arthur at 106 is closed and a major roadway past 106 and take foothill boulevard. access 580 without major slowing. starting to build for oakland freeways and towards the metering lights. we have a back up out of emeryville and a smooth drive

past university avenue in the commute direction from 20 to 21 minutes. an easy drive when you get through, but the back up now goes past west grand avenue. they build there as well. back to you. >> the couple accused of kidnapping jaycee dugard will be in court for a pretrial hearing as they face new charges in the case. phillip and nancy garrido are indicted on 18 charges including rape and false imprisonment. attorneys representing them hope to keep graphic unreleased details private. dugard will not have to take the stand until the trial begins. they took then 11-year-old dugard from a south lake tahoe bus stop in 19 none and kept her hidden in their home for several years. >> san pablo police told us they are getting good tips and need your help to figure out who abandoned a toddler on the side

of the street. the boy was wearing ohm one shoe and was found wandering the front yard. he is said to be between the age of 18 months and two years old. an eyewitness said they saw a woman wearing a brown jacket, pants and a backpack drop off a boy before jumping into a cab. >> the cab was yellow. we are currently contacting cab companies from vallejo to oakland. >> police say a man recognized the boy and said he knows who his mother is. officers are following up on the information. switching gears now, it's 6:36. some of the best golfers in the world are getting a few more minutes of sleep before teeing off. the executive director joins us live from harding park golf course. good morning. >> good morning. how are you? >> doing grit. it will be a great day for golf

pretty nice. we will check the forecast coming up. . >> to decision 2010, leaders are getting ready to lay out how they will change the country when they take control of the house in january. tracy pots is live in washington, d.c. talking about slashing the budget and starting all over with health care reform. >> that's right, laura. these are the priorities. the party said they don't like the way health care reform was implement and they want to make major changes. first they want to deal with spending. going through the budget, trying to figure out why where they can cut. this is a big priority andy we are going to hear from the transition chair for the republican party talking about what they will be doing between now and january to get ready for this big change. president obama has said he wants to work with the new republican majority in the house.

accident right there. watch it as you come towards that interchange. 880 southbound and northbound affected on to southbound 101. avoid that interchange and use brocaw to 880 further north. a good connector ramp east of the freeway that takes to you 880. slowing in both directions as we predicted. the south bay commute and the rig has been uprighted. he will have an update coming up live at the scene and whether or not they think they can move the rig. that's better new for you through industry streets. >> the weather speaking of san jose. not much wind and we have more clouds than yesterday at this time. 58 in oakland and the commute is looking okay. san francisco look at that. 63 degrees. a little bit of a sea breeze.

radar not picking up yet, but systems to follow into tomorrow will bring in a chance of showers. today a little bit cooler and filtered sunshine. for friday, a system that is going to weaken as it approaches the coast. by friday night and early saturday, maybe a few showers. it's sunday i think we will see the best chance for rain. temperatures around the bay area 50s and 60s for most of the bay area. 70s with clouds and sun at times. the weekend forecast includes a big drop in temperatures. 50s and sicks for highs and rainy day sunday, but at least an extra hour of sleep as daylight savings ends this weekend. >> good morning. we are looking at the dow industrials rise better than 100 point this is morning. it has been a phenomenal couple of days at the nasdaq. this is the folks from microsoft

rescued from the very officer he was runing for in the first place. he was taken to highland hospital where he later died. i just spoke with oakland police. they are the lead agency in the investigation. the intersection here at 106 th and mac arthur has been closed since after 2:00 this morning. they told me they hope to have this intersection reopened within about 30 minutes. live in oakland, christie smith, today in the bay. >> thanks for the update, christie. >> we have breaking news out of the south bay as well. a big rig blocked most of highway 101 at 880 and starts in the wrong direction. today in the bay is live near the intersection in san jose with a look at how things are going. the good news is that basically this is against the morning rush commute, but it's causing a mess. >> if you are on southbound 101 approaching 880, you can see the

headlights heading in a southbound direction because four of the five lanes -- >> we lost his shot. that truck came close. i hope he didn't clip or camera. the clean up truck was right there. to tell people who bob was saying, it looks like several lanes, four out of five are blocked? >> depenning on which side of the interchange you are. >> i'm getting word that it was a cable only issue. he is okay. >> all right. that's better news for at least the crew. the morning commute we should see improvement. bob did minutes ago give me an update that the big rig was up right on its wheels. we don't know if they cleared it from the scene. if it clears before the end of

the show, they will let us know. you see the slowing on the northbound side. the southbound side lightened up as far as the flow and indicating they may be opening over the next few minutes. really jamming up from 680 up to the scene and that's the start as well and up towards 880. 87 as well. avoid the 101 interchange for the time being. they may have it closed for the next 20 minutes. brocaw or 280 to avoid the area. that's a good option. slowing in general. it may cause a disturbance and we will follow that. the east bay typical slowing for livermore and oakland we will see the slow down past the coliseum as well. no major issues from the coliseum to the toll plaza. the back up into the maze and golden gate bridge shows an easy drive from the north bay better than yesterday when the folks headed into san francisco for the parade.
