the city braces a former bart police officer mehserle. he will learn his fate and faces up to 14 years in prison, but his attorney said mehserle is trying to keep a positive attitude. oscar grand's family is also on pins and needle this is morning. >> in a few short hours, mehserle will learn his face though he faces 14 years in state prison. he is doing his best to keep a positive attitude. >> i am not just nervous, i will terrified. >> he spent the evening at the los angeles county jail gearing up his client for what he expect

to be a very tough day. >> don't count on it ever going the way you think it should go because it never happened yet. >> he faces up to 14 years in state prison after a jury convicted him of involuntary manslaughter. michael insisted the killing was nothing more than a tragic mistake. >> this is not the man who would take the life of a human being. this is a man who went into law enforcement to protect life, not to take t. >> it's our proep and our prayer that the justice system allow us to see the system at work by giving him the maximum of 14 years. >> oscar grant's family said not even the maximum is enough and don't believe the shooting was unintentional and don't think mehserle is remorseful. >> we're haven't heard an apology. he has been in hiding, in court, and now on national television

oakland city hall. participants are asked to bring flowers, cards, and pictures in memory of grant. >> jobs were added for the first time since may. will it make a dent in the unemployment rate? a look at the labor department's latest job report. >> the labor department will release the october jobs report. this will be at 5:30, under a half hour. the general consensus among e n economieco economists say the creation of 60,000 nonfarm jobs which is heading in the right direction, but not enough. the economy needs to add 100,000 new jobs a month to keep up with population growth and 200,000 jobs to get the 15 million unemployed americans back to work. economists don't think the outlook for 2011 such better and the rate can stay high for quite a bit longer.

yesterday the federal reserve announced it would purchase 600 billion in t bonds hoping that the infusion will cash will boost the economy on other loans and making it easier for employers to start hiring again. later president obama will head to asia to negotiate new trade deals. the idea behind those is they will put more americans to work. we will hear from the president before he departs. >> the man accused of stealing ballots on election day will be back to work. he will not explain why he took the ballots. he grabbed the ballots, memory card and a teenager's cell phone. the missing ballots were found and fished out of a pond at san francisco's palace of fine arts. three days after the election, a few races are too close to call.

we checked the website and the latest numbers show san francisco district attorney camera harris holds her lead in the race for state attorney general. harris leads republican couey by 12,000 votes. when it comes to the congressional seat in district 11, jerry mcnerny holds a tiny lead. he leads republican david harmer by just 129 votes. absentee ballots are being counted in both races. >> voter who is have a say in who takes over gavin newsom's place won't have a say as the mayor of san francisco. the decision is in the hands of the board of supervisors. how the decision will be made is up in the air. on tuesday the president will get the ball rolling on setting up the process choosing an interim mayor. the president becomes the acting mayor until the majority approves a new mayor.

it is clear out there, but you see there is fog. you want to watch your commute as you head out of the inland areas. we will have the traffic and weather in a monday. there no survivors aboard a plane that crashed into the mountains in the eastern part of cuba. we have photos taken after the flight went down. the cuban government said the flight crew declared an emergency moments before the crash. the plane was careering 68 people and 28 foreigners. it appears no americans were on board. it takes off from port-au-prince and lands in va ha van a. also this morning, the ceo of qantas said a faulty design may be behind thursday's mid-air jumbo jet blowout.

it said it's too early to tell what caused the engines to blow uh. world headers expect another disaster to strike haiti soon. hurricane tomas may take a toll. thousands of people are living in tents after the devastating earthquake earlier this year. it is a category one and hitting haiti's southwest coast and raising concerns and risks over flooding. the hurricane is expected to take a day or more to pass through haiti. this morning a jury will weigh in on whether a parolee convicted of killing two children and their mother should face the death penalty. he is accused of killing jennifer hawk pettitte and her

daughters three years ago. the lone surviving victim of the, tack, husband and father william escapeed from the basement after being tied and beaten. >> there is some relief, but my family is still gone. it doesn't bring them back. it doesn't bring back the home we had. >> hayes' suspected a comp police still faces trial to begin next year. >> medical marijuana is being delivered in one marin county city. the alliance for medical marijuana in fairfax will deliver pot to members next week. the collective has been working with the city's attorney since mid-summer to resolve concerns about insurance coverage. the independent journal said the

policy relieves the town of any damage caused by the delivery service. that policy also ensures delivery workers and the marijuana itself. the california high speed rail authority said the first bullet train line will roll through the central valley connecting fresno to merced or bakers feel. it will not serve the far northern or southern parts of the state. lawmakers wanted to connect l.a. to anaheim first. the entire line one way or the other is expected to be completed by 2020. is it the final frontier for the shuttle discovery? the final mission has been delayed three times, once to fix a leaky fuel valve and another time for an electrical problem and then stormy weather canceled another launch.

59 degrees and a few high clouds. in oakland a pleasant start to the morning. northwest wind at 5. golden gate bridge, you will run into patchy fog this morning. currently 56 degrees. we will see clouds on the increase during the day. patches of fog for the morning. temperatures hanging on to the 70s and maybe close to 80 in the warmest spots. come this weekend, big changes by sunday. we will see temperatures drop as

much as 20 degrees from today's highs by the time we wrap up the weekend. the clouds are streaming in from the south. one system offshore that will get split apart and dive into southern california. tonight and saturday a slight chance of showers. a cooler start to the weekend and highs dropping off for saturday. sunday looks to be the main event. snow levels close to 6,000 feet in the sierra. if you head to lake tahoe, bring the snow cables for the weekend. in terms of rainfall projection, you can see the totals starting to stack up about a half inch to an inch for most of the bay area and all the rain coming down around midday. around the bay area, a mix of clouds and sun. 78 degrees around san jose. 60s on the coast. we will see the sea breeze picking up and just a little bit of cooling for the coast and peninsula. inland with 70s and that will continue towards the north bay. temperatures cooling and a

bag of clouds and sunshine. temperatures upper 70s and upper 60s around san francisco. cooling down more on the evening and more on rain in the forecast. a closer look coming up in a few minutes. >> oakland police are monitoring protests planned over the sentencing of the former bart police officer convicted of involuntary manslaughter for the killing of oscar grant. we have a look at what police are doing to be ready. >> reporter: good morning. oakland police and community leaders are expecting a smaller turn out than in past demonstrations tied to oscar grant. oakland police officers will ob duty today and got law enforcement from outside agencies on stand by to help out just in case near downtown where peaceful demonstrations have turned violent after the former police officer was convicted in july of involuntary manslaughter for shooting passenger grant. anger boiled over as many

thought it was way too lenient. some businesses in the downtown area that were vandalized are boarded up. oakland police established an emergency operation center to keep the public informed. parking in the downtown area is limited today. mehserle shot grant at the bart station and his attorney is pushing for probation and the shooting was accidental and that he meant to grab his tazer and not his gun. in oakland, christie smith today in the bay. >> the u.s. department of labor released monthly jobs reports. bob redell is in the satellite center pulling together the latest information. >> good morning. there is a surprise. it's not in the unemployment rate. that is 9.6% for the third

straight month. the surprise is in the creation of new nonfarm jobs. the consensus was that it would be somewhere in the 60,000 range. it turns out it was 151,000 new payroll jobs created according to the u.s. department of labor. there were revisions revised september saying there were 110,000 fewer job losses and looking at august and september, the u.s. department of labor said there were 93,000 more jobs or they were revising the plift sector job creation number to 93,000, an increase. the 151,000 new job number for the month of october is the most jobs created in five months. this is certainly good new when is you consider you need 100,000 new jobs each month to keep up with the u.s. population growth.

still short of the 200,000 new jobs to knock down the number of unemployed americans. there 15 million american unemployed. you need 15,000 a month to reduce that number. no surprise that the unemployment rate is remaining at 9.6% for the third straight month. >> good news. thank you very much. we have new video coming into our newsroom this morning. a car driving right into a house in oakland this morning. what a mess. it happened on capistrano drive at 2:00. that knocked out power in the house. police took one person in the car and a second person was also in the car taken to a local hospital for injuries. other than that not told of other damage or injury to people in the house. the people in the car feeling the effect there. >> a judge said court psychiatrists need more time to decide if the man accused of kidnapping jaycee dugard is

competent to stand trial. a judge is expected to rule on phillip garrido's mental state in march. at that time he will also rule on a request from several news organizations to unseal documents in the case. garrido and his wife nancy face kidnapping, rape, and child pornography charges. they allegedly kidnapped jaycee when she was 11 and held her captive for more than 17 years. meantime lawyers say allowing jaycee's tale of terror to be public knowledge would make it impossible for finding an impartial jury. they described evil acts, but he questions if her participation qualifies as evil. outside the courtroom, the lawyer said he thinks it will be difficult to find jurors anywhere in california because

of the media coverage. >> four working mothers ask an alameda superior court judge to stop cuts to child air programs. they cut parts of a welfare work program. the program helps pay for child care for low income working families being slashed. they say the department of education failed to tell them what the alternatives would be. the judge is expected to issue a written ruling today at noon. 49ers have the week off. they will not play sunday. that gives more time to get over the london jet lag. the raiders host the chiefs at 1:15 on sunday. we don't know if the game will be blacked out. normally the decision is made on thursday, but they are so close to sold out, the deadline has been extended to 1:00. if it sells out by then, the game will be on here in the bay area. the sharks will be back home tomorrow. they are trying to figure out how to get the puck in the net.

the team has not score and they are shutout in st. louis. hopefully they will turn around tomorrow night versus the lightning at the tank at 7:30. the warriors are back at the oracle arena and host the utah jazz at 7:30 and the warriors are off to a good start. they are 3-0 at home and 4-0 overall. good fastball matchups. cal visits washington state. number 15 arizona will play number 13 stanford and that is a good matchup at stanford. that game starts at 5:00 in the evening. san jose state has a bye this week. >> earthquakes are in the middle of the playoffs. check that guy out. that's a fan. the team taking the bulls by the horn. they beat them by two goals. the hero was danville native who scored the series-clinching goal. a nice shot and the quakes

the plan right now. heading into the city, look at that. you are dealing with fog and rob, there you go. tough to see, but what does it mean for the weather? >> at least we don't see much in the way of rain. 50s and 60s and 62 in oakland and the winds are light. with mainly clear skies early on, we did have the fog in the north bay and you are seeing around the golden geaj bridge. high clouds in the south and in terms of the rain, sunday will be the main event. the system that comes in first will fall apart as it crosses the bay. sunday we will see the gold front and that's when the rain will move through from about a third of an inch to close to an inch of rain. the north bay locations may pick up two inches in the hills around sonoma. cooler and breezy and a big drop as you wrap up the weekend. around the bay area, not too bad. 70s for most places and closer

daylight savings time ends and you get to turn your clocks back an hour. do you know why we do it? today in the bay's tracie potts live in washington. why? why do we do it? >> because we want that extra hour of sleep. no other significant reason. actually this dates back to 1918 and the u.s. has gone back and forth with daylight savings time since then, but i have a couple of questions if you are ready. >> fire away. >> here we go. when was the last time the united states changed the start or the end of daylight savings

today in the bay's christie smith is live with a look at how oscar grant supporters are reacting. christie? >> good morning. supporters say this is really a day to honor oscar grant. there many people who bring flowers and cards and photos to a gathering. some businesses like california bank here downtown are taking a much more cautious approach up to six large windows boarded up on this side of the building alone. we have new video for you this morning from where we are at 20th and franklin streets. the nurse's association is also boarded up with union bank. this is on one corner. just in case vandals get out of hand and following the sentencing for the shooting of oscar grant. some say they will take the day off and others doing nothing at all thinking it won't boil over taz did in july and windows are

go until the summer olympics get under way in london. teams are getting ready to compete and that includes the water polo team. they have to do preparation early. it's two years away, but never too early to get ready. peter verelis joins us. it's early in the morning and have to get up and get it going. >> we are used to being up early for training. >> you practice early in the morning in palo alto? >> i'm training here at stanford and we are based in southern california north of los angeles in thousand oaks. >> how many bay area connections do we have? >> we have a few die guys and a larger training group with about 30 guys in the mix to make the team. four or five are from northern california. >> when you get it widdled down, how many will you travel with? >> 13. >> pretty competitive. >> very. every year is their own tryout
