johannes mehserle. there are a lot of broken windows. thanks for joining us on this saturday morning. i'm kris sanchez. first, we want to check in on our forecast with "today in the bay" meteorologist, craig herrera, who says we may not get the rain today but we will get it tomorrow. we are going to get soaked tomorrow. quite a bit tomorrow. today, clouds this morning, mist, cloudy and breezy later this afternoon. wind gets heavy. so does the rain tomorrow. extended forecast. a couple of showers for the north end of the bay on tuesday. delays for some arriving flights due to the low ceilings. 29 minutes. call ahead of time if you are waiting for somebody to come in at sfo. none reported at san jose or oakland. low to mid-50s, a couple of 60s out there due to the cloud cover. highs today into the 60s. most places in the 60s. a couple of raindrops later. heavy rain tomorrow. more on the seven-day forecast. we also set the clocks back one

hour tonight. >> happy about that. thanks, craig. >> certainly. this morning, we begin with developing news overnight in the east bay where a man is dead and two others are injured after someone opened fire outside a house party. this happened on capistrano drive in east oakland. police arrived on the scene at around 11:00 and found two victims lying outside a house. one of the victims had been shot in the chest and died at the scene. police say it is possible that a third gun shshot victim fled th scene. a bizarre kidnapping tale. a south bay man tied up and beaten and held for hostage jumped out a second-story window to escape the men holding him for ransom. they are questioning the men they believe are responsible. this happened on fargate circle on valley crest drive in east bay. they tell us that he was

ambushed by at least five men as he left his home on thursday to run errands. as the men held the victim hostage, one of the suspects used the victim's only cell phone to call the man's family and demand money. last night, police were able to pinpoint and stake out the hostages situations and location. after four of the suspects were nabbed, the victim managed to jump out of a window to safety. he is injured but will survive. his alleged kidnappers are at the santa clara jail facing felony charges. it is done but not over. former b.a.r.t. police officer johannes mehserle is now sentenced but the community is not at peace. more than 150 people are in jail after a peaceful rally at oakland city hall. they and many of the more peaceful protesters are infuriated at the fact that he got the leanest penalty possible for killing oscar grant on new year's day, 2009.

>> while oakland is peaceful this morning, right now, police say 152 people were arrested, most for unlawful assembly and disturbing the paechlts one police officer was hit by a car. at one point, a police officer had his own gun taken from his holster and had that gun aimed at him. that suspect was later apprehended, the gun recovered. protesters also damaged seven buildings during the night. it all started with a peaceful rally outside city hall where as many as 500 people gathered together to sing songs and give speeches in oscar grant's memory. a splint ter group of protesters left that rally into neighborhoods. some of the people told nbc bay area they were heading toward the b.a.r.t. station where johan n mehserle shot and killed oscar

grant. protesters smashed the windows of buses, cars and stores. police cut off the group of about 100 people or so at sixth avenue and east 17th. dozen of police officers in riot gear surrounded them on every block. that's where an oakland police officer was hit by the car but not seriously injured. the oakland police strategy was different for sentencing day than for the day the verdict was announced. there were more police officers on the street both in uniform and in plainclothes. at east 18th and sixth avenue, police were told to hold the line as part of the department's strategy to corral the protesters. the chief says he has had enough resources to execute this plan with precision thanks to the help from the albany, san francisco and hayward police department. but some residents say the strong police presence may have escalated the violence. >> then, i saw street after street after street as the police corralled the protesters,

herded them over here. >> i am trying to send a message. you don't get to do this in oakland. you have a right to protest and freedom of speech and a right to voice your discontent. you do not have a right to tear this city up. >> the police would not say how many police officers were on the street overnight. some were carrying cameras to document their response. >> all of this is sfaparked by los angeles judge's decision to give joe haan ness mehserle two years behind bars. >> reporter: people protested after a judge made rulings he admitted no one will be happy with. four months after a jury convicted b.a.r.t. police officer of involuntary manslaughter for the 2009 killing of oscar granted, judge robert perry sentenced him to

two years in state prison for the crime. >> i want to make this clear. johannes mehserle is still in custody and still behind bars. i won't be happy and rest until he is out of custody. >> reporter: the sentence could have been much longer. the judge threw out a gun enhancement after concluded the court mistakenly failed to instruct the jury clearly enough. >> to now decide that is a judicial error, to throw out what we all knew was right and then admit that i am so sorry that i made that gross of an error showed that there is something wrong with this criminal justice system. >> reporter: for the first time, grant's family got a chance to tell the judge just how much they have suffered. his mother said she is not sure how she will continue without her son and begged the judge to throw the book at the former officer. his aunt called mehserle an uncaring monster who has no

remorse. johannes mehserle got a chance to talk to. he said, i, with all my heart, have been and always will be sorry for taking oscar from them. i pray one day they will find it in their hearts to forgive me. >> his message to the bay area was that he is so sorry that he took the life of oscar grant. he did not mean to. he lives with that reality every day. he feels so sorry for the family. he apologized to them. >> he did not take responsibility for his actions. he never stated that. he put it back on oscar. he put it back on the young men on the platform. >> reporter: jody hernandez for "today in the bay." mehserle is now sentenced and will spend the next seven months in jail. the legal wrangling in this case is just beginning. the u.s. justice department and the fbi are investigating the shooting to see whether mehserle should be prosecuted in federal

good morning to you. waking up nice and dry. your honey-do list will probably be pretty long today. you won't be able to get anything done tomorrow. super soaker on the way. in san francisco, parking in a no-parking zone or forgetting to feed the meter is more likely than ever to get you a ticket. apparently, parking enforcement officers have been too kind in the past few months writing fewer tickets than usual according to the san francisco examiner. that has left the department budget $7.5 million short.

the city is budgeted to bring in more than $256 million from parking tickets for the fiscal year. so watch yourself. tonight, a bay area religious landmark is set to make history. dr. jane allison shaw will be the first woman to lead grace cathedral in san francisco and also the first openly gay leader. it is one of the largest eppiscopal churches in the country. a stunning turnaround in the race for oakland mayor. councilwoman, jean quan, has catapulted into the lead ahead of former state senator, don perata. she received a boost when third place candidate, rebecca caplan, was eliminated. her votes were awarded to the two remaining candidates and

quan received 75% of those votes. until yesterday, perata held a comfortable lead and had been expected to lead. the latest tally of votes put quan in front with 51% of the vote. california's attorney general race could take weeks to desite after claiming victory prematurely. steve cooly is trailing camilla harris by about 12,000 votes. so far, 7 million votes have been counted. more than 2 million late or provisional ballots remain to be counted before the end of the month. harris' campaign says they are confident they will pull out the win. cooly's camp says they are not making any more predictions. voters won't have a say in who takes over for gavin newsom as mayor of san francisco now that he is headed to sacramento as lieutenant governor. the decision is in the hands of the board of supervisors. how the decision will be made is still up in the air. on tuesday, the president of the board will get the ball rolling

on setting out the process for choosing an interim mayor. the board president becomes the acting mayor until a majority of the board approves a new mayor. voters will get to elect for themselves their mayor in next year's november election. the former contractor whose sexual harassment allegations cost mark hurd his job as ceo of hewlett-packard is now leaking something else. the allegations surfaced in yesterday's wall street journal. a source close to hurd says it never happened. oracle hired him. the new details come as hp and oracle currently involved in a bitter dispute. coming up on "today in the bay," new concerns for a san bruno neighborhood devastated by a gas line explosion. could winter weather threaten to

the san bruno explosion could hit more than $1 billion. that is fueling fears over how much the bill customers may end up paying. we watch for mudslides whenever we have a fire. this is a unique situation where the gas pipeline exploded. i remember that they were putting gas in. it seemed kind of superficial at the time. now, we know why. >> you needed it. without that brush or the grass to hold on to some of the moisture, you usually get some mudslides and landslides in some cases. >> we are going to have half an inch to an inch of rain in that area. it is going to be kind of messy. we will watch that for you close. it is a good, soaking rain that comes through. it will go through quickly but sit there for at least four, five hours. that's enough time to do damage. that will happen tomorrow. right now, cloud cover. we will watch that for you tomorrow. from san francisco, looking out towards alcatraz. we have some mist and drizzle and some delays at sfo for some

arriving flights. next shot over oakland. plenty of cloud cover here too. this is all ahead of the next storm coming through. there is one storm moving to southern california, a very weak one. the next one, the big one, is coming to us tomorrow. that's san jose live right now with the headlines throughout the rest of the morning today. a lot of clouds, mist and drizzle for the morning hours. becoming breezy tonight. rain comes in. heavy at times. especially, from about 11:00 to 4:00 in the afternoon. extended forecast will have some dry days. the next chance for rain for the north end of the bay, mainly, will be on tuesday. the delays at sfo, talking about our 29 minutes for arriving flights due to low ceilings at sfo. right now, mostly 50s up and down the entire bay area. low to mid-50s at that. a couple places close to 60. we are only going to warm up another 5 to 10 degrees in some cases in and across the bay area with all the cloud cover in place. this is headed into the central and southern half of the state.

on your mark, get set, go, the new york marathon is off and running on the streets of manhattan. among those that laced up their sneakers this morning, edison pena. if you don't know the name, you will know his face, one of the 33 chilean miners trapped undergrowth for more than three months. this is his first marathon. he has competed in a triathlon before. this time around, his training regimen was a little different. he jogged as many as six miles a day underground by cutting his steel tip work boots to ankle height. he ran in 85-degree heat, pitch darkness, guided only by the light of his helmet. now, he says, he is running to celebrate his life. wow! the confetti isn't completely clear from the streets in san francisco. fans are already asking, what's next for the g-men. laura has that and more.

mystery of a russian hill resident. mr. is say -year-old publicist kathleen horan was robbed and killed inside her home last week. investigators put out a sketch of the suspect who posed as a utility worker to gain access to her apartment building. they arrested 43-year-old gary scott holland. they noticed him laying on the ground and went up to him and talked to him. it was strange enough that they called police. when officers got out there, they put two and two together and arrested holland. >> we are glad to make an arrest but hearing about it is shocking. >> holland was on parole for attempted murder in fresno. he has been arrested on suspicion of murder in this case. this morning, an east bay woman is reef covering from injuries after allegedly jumping out of a window to escape police. a 46-year-old woman stabbed a man inside a home near quals

circle. when officers arrived on scene, they discovered the woman lying injured on the ground outside the home after jumping from the second story. both the woman and stabbing victim are expected to survive. as soon as the woman recovers, police plan to charge her with assault with a deadly weapon. the controversial cow palace could soon be under control of daly city. in the past six months, two fatalities and many emergency room visits for attendees of cow palace events. as a result, the teachers, residents and leaders of daly city scheduled a press conference for 11:30 this morning. they will introduce legislation they want passed to provide the city with control of the cow palace. attendees would have to be 18 years or older and require more safety, fire, and police roe tex at cow palace events. last weekend's event that sent people to the hospital. it was an event for 16 and up. alameda police have arrested

halloween candy still isn't out of the house. yet, the holiday season is upon us. not just a season of getting. of course, it is also a season of giving. the executive director of sacred heart community services joins us today. thanks for joining us this morning. >> thank you, kris. glad to join you today. >> obviously, this is an unfortunate sign of the times that you have 3,000 folks lined up already this morning looking to sign up for holiday gift season, right? >> yes. it is really devastating to see what's happening with the economy and the toll it is taking on working poor families. we have an extraordinary need. we have not seen these kind of numbers before. we are hearing the economy is supposed to be getting better.

we are not feeling it yet. >> you were telling me just a second ago that 3,000 people are lined up. you expect 6,000 people will make their way through your doors by the end of the day. how does this compare to last year? remember, the experts are telling us, the recession is over. >> yeah, in fact, we are seeing people that started lining up instead of lining up at 2:00 in the morning. we had people lining up at 7:30 last night. we had people that are really, really struggling in this economy. they are just signing up literally today for the chance to actually provide holiday food box and toys for their children this season. so we are just overwhelmed with the response right now. we are ready to try to step up and meet that demand. that's why i am talking to you today. we need help from the community to make it happen. >> we always hear that aid groups saying there is no donation too small, no donation too small. if you don't have a lot to give, the best way to give is a small cash donation versus trying to

buy something. is that right? >> that's probably the best way to stretch those dollars to make sure we are able to feed these families and purchase toys or gift cards for the family so they could make sure they have part of the joy of the holiday season. being able to come to our website at sacred heart or contacting us at 408-278-2170, we could try to help folks and try to connect people up with ways they can get involved. that's a big part of the work we are doing here. >> i was just wanting to mention, we have your information up on our website and on our screen right now. we are not just talking about the toys for the holiday season. we are talking about critical needs type stuff, socks for the babies and diapers and formula. that sort of thing, right? >> exactly. that's really the work that happens year-around here at sacred heart community service where we have thousands of volunteers that come help us
