details of exactly what happened. christie? >> good morning. oakland police just cleared the scene in this alley where we are standing women understand they were searching this area behind me along the fence looking for a weapon. we understand this started as a domestic dispute call around 9:30 at a laundromat. near 58th and bancroft. there was a sort of altercation and the man involved ran and exactly what happened next is unclear. oakland police fired and now according to the coroner's office, a 37-year-old man is dead this morning. no officers injured as far as we know. we do have calls into the police

department, but what we know is they have cleared the scene. a 37-year-old man is dead and this is still under investigation. that's the latest from here reporting live in oakland. christie smith today in the bay. >> most of the 152 people arrested during protests of mehserle's sentence are out of jail this morning. at last check, just people arrested in oakland last friday are still in jail. police released them after citing them to appear in court. it was for vandalism and disturbing the peace. they took to the streets after the judge sentenced the police officer to two years in prison after shooting and killing oscar grant. . >> now to decision 2010. things are still uncertainty in the hotly contested race for oakland. we hoped to find out the winner yesterday afternoon, but now the registrar is saying we may not

know until the end of the week. rank choice vote suggest turning the election into a race between senator don pe rota and jean quan. the ballot showed perotta the clear winner, but ranked choice are painting a different picture. 70% of kaplan's votes are going quan. that may be the difference in the contest. the race for attorney general is up in the air and this morning kamala harris needs more money. harris's camp said the money would be used to send monitors across the state to watch the ballot counts. there is $2 million that must be counted state-wide. a spokesman is remaining optimistic, saying many ballots are from democratic-leaning counties. >> the executive who oversees

the smart meter program admits that he tried to sneak on to an online forum that krit sighs pg pg&e. the moderator of a forum on google found out about devereaux when she checked an e-mail could from a man who called himself ralph. he also joined at least one other forum as well. devereaux calls it a mistake and said he did it without telling other executives. bay area college students may be losing sleep, but not because of an all night study session. rather because of fear that their education could cost more money. we have a look at the latest hikes on the table or across the state. >> good morning. $100 may not sound like a lot, but it's a tuition hike at schools like this and uc schools

are going to consider raising tuition. tomorrow trustees will vote to up tuition for the rest of this school year which is about a 5% increase. then they could up tuition by $440 in the fall, 10% on top of the 5%. that puts tuition at nearly $5,000. still might sound like a deal for cal. they will vote to raise tuition by more than $800. uc board president made that announcement at the same time he announced there could be changes to the financial aid system that would defreeway cost for half of the students there. students say they will rally to protest the tuition hikes and say that the planned hikes go counter to what they were trying to do when they increased funding. the trustees at san jose state university and the rest of the system are going to vote tomorrow and for the uc board, they are going to take up the issue next week. students say they are organizing

and will not take this lying down. chris sanchez today in the bay. >> governor arnold schwarzenegger is pradsing californians for the way they voted a week ago today. scott joins us with more on his late night appearance. the governor. >> jay never invites me. the governor was on "the tonight show" and no doubt looking for a big name. the governor said we understood the issues really well. he turned his attention to the national election. >> what was your reaction to these mid-term elections? surprise? >> i think it led up to that kind of a result. there was no surprise by any means, but really crazy in a way because it was all over the place. it was so extreme the whole thing. extreme right and extreme left. i think the important thing is that no matter who is in power,

an 87-year-old who claims he became legally blind will receive a $250,000 settle am. he filed back in march saying he was one of eight patients to receive treatment at the hospital. an investigation revealed that optometrist at the hospital did not follow policy that requires all patients to be treated by an ophthalmologist. after the investigation, the optometry section was moved for poster supervision. >> 6:09 and want to check your morning commute. >> a report of an accident. westbound 580 at 680. the same area with the huge accident and more details came in and it sounds like a minor accident. just property damage and it moved to the shoulder. no major slowing on your left side of the screen where the interchange is. the slowing with a pattern

new shipping rule. the obama administration has banned freight out of places like yemen and somalia after attempts to put bombs on planes there. shipments of toners were restricted and security rules have been unchanged. >> the former chief of bp is talking about the gulf oil spill. the company was unprepared for the spill, forcing it to improvise solutions. hayward said contingency plans were inadequate and they were making it up day to day. the spill pushed bp to the brink of disaster and the company was not ready to handle the media scrutiny. hayward left the top spot after take much of the flack for the poor handling of the disaster. april 20th explosion killed 11 people and started the worst oil spill in u.s. history.

president obama arrived in indonesia. he and the first lady flew into the capital of jakarta and the president and his wife welcomed them to the presidential palace. indonesia is the world's largest muslim nation and president obama had to shorten his stay because of concerns over voll cannish ash. that means there is not going to be enough time for him to visit his neighborhood where he grew up. it is continuing to erupt and thousands are fleeing, fearing the volcano will continue to erupt again and again and it's spug hot ash this morning. whole ville annuals have been smother and people were cut down by the searing gasses that raced down the mountain at high speed. hospitals are overloaded with people who need to be treated for bad burns. >>a i train is to blame for a massive explosion in poland.

one was loaded with diesel. they slammed into each other creating a huge fireball. they think an engineer ignored a red light. somehow the explosion only injured two people and the injuries were not serious. elizabeth smart will testify about what happened the night she was taken eight years ago. smart is now city and spent her first day on the stand yesterday. she described the first night of her abduction and how brian david mitchell forced her to marry him in a bizarre religious ritual. she said she was raped almost every day until her rescue months later. mitchell's defense does not dispute the kidnapping. they are portraying him as a deranged man who didn't know what he was doing. putting smart on the stand is part of the prosecution strategy. >> i think they are going into

the sexual details to show that this was done for sexual reasons not for religious reasons or something along those lines. >> mitch cell now 67 and faces life in prison. that trial is expected to last about a month. >> it's 6:and 16 three-alarm warehouse fire in san carlos could have affected a famous figure. want to check in with today in the bay's rob redell. looks like they are out there investigating. >> they are. we are at the warehouse district close to 101. if you look at the back behind the white van, there is a warehouse that was burned this morning. the fire started just before 3:00. the fire is out in the mop up mode and trying to figure out what started the fire. it does not seem suspicious. the big disappointment and we

have the fire chief here. what did you find? >> the crews made entry and found a number of vehicles and storage containers as we found out later all belongs to neal young and his family. there were a couple of vehicles in there and while the fire was burning in the front, they made entry and able to remove a number of items and a number of vehicles were parked in the back and a number much paintings and storage cases were removed. as it gets closer to daylight, we will have a better idea of what the total damage and the loss is in there. probably about a 10,000 square foot warehouse. really full and a lot of memorability in there. at least six vehicles. >> vintage vehicles are and musical instruments i presume? >> we suspected a lost that was inside the cases. none of that was outside, but closer to daylight, we will have

shot by a police officer. police were called to a laundromat around 10:00 on a report of domestic disturbance. something happened after they arrived that caused two officers to shoot the man. he later died. no officers were injured. we will check in with christie for the details. >> college students are having to focus on their checkbooks as much as their text books these days. education continues to escalate and tuition keeps taking a hit. chris sanchez is live at the bay this morning where the bill could be going up again. chris? >> good morning. what's $100? a lot of folks it may seem like a dinner out. here at san jose state university, it is the latest fee hike that could distract them from the text books. tomorrow csu trustees will decide whether to vote on a $100 increase for the rest of the year and that is a 5% increase.

report. out where you guys are on the west coast, the number one stressor. it's work. people are stressed out at work and the survey found that people don't think their bosses are doing enough to help them with the work-life balance. that's more stressful. the good news if there is anything good out of it, we recognize our stress and know what to do about the stress. people seem to be too biz to get it done. one of the things they pointed out for parents to be aware of is the stress you are experiencing is also stressing out your kids. they found a third of kids said they cooperate even sleep at some point because they were so stressed out and they were feeding off of that stress from their parents. it's also got a physical component. people who are over weight report more stress and people who are stressed out gain more weight. it can lead to chronic illnesses

northbound commute look nice. 101 off of 680, the first two areas to show the commute. the earlier band is cleared, but we have an accident on monterey road complicating thins into morgan hill. keep that in mind and we will look at the chopper shot. they are off there as well. the bay bridge metering lights backed up here at the toll plaza building back past west grand. a low build and a her volume of traffic. folks may be slow moving because it's cold out there. a lot of heaters running this morning. we have 30s and 40s outside. across the north bay into the south around gilroy is 35. 38 in livermore woochlt ve sunshine to start and you will need it given how chilly it is. by the afternoon we will see clouds from the north and see one more chance of showers showing up later on today. starting off in the north bay

towards the evening and breaking up south overnight. in terms of rainfall, looking at about a quarter inch or less and falling in the north bay. after this system goes by, we will clear out and warm up as we head through the rest of the week. tickets mainly south of san jose heading off to the north and highs in the 50s. this is the last system we will see for a while and upon dropping in this afternoon and this evening. clearing skies and warming for veteran's day and takes us through the weekend. >> 6:49 right now. new this morning, one man is dead after an officer-involved shooting. christie smith is live with the latest developments. christie? >> good morning. we know that oakland police were out here for most of the night searching up and down this alley, perhaps look being for a w weapon. the person they were looking for ran around this way down the

alley. it started at a laundromat around the corner at a domestic disturbance call. police responded and apparently the guy was agitate and took off on foot. there was a struggle as the suspect did not give up to officers and started hiding between poles and cars and tried to jump a fence in the aly and an officer fired. details in the area are still being pluflushed out. i wanted to show you here this is the area where officers were searching for quite sometime overnight. the man who died is 37 years old according to the coroner. we have calls into the oakland police department. usually in these cases, officers are put on administrative leave while an investigation is under way. that's the latest from here, live in oakland with christie smith, today in the bay.

>> thank you very much. >> firefighters found something interesting after a three-alarm warehouse fire. legendary singer neal young has storage space there and some of his memorability may be damaged. once again from near the fire in san carlos, we have the latest. what do they know? >> there was definitely damage to the contents in the warehouse in the left of this larger white warehouse. the fire department confirmed that what was inside belongs to rock 'n' roller neal young. vintage cars and they believe possibly musical instruments and art. they know at least two of the cars and we want to take a look at the video provided to us. because of where the fire was located, they were able to see much of the memorability out towards the back.

they are guesstimating that they saved about 70% of the items and the items sustained smoke damage as opposed to water and fire. at least that's a good indication. he said the place was packed with a lot of his items. the 10,000 square foot warehouse is large. right now they are trying to figure out how much was damaged. the estimate is $750,000 in damage. they were able to get inside and trying to figure out what caused the fire. the initial gut reaction is this was not suspicious. live here in san carlos, live in the bay.
