smith. >> there is a memorial outside of the barbershop where he works. supporters will gather and march from here all the way to the fruit va le bart station for derek jones, a 37 year old father of one. he was shot and killed by oakland police. an independent autopsy revealed he was hit in the front of his and suffered multiple gunshot wounds. family and friends thought he was shot in the back. he was shot as he reached toward his waist band. it started as a domestic violence call. when police arrived, they tried to shock him, but it didn't work. that according to the tribune. he was shot when he got stuck in

a fence and there was a confrontation there with police. he was not armed, but what he had on him we don't know. the flyers for the march, they raise questions about the shooting on the heels of the mehserle sentence for shooting oscar grant also at the bart station. christie smith today in the east bay. >> investigators tried to figure out what caused a power outage that forced a martinez oil refinery to shoot flame into the air. this morning the shelter in place order has been lifted and health advisories were posted near the plant. avon, clyde and concord. video from last night with smoke pouring into the air for hours. an outage caused the plant to shut down. the burn off from six stacks

they won't change the outcome. the final count is jean quan with 53,778 votes, topping former front-runner don perotta. >> we are feeling relieved. it's been a long, long wait. i realize it's a 158-year wait. we are just very, very proud. >> while quan is celebrating, perotta is contemplating his next move. announcing a press conference, he included an article about voter confusion with the rank choice voting system. the campaign won't say what the plan is, but points out that perotta had a lead over quan. compared to quan's 29,206. quan moved ahead when voters's second and third choices were added in. the mayor-elect is ready to hit

the job running. >> economy and jobs, children and schools and public safety. >> priorities she is ready to fight for from a new office at city hall. today in the east bay. >> the results are not final until the election is certified. in the days up until after the election, perotta has the news conference later this morning and we will be covering it. the people of san leandro know their mayor. steven cassidy is the unofficial winner. the registrar of voters counting ballots not only from the confusing oakland race, but the san leandro race. cassidy won over incumbent tony santos. jerry mcnerny claiming victory.

his tam pain manager made the announcement last night. all four districts reported nearly all outstanding votes. he now maintains what they call an insurmountable lead of 1,681 votes over gop rival harmer. he has not conceded. the country pauses to honor veterans past and present. it's veteran's day and there events all over the area to salute the men and women who have served or are serving. president barack obama laid a wreath at the tomb of the unknown, but since the president is overseas, vice president joe biden will have the honor this year. the president is in seoul, south korea where he met with troops serving there. here in the bay area, veterans will be honored in pleasant hill and lawmakers will speak at a ceremoniy at 8:00 at the pleasant hill community center.

through the weekend including oakland thanks to a light breeze. 70s around the inner bay and 70s to start next week as well. back to you. >> first uc students and now california state students are facing tuition hikes. the csu board of trustees approved a plan to raise tuition for under graduate, graduate and credential programs by 15.5% on top of the more than 30% increase over the past year. the plan is to hike true diminution in two steps increasing by 5% in the winter and spring terms and another 10.5% next fall. sliding ahead of the opening bell as leaders strengthen a week economy. for more on that let's turn live to courtney reagan. good morning. >> futures are lower this morning partly due to

disappointing earnings from cisco systems when they reported after the bell. it is the largest maker of net gear so look for the nasdaq to be lower. a sharp drop in people file are figure unemployment. those numbers came out a day early because of the holiday today. investors are uneasy in the market this morning. asian marks rose overnight. good data out of china. europe a touch lower. there is a lot going on with the european debt crisis over there. new data in the u.s. today because the bond market is closed for veteran's day. the equity markets are open. fidelity said balances on 401(k) rose 9% this summer tracking the rise in the stock market. the number of hardship loans against 401(k)s picked up,

increased by a year over the past decade. that age is 28 for men and 26 for women. in addition the percentage of daals who are married went down from 57% in 2000 to 54% in 2010. the figures continue a trend that began in the mid 50s. there is a link between math and money. couple who is score well on a math test accumulate more money by middle age than those with lesser skill. when both spouses answered three math questions correctly, their family wealth average $1.7 million compared to 200,000 when neither spouse answered any correctly. wealth was also lower when the primary financial decision maker had the lower math score. some indicators suggest the green resolution is losing

passenger, oscar grant. they question the timing of this shooting on the heels of the mehserle sentencing. jones was 37 years old, a father of one, unarm and shot and killed by oakland police monday night. some supporters of his thought he was shot in the back, but they are reporting an independent autopsy shows he was hit in the front. oakland police said they believed he was reaching towards his waist band in a police foot chase, making officers believe he had a weapon. this followed a domestic violence call after a woman was fighting with him at the barbershop earlier. police apparently tried to shock him, but that did not work. there was a chase and the confrontation. folks meeting here this afternoon at 3:00. live in oakland, christie smith in the east bay. >> land in sight for the cruise
