the hearing for seven people accused of raping a high school student. >> the district attorney here in richmond has charged seven men, most of them under the age of 22 in this gang rape of a 16-year-old girl outside last year's homecoming dance on the richmond high campus right behind me. they are expected in a martinez courtroom later this morning for what will be a preliminary hearing. this is so the judge can decide whether there is enough evidence to move on with the trial. the hearing could last several days bah the da is expected to call many people to the stand including police, experts and witnesses. police have said several people watched the gang rape as it went on for a reported 2 1/2 hours in october. those people apparently did nothing. security and administrators on campus said they weren't aware this was going on especially since it was on a dark part of the school grounds.

to try to prevent this from happening again, the school district spent $2.5 million on security upgrades. they improved the lighting and added fences and cut back trees and installed over 200 high def cameras. >> it seemed like last month. every time you pass by the school, you think about that and what was running through their mind when it happened. >> the school is much safer than it was before. you still have the conscious going on in your head. >> the victim who has since remained anonymous has left the school district and settled her case against it. live outside richmond high, today in the bay. >> such a disturbing case. thank you, bob. new this morning, a defensive lineman will appear in court to face charges of driving under the influence.

number 91, ray mcdonald is expected to go before a judge in the superior court at redwood city. mcdonald was arrested in june on the 12th when a highway patrol officer pulled him over for allegedly driving 94 miles an hour on interstate 280. he was given a test and later booked into the county jail in redwood city and later released. he told the team and has been playing all season. >> a san francisco cable car operator is in the hospital with life-threatening injuries after somebody stabbed him in chinatown. it happened about 4:20 at mason and jackson streets on a cable car out of service. there were no passengers on board. a suspect attacked the operator, stabbing him several times in the torso and the arm. officers arrested 32-year-old george just two blocks away. they arrested three of the family member who is were trying

to prevent officers from taking him into custody. the motive is unclear. >> they will talk to the witnesses as well as the victim. because of the injuries, they haven't been able to get a good interview yet. >> it's sad. they are out here trying to help the tourists get around and enjoy our beautiful city on a beautiful day. it doesn't make any sense. >> the cable car operator's identity has not been released. >> a scare at a chuck e. cheese restaurant. he held dozens of people up at the family restaurant saturday night around 10:00. three men went in with guns and forced about 40 workers and customers into a storeroom. they got away and the robbers cover their faces. they do not have good descriptions. >> a san francisco college

student on the verge of being deport side breathing a sigh of relief. it may have arrived just in time. 20-year-old nursing student steve lee was set to be deported today. last night his attorney said dianne feinstein intervened and that led to the delaying of the deportation. his parents fled to peru to escape chinese rule. he was born to n peru and they came to the united states and were supposed to leave years ago. his parents are being deported to china and since he was born in peru, he is being sent there. >> efforts to crack down on nightclub violence may take a turn. the supervisor proposes getting your photo taken when you go into a club. the plan will be discussed at the public safety meeting.

it would require clubs to take your photo and get your personal information. supporters say something has to be done to curb violence at club. they worry about privacy invasion. there have been shootings at six clubs leaving 12 people shot and five people dead. police would hold the information on you for about 15 days. pa. >> 5:05 and no shortage of high powered women in the bay area, but a life of power is a life of high stress. that is taking its toll on women's hearts. good morning. >> high stress at work is bad for women's hearts. that may sound like a no kidding story. what's new is how seriously that can affect your heart or the heart of the women in your life. let's start with the study. researchers followed more than 17,000 healthy women and most of them health workers about 57. what they found is women who said they had high stress jobs

or high strain from their jobs reported a 40% increase in cardiovascular disease. that's an 88% increase in risk for heart attacks. a 43% increase in risk for needing bypass or other invasive surgeries. in california, 33.7% of women die of heart disease and stroke as an average of 106 women each and every day. women who say they are afraid they will lose their jobs also had risks and high blood pressure, cholesterol and higher body weight. heart experts say we don't have to take this laying down. we do have to manage that stress. the doctor said exercise, try not to bring your work home and have fun with family and friends and take a little bit of time for yourself as little as 10 to 15 minutes a day can zap the stress that can damage your

heart and end your life. i laughed when i said don't take it laying down. who has time to lay down? it's 5:07 right now. new parks are on hold. the city wants more parks and it collects fees to build them. no money to maintain them. on tuesday, the city counsel will consider a plan to end the park freeze and allow parks to be built. they racked up 80 to $1 million in fees since 2006. >> crab season is set to get under way, but don't get out the butter just yet. no crabs will be pulled out of the water today. due to windy conditions, they want to test the harvest before it goes to market. crabs may be light and not full this year. over the next couple of days, there will be crab testing that may affect the price per pound at market and when the season gets under way.

crab haulers are hoping for a large season. they have a large number and they want to see how big and meaty they are first. they are baited and ready to go for the last results. >> for the big fat crabs and the big fat traffic report. thins are moving smoothly. these are a look at the east bay travel times. they are looking fantastic. 580 and 680 as well. oakland things are moving nicely. it takes a while before traffic starts to build up there along the 205, 80, everything green. green means go which is nice on a monday morning. a nice way to start the day. the east shore freeway moving good. everything moving on time and 18 minutes across there. the pass not doing too bad. it takes a while to back up. a little bit towards 80. a nice way to start. >> a nice way to start in the weather department.

you can feel the warmer temperatures already. >> some spots this morning started off in the 70s. yellow and orange on the maps. you don't see this too often before 6:00 in the morning. 70 in mare field and 69 in oakland. school where the winds have backed off. you can see the gusty winds around fairfield and the mid-spans of the bridges. we are talking the bay bridge and san mateo bridge. gusty across the mid-span and clearer skies and high pressure keeping us warm and dry. big changes are coming up especially towards thursday and friday. around the bay area if you like sunday's forecast, you love today. 70s and low 80s again. not quite as gusty around the east bay hilltops. through the week, cooling approaching wednesday and friday and saturday, we talk highs in the 50s and 60s with showers as we move through the weekend. back to you. >> a chance of moisture coming in. >> facebook makes an

the steering wheel. you will get bounced around and a few spots are seeing 70s to start the morning off. around novato and fairfield and oakland close to 70. the wind speeds. this is closer to sea level where at north through fairfield and at times with the bridges this morning, you are seeing winds up to 25 miles per hour. right now in san jose, 62 and winds generally southwest at 5. not too windy around the santa clara valley. the camera bouncing around and temperatures close to 70. over to san francisco, not much wind. 65 degrees and close to the average high temperature for this time of year already this morning. we will be on the way to temperatures easily near the 70s. breezy and dry. morning temperatures in the 60s and 70s thanks to the off sore winds. 70s and 80s and don't get too used to it. towards the middle of the week, cooling and showers as you approach the weekend for the allergy report. cedar pollen in the low to

moderate range. the winds are kicking up and that's causing issues. clear skies for now and high pressure is holding off and the storm track keeping it off towards seattle and british columbia. this is the reason why those winds out of the north will see temperatures in the 70s and 80s and more 70s tomorrow, but the bigger changes arrive on thursday and friday. the high breaks down and the system is dropping in from alaska. weingly see a big drop in temperatures. highs in the 60s and as cold air settles in, highs only in the 50s and the system is cold enough for snow levels as low as 3500 feet. the first dusting of snow possible around the higher peeks. enjoy the sunshine. upper 70s to near 80. 78 degrees in san jose. if you head to the coast, a pleasant day around half moon bay. i think we will hit low 80s

minutes. >> a disturbing case that captured the attention of the bay area and the nation a year ago is in court this morning. seven people are accused of raping a high school student on the campus during a school dance. dozens of other people watched. the preliminary hearing begins at 8:30 this morning and will determine if there is evidence to bring the case to trial. a lot has changed since the attack. $2.5 million have been spent on upgrades including fens and additional lighting and more than 200 surveillance cameras. a district official hopes the best for the victim. >> it was the best investment we could have made to ensure the safety of the students. >> the school is much safer than it was before, but you still have that conscious going on in your head. >> the victim's identity remains anonymous and she left the school district and settled her case against it. >> the antioch man who allegedly

threatened to blow up the bay bridge heads to court. craig carlos valentino is facing multiple charges from an ordeal that began 7:00 thursday morning. he took his 16-year-old daughter hostage and drove on to the bridge and called 911 threatening to blow it up. he let his daughter go, but threatened to kill himself. no one was hurt. it backed up traffic thursday morning for hours. >> new this morning, new wireless towers may not go up for the next several months in and around walnut creek. they will consider a six-month moratorium on wireless towers. that move comes after neighbors demanded changes in city rules to specify where the towers can be placed. current law regulates the height of the towers and what they can look like and not exactly where they can go. despite public outcry, mountain

view approved a cell phone tower on the first presbyterian church last week. >> helping a san francisco college student on the brink of deportation. 20-year-old nursing student steve lee was set to be deported to peru today. senator dianne feinstein intervene and that led to them delaying the deportation. his parents were born in china and fled to peru. lee was born in peru and the family came to the united states. they were supposed to leave years ago. they are a wading deportation to china, but since he was born in peru, he is being sent there. he is being held in an arizona detention center. >> jerry brown will become governor in january, but will begin tackling the budget this week. he is am category up with plans to deal with this thing in a

couple of months with a $25 billion deficit. governor schwarzenegger scheduled a session to get under way in december. he is urging lawmakers to make deep cuts before he leaves office. the question is whether lawmakers notorious for stonewalling with the budget will go along with the lame duck governor or wait for brown. the situation is similar to the stalemate we saw this past summer. >> they're are out of control. too left and right. no one wants to come to the middle. 100 days without a budget? come on. that's ridiculous. >> california's fiscal year starts july 1st, but the governor is required to present the legislature, a proposed budget by january 10th. >> even though the government said the recession ended a year and a half okay, many are feeling the pinch. one business district is thriving. businesses along lakeshore satisfy are not doing badly.

while they plague other parts of the bay area, there hardly any there. there several new businesses on lakeshore avenue. >> it's very boring stuff that makes a difference. cleaning the sidewalks and steam cleaning every month. we have the gardener and keep up the lighting and have events. >> some of the new businesses opening up include a yoga studio and organic mattress store. stores like trader joes are also keeping traffic up. >> conflicting viewpoints over mandatory student testing. the testses are designed to help teachers tailor curriculum to target weak spots in academics. the testing is for first through eighth great and covers 28 elementary schools and four middle schools. ox ponents say it means more work and takes away from actual teaching time.

students take test in math and english four times a year. meantime teachers are being trained to modify the lesson plans. >> new reports of harmful lead in reusable grocery bags. they have been encouraging customers to switch from disposable to cut down on waste and save money. some respects say there potentially dangerous levels of lead in the bags. today democratic senator charles schumer said he wants to get to the bottom of the issue before it gets too late. >> lead takes years to accumulate to have harmful effects. these bags are relatively new. if we can get rid of the lead in these bags now, the danger to people is negligible or nonexistent. >> schumer blasted china where most of the bags are made for allegedly disregarding safety rules. >> this thanksgiving may be

without the main course for dozens of families in need in contra costa county. the salvation army is in dire need of donations for turkeys. christie smith is live with how short they are. christie? >> reporter: good morning, brent. the salvation army here in antioch are trying to feed about 150 families for thanksgiving. on friday they only had seven turkeys. we checked in with them this morning. ideally they would like to see this freezer full, but they did get some over the weekend. they are up to about 37. they are quite short of what they need. the food you see here is federal food that subsidized. what happens is that this is food they used to feed people on a daily basis. still they need the turkeys and the trimmings. you can see that their shelves are bare right now. they are asking the public for help. here with me is jackie smith.

good morning. you were saying a couple of years ago it was only 50 families? >> last year it was 75. our eyes widen and this year it's over 150 as of last monday that have called in that need food. >> it seems obvious, but do you think this is tied to the economy both the need and also that your shelves are bare? >> absolutely. we have been struggling for two years. the day it day is up 62% by families. we knew the struggle and i didn't think thanksgiving would hit us this hard or the holiday season. it looks like it will be a struggle all the way for everybody. >> these are completely bare. forever folks watching, you need the turkeys and what other sorts of things? >> cereals, soup, bread, canned vegetables and fruits. things they can make a thanksgiving dinner and have food after thanksgiving.

out the city hall of san jose this morning. a little dark out there, but the sun is beginning to come up and it warms up to a nice day. you see the temperatures. a 77. getting up there close to the 80 mark in walnut creek. cooler temperatures on the way. rob will have details coming up in a few minutes. >> congress returns to washington today, but will anything get done? it's a time when many lawmakers who were voted out of office come back for the last few weeks of business. tracie potts joins us live from washington with more. good morning. >> good morning. the bay area's nancy pelosi is not out of office, but out of the majority leadership. there have been questions about whether or not she would want to be and would be voted in as minority leader. when the house votes, she will be minority leader. questions about whether or not she will be elected.

with so much about her and the things she puts in congress. we understand she will now be the democrat minority leader. the biggest issue on the agenda before that new congress comes in, what to do about the bush tax cuts that expire at the end of the year. the white house has been floating this compromise of a temporary extension for the wealthiest americans, those who makeover $250,000 a year as opposed to the permanent that machine republicans want. that's what they will be talking about. they got to pass spending to avoid a government shut down much the government is running on borrowed money right now. they have get to pass one major spending bill this year. they have to deal with social security and medicare extensions that need unemployment insurance. another thing that the democrats want to get past another extension of unemployment.

what to expect in court. our legal expert steven clark is joining us this morning. good to see you. >> good morning. >> the pretrial begins today. what prosecutors need to show. this is about whether or not this goes to a full trial. >> what the da has to show at this point in the proceedings is, is there enough evidence to take the case to trial? it's a reasonable suspicion and it's not the beyond a reasonable doubt standard. the judge will be looking to see if they put on a prima fashia against all seven defendants. all seven will be in court and trying to knock their case out. talk about the seven accused people. are they all attackers? the reason i ask, would it be difficult to prove who specifically did what since you have seven of them and therefore would some get one sentence and somebody else get a difference sentence? >> the da has to prove all the

case against each one. they have to attack their case individually. this case will come down to other people who were there and witnesses against these seven as well as probably the most important thing, the forensic evidence, the dna evidence which i expect them to put on and that will be challenged. that is the critical part of the case. the victim will not testify it. >> i will ask you about the victim. in lieu of that, let's talk about the dna. how hard is it, when you have one attacker, this dna goes with that person. since you have seven and you have to sort through, does that make it complicated? >> it makes it complicated, but not particularly complicated. the da is unique to each individual and there would be exemptionulars and the prosecution has that evidence. they will put it on. because of the nature of this case and the age of the victim, that dna is not supposed to be

there. any presence of dna from the defendants i think will be very strong evidence in this case. >> in this particular case are all of these people who are accused people who allegedly took part in the actual rape and attack itself or is there a charge for not doing anything? i guess maybe in a way being an accomplice? >> that's a great point. that made this a national case. so many people took no action to protect this young woman. the law does not impose criminal liability on just standing around. these people, the seven in court are the actual attackers and not the bystanders who we heard about. >> they think man, somebody should have stepped forward, but legally you are not required to. it's based on the attack. >> it was a horrible moral act in terms of watching and not taking action.

weekend. back to you. >> new this morning, the taliban is taking responsibility for an attack on a u.s. military base in eastern afghanistan. a taliban spokesperson said militants fired a rocket at a base in the capital of the eastern province much flame and smoke were rising from inside of the base. they couldn't be reached immediately for comment, but look at thick black smoke. they stepped up attacks against afghan and foreign targets. we now know the cause of a powerful explosion in mexico's posh riviera that killed five canadians and two mexican workers south of cancun. it was because of a build up of gas from a nearby swamp. two americans were also hurt. witnesses say the floor was building was hurled up through the ceiling through the force of that explosion.

wall street keeping a close eye on a lame duck congress and the potential of extensions of the bush tax cuts. really bad week. worst in three months for the market. dow ended 90 points lower on friday. cat pillar buying another company for $7 billion. meantime, retail sales, particularly cars up big. that could help the mood a little bit. >> thanks a lot. stress is bad for your heart, but a study reveals how bad it is for women. today in the bay's chris sanchez with the toll job strain can take on you or the woman in your life. >> we are everywhere. stress is bad for our health, but what's new is researchers know what that means for women in particular. all of the other previous long-term side e studies focus on men and stress and we are more than half of the workforce. here's how the study from the

national institutes of health work. researchers followed more than 17,000 healthy women for 10 years. mostly they were health care workers and most of them white and the average age is 57. they honed in on who the women were and the ones that said they did demanding work with little or no authority and little opportunity to use skills, this is what they use job strain. they had a 40% increased risk of cardiovascular disease. they had an 88% increase in heart attack. a 43% increase for a risk forever needing bypass or other invasive surgeries. in california 3.7% of women die of heard disease and stroke, an average of 106 women every day. women who are afraid they will lose their jobs suffered with higher blood pressure and cholesterol and higher body weight. here's the thing. heart experts say this doesn't have to work out this way.
