good morning. we have a busy morning of news ahead. let's start with rob and an hour by hour forecast. >> tough to top yesterday's weather around the bay, but we will come close. temperatures in the 40s and 50s and not quite as warm as yesterday because of the winds start to back off. clear skies and nothing showing up for now. high pressure will start to weaken and the cooler changes will start to drop in starting tomorrow. another gorgeous day in the east bay and beyond. 76 for dublin and you can see even around places like oakland and the inner bay, highs in the low 70s and concord and solano county. highs in the mid- to upper 70s. the seven-day forecast brings highs in the 50s and rain on the way. we'll let you know when in a few minutes.

>> mike's off and here's a look at the east bay commute. we got all green across the board. no construction to speak of. the pass is particularly fast this morning at 64 miles an hour. meanwhile, we have developing news and an active scene after a police chase from the east bay across the bay bridge into san francisco. today in the east bay's christie smith is live where it ended and the arrest of three suspects. >> good morning, scott. police are here processing the scene at east 25th and highland, paying particular attention to this white car here that you see behind me. they got the third suspect in custody after he jumped out of the car and started running into back yards. this is also the car that investigators believe could be tied to a string of street robbers, as many as seven in the

lake area recently. i spoke with police and they told me they have three in custody. apparently one of the victims gave a description of three people and the car. very likely a stolen car. there no plates on it this morning. officers spotted it overnight near interstate 580. police followed the car and the chp pursued the car over the bay bridge. the driver turned it around at the island and went back into oakland. police followed the driver to where we are now. the chp told us they used a pit maneuver to stop the car and crash into a parked car here. they were able to arrest two people inside immediately. both a man and a woman. a third suspect ran. a 90-minute search just a short time ago with help from an emeryville police dog. they should be wrapping up soon. live in oakland, today in the

east bay. >> thank you. an east bay man's computer was stolen and she getting very little help from the police in nabbing the person responsible. he doesn't want to reveal his identity, but they ripped off his mac pro computer. scary situation, but he installed that tracking software called prey. it enables his computer to take a picture of the suspect and reveal his gps location. case practically closed. >> i have a photo of the individual using my phone as well as a location of the block or the neighborhood he was using it from. >> the victim is frustrated because oakland police have not contacted him even though he has all the evidence. we contacted the police and they haven't returned our calls either. >> could johannis mehserle be

home by christmas? today in the bay confirmed the former bart police officer will be back in a courtroom on december 3rd. his lawyer told us he is going to ask a judge to release mehserle on bail in the appeals process. that's an unusual move and not one that usually pays off. he was sentenced to prison in the death of osktar grant nearly two years ago. another emotional day in a rich understand mond courtroom about the gang rape of a young girl outside a high school dance. several suspects were escorted into the courthouse in shackles and handcuffs. the judge is deciding whether there is enough evidence for a trial. three of the suspects who were juveniles at the time are being tried as adults. a police officer who found a girl draped over a bench at the scene testified and told the

judge i thought he was dead. the only thing touching the ground were the tops of her feet and side of her face. i shook her and she moaned a little bit. the preliminary hearing is expected to last three weeks. a south bay group on a mission to stop school bullying. pact will meet at cam brian park at 7:00 tonight. if you are concerned, they want to hear from you. they want to find out ways to bring justice to families and raise awareness about the damaging effects. a marijuana mecca with an ocean view in richmond. a report calls for a medical marijuana farm that will be grown, stored and sold at the century-old buildings at point malati. it would bring $3.2 million a year in tax revenue. here is a look at the beachfront

immigration status can qualify for tuition. they passed the law in 2001, but out of state students sued saying it wasn't fair that noncitizens could get a lower tuition than they could. the high court reversed the decision. mike is off so let's take a look at the east bay commute. this is starting outside of oakland on the east shore freeway. the maze times looking reasonable and the pass usually causing trouble, but giving us a break this morning as mike has the day off. >> let's say hi to rob. if i have to do your job, i'm in big trouble. >> the weather lately has been easy. blue sky, sunny and temperatures in the sunny. we will see changes later on this week. 54 degrees and you will notice it's cooler outside. the offshore wins that have been powering up the warm days.

50 in concord and 51 degrees. northwest at five. in terms of the wind speeds, we are still seeing the winds around the hilltops, but the wind speeds are dropping off. high pressure weakens and that will open the door to much cooler air. changes as early as late thursday with a chance of showers getting started on friday. today another gorgeous day. 77 degrees around livermore and pleasanton closer to 78. upper 70s and the seven-day forecast with the change coming as we head towards thursday and friday. temperatures dropping off and we are expecting air cold enough for snow above 3500 feet. possibly mount diablo may get a dusting of snow and cooler for the weekend. coming up, midnight madness

you are looking at oakland on a warm day. we will check with rob in a minute. one bay area bird is breathing easier after being freed from a sadistic form of animal abuse. they captured a bird and cut a beer can collar from his neck. you can imagine it was not easy catching the young male sea gull. >> for took a really long time. we tried a lot of strategies, but somebody already caught him and hurt him and it was harder to draw him closer. we could have caught 30 other birds the last couple of times we have been up here. it worked. >> there may be as many as four other birds with similar collars, there is a $3,000

mid 70s and a high of 74. 73 around san rafael and mid 70s into the delta towards vaccaville. i want to show tonight's temperatures. we have partly cloudy skies, but a rare treat where we are not fogged in. you may actually see the meteor shower around 2:00 a.m. if you want to see that, hopefully we will have the partly cloudy skies. a quick check of the east bay and the seven-day forecast, weekend highs only in the 50s with scattered showers and probably the first taste of snow this fall atop mount diablo. >> beatles fans rate to twist and shout as apple is expected to announce the music catalog will join i tunes. apple has not confirmed anything, telling everyone to be ready for an announcement at 7:00 our time. the absence is the biggest

america and jpmorgan say they are fixing procedures for managing foreclosures. they testified this afternoon and jpmorgan that collects payments for about nine million loans to set up procedures to review documents. they identified issues for improvements, but insist they have not foreclosed on borrowers who haven't missed payments. >> the senate has two democratic lawmakers. chris coons was sworn in bite vice president, joe biden. coons was elected to fill the seat in delaware long held by biden and matchen who served as governor of west virginia takes the seat of the late robert bird, the longest serving senator who died in june. both were special elections and they were sworn in early. everyone else has to wait until

next year. a house panel shot down charles rangle's request to delay the trial on ethics abuses. including not reporting income from a villa in the dominican republic. following his opening statement in washington, he left and said he would not come back without legal representation. we are getting a look at the tea party effect. new members have not learned their way around the capital and already we see big changes like the senate's top republican doing an about-face on an issue plaguing washington for years. earmarks and spending money for projects back home. tracie potts reports. . >> banning earmarks is a small, but important symbolic step to show we are serious. >> it's a 180 for senate leader mitch mcconnell as tea partiers arrive. republicans are benning e no longer backing the idea of

bridge. we will seeing with the driver quickly turning around and the car may be stolen. it has no license plates on it this morning. oakland police tell me there have been a series of street robberies near the lake merit area. the latest on jean street. the latest phoned in a description of the car. officers spotted it overnight near interstate 580. oakland police pursued it and the chp took over following the car and driver over the bridge. the driver came back to oakland where we are and the chp performinging a pit maneuver, forcing the driver to turn. he crashed into another parked car here and got out and ran. they are telling us after a 90-minute search through back

yards with help of outside agencies, it ended with the help of an emeryville police dog. they found the driver and arrested two other people in the car, both a man and a woman. oakland police going through the car out here. no word on what they found, but they tell us they will be wrapping up soon. live in oakland, christie smith, today in the east bay. >> we have sports to tell you about from overnight. college basketball fans stayed up watching games from around the clock to celebrate the start of the new season. it shows game after game for fun. the st. marys gales took on st. john's red storm. the late night game paid off for them and they win, 76-71 and one player had 22 points. 11:00 tip off is strange, but look at this. there was a game in hawaii that started at 1:00 a.m. our time.

they are living on the west coast and had to get up at 3:00 to see their teams play and another game started about an hour ago. the golden state warriors are home after a long road trip and play the knicks at the oracle arena and played a close one. he ledded warriors with 27 points and went on to win 101-97. raiders fans can meet one of the players in person. the linebacker will be making an appearance at an oakland lucky super market from 2:00 to 4:00. part of a limited edition soda can that will feature his face. he will be meeting with fans and signing autographs. . the weather for any of your plans will look outstanding for another day. this morning is chilly. a few spots waking up to the 40s, but the afternoon, at least

mostly in the 70s for one more day. for thursday and friday, we will see cooling. by friday afternoon, a chance that we will see rain showing up on the radar. the changes will take place as high pressure is giving thus dose of weather weakens, opening up the door for weather systems to dropout of alaska. those will be cold systems into highs only in the 60s and 50s by the time we approach the weekend. a cool start, but t-shirt weather around the bay. if you are heading to the peninsula, highs in the low 70s for the east bay hilltops, upper 70s. 77 for concord. your east bay seven-day forecast keeps things pleasant through tomorrow and friday we cool off and a chance of showers late in the day and scattered showers and highs ohm in the 50s and air cold enough to give us some snow across the higher peaks of the bay area, about 3500 feet this weekend.
