a short distance away and so close i think it's the same. i will follow that to let you know if san ramon has an issue for the southbound direction. out of livermore, traffic is nice with 580 approaching the interchange and a light volume and we'll look for 6:00 for the start. >> thanks a lot. a lawyer for one of the people accused of kidnapping and raping jaycee dugard is fighting to keep documents sealed. phillip garrido's defender filed papers arguing that the convicted rapists would not get a fair trial if the documents are released. garrido and his wife nancy are indicted on 18 counts from rape to false imprisonment. the garridos abducted dugard in 19 none and held her captive until this past year. >> protesters are expected to make a push against increasing student fees at uc colleges. police would be armed with pepper spray and canned cuffs.

monty francis will thereby as the board makes its final decision. good morning. >> reporter: the uc regents are scheduled to meet here at 8:30 and expected to vote on the increase. the more student protests are expected. yesterday hundreds of students gathered to protest the $822 per year. 13 people were arrested and most were uc students. tuition has gone up times and this helps deal with the big budget shortfall. it comes on the feels of a tuition increase last year. it would raise to more than $1100. officials say police fired pepper spray on the students yesterday when they tried to breakthrough a barricade. one ripped a baton out of his hand and the officer drew a gun. >> here went down and he was hit over the head. he got up and drew his weapon.

frchlt 10:00 this morning to 3:00 this afternoon, people 12 years old and older can get tested at regional medical centers at 2500 alhambra avenue in martinez. the respiratory care department and students from independent university will do the screenings. >> they will also be on hand in union square testing holiday toys for lead. members of the get the lead out coalition will test for lead using portable x-ray machines. they will be showing off the toy safety ap and handing out pamphlets on safe shopping tips. >> south bay is gearing up for an all day meeting to get the ball rolling on the budget. after facing a guj et gap last year, san jose faces a shortfall of $70 million next year. the mayor said the city will face a $22 million increase in retirement benefit costs.

luther king,jr. library. they hope to have finalists selected by early next year. >> we have a reason to be bay area proud. in petaluma, an elementary will be a 2010 blue ribbon school. the blue ribbon designates a school where students achieve at very high levels or made significant progress to close gaps in achievement, especially with disadvantage and minority schools. >> the plan for a target store in san francisco scores a bull's-eye. a box store has been approved on the first and second floors and according to the examiner, the sign is going to be replaced with the target signature bull's-eye logo. the 100,000 square foot store is expected to create about 250 local jobs and bring in nearly $2 million in sales tax revenue every year.

>> a live look at san jose and patchy fog earlier, but breezy conditions around the bay and probably limiting some of that fog from forming. look at what's happening just into the newsroom to the north. western washington at snoqualmie pass. it's like the i-80 of western washington. trucks sliding down the grade and a number of accidents from snow levels dropping close to 2,000 feet. that say preview heading into the weekend. not just for the sierra.

a good chance with elevations above 3,000 feet. you can see a little bit of that. all the action mainly from the california-oregon border, but the trailing edge of this system will across into lake county. northern sonoma county may see a stray shower or two. not much wind for now in san jose. patchy fog this morning. 44 degrees to san francisco. 47. southwest wind at 7 miles per hour. a few patches of fog and over to oakland, northwest winds at 12. we have breezy conditions around the san mateo bridge. berkeley and oakland and winds from about 10 to 15 miles per hour. fetchy fog and breezy in spots where we are not seeing the wind, we can drop into the upper 30s. the combination of an onshore breeze and clouds and highs mostly in the 50s to low 60s. highs mainly upper 50s to 60s. the radar looks dry. as you saw, the pacific

northwest getting slammed and the weather pattern, you see the low. that's going to be dropping towards the bay area by the weekend. today will be dry and cooler and breezy. the first chance of rain the evening commute is a different story. we head to the weekend and the cold low just to the north. we seal breezy conditions and off and on rain at times mixed with sunshine. if you get sunshine to warm up the ground levels and higher up in the atmosphere. cold dry air can be a recipe for thundershowers and small hail. snow levels bombing out close to 2500 feet this weekend. it will be cold and obviously a tough drive heading to the high country. friday is a good travel day. by saturday and sunday, lowering snow levels and more miles of driving by sunday as the snow levels drop as low as 2,000 feet. around the bay area, temperatures in the low 60s for most of our inland spots and

approach. you can see it there on the coastline. we will let you know when it arrives in a few minutes. >> a state-wide alert for missing bay area father. he left his home in concord on wednesday and hasn't been heart from since. christie smith is live in concord. we understand the missing man's father said his son was in a fight with his wife, but it's out of character for him to be gone so long. >> his father is worried sick and said this is totally out of character, even if he was upset and wanted to blow off steam. they say he just wouldn't be gone this long and not contact anyone. it's been eight days now and apparently there has been no activity on his credit cards or bank account. brian herb is 33 years old. concord police say he did take money, clothes and camping equipment when he left. there is a missing persons

investigation going on now and herb has been entered into the state missing persons system. foul play is not suspected. it is believed he left voluntarily. based on the camping equipment and clothes, investigators think he could be at a state campground or remote area or maybe even big sur. rank rangers have been notified. he is an avid outdoorsman and worked tuesday night at his dad's restaurant in pleasant hill. he was last seen in his car that has been listed in the missing persons system, a dark blue ford f350 with a california license plate 73 p 4909. it was a long bed truck with tinted windows. live in concord, christie smith today in the bay. >> thanks a lot. despite protests from students, the vote for the tuition

increases will go on for the uc board of regents. they plan to vote on an 8% fee increase that follows a 32% increase earlier this year. things got unruly when four officers were injury and 13 people were arrested as protesters tried to storm the meading in san francisco. the uc board said they need to offset cuts and scheduled to vote on a plan to expand the uc financial aid program. dozens of activists will stage a sleep out at the campus to raise awareness. they will bring sleeping bags and blankets and sleep out for 15 minutes starting at noon. they are holding a canned food and clothing drive next week. >> did someone steal a malty poo

puppy? a cleaning lady at the veterinary hospital said she saw bear, the dog in his cage monday night and that was the last time anyone saw the dog. by the time the employees arrived, bear was gone. the owners believe someone stole their puppy. the vet told them the dog got out even though all the doors were locked. >> it is possible if they let the person who stole the dog if that is an inside job if they are working when they see a dog they like, what's to stop them? >> it will continue to search for bear. if you know anything, call dublin police. >> richmond voters are saying no to slots, but how about pot? they shot down plans to build an indian casino and they're collecting on what to do. during a community meeting, people made it clear that any new development has to deliver jobs. a study from a consulting firm

said building a marijuana farm, kitchen and lab would bring in about $1 million surplus for the general funds, but the new and potentially risky idea may not work in richmond. >> it's against federal law. nothing could stop the feds from coming down next year and shutting out of business. >> the richmond city council will take up the issue at a meeting in december. >> angry parents in one school district not waking up any happier this morning. the vallejo school district said parents do not have the right to opt out of a lesson plan designed to promote tolerance. about 100 parents packed the school district to protest. most of them don't think it's appropriate for them to learn about same-sex relationships through documentaries that will be shown to students. parents say they have the right to control what their kids learn. >> this is sex education. you have to be involved in sex to be a lesbian or to be a gay

man. what you do in your home, that's your home. as far as me and mine, my children are not ready for this. >> the videos are required as part of a legal settlement between the school district and the aclu. the case stems from complaints by a lesbian student who said she was bullied by teachers and school staff. >> the cost of commuting could be going up. the board is set fare prices for the new station. round trip fares to downtown san francisco are expected to cost about $10.80. a two-way trip to the san francisco airport is going to be about $20.80. the new station is set to open in 2011. the golden gate bridge district is expected to get approval on a plan to deal with a five-year, $89 million budget shortfall. they want to reduce the discount to 30% for both crossings.

experian. the average debt payment per month in this country is $903 a month. where you are in the bay area, it's much higher. for san francisco, $1098 a month people are paying for debt only. minimum payments. that's 22% over the national average. that includes credit cars, car loans and even your mortgage. it's weighted because some people rent, but the bottom line is the numbers are starting to come down. consumers are shedding the debt. in the month of october, there were more late payments than the entire lest of the year. b of a saw fewer late payments. that's good. people are starting to make more late payments as they spend more and it could be the beginning of

we still have the accident. one of the vehicles involved in an earlier accident, the speeds through the area are still close to the speed limit. a visual distraction for most folks if you are staying out of the slow lane. at the dublin interchange, about a 15-minute drive e. 580 looking good in the westbound direction. right here southbound 880 at 92, a disabled big rig and it was on the ramp. got that confirmation that it cleared as well. slowing, but that might be left over from earlier distractions as well as traffic building up and heading to the san mateo bridge. gusts of wind shaking the camera from time to time. >> one of the spots in san jose where we had patchy fog.
